Abstract

Indonesia, known as a Country with high biodiversity, faces significant challenges in protecting its genetic resources from the increasing threats of exploitation and biopiracy, often perpetrated by foreign entities exploiting Indonesia's genetic wealth without proper authorization or fair benefit-sharing. Therefore, it is crucial to analyze the legal protection of genetic resources in Indonesia as communal intellectual property, particularly in relation to the Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement) and national efforts to protect genetic resources. This study employs a normative legal research method, examining various legal sources to address issues related to genetic resources. The research adopts a statutory and conceptual approach by analyzing existing legislation and the protection frameworks implemented in Indonesia for genetic resources. A qualitative analysis is further conducted by describing and interpreting various research sources to provide comprehensive answers to the research questions. The Result indicate that the TRIPS Agreement offers intellectual property protection standards that predominantly emphasize individual rights, failing to fully address the protection of communal intellectual property. In response to this limitation, Indonesia has implemented national policies, including Government Regulation No. 56 of 2022 and the Access and Benefit Sharing (ABS) mechanism. These policies aim to protect indigenous peoples' rights and ensure that the benefits derived from the utilization of genetic resources are distributed equitably. However, the implementation of these protections faces significant obstacles, such as weak institutional capacity, limited public awareness, and gaps in harmonization with international standards. To address these challenges, strategic measures are necessary, including strengthening cross-sector coordination, enhancing indigenous community education, and developing a more comprehensive benefit-sharing mechanism. These steps are essential to ensure that genetic resources are not only protected but also contribute sustainably to the nation’s welfare.

Abstract

The World Bank has launched a maritime economic-environmental strategy referred to as the blue economy. This strategic initiative places a strong emphasis on sustainability in marine economic endeavors, aiming to generate both economic and social benefits while protecting the lasting integrity of marine ecosystems amidst the challenges of climate change. The core objective of the blue economy is to notably improve human welfare and social equity while simultaneously reducing environmental risks and ecological scarcities. The relevance of the blue economy concept is especially pronounced in countries with extensive water bodies, such as Indonesia. As an archipelagic state, Indonesia holds significant promise for the development and utilization of marine resources. Leveraging this economic potential holds the potential to create new job opportunities, enhance food security, and support the sustainability of global marine ecosystems. In this regard, adopting a blue economy strategy emerges as a compelling approach to achieve these objectives, especially given that a significant portion of Indonesia's population relies on traditional fishing for their livelihoods. The upcoming research aims to explore two fundamental aspects: firstly, the regulatory framework of the blue economy in relation to climate change, adhering to international legal standards; and secondly, the practical implementation of the blue economy in addressing climate change challenges specific to Indonesia. This research employs a normative research methodology, characterized by a problem-solving approach structured across a series of defined stages.

Abstract

Marriage is a sacred process with several legal requirements that must be obeyed when one of the conditions for the validity of a marriage is not fulfilled. Furthermore, if things contained in the prohibition of marriage, such as committing inbreeding or incest, then the marriage is considered invalid or can even be canceled by law. When a marriage is considered invalid or even annulled by law, it will have legal consequences for the position of children born from the marriage, including the position of children in inheritance. This research uses a normative legal approach method that uses doctrines and principles of law as a reference and uses primary and tertiary legal materials. From this research, it can be concluded that inbreeding or incest is considered invalid in Indonesia, so it results in the position that children born from incest relationships are illegitimate children and are also referred to as adulterous children or discordant children (civil code). In terms of inheritance, children of incest have no inheritance at all. Both Islamic and Civil Law state that children of incest only have relation to their biological mother and mother's family, while to their biological father, there are no relations at all because they have no obligation to inherit each other and only have a right to demand the necessary maintenance from their biological father asset’s

Abstract

Reproductive rights are the basic rights of every individual or couple to be able to freely and responsibly decide the number, spacing of births, and time to have children, so as to obtain good quality in reproductive health. Protection of reproductive rights for women is important to prepare new humans as superior future generations. Protection of women's reproduction is needed to guarantee legal protection in their growth and development and human rights that are recognized while in the womb. This service aims to provide counseling and interactive discussions to mothers of the Cipadang Gedong Tataan Village farmer group regarding the protection of women's reproductive rights so that these rights are not misused. Increase knowledge, understanding and legal awareness of the community, especially to mothers of the Cipadang Gedong Tataan Village farmer group regarding the protection of women's reproductive rights. This service provides important insights for mothers of the Cipadang Gedong Tataan Village farmer group regarding the protection of women's reproductive rights. The implication of this service is that universities and non-governmental organizations must encourage and support this service activity so that the community understands the protection of women's reproductive rights.

Abstract

Background: East Lampung Regency ranks first in Lampung Province and ninth nationally as a sending region for migrant workers (PMI), with 75,311 people. Despite contributing significantly to the migrant workforce, the region faces numerous civil law challenges, including cases of employment termination, passport detention, undocumented workers, and overstays, making it a critical area for addressing migrant worker issues. Methods: This study employed a qualitative approach, analyzing secondary data from government reports, legal records, and migrant worker case studies in East Lampung. Interviews with key stakeholders, such as government officials, legal experts, and migrant worker advocacy groups, were also conducted to understand the root causes and impacts of these civil law cases. Findings: The research found that East Lampung's prominence as a PMI sending region correlates with an increase in civil law cases involving migrant workers. Issues like lack of proper documentation and legal protection are key factors contributing to the high incidence of cases such as termination of employment and passport detention. The study also identified gaps in policy implementation and support systems for migrant workers, both before and after departure. Conclusion: East Lampung Regency's status as a leading PMI sending region is accompanied by significant legal challenges for migrant workers. Strengthening legal frameworks, improving migrant worker documentation, and providing pre-departure training on legal rights are essential for reducing civil law cases and ensuring better protection for workers.  Novelty/Originality of this study: This study is unique in highlighting the specific legal issues faced by migrant workers from East Lampung Regency. It provides a comprehensive analysis of the underlying causes of civil law cases and offers recommendations for policy improvements to enhance the protection and welfare of migrant workers from this region.

Abstract

Trading in influence is a form of corruption that has gained increasing attention in Indonesia's legal system. This practice involves leveraging social relationships and access to public officials to gain certain advantages, either directly or indirectly. However, Indonesian law has yet to explicitly criminalize trading in influence as a distinct corruption offense, leading many cases that should fall under this category to be prosecuted under bribery or gratification laws instead. Amid these legal limitations, the concept of restorative justice emerges as an alternative resolution mechanism that focuses more on restitution and reconciliation rather than mere punishment. This study employs a normative juridical approach by analyzing relevant legal regulations and case studies at both national and international levels. From a criminal procedure law perspective, implementing restorative justice in trading in influence cases faces significant challenges, particularly in terms of evidence and victim identification. Nevertheless, this mechanism has the potential to enhance law enforcement effectiveness by promoting transparency, accountability, and the restitution of unlawfully obtained benefits. In the context of implementing Target 16 of the SDGs, the application of restorative justice can strengthen the rule of law and foster more transparent and inclusive institutions. Therefore, clearer regulatory reforms are necessary to accommodate restorative justice as a viable approach to addressing trading in influence as part of Indonesia's broader anti-corruption efforts.

Abstract

The implementation of personal data protection regulations in the Indonesian fintech sector, specifically Law Number 27 of 2022 concerning Personal Data Protection and Financial Services Authority Regulation Number 77 of 2016, shows significant progress in implementing a comprehensive legal framework. This framework adopts international standards such as the General Data Protection Regulation, is supported by the establishment of a Personal Data Protection Agency, and mandates reporting of data breach incidents. However, covering personal data remains a serious threat, resulting in financial losses, psychological distress, and reputational damage for consumers. This highlights the challenges in consistent law enforcement, low digital literacy among the public, and the need for wider implementation of advanced security technologies. To improve legal protection, it is important to strengthen oversight and law enforcement mechanisms, improve digital literacy among the public through continuing education, mandate the implementation of advanced security technologies by fintech providers, and regulate reporting and complaint mechanisms.

Abstract

Artificial Intelligence (AI) technology has ushered the world into a new era in which machines exhibit certain aspects of human intelligence. One such capability of AI is its ability to generate written responses based on commands or inquiries posed by humans, facilitated by natural language processing (NLP). This output raises legal concerns regarding copyright ownership and the ethical considerations surrounding intellectual property. This research examines the ethical dimensions of intellectual property in relation to AI-generated writing and analyzes the status of copyright ownership for works produced by AI. The study employed a normative legal method, employing statutory, case-based, and conceptual approaches. The data sources included primary, secondary, and tertiary legal sources. The findings indicate that, in its current implementation, AI-generated written works conflict with the ethical values of intellectual property due to the infringement of moral rights associated with copyright (right of attribution and right of integrity). Copyright ownership of AI-generated works for outputs that do not meet this standard, ownership is classified as public property under the principle of the public domain (open to the public). Consequently, developers and users of AI platforms cannot be regarded as copyright owners, as the requisite originality is absent, and AI, as a machine, cannot be deemed a creator due to the absence of human agency. The legal framework governing AI and its copyright remains inadequately defined under national legislation, resulting in insufficient legal protection against AI utilization. So, regulations regarding artificial intelligence are needed to handle this.

Abstract

Konflik bersenjata yang terjadi di Papua antara aparat militer Republik Indonesia dan kelompok separatis seperti Organisasi Papua Merdeka (OPM) serta Tentara Pembebasan Nasional Papua Barat (TPNPB), telah berlangsung selama beberapa dekade dan menunjukkan intensitas kekerasan yang signifikan. Meskipun pemerintah Indonesia tidak secara eksplisit menyatakan situasi di Papua sebagai konflik bersenjata non-internasional (Non-International Armed Conflict/NIAC), kenyataan di lapangan menunjukkan keterlibatan aktor non-negara bersenjata dan penggunaan kekuatan militer reguler yang terus meningkat. Hal ini menimbulkan dilema hukum terkait legalitas tindakan militer, serta urgensi penerapan prinsip-prinsip dasar Hukum Humaniter Internasional (HHI) dalam operasi militer di dalam negeri. Masalah ini penting untuk segera diselesaikan karena dampaknya yang terus meluas terhadap keamanan nasional, perlindungan hak asasi manusia, dan stabilitas sosial-politik baik di tingkat lokal maupun nasional. Penelitian ini bertujuan untuk menganalisis kesesuaian kegiatan operasional TNI dalam menangani separatisme bersenjata di Papua dengan prinsip-prinsip HHI, yaitu prinsip distinction, proportionality, dan military necessity. Melalui pendekatan yuridis-normatif, penelitian ini menunjukkan bahwa penerapan prinsip HHI belum optimal karena berbagai kendala, mulai dari ketidakjelasan status hukum konflik, minimnya regulasi teknis nasional, hingga absennya evaluasi strategis terhadap dampak operasi militer terhadap warga sipil. Selain itu, penelitian ini juga menyoroti perlunya reformasi kebijakan keamanan dan transparansi operasi militer sebagai bagian dari tanggung jawab hukum dan moral negara dalam melindungi hak asasi manusia serta menjaga legitimasi di mata hukum internasional. Oleh karena itu, penguatan kerangka hukum nasional yang selaras dengan HHI merupakan langkah strategis dalam menyelesaikan konflik Papua secara damai dan berkeadilan.

Abstract

Perdagangan bebas memicu berkembangnya kejahatan penipuan investasi fiktif yang merugikan masyarakat dan mengancam kedaulatan hukum pidana negara. Kejahatan ini memanfaatkan celah regulasi dan lemahnya koordinasi antarnegara. Penelitian ini bertujuan menganalisis efektivitas penegakan hukum pidana dalam menanggulangi penipuan investasi fiktif di era globalisasi. Metode yang digunakan adalah yuridis normatif dengan pendekatan peraturan perundang-undangan, khususnya KUHP, UU ITE, serta UNTOC sebagai instrumen internasional. Hasil kajian menunjukkan lemahnya penegakan hukum disebabkan keterbatasan yurisdiksi, kurangnya kapasitas aparat, dan minimnya kerja sama internasional. Kebaruan penelitian ini terletak pada usulan pembentukan gugus tugas pidana lintas negara berbasis mutual legal assistance untuk meningkatkan efektivitas penindakan. Integrasi antara hukum pidana nasional dan internasional diperlukan guna memperkuat kedaulatan negara menghadapi kejahatan lintas batas.
