Abstract

Abstrak Artikel ini mengkaji penerapan hukuman mati dalam perspektif hukum Islam kontemporer dengan menggunakan pendekatan kualitatif-normatif. Data primer diperoleh dari Al‑Qur’an, Hadis, kitab ushul fiqh, serta peraturan perundang‑undangan nasional seperti KUHP dan UU pelaksanaan hukuman mati. Data sekunder terdiri dari literatur seperti jurnal, tesis, dan studi komparatif tentang hudud, qisas, ta‘zīr, serta teori maqāṣid al‑Sharī‘ah. Analisis menggunakan content analysis dengan metode deduktif‑induktif, dibingkai oleh pendekatan ushul fiqh dan maqāṣid al‑Sharī‘ah untuk menilai relevansi syariat dalam konteks modern. Hasilnya menunjukkan bahwa penerapan hukuman mati harus memenuhi prinsip keadilan, perlindungan maqāṣid, dan penghormatan hak asasi manusia. Kajian ini merekomendasikan kebutuhan terhadap ijtihād kontemporer dalam menjaga keseimbangan antara syariat, kemaslahatan sosial, dan norma internasional. Kata kunci: hukuman mati, hukum Islam kontemporer, maqāṣid al‑Sharī‘ah, hudud, qisas, ta‘zīr, ijtihād.   Abstract This article analyzes the implementation of the death penalty within a contemporary Islamic legal perspective using a qualitative-normative approach. Primary data are derived from the Qur’an, Hadith, ushul fiqh texts, and national legislation such as the Criminal Code and death penalty laws. Secondary data include literature reviews, theses, and comparative studies on hudud, qisas, ta‘zīr, and maqāṣid al‑Sharī‘ah theory. Analysis is conducted through content analysis with deductive-inductive methods, framed by ushul fiqh and maqāṣid al‑Sharī‘ah approaches to assess the relevance of Sharia in a modern context. The results indicate that the application of the death penalty must uphold principles of justice, maqāṣid protection, and respect for human rights. This study recommends the need for contemporary ijtihād to balance Sharia, social welfare, and international norms. Abstract

Abstrak Pernikahan wanita hamil di luar nikah merupakan isu multidimensional yang mencakup aspek sosial, moral, dan hukum dalam masyarakat Muslim kontemporer. Wacana ini telah lama menjadi perhatian dalam literatur fikih klasik, yang menunjukkan adanya perbedaan pandangan ulama mengenai kebolehan menikahi wanita yang tengah mengandung akibat hubungan nonmarital. Namun, perkembangan sosial dan transformasi nilai dalam masyarakat modern menuntut adanya pembacaan ulang terhadap konstruksi hukum Islam yang lebih kontekstual, inklusif, dan berorientasi pada kemaslahatan. Studi ini bertujuan untuk mengkaji respons hukum Islam kontemporer terhadap praktik pernikahan wanita hamil melalui pendekatan maqāṣid al-syarī‘ah, yaitu suatu kerangka normatif yang menekankan pada pemeliharaan tujuan-tujuan syariat sebagai fondasi pengambilan hukum. Penelitian ini menggunakan metode normatif-yuridis dengan cara menelaah sumber-sumber hukum Islam klasik dan kontemporer, termasuk pendapat ulama, fatwa institusional, serta regulasi hukum Islam di Indonesia seperti Kompilasi Hukum Islam (KHI). Studi ini menunjukkan bahwa pendekatan maqāṣid al-syarī‘ah, terutama dalam dimensi perlindungan terhadap nasab (hifẓ al-nasl), kehormatan (hifẓ al- ‘irḍ), jiwa (hifẓ al-nafs), dan agama (hifẓ al-dīn), memberikan justifikasi normatif atas kebolehan pernikahan wanita hamil dalam kondisi tertentu. Legalitas ini tetap mensyaratkan adanya pertobatan, kesediaan untuk bertanggung jawab dari pihak pria, serta komitmen memperbaiki kondisi sosial-hukum anak yang dikandung. Dengan demikian, aktualisasi maqāṣid menjadi strategi penting dalam merespons dinamika sosial umat Islam secara bijak dan solutif Kata Kunci: Pernikahan Wanita Hamil, Maqāṣid Al-Syarī‘Ah, Hukum Islam Kontemporer   Abstract The marriage of pregnant women outside of wedlock constitutes a multidimensional issue encompassing social, moral, and legal aspects within contemporary Muslim societies. This discourse has long been a subject of attention in classical Islamic jurisprudence, which reveals differing opinions among scholars regarding the permissibility of marrying a woman who is pregnant due to extramarital relations. However, ongoing social changes and value transformations in modern society demand a renewed interpretation of Islamic legal constructions that is more contextual, inclusive, and oriented toward public welfare (maṣlaḥah). This study aims to examine contemporary Islamic legal responses to the practice of marrying pregnant women through the lens of maqāṣid al-sharī‘ah, a normative framework that emphasizes the preservation of the objectives of Islamic law as the foundation for legal reasoning. This research employs a normative-juridical method by analyzing both classical and contemporary Islamic legal sources, including the opinions of scholars, institutional fatwas, and relevant legal regulations in Indonesia such as the Compilation of Islamic Law (KHI). The findings indicate that the maqāṣid al-sharī‘ah approach—particularly in relation to the protection of lineage (ḥifẓ al-nasl), honor (ḥifẓ al-‘irḍ), life (ḥifẓ al-nafs), and religion (ḥifẓ al-dīn)—provides normative justification for the permissibility of marrying pregnant women under specific conditions. This permissibility requires sincere repentance, willingness to assume responsibility by the male partner, and a commitment to improve the legal and social status of the unborn child. Therefore, the actualization of maqāṣid becomes a strategic tool in responding to contemporary social realities among Muslims with wisdom and solution-oriented insights. Abstract

This article examines the products of Islamic legal thought, which have a broad impact on Muslim communities and can serve as a strong foundation for legal principles. The aim of this study is to explore the existence, issues, and application of Islamic legal instruments within the legal system. The research employs a qualitative method, utilizing bibliometric and textual approaches, along with descriptive analysis.The findings reveal that Islamic law has developed in Indonesia through the products of four schools of legal thought: fiqh (Islamic jurisprudence), fatwas by religious scholars, court decisions (ijtihad), statutory regulations, and sociological legal theories. The challenges in legislating Islamic legal thought in Indonesia include low legal awareness, discrimination, the pluralistic legal system, internal debates among Muslims, lack of education, and political dynamics. Addressing these challenges requires an integrative approach involving all elements of society to foster better understanding and support for the implementation of Islamic law within the national framework.

Abstract

Abstrak Penelitian ini bertujuan menganalisis konsep pengelolaan zakat dalam hukum Islam klasik, mengevaluasi model kontemporer, serta mengkaji isu-isu hukum dan solusi syariah dalam konteks dinamika sosial-ekonomi modern. Penelitian kualitatif ini menggunakan pendekatan multidisipliner dengan analisis teks fiqh klasik, fatwa kontemporer, studi kasus lembaga zakat global, dan data empiris terkini. Pendekatan maqasid al-shariah dan teori taysir (kemudahan) menjadi kerangka analisis utama. penelitian ini menemukan bahwa, prinsip keadilan distributif (QS. At-Taubah: 60) dan sistem Baitul Mal tetap relevan, tetapi memerlukan reinterpretasi untuk menjawab kompleksitas modern, seperti perluasan objek zakat (aset digital, saham) dan redefinisi asnaf (pengungsi, urban poor). Sinergi tridaya (negara, swasta, komunitas) terbukti optimal: negara sebagai regulator, lembaga swasta sebagai inovator, dan komunitas sebagai jaring pengaman berbasis lokal. Prinsip amanah (QS. An-Nisa: 58) menuntut sistem pengawasan hybrid (syariah-audit keuangan) dan sanksi progresif (pidana hingga restorative justice). Dengan demikian, zakat berpotensi menjadi instrumen transformatif pengentasan kemiskinan global jika dikelola dengan integritas syar’i, adaptasi teknologi, dan kolaborasi antarlembaga. Rekomendasi kebijakan mencakup harmonisasi regulasi internasional, sertifikasi amil berbasis kompetensi, dan pemberdayaan berbasis data. Kata Kunci: Zakat, Hukum Islam, Kontemporer.   Abstract This study aims to analyze the concept of zakat management in classical Islamic law, evaluate contemporary models, and examine legal issues and sharia solutions in the context of modern socio-economic dynamics. This qualitative study uses a multidisciplinary approach with analysis of classical fiqh texts, contemporary fatwas, case studies of global zakat institutions, and current empirical data. The maqasid al-shariah approach and the theory of taysir (ease) are the main analytical frameworks. This study found that the principle of distributive justice (QS. At-Taubah: 60) and the Baitul Mal system remain relevant, but require reinterpretation to address modern complexities, such as the expansion of zakat objects (digital assets, stocks) and the redefinition of asnaf (refugees, urban poor). The synergy of tridaya (state, private sector, community) has proven optimal: the state as a regulator, private institutions as innovators, and the community as a locally-based safety net. The principle of amanah (QS. An-Nisa: 58) demands a hybrid supervision system (sharia-financial audit) and progressive sanctions (criminal to restorative justice). Thus, zakat has the potential to become a transformative instrument for global poverty alleviation if managed with sharia integrity, technological adaptation, and inter-institutional collaboration. Policy recommendations include harmonization of international regulations, competency-based amil certification, and data-based empowerment. Keywords: Zakat, Islamic Law, Contemporary.

Abstract

Abstrak Pernikahan beda agama merupakan isu krusial dalam wacana hukum Islam kontemporer, khususnya ketika dihadapkan pada prinsip-prinsip maqāṣid al-syarī‘ah. Artikel ini mengkaji problematika nikah beda agama dengan menitikberatkan pada prinsip ḥifẓ al-dīn (perlindungan terhadap agama) sebagai fondasi normatif utama dalam hukum keluarga Islam. Dalam konteks Indonesia, realitas sosial yang plural dan kompleks semakin memunculkan ketegangan antara norma keagamaan dan kebebasan individu, terlebih pasca diterbitkannya Surat Edaran Mahkamah Agung (SEMA) No. 2 Tahun 2023 yang secara eksplisit menolak legalitas pernikahan lintas agama. Dengan pendekatan yuridis-normatif berbasis maqāṣid, kajian ini menemukan bahwa pernikahan beda agama tidak hanya berpotensi melemahkan prinsip ḥifẓ al-dīn, tetapi juga menimbulkan implikasi negatif terhadap keturunan (ḥifẓ al-nasl), akal (ḥifẓ al-‘aql), dan harta (ḥifẓ al-māl). Oleh karena itu, diperlukan pendekatan hukum yang tidak sekadar legalistik, tetapi juga integratif dan solutif dalam menjawab ketegangan antara norma syar‘i dan realitas hukum nasional. Kata kunci: Nikah beda agama, maqāṣid al-syarī‘ah, ḥifẓ al-dīn, hukum keluarga Islam, SEMA No. 2 Tahun 2023   Abstract Interfaith marriage is a crucial issue in contemporary Islamic legal discourse, especially when faced with the principles of maqāṣid al-syarī‘ah. This article examines the problematic of interfaith marriage by emphasizing the principle of ḥifẓ al-dīn (protection of religion) as the main normative foundation in Islamic family law. In the Indonesian context, plural and complex social realities increasingly give rise to tensions between religious norms and individual freedom, especially after the issuance of the Supreme Court Circular (SEMA) No. 2 of 2023 which explicitly rejects the legality of interfaith marriage. With a juridical-normative approach based on maqāṣid, this study found that interfaith marriage not only has the potential to weaken the principle of ḥifẓ al-dīn, but also has negative implications for descendants (ḥifẓ al-nasl), reason (ḥifẓ al-‘aql), and property (ḥifẓ al-māl). Therefore, a legal approach is needed that is not merely legalistic, but also integrative and solution-oriented in responding to the tension between sharia norms and national legal realities. Abstract

 Tulisan ini membahas tentang nikah misyar pespektif fikih kontemporer. Tulisan ini mengkaji definisi, kontaversi ulama kontemporer dan tinjauan dari sudut pandang maslahah. kajian ini termasuk kajian kepustakaan (library research), yaitu metode penelitian yang melibatkan pengumpulan dan evaluasi informasi dari sumber-sumber tertulis, seperti jurnal, buku, laporan, dokumen, dan artikel yang relevan dengan topik penelitian.Tujuan penelitian ini adalah untuk mengetahui tentang nikah misyar dalam fikih kontemporer. Hasil dari penelitian ini yaitu nikah misyar pada hakikatnya adalah pernikahan yang dilaksanankan sesuai dengan rukun dan syarat pernikahan, namun dalam persoalan hak dan kewajiban, istri merelakan haknya untuk tidak diberikan. Fatwa ulama kontemporer tentang hukum nikah misyar memiliki pandangan hukum yang berbeda, sebahagian kelompok membolehkan nikah misyar. Sedangkan sebagian lagi menyatakan bahwa hukumnya haram, dan sebagian lainnya memperbolehkan beserta makruh.Nikah misyar ditinjau dari sudut pandang maslahah dalam konteks negara Indonesia dapat dilihat dengan dua cara, yakni tawfīq, dan istislah bi al- ‘urf. Jika metode tawfiq yang digunakan, maka berarti pendapat yang membolehkan maupun yang melarang nikah misyar sama-sama digunakan dengan cara membolehkan nikah misyar dengan disertai syarat-syarat yang cukup ketat, dengan tujuan agar kebolehan tersebut tidak disalahgunakan sehingga menimbulkan mafsadat. Adapun jika metode istislah bi al-‘urf yakni memilih kemaslahatan yang paling sesuai dengan kebutuhan masyarakat Indonesia.

Abstract

This study discusses the role of the Makassar City Religious Affairs Office (KUA) in preventing marital violations based on the principle of maṣlaḥah mursalah. The aim is to obtain a complete picture of the position of the Religious Affairs Office (KUA) as the front guard in resolving various problems and marital violations in the community. This study is qualitative using a descriptive phenomenological approach. Data were obtained from two types of sources, namely primary sources and secondary sources. Primary sources are carried out through interviews, observations, and documentation whereas secondary sources are in the form of certain documents, standard books, articles, or other materials related to the topic studied. Interviews were conducted with the Head of KUA, Penghulu, and office staff. This study involved five KUA in Makassar City with a case study approach that was analyzed in depth through the principle of maṣlaḥah mursalah. This study found that the KUA in Makassar City has played an active role in taking various strategic steps to realize flexible marriage law policies that are in line with the dynamics and needs of society. Other policies that have also been implemented include the formation of a special team, the implementation of routine studies on Islamic marriage law, and increasing cooperation with research institutions. This policy is implemented to make marriage law relevant and responsive to social change. All of this is evidence that in addition to being a public service institution, the KUA in Makassar has also played a role in maintaining legal flexibility so that it remains in line with the interests of the wider community.

Abstract

The renewal of Islamic law essentially rests on something that already exists, then undergoes a qualitative change as a product of interactions in community life. It can be said that the process of Islamic legal renewal is viewed as something autonomous, but it also interacts with other elements in society so that it becomes interdependent. Therefore the concept of renewal of Islamic law demands the presence of an adaptive attitude, with the social conditions of the society in which it interacts. Thus, the renewal of Islamic law must be undertaken in response to the demands of change occurring among the society. The reform of schools in Islamic Law is carried out as an attempt to implement the Islamic law of Ijtihad, namely the results of ijtihad scholars who have lost their actual power in the context of today by re-studying by the competent authorities and ijtihad against new issues that have never been discussed by scholars. In the course of history, Islamic law has been a dynamic and creative force. This is characterized by the presence of various sects with different patterns and characteristics, according to the socio-historical and political background in which they grew and developed. In the paradigm of classical jurisprudence there are five principles that allow Islamic law to develop according to time namely 1) Principle of Ijma, 2) Principle of Qiyas, 3) Principle of Maslahah Mursalah, 4) Principle of maintaining Urf. Abstract

Various attempts have been pioneered by modern Muslim scholars to revive the spirit of ijtihad. The revitalization of the Shariah maqasid, the renewal of ijtihad methodology, the strengthening of the fatwa institutions, as well as the reform of the Islamic education curriculum constitute strategic steps to restore ijtihad as the main axis of the renewal of Islamic law. Thus, this paper wants to study the problem of the freeze of ijtihad as well as decipher the efforts that need to be made so that ijtihad is able to absorb and respond to contemporary legal issues relevantly and solvetively. The freezing of ijtihad was the result of the accumulation of various factors: the politicization of religion, conservative education, the dominance of taqlid, to a stagnant religious culture. Whereas, Islam itself encourages ijtihad as a means of answering the challenges of the times. Therefore, the reactualization of ijtihad becomes an urgent need in building a contextualized and dynamic Islamic law. Efforts to break the freeze of ijtihad must be conducted comprehensively, covering aspects of methodology, education, institutions, and thought reform. Without ijtihad, Islamic law will lose its adaptability to the dynamics of the times. On the contrary, fresh and contextualized ijtihad is precisely evidence that Islamic sharia is capable of guiding mankind at all times.

Abstract

The digital transformation has significantly influenced the structure of religious authority in Islam, particularly in the domain of fatwas. In Indonesia, the emergence of popular religious figures on social media as primary sources of Islamic legal guidance indicates a shift from formal institutions to non-institutional actors. This phenomenon has led to the fragmentation of religious authority, undermining the legitimacy of fatwas and confusing the Muslim public. This study aims to analyze how the transformation of fatwa authority unfolds in the digital era, the extent to which collective ijtihad remains relevant in addressing this shift, and how contemporary Islamic legal thought—particularly that of Fazlur Rahman and Jasser Auda—can contribute to reframing fatwa authority today. Using a normative-qualitative approach and library research method, this study employs descriptive and comparative analysis of primary texts by key thinkers and official fatwa documents. The findings reveal that collective ijtihad is an essential epistemological strategy to restore balance amid the fragmented landscape of digital fatwas. Furthermore, Fazlur Rahman’s ethical-textual reinterpretation and Jasser Auda’s systems-based maqasid theory offer strong theoretical foundations for developing a participatory and adaptive model of fatwa authority. This study recommends an integrated approach between maqasid al-shariah and collective ijtihad as a constructive effort to reconstruct Islamic legal authority in a way that is both contextually grounded and epistemologically legitimate in the digital age.
