Abstract

This study aims to find out how the relationship between Makassar City Regional Regulation Number 5 of 2006 concerning Zakat Management and Islamic law. This type of research is field qualitative with a sociological juridical approach and normative theology of syar'i. The decentralization system provides space for local governments to form regulations as one of the legal instruments, and the Makassar City Government has taken advantage of this authority by establishing Regional Regulation Number 5 of 2006 concerning Zakat Management as an effort to maximize the potential of zakat in reducing poverty, especially since the population of Makassar City is predominantly Muslim. Materially, the local regulations do not conflict with the obligations of charity ordered by the Qur'an, even their existence serves as a reinforcement of the obligations of charity for Muslims, and the formalization of religiosity values into positive law is not new, because previously various law-level regulations have been born such as the Marriage Law, the Zakat Management Law, and the Hajj Implementation Law, so that its existence can be ensured that it does not conflict with Islamic law and even has a very close relationship.

Abstract

The existence of female workers in the MSME industry is a form of empowering women in the world of work but does not rule out the possibility of discrimination in the work environment. This study aims to determine the implementation of women's MSME labor rights based on Law Number 11 of 2020 concerning Job Creation in Pinrang Regency. The type of research conducted is field qualitative research with juridical approaches. The results of the study show that female MSME workers in Pinrang Regency have obtained their rights in accordance with statutory provisions, and the government has monitored every business actor, to minimize the gap between women workers.

Abstract

Regional government affairs are organized using the principle of autonomy. Regional governments have roles and strategies in fostering and supervising their regions, especially in the preparation and implementation of regional regulations. This study aims to find out how the Implementation of Regional Regulation Number 6 of 2017 Article 18 Paragraph 2 regarding the Control of Livestock. This type of research uses a qualitative field research method with an empirical juridical and normative syar'i approach. The results of this study indicate that the Implementation of Regional Regulation Number 6 of 2017 Article 18 Paragraph 2 on the Control of Livestock has not been running effectively and efficiently. As for several factors of the ineffectiveness of Regional Regulation No. 6 of 2017 include the lack of socialization provided by the government, lack of legal awareness, lack of firmness from law enforcement, and the absence of availability of land owned by breeders.

Abstract

The existence of wild animals in Selayar Islands Regency reaps various polemics, ranging from disturbances of order, public comfort, destruction of agricultural land and destruction of public facilities. This study aims to determine how effective Regional Regulation Number 20 of 2009 concerning Livestock Rearing in Selayar Island Islamic Law Perspective. The type of research used is descriptive qualitative, with normative juridical and syar'i approaches. The results showed that Regional Regulation Number 20 of 2009 has not been implemented optimally in carrying out supervision and control of wild livestock due to lack of public awareness and government indecision in implementing sanctions for livestock owners. Islam allows keeping livestock for the purpose of obtaining benefits, but it is also expressly stipulated that every farmer is obliged to keep and care for his pets to prevent damage (inconvenience) caused by pets.

Abstract

Good governance can be seen from aspects, oneofthem is measuring the maturity of government institutions in carriying out their functions and rules, from the lowest level to the highest in the government sysrem. Indonesia is known as a coutry that implments a decentralized system, which makes local governments run their own government, in the case at the village government level also gets is own authority in regulating its government, therefore, to provide a balance in running the govermentin the village, the village head neads partners in running the government, so a legislative body is formed, known as the village consultative body (BPD), one of the duties and functions of the BPD is to provide supervision over the performance of the village head in carrying out his duties as head of government at the village level. Departing from this background, the author takes two main problems, namely the from of BPD panciro’s supervision of the village head, and the view of Islamic law on the supervisory function carried out by the BPD against the village head. In this study the author uses a qualitative field research method. As for the research result obtained from the research location, firstly, the panciro’s BPD in carrying out its supervisior function is carried out in a complrkx and family manner, for example in a work program, the BPD involves itself starting from program planning, to the realization stage, so that it can provide supervision as well as performance appraisel fillage head. Secondly, in Islamic low or in this case siyasah syaríah known al-Hisbah which means calling for good and keeping away from evil, seeing the from of supervision carried out by the panciro BPD, then this concept is indirectly developing in government where the BPD as much as possible prevents irregularities deviations that can harm society.

Abstract

This research aims to describe the caliphate government system in the view of Sheikh Taqiyuddin an-Nabhani and the relationship between religion and the caliphate state in the view of Sheikh Taqiyuddin an-Nabhani. And the ideal state form according to Sheikh Taqiyuddin an-Nabhani. In answering the problem, the author uses the fiqh siyasah approach as for the method of collecting secondary data in the form of primary material, secondary is done by reading literature, scientific works, research results, documents or books related to research. The results of the research show that the Islamic government system in the view of Sheikh Taqiyuddin An-Nabhani consists of four pillars, namely sovereignty in the hands of syara', power belonging to the people, appointing a caliph whose law is obligatory for all Muslims, only the caliph has the right to do tabbani (adoption) against syara law '. The relationship between religion and the state according to Sheikh Taqiyuddin An-Nabhani is to preserve religion, organize community affairs, protect the country and the people, spread the message of Islam, eliminate opposition and disagreements between communities. The ideal form of government according to Sheikh Taqiyuddin An-Nabhani from the aspect of the form that describes the existence of the country, as well as the things that make it completely different from the form of government that exists in the world. Includes non-monarchical Islamic governments, non-republican Islamic governments, non-imperial Islamic governments, and non-federal Islamic governments.

Abstract

This research aims to find out how the Fatwa Authority of the Indonesian Ulema Council regarding Panai Money has studied Siyasah Syar'iyyah in Makasssar City. The main problem is divided into several sub-problems, namely: What are the legal rules for the Indonesian MUI fatwa regarding Panai money and how to implement the MUI fatwa regarding Panai money? Study the Siyasah Syariyyah. The research method used is qualitative research with data collection methods in the form of observation, interviews, documentation and reference tracking. The results of this research show that the MUI Fatwa Legal Rules regarding Uang Panai' are that the MUI Fatwa Legal Rules state that panai money is fine but does not make it difficult for men to get involved in it. Even though there is no Uang Panai elsewhere, the MUI respects the Uang Panai tradition in South Sulawesi. MUI does not prohibit, reject, or continue to tolerate this tradition so that it has become the custom of the Makassar Bugis community. MUI emphasized that many young people end up choosing not to get married not because of this tradition, but because it is difficult and requires more money than men can afford. The Bugis in society accept the validity of panai money and anticipate that the money will be changed according to the talents of the prospective bride and groom. (The man who wants to ask questions). Implementation of the MUI Fatwa regarding Uang Panai, which states that because Uang Panai has the power to issue infaq, it is preferred if it is a custom in Bugis marriages. In addition, it is very important that Uang Panai is resolved peacefully to prevent the development of tabzir, israf (waste) and hedonistic styles. For the legal requirements of panai money, the custom was basically accepted during that time. Basically, these practices are legal as long as they comply with sharia standards. Therefore, Uang Panai is subject to Sharia law, including allowing marriage and not oppressing men. Respect women, be trustworthy, and avoid subsequent manipulative behavior.

Abstract

Maja Labo Dahu's philosophy represents the Bima community's local values that have been internalized into Islamic law. This research aims to find answers to the issues examined, namely the existence of Islamic law in the Sultanate of Bima. The primary focus lies in the analysis of the implementation of Islamic law during the Sultanate of Bima and the internalization of the philosophy of Maja Labo Dahu within the Sultanate of Bima. The method used in this research is a descriptive qualitative method, which explores written documents and information from Bima community figures who know the implementation of Islamic law in the Sultanate of Bima as a result of the internalization between the philosophy of Maja Labo Dahu and the fiqh tashrī' in Islam. The data used in this research were obtained through observation, cross-checking interviews, and literature study. The findings of this research reveal that Islamic law has existed in the Sultanate of Bima since Islam was accepted as the official religion, based on the legitimacy of the theory of shahada, which explains the application of Islamic law coinciding with the Bima community's embrace of Islam. However, formally and juridically, Islamic law was declared applicable throughout the Sultanate of Bima after the establishment of three legal institutions, namely Sara Tua, Sara Sara, and Sara hukum, which were responsible for coordinating the implementation of laws such as flogging, stoning, retribution, and discretionary punishment. The philosophy of Maja Labo Dahu has been internalized into the Islamic law of the Kingdom of Bima, causing the Bima community to feel fear and shame in committing legal violations. Abstract

This study aims to find out the practice of early marriage, express the community’s views on early marriage and make an analysis based on Islamic law about the practice of early marriage in the Darul Istiqamah Lappa'e Islamic Boarding School, Sinjai. This research is a field study using a descriptive qualitative approach. The results of the study show that early marriage at the Darul Istiqamah Lappa’e Islamic Boarding School is based on parental approval and encouragement. In addition, the community views early marriage in Islamic boarding schools as a positive thing because it aims to foster young people to achieve piety and avoid promiscuity that is contrary to Islamic teachings. According to Islamic law, early marriage at the Darul Istiqamah Islamic Boarding School does not violate religious law because it is considered a solution to prevent greater dangers, such as adultery or pregnancy out of wedlock, by referring to the rules of Dar’u al-Mafasid. In addition, early marriage is carried out with the consent of the students themselves without coercion, with various considerations of benefits, namely efforts to achieve greater goodness and benefits.

Abstract

Wakaf sebagai fondasi yang sangat kuat dan terkait erat dengan ekonomi, wakaf telah membantu perbaikan di Indonesia secara umum, baik dalam peningkatan SDM maupun peningkatan aset sosial. Nazhir sebagai pengelola wakaf berperan penting dalam produktifitasnya wakaf tersebut agar mendapat kepercayaan dan kepuasan masyarakat, dengan ini akan tumbuh rasa semangat wakaf dikalangan masyarakat Kecamatan Baranti Kabupaten Sidrap. Kepercayaan dan kepuasan masyarakat bisa didapatkan nazhir apabila nazhir mampu mengembankan amanah yang diberikan kepadanya dengan sebaik-baiknya, karena kepercayaan menunjukkan bahwa seseorang memiliki rasa atau keinginan untuk bergantung kepada pihak lain dalam hal ini adalah nazhir. Maka dari itu wakaf harus diperhatikan lebih terutama pengelola wakaf karena bersangkutan dengan kehidupan sosial dan ekonomi. Apabila nazhir menyepelekan hal ini maka akan menimbulkan ketidakpercayaan dan ketidakpuasan masyarakat kemudian masyarakat. selain itu nazhir juga harus menunjukkan kepada masyarakat betapa pentingnya wakaf, karena tidak sedikit masyarakat di Kecamatan Baranti Kabupaten Sidrap masih minim pengetahuannya tentang wakaf. Jenis penelitian ini adalah kualitatif, yaitu penelitian yang turun langsung ke lapangan guna memperoleh data yang lengkap. Pendekatan yang digunakan adalah pendekatan syar’i dan pendekatan, yuridis, yaitu melihat atau memandang sesuatu dari aspek segi hukumnya baik hukum Islam dan hukum berdasarkan undang-undang. Sedangkan teknik pengumpulan data yang digunakan adalah observasi/wawancara dan dokumentasi.
