Abstract

The online criminal trial discourse has become a hot discussion topic by criminal law practitioners, especially regarding the obscenity case in Petamburan that involved the suspect, HRS. HRS himself and his lawyer refused to hold the online trial for being contrary to the Criminal Procedure Code (KUHAP) although there is a Memorandum of Understanding between the Supreme Court, Attorney General's Office, Police, and the Directorate General (Ditjen) of Corrections regarding the Implementation of Criminal Trial Proceedings via video conferencing as efforts to prevent the spread of Covid-19 on April 13, 2020. This study aims to provide an answer that Islamic criminal procedural law can accommodate models of virtual criminal case resolution because it considers emergency situations. Moreover, the reason for the emergency has to do with humanity. The data used as materials for data analysis was library research which were taken from fiqh books, written documents, laws and other regulations. The results show that Islamic criminal law can consider its feasibility.Keywords: Virtual criminal court – Islamic criminal

Abstract

The objective of this research was to examine the oversight conducted by the Government's Internal Control Apparatus (APIP) regarding the misuse of official authority within the Jeneponto District Government. This research employs a qualitative methodology with a sociological research approach. The informants include the Auditor of the Jeneponto Regency Government Internal Supervisory Apparatus, the Head of the Sub-Division of Discipline Development, Welfare, and Facilitation of the ASN Profession at the Jeneponto Regency Personnel and Human Resources Development Agency (BKPSDM), the Secretary and Acting Head of Treasury at the Jeneponto Regency Financial and Asset Management Agency, the Head of Budget at the Jeneponto Regency Financial and Asset Management Agency, and the Regent of Jeneponto. Data collection methods encompass observation, interviews, and documentation. Subsequently, the techniques for processing and analyzing data are executed through three distinct phases: data collection, data reduction, data presentation, and conclusion drawing. The outcomes indicate that: 1) The supervision by the Government Internal Supervisory Apparatus (APIP) over the abuse of authority in the Jeneponto Regency Government is not fully optimizing APIP's role in supervising, guiding, evaluating, and monitoring the duties and functions of regional apparatuses in the execution of bureaucratic activities. This is evidenced by the presence of several civil servants who have been implicated and directly involved in legal proceedings due to exceeding their official authority. 2) There is a shortage of qualified auditors, with the current number of personnel being insufficient relative to the number of civil servants requiring oversight across 11 sub-districts and 113 villages.

Abstract

The aim of this research is to explain the review of Islamic law in determining the age limit for marriage and the application of the principle of maslahah murlah in granting marriage dispensations. This research uses qualitative research with a phenomenological approach, data collection methods using documentation methods with data analysis using the process of collecting, compiling and discussing information contained in written documents. The results of this research show: 1) Early marriage, even though it is legally legal, does not absolutely apply to everyone and in all conditions. This is because under certain conditions that can cause mafsadat (loss), the law can become makruh or even haram. Legal provisions in Islam cannot be separated from the positive and negative values that arise from them. 2) The context in considering maslahah murrasa, the judge's perception regarding marriage dispensation is included in the realm of maslahah khashshah or the individual or personal benefit of the applicant, because marriage dispensation cases include marriage cases that are private and only involve a few individuals, namely the applicants. So there is no consideration of maslahah 'ammah or general benefit for society.

Abstract

The implementation of the inheritance distribution system within the community remains partially ineffective, as conflicts among heirs frequently arise. These disputes hinder the objectives of Islamic law as outlined in maqāṣid al-syarīʿah, emphasizing the need for preventive efforts. This study aims to analyze inheritance conflict prevention in Bone Regency through gender-equitable deliberation by examining conflict resolution methods, causes of disputes, women’s inheritance rights, and conflict prevention strategies from the perspective of maqāṣid al-syarīʿah. This empirical research was conducted in Bone Regency using a theological-normative approach based on maqāṣid al-syarīʿah. Primary data were collected through interviews with academics, judges, and government officials, while secondary data were obtained from relevant literature and analyzed qualitatively. The findings reveal that inheritance disputes can be resolved through court litigation or non-litigation pathways involving local authorities. Key causes of conflicts include heirs’ greed, limited understanding of inheritance laws, lack of property transfer documentation, unfair distribution, and delays in inheritance division. Women's inheritance rights in Bone's customary law are preserved through deliberation during the distribution process. To prevent inheritance disputes, measures such as public education on inheritance law, facilitated consultations involving local authorities, and proper documentation of property transfers are recommended. These initiatives align with the values of maqāṣid al-syarīʿah, which prioritize the preservation of religion, life, intellect, property, and lineage. The government and relevant stakeholders are expected to play an active role in guiding and educating communities to ensure effective inheritance distribution and prevent conflicts.

Abstract

This article explores the views of classical scholars on the hijab, based on the Quran and Hadith, as well as the principles of Sharia that regulate women's attire and modesty. The article then analyzes how contemporary thinkers have adapted and interpreted the laws of hijab in social and cultural contexts. By comparing the perspectives of both groups of scholars, this article aims to provide a comprehensive understanding of the position of the hijab in Islamic law, as well as the challenges and dynamics faced by Muslim women in the modern era. The research findings indicate that the hijab is a religious commandment that must be followed by Muslim women. It serves to protect the body and, most importantly, as a duty for Muslim women to cover their modesty to be preserved from slander. By wearing the hijab, a woman demonstrates her commitment to the religious and cultural values of Islam. It also acts as a shield against unwanted gazes and inappropriate treatment from others. The hijab is part of worship and devotion to Allah, reflecting adherence to religious teachings. The wearing of the hijab is aimed at maintaining the honor and dignity of Muslim women, keeping them free from disturbances, and making them easily recognizable. The requirements for wearing the hijab include covering the entire body except for what is ordinarily visible, such as the face and hands, being thick, being loose, and not resembling men's clothing. Dalam artikel ini, penulis mengeksplorasi pandangan ulama klasik mengenai jilbab yang berlandaskan pada Al-Qur'an dan Hadis, serta prinsip-prinsip syariah yang mengatur aurat dan busana perempuan. Selanjutnya, artikel ini menganalisis bagaimana pemikiran kontemporer telah mengadaptasi dan menafsirkan hukum jilbab dalam konteks sosial, budaya. Dengan membandingkan perspektif kedua kelompok ulama, artikel ini bertujuan untuk memberikan pemahaman yang lebih komprehensif mengenai posisi jilbab dalam hukum Islam, serta tantangan dan dinamika yang dihadapi oleh perempuan Muslim di era modern. Hasil penelitian menunjukkan bahwa jilbab merupakan ajaran agama yang harus dipatuhi oleh perempuan muslimah, berfungsi untuk melindungi tubuh dan yang terpenting sebagai kewajiban khususnya wanita muslimah menutup aurat agar terpelihara dari fitnah dengan mengenakan jilbab, seorang wanita menunjukkan komitmennya terhadap nilai-nilai agama dan budaya Islam begitu halnya sebagai pelindung dari pandangan yang tidak diinginkan dan perlakuan yang tidak pantas dari orang lain. Jilbab adalah bagian dari ibadah dan pengabdian kepada Allah, mencerminkan kepatuhan terhadap ajaran agama bahwa pemakaian jilbab terpulang kepada tujuannya untuk menjaga kehormatan dan kemuliaan wanita muslimah, bebas dari gangguan, lebih mudah dikenali. Adapun syaratnya, antara lain: harus menutupi seluruh tubuh kecuali yang biasa tampak muka dan telapak tangan, harus tebal, harus longgar, dan tidak boleh menyerupai pakaian laki-laki

Abstract

The death penalty in Islamic law holds significant importance as a form of justice for serious crimes such as intentional murder, adultery by a married person, robbery, apostasy, and rebellion. From the perspective of Islamic law, the death penalty is not only intended to serve as a deterrent but also as a means to uphold justice for the victim, the victim’s family, and society at large. While there are views that associate the death penalty with violations of human rights, in Islamic law, its application is based on the principle of justice, which must be proportionate to the crime committed, while considering the public benefit. The application of the death penalty, whether as hudud, qishash, or ta'zir, demonstrates that justice in Islam is not only retributive but also preventive, aimed at maintaining social balance. This study aims to examine the application of the death penalty in Islamic law from the perspectives of justice and human rights. The findings show that the death penalty serves as an instrument of justice that protects the rights of society and victims from the threat of serious crimes, while upholding the principles of justice and public benefit in its implementation.

Abstract

This study aims to analyze the forms of malpractice in illegal abortion provocatus in Makassar City, evaluate the legal aspects of the perpetrators, and examine the practice through the sadd al-dzari'ah approach in Islamic law as a preventive strategy against medical crimes. The practice of abortion performed without professional medical supervision, especially by non-medical individuals such as birth attendants or untrained personnel, poses a serious threat to the safety of women's lives and reproductive health. This research uses a qualitative approach with a type of field research. Data collection techniques are carried out through observation, in-depth interviews, and documentation studies, which are then analyzed descriptive-qualitatively. Field findings show that illegal abortions in Makassar are often performed without proper medical standards, causing harmful physical and psychological complications. Several cases have been handled by law enforcement officials and resulted in criminal verdicts against the perpetrators. From the perspective of sadd al-dzari'ah, this practice is considered to pave the way for wider damage (mafsadah), as it ignores the protection of the soul and violates the basic principles of Islamic law. This study recommends strengthening the legal system and health policies oriented towards prevention, as well as the need for public education based on Islamic values to close the gap in the occurrence of illegal abortion practices and increase awareness of the importance of reproductive health protection.

Abstract

The main problem in this study is how to analyze the increase in child marriage in Tempe District, Wajo Regency, from the Maqasid Syar'iah Perspective? The main problem is then broken down into several sub-problems or research questions, namely: 1) What are the Causes of the Increase in Child Marriage in Tempe District, Wajo Regency? 2) What are the solutions to reduce the increase in child marriage in Tempe District, Wajo Regency? 3) How is Maqasid Syar'iah Perspective on Increasing Child Marriage in Tempe District, Wajo Regency? his type of research is classified as qualitative with the research approach used is a juridical approach, a syar'i approach, and a sociological approach. The data sources of this research are Furthermore, the data collection methods used are observation, interviews, documentation, and reference tracing. Then, data processing techniques and data analysis were carried out through several stages, namely: data collection, data reduction, data presentation, and drawing conclusions. The results of this study indicate that 1) The factors that cause an increase in child marriage in Tempe sub-district, Wajo Regency, are: a) educational factors; b) economic factors; c) cultural factors; d) community mindset factors; e) factors of pregnancy out of wedlock. 2) Solutions in suppressing the increase in child marriage in Tempe District are: a). Provide services in the field of administration including registration of marriage, divorce and reconciliation as well as other records related to the duties and roles of KUA; b) Providing Counseling and Socialization of the Marriage Law; c) Providing services in the field of marriage and sakinah families. 3) Maqashid Sharia perspective on child marriage Whether or not child marriage can be seen from one maqashid point of view, such as hifz al-nasl to avoid adultery. 1) However, it is also necessary to look at other maqashid values ​​so that the sharia maqashid analysis does not overlap. 2) The implications of this research are: 3) For the people of Tempe District, Wajo Regency, to always follow and obey all government regulations, especially regarding Law no. 16 of 2019 concerning marriage. The local government should give warnings or sanctions for people who violate the rules of Law no. 16 of 2019 concerning Marriage, especially the age limit. 3) KUA employees in the field of penghulu can optimize the penghulu to socialize and emphasize the importance of getting married according to the age limit that has been determined by law. Both through marriage advice and when invited to religious activities.

Abstract

This research aims to find out how the juridical analysis of positive fictitious decisions after Law no. 6 of 2023 Syar'iyyah siyasah perspective. In answering this problem, the author uses a normative juridical approach and a normative theological approach (syar'i). The method for collecting secondary data in the form of primary and secondary materials is done by reading literature, scientific works, documents or books related to the research. The research results show that 1) The legal position of fictitious decisions is positive after the promulgation of the law. No. 6 of 2023, which is regulated in this Law, namely in article 175 number 7 paragraph (4), however the phrase not stipulate but grant in this article creates unclear meaning and has the potential to give rise to new problems 2) Procedures for resolving positive fictitious decisions after the issuance of the Law. No. 6 of 2023 article 175 number 7 paragraph (5) will be further regulated in a Presidential Regulation, but to date this Presidential Regulation has not been issued as a result of which the procedure for resolving positive fictitious decisions has become ambiguous and unclear. 3) The siyasah syar'iyyah view of positive fictitious decisions after the issuance of the law. No. 6 of 2023 does not explain the view of Islamic law regarding the details of positive fictitious decisions because this is purely procedural from Indonesian positive law which is administrative in nature.

Abstract

This study aims to find out the practice of early marriage, express the community’s views on early marriage and make an analysis based on Islamic law about the practice of early marriage in the Darul Istiqamah Lappa'e Islamic Boarding School, Sinjai. This research is a field study using a descriptive qualitative approach. The results of the study show that early marriage at the Darul Istiqamah Lappa’e Islamic Boarding School is based on parental approval and encouragement. In addition, the community views early marriage in Islamic boarding schools as a positive thing because it aims to foster young people to achieve piety and avoid promiscuity that is contrary to Islamic teachings. According to Islamic law, early marriage at the Darul Istiqamah Islamic Boarding School does not violate religious law because it is considered a solution to prevent greater dangers, such as adultery or pregnancy out of wedlock, by referring to the rules of Dar’u al-Mafasid. In addition, early marriage is carried out with the consent of the students themselves without coercion, with various considerations of benefits, namely efforts to achieve greater goodness and benefits.
