Abstract

In the substantive understanding of religion, there is no differentiation between man and woman. The Al-Quran enshrines the principles of justice, equality, democracy and muasyarahbilma’ruf(humanizing actions). This manner of interpretation must become the basis in understanding the connection between religious teachings and the Draft Law on Gender Equality. To see Islam in a theological light, indeed there are several religious texts which directly differentiate man and woman, but what we must realize is that the Quran which was bestowed upon the Prophet not only contained provisions on how to life one’s life, but also the method to organize life itself. Understanding Islam depends greatly on our manner of interpretation. If a patriarchal reading of Islam were to be fostered, then the result will be rejection of the draft law on the pretenses of religious desecration. However, if we were to understand religion on the basis of equality, then a solution to the existing problem will surely be found.

Abstract

Nowadays the meaning of the jilbab has shifted and become somewhat misinterpreted. Understandings of the  purpose of the jilbab began with Tauhid, the principle teaching of Islam. The Tauhid teaches the true meaning of devotion to God or godliness, and also the true meaning of how to be human. The Tauhid teachings bring about recognition of sameness before God, and the obligation to respect other people without discrimination based on differences in sex, gender, ethnicity or religion. In Indonesia, the jilbab is not only worn as a form of identity but as a fashion accessory. It is not clear whether the use of the terms jilbab or hijab are to be interpreted as head coverings to the chest for women or not. For this reason, there is a need for a comprehensive understanding of the terms to be taken from a holy book, in this case the Al’Qur’an and hadis, so that there is no longer a distortion in meaning. A full understanding of the verses and hadis in relation to the jilbab and the hijab is not limited to symbolic use. Whether of not the use of the veil is merely symbolic, it must be considered in the current context of the rise of capitalist religiosity.

Abstract

The provision of women's rights to become witneses promoted by Islam during the life of the Prophet Muhammad was indeed a high achietlement considering the tradition of the era which did not recognize women's rights to become witnesses in legal affairs. The Prophet permitted women to act as witnesess not only on trade, but also in courts for public disputes. This is because the essential thing in the affair of giving witness does not lie in the type of the sex of the witness, but on the capacity, expertise of the witness in performing their task to attain justice. In short there is no preference in the sex of a witness; men and women have rights become witnesses as far as they have intellectual cabability to do so.

Abstract

This article examines a number of Prophetic traditions Ouulits) dealing with wali (guardianship) in the context of marriage contract ('aqdun nikah) using a hermeneutical approoch. There are many approoches and assumptions with regard to studying the issue of wali. The author argues that it is necessary to link the study of waliwith that of Arabian culture. Having studied the discourse of wali mentioned in a number of hadits, as well as put them in the contexts of Islamic massage and Arabian culture, the writer concludes that the hadits dealing with wali have indeed a temporal function, and addressed to minors (children not reaching their adulthood) and those who lack capability to take care and manage their own lives. Thus the author suggests that patriarchal culture which discriminate adult, intelligent women to act as waliin the event of marriage slwuld be reviewed in order to create egalitarian society.

Abstract

There are two hadith that discuss the issue of mut'ah marriage, one of them permits mut'ah marriage, while the other hadith forbids its existence. In terms of the legitimacy of hadith (takhrij hadith), both hadith demonstrate their validity, meaning that both hadith can serve as evidence in making laws. In the view of the writer, these two hadith cannot be separated. In the writer's analysis, they are related and in fact strengthen each other, in the way that eventually mut'ah marriage was prohibited. Hence the two hadith are not contradictory. What occurred was a nullification of the law of mut'ah marriage which was previously allowed, then was later forbidden. One law was repealed and replaced by a new one, making the old law legally null and void.

Suami beliau bernama Prof Dr Ir Mohammad Sadli, MSc (suami, almarhum). Beliau mengenyam pendidikan di Fakultas Farmasi Universitas Gadjah Mada (UGM), (Sarjana Muda 1953). Kemudian beliau melanjutkan studinya  ke Program Pascasarjana Fakultas Psikologi Universitas Indonesia (1961) dan Doktor Psikologi UI (1976). Adapun kegiatan penting yang pernah digelutinya adalah sebagai ketua Komisi Nasional Anti Kekerasan terhadap Perempuan (Komnas Perempuan, 1998-2004), mendirikan Pusat Studi Kajian Wanita UI, Anggota Komisi Nasional Hak Asasi Manusia (1996-2000), Tim Gabungan Pencari  Fakta (TGPF) kasus kerusuhan 13-15 Mei 1998, di mana kekerasan seksual menjadi bagian integral (23 Juli-23 Oktober 1998) dan Menulis banyak tulisan ilmiah dan artikel. Bukunya antara lain, Menjadi Perempuan Sehat dan Produktif di Usia Lanjut (2007). Beliau juga aktif di dunia olah raga dalam rangka penyiapan atlet putri di bidang bulu tangkis.

Abstract

Majelis Taklim sebagai bagian integral pendidikan Islam dan Sistem Pendidikan di Indonesia menempati peran strategis pembinaan jamaah dalam perwjudan insan beriman, bertakwa, dan masyarakat utama. Selama ini, kajian akademik pendidikan nonformal berbasis Majelis Taklim Perempuan masih kurang mendapatkan perhatian serius di kalangan akademisi. Tulisan ini mengangkat dua pokok objek penelitian: pertama, pengembangan materi pendidikan dalam perspektif epistemologi bayānī, ’irfānī, dan burhānī, pada pendidikan nonformal berbasis Majelis Taklim Perempuan di kota Yogyakarta; dan kedua, pengembangan kegiatan pendidikan nonformal berbasis Majelis Taklim Perempuan di kota Yogyakarta perspektif ilmu sosial profetik. Subjek penelitian pada lima pengajian ibu-ibu di kota Yogyakarta: 1) Pengajian ’Aisyiyah Ranting Kadipaten Wetan dan Ngasem, 2) Pengajian Dewi Khodijah Pasar Beringharjo, 3) Pengajian Kartini Kecamatan Jetis dan Kampung Sitisewu, 4) Pengajian Raudlatul Jannah Muslimat NU Cabang Kota Yogyakarta, dan 5) Pengajian Al-Wardah (WSI-KBW UCY). Hasil temuan penelitian ini adalah 1) Proses penyajian materi dengan fokus pengembangan cara unik yang dilakukan ustaz dan ustazah 2) rintisan kegiatan pemberdayaan masyarakat telah dilakukan melalui aktivisme sejarah, pilar humanisasi, liberasi, dan transendensi.   [Majelis Taklim (Woman Islamic Forum), which serves as an integral part of Islamic education in Indonesia, has been playing a role model in Presenting the women community to challenge the religious activism in the community. Surprisingly, the few studies are less attention in an academic project to address the Majelis Taklim issue. This thesis raises two main points as the implementation of teaching materials in Majelis Taklim in Yogyakarta on bayānī, 'irfānī, and burhānī epistemology perspective. Second, Majelis Taklim in Yogyakarta teaches on the prophetic approach for Social Perspective. The paper addresses five Majelis in Yogyakarta as Pengajian ‘Aisyiyah Subdipaten Wetan and Ngasem, Pengajian Khodijah Pasar Beringharjo, Pengajian Kartini, Jetis District and Kampung Sitisewu, Pengajian Raudlatul Jannah Muslimat NU Yogyakarta City Branch, and Pengajian Al-Wardah (WSI-KBWUCY). Abstract

Peran perempuan dan laki-laki yang tidak setara dan tidak seimbang telah menjadi subyek perdebatan sengit dalam masyarakat Muslim. Secara umum persepsi terhadap budaya dan agama telah berlangsung lama bahwa peran laki-laki harus mendominasi peran perempuan, dan subordinasi perempuan adalah nasib yang tidak dapat diubah. Penelitian ini mengkaji pemahaman guru-guru Muslim Indonesia terhadap konseptualisasi teks-teks Islam terutama hadis (perkataan Nabi Muhammad), mengenai aspek yang menggambarkan dan menentukan peran gender. Penelitian kualitatif ini adalah untuk mengungkap persepsi lima guru laki-laki dan lima perempuan, yang bekerja di Sekolah Menengah Islam di Yogyakarta, terkait dengan pemahaman mereka tentang status perempuan dalam masyarakat Islam. Data dikumpulkan melalui diskusi kelompok (FGD) yang melibatkan laik-laki dan perempuan dan dilakukan secara online melalui Zoom. Hasil penelitian menunjukkan bahwa para guru mengakui bahwa sikap individu dan institusional berusaha untuk membatasi partisipasi perempuan dalam masyarakat Muslim, dan sebagian besar Muslim yakin bahwa sikap tersebut berasal dari teks-teks Islam (terutama hadis) yang telah diterjemahkan secara historis dan atau harfiah. Pandangan mereka bervariasi terkait dengan tiga konsep Islam yang dianalisis karena berpengaruh bagi status sosial dan pekerjaan perempuan, yaitu kodrat (sifatmanusia), qiwama (kedudukan sosial dan kepemimpinan), dan laknat (penilaian atau murka oleh para malaikat). Pada dasarnya, tidak semua guru dalam penelitian ini memiliki kesempatan untuk mengajar subjek yurisprudensi Islam (fiqh), di mana topik pernikahan secara khusus dibahas. Namun, mereka semua menyadari kebutuhan yang sedang berlangsung di kelas dan masyarakat. Penelitian ini memiliki implikasi praktis dari pendekatan pedagogis di sekolah-sekolah Islam untuk pendidikan tentang kesetaraan gender. [Unequal and unbalanced roles of women and men have become the subject of intense debate in Muslim society. Common cultural and religious perceptions have long been that men’s roles should dominate over women’s roles and that women’s subordination is an unalterable fate. This study examines conceptualization by Indonesian Muslim teachers regarding Islamic texts, primarily of the hadith (the sayings of the Prophet Muhammad), that describe and prescribe aspects of gender roles. This qualitative study was designed to explore perceptions of five male and five female teachers, employed in Islamic Secondary Schools in Yogyakarta, as related to their understanding of women’s status in Islamic society. The data were gathered through mixed-gender focus group discussions conducted online via Zoom. Findings show that the subjects clearly acknowledge that individual and institutional attitudes persist for circumscribing women’s participation within Muslim society, and that most Muslims derive these attitudes from Islamic texts (mainly the hadith) that have been translated in historical and/or literal ways. The teachers varied in their views about three Islamic concepts which were analyzed as influential for the societal and occupational status of women, namely kodrat (human nature), qiwama (societal standing and leadership), and laknat (judgment by, or wrath of, the angels). Basically, not all of the teachers in this study had occasion to teach the subject of Islamic Jurisprudence (fiqh), in which the marriage topic is specifically covered, yet they were all aware of an ongoing need in classroom and society. This study has practical implications of the pedagogical approaches in Islamic schools for education on gender equality.]
