Abstract

The purpose of this study was to determine the influence of leadership, quality of human resources and organizational culture on employee performance at the Utsman Bin Affan Library of UMI Makassar. The population of this research is the total number of employees within the Utsman Bin Affan library at UMI Makassar, totaling 30 people. The research approach used is descriptive quantitative. Data collection was carried out by distributing questionnaires and literature study. Processing and data analysis using the latest version of the SPSS application. The results of this study indicate that based on partial testing, leadership variables, human resource quality, and organizational culture have a positive and significant effect on employee performance at the Utsman Bin Affan UMI Makassar Library. This can be seen from the value of t-count> t-table, namely 2.98 which is obtained from df2 = 26; α = 0.05 and it can also be seen from the significance level value <0.05, namely the leadership variable with the t-test 3.121> 2.98 or the significance 0.004 <0.05 (significant effect), the variable quality of human resources with t-test 3.566> 2.98 or a significance of 0.001 <0.05 (significant effect), and the organizational culture variable with t-count 3.006> 2.98 or a significance of 0.002 <0.05 (significant effect).

Abstract

This article aims to analyze and compare the two forms of jihad in Islam with the principles of IHL, in order to assess their compatibility and potential disharmony. The concept of jihad in Islam is often misunderstood, especially when associated with armed conflict. In classical Islamic jurisprudence discourse, jihad is divided into two main forms: defensive jihad (difaa'i) and offensive jihad (tulubi). Meanwhile, international humanitarian law (IHL) regulates the legality and limitations in armed conflict, particularly regarding the protection of civilians and non-combatants. The primary data sources in this study are divided into primary data in Islamic studies such as verses of the Qur'an and the Hadith of the Prophet Muhammad regarding jihad and war, and primary data in International Humanitarian Law, namely the 1949 Geneva Conventions and their Additional Protocols. Meanwhile, secondary data was obtained from literature on Islamic studies and International Humanitarian Law, journals, and research related to Jihad and War. Using a normative-comparative approach to primary and secondary legal sources, it was found that defensive jihad is more compatible in principle with IHL, while offensive jihad has the potential to conflict with modern International Humanitarian Law in practice.

Abstract

This research aims to describe the occupational Health and Safety (K3) system at PT Huady Nickel Alloy in Bantaeng Regency. The problem in this research is the large number of work accident cases. The approach used is a normative star's approach and an empirical juridical approach. The data collection method was carried out by means of interviews. The results of this research show that: the K3 system in this company implements Job Safety Analysis (JSA), where Job Safety Analysis (JSA) for each person or worker about what is done to do the job well and safely, apart from that, guidance is also given before starting a job, safety observations and as a topic at a safety meeting and then as a form of determining the standards needed for safety at work but in the implementation there are still individuals who underestimate the use of PPE and have the potential to cause harm to themselves. PT Huady Nickel Alloy has provided various Apart from providing PPE, these types of facilities also provide treatment such as providing first aid and providing clinics for further examinations.

Abstract

Tulisan ini akan mengelaborasi dan mendeskripsikan kompetensi mediator di Pengadilan Agama Makassar dalam perspektif teoretis dan faktual. Tulisan ini merupakan hasil penelitian lapangan yang bersifat deskriptif kualitatif, yang berlokasi di Pengadilan Agama Makassar. Adapun pendekatang yang digunakan adalah pendekatan yuridis, teologis, sosiologis dan fenomenologis. Apapun pengumpulan datanya di lapangan menggunakan teknik observasi wawancara/interview dan dokumentasi. Data yang telah dikumpulkan kemudian diolah dengan menggunakan analisis reduksi data, penyajian data adan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa pemilihan mediator di Pengadilan Agama Makassar sudah sejalan dengan PERMA Nomor 1 Tahun 2016 Tentang Prosedur Mediasi di Pengadilan. Namun mediator menjadi kesulitan mendamaikan para pihak disebabkan berbagai faktor, termasuk di dalamnya adalah keengganan para pihak untuk menghadiri mediasi dan waktu penempatan mediasi yang terbilang kurang tepat atau terlambar, jika merujuk pada QS al-Nisa>’/4: 35. Sehingga pertengkaran yang sudah berlangsung terus-menerus atau berlarut-larut akan sulit didamaikan. Selain itu, mediator yang menengahi proses mediasi di Pengadilan Agama Makassar, secara keseluruhan adalah hakim dengan latar belakang keilmuan hukum. sedang idealnya yang dalam proses mediasi dibutuhkan seorang mediator profesional dengan latar belakang keilmuan yang linear dengan akar permasalahan yang menjadi penyebab perselisihan para pihak.

Abstract

This paper elaborated on the Substance of the Prohibition of Alcoholic Beverages in the Provincial Regulation of Papua Number 15 of 2013 concerning the Prohibition of the Production, Distribution, and Sales of Alcoholic Beverages in the Manifestation of Maqasid al-Shari’a in Papua. This type of research was qualitative empirical legal research with a normative theological approach, statute approach, and sociological approach. The results showed that the substance of the prohibition of alcoholic beverages in the Provincial Regulation of Papua Number 15/2013 which totally prohibited the production, distribution, sales, and consumption of alcoholic beverages was legally contrary to Presidential Decree Number 74 of 2013. Based on the principle of “Lex Superiori Derogad Lege Inferiori”, the Provincial Regulation of Papua Number 15 of 2013 could be ruled out by the Presidential Decree Number 74 of 2013. Therefore, the Ministry of Home Affairs canceled the Provincial Regulation Number 15 of 2013 because it violated the principle of the hierarchy of laws and regulations. Based on the perspective of maqasid al-shari’a, the regulation of alcoholic beverages in the Provincial Regulation of Papua was a necessity of daruriyyat. Thus, everything to make it happen was also daruriyyat.

Abstract

This article will try to see how the correlation between Human Rights Obligations and Human Rights when viewed in the perspective of Islamic Criminal Law. The theme of Human Rights Obligations, by scientists and the world community, is not an issue that is considered as important as the issue of Human Rights. Even though the Human Rights Obligation is an important point of whether human rights are upright or not. The description of the relationship is in the concept of Islamic criminal law as summarized in al-Daruriyyat al-khamzah (religious preservation obligations, life obligations, obligations to preserve reason, obligations to preserve offspring and obligations to preserve property.

Abstract

Kaboro Coi practice was originally just a tradition, but the community has considered it an obligation, not carrying out the cooboro coi will get social sanctions from the community, such as being ostracized and the community no longer cares about any event events (hajatan) conducted by families who do not carry out the Kaboro Coi tradition. Seen from the perspective of Islamic law Kaboro coi practice has a substance that shows the value of togetherness, helping each other to help each other, like the concept of "wata ᾶwanu‘ alal birri wa taqwa ". This study, does not want to see the Kaboro Coi tradition as an act that implies rewards and sins when done and not done, but just want to see why this tradition is important to do.The data used as material for analysis are field data obtained through observation, interviews, and literature studies. Abstract

This study examines the role of the kuda pattu’duq tradition in the community of Campalagian District, Polewali Mandar Regency, from the perspective of maqashid al-shari’ah. The research focuses on how this tradition conveys social and religious meaning and its impact on community life. The objectives are to identify the significance of kuda pattu’duq, explore its relevance to maqashid al-shari’ah principles, and analyze its implications for social and religious life. A qualitative approach was employed, combining phenomenological, sociological, and sharia perspectives. Data were collected through observation, interviews, and documentation from cultural figures, community leaders, youth, religious leaders, and government officials, then analyzed thematically. Findings indicate that horses, riders, traditional attire, kalindaqdaq, and rebana hold symbolic social and religious meanings; maqashid al-shari’ah emphasizes the protection of religion (hifdz ad-din), life (hifdz an-nafs), and wealth (hifdz al-maal) as guiding principles for the tradition; while its social and religious implications include enhanced solidarity, cultural promotion, motivation for Qur’an recitation, and parental expressions of gratitude. This study demonstrates that the kuda pattu’duq tradition strengthens Mandar cultural identity while fostering religious understanding among the younger generation.
