Abstract

Struktur pasar yang kompetitif merupakan fondasi penting bagi terciptanya efisiensi ekonomi dan perlindungan konsumen. Namun, praktik monopoli yang dilakukan oleh pelaku usaha dominan sering kali menciptakan ketimpangan dalam akses pasar dan harga yang merugikan konsumen. Penelitian ini bertujuan untuk menganalisis praktik monopoli perdagangan di Indonesia dari perspektif hukum serta mengevaluasi efektivitas Undang-Undang Nomor 5 Tahun 1999 dalam menciptakan iklim usaha yang sehat. Pendekatan yang digunakan adalah yuridis normatif dengan metode deskriptif melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa praktik monopoli di Indonesia terjadi melalui merger, integrasi vertikal, dan penyalahgunaan dominasi pasar yang berdampak pada harga tinggi, rendahnya inovasi, serta terbatasnya peluang bagi UMKM. Keberadaan Komisi Pengawas Persaingan Usaha (KPPU) menjadi instrumen penting dalam menegakkan keadilan ekonomi, meskipun masih terdapat tantangan dalam hal efektivitas implementasi dan adaptasi terhadap praktik monopoli di era digital. Diperlukan reformasi regulasi dan penguatan kelembagaan agar pasar yang adil dan inklusif dapat terwujud secara berkelanjutan

Abstract

The issue of hygiene and household waste management in Indonesia is becoming increasingly urgent. A public culture that does not care about cleanliness and the environment is the main challenge. Ironically, while 65 million tons of waste are generated each day, a mere 7% of it is recycled. This research utilizes normative methods, focusing on both statutory and conceptual approaches, to explore relevant legislation and legal concepts related to waste management. This research highlights the lack of research that emphasizes the social capital aspect of waste management and proposes a social capital-based waste service levy model as a solution. The research results show that low public awareness, lack of infrastructure, and weak implementation of regulations are the main problems in waste management in Indonesia. The social capital-based retribution model, which involves the use of special plastic bags and active community participation, is expected to increase the effectiveness and efficiency of waste management. This approach utilizes existing social networks and norms, encourages communities to be more responsible in managing their household waste, and creates a fairer and more transparent retribution mechanism. Thus, this research provides a new contribution in efforts to create a cleaner and healthier environment in Indonesia.

Abstract

This article explores how Indonesia’s village governments interpret and implement the Sustainable Development Goals (SDGs) through the process of vernacularization. Given Indonesia’s more than 81,000 villages, each with unique socio-cultural characteristics, localizing global norms is both a legal and practical challenge. The urgency lies in aligning global development frameworks with traditional village governance while maintaining local identities. This study aims to assess the implementation of Village SDGs and to evaluate vernacularization as a mechanism for translating global norms into culturally resonant practices at the grassroots level. Using a normative juridical method, this research analyzes legal documents, policy frameworks, and academic literature to identify patterns in SDG localization. Qualitative doctrinal analysis and thematic content review are applied to trace how global values are reinterpreted through local institutions and practices. Findings indicate that the 17 SDGs, along with Indonesia’s additional Goal 18 on adaptive village culture, align with existing local norms but require contextual adaptation. This is achieved through a three step vernacularization model involving translation, the role of vernacularizers, and framing, all grounded in a human rights based approach. The study concludes that vernacularization is essential to ensuring inclusive, culturally grounded, and sustainable implementation of the SDGs, reinforcing both universal values and local autonomy.

Abstract

General Agreement on Trade and Servies WTO in the Service sector is regulated in the Doha Round along with 12 other trade sectors which are compromises between developing countries and developed countries. The service trade liberalization regulation in Indonesia has been implemented in law Number 20 of 1999 concerning the National Education System and Law Number 12 of 2012 concerning Higher Education.

Abstract

There are 3 (three) conditions that must be met in order to become an heir as regulated in Article 171 letter c of the Compilation of Islamic Law (KHI) namely that an heir is a person who at the time of death, he was related by blood or marriage to the testator, was a Muslim and was not prevented by law from becoming an heir. As in case number 0554/Pdt.P/2023/Pa .Sby. In this decision the Panel of Judges granted the applicant's request and determined the applicant to be a mandatory testator. This research method is  normative legal research, conceptual approach and case approach. The result states that the judge granted the Petitioner to be the Legal Heir as a Testament Wajibah even though he had a different religion from the Muslim heir due to consideration of justice. Judges are not mouthpieces of the law, so for the sake of 'justice' judges carry out legal inroads (contra legem) into the provisions contained in the Compilation of Islam.

Abstract

Consumer protection in the digital era is a major challenge faced by Indonesia along with the rapid development of technology and electronic transactions. Despite the existence of regulations such as the Consumer Protection Law and the Electronic Information and Transaction Law (ITE Law), the current regulations are still unable to address new problems arising from digitalization, such as personal data leakage, online fraud, as well as difficulties in enforcing laws against cross-border digital platforms. This research aims to explore the urgency of law reform to strengthen consumer protection in the digital era. Through a qualitative approach, this research identifies various challenges faced by digital consumers, including a lack of transparency in digital services, low digital literacy, and insufficient supervision of businesses in the digital sector. The findings show that comprehensive legal reforms are needed to strengthen transparency, data security, and make it easier for consumers to access their rights. This reform should also include the establishment of special mediation and arbitration institutions for the digital sector, strengthening supervision of business actors, and harmonization between domestic regulations and international standards. This research concludes that with more responsive and sustainable legal reforms, Indonesia can create a safer, fairer and more reliable digital environment for consumers.

Abstract

Permasalahan lingkungan, sosial, ekonomi dan hukum mendorong terciptanya urgensi penerapan pendekatan ekonomi yang berkelanjutan berupa ekonomi hijau, ekonomi biru dan ekonomi sirkular berpotensi meningkatkan keuntungan guna peningkatan ekonomi nasional dan internasional secara berkelanjutan. Didapati rumusan masalah bagaimana sistem hukum terintegrasi mengenai green, blue dan circular economy untuk pembangunan ekonomi berkelanjutan bagi Indonesia dan apa yang menjadi faktor penghambat dalam mewujudkannya. Penelitian ini menggunakan penelitian normatif yuridis yang menggunakan metode pengumupulan data dengan cara studi literatur terkait judul. Hasil penelitian menunjukkan Indonesia telah mulai menerapkan ketiga sistem ekonomi tersebut, namun belum adanya sistem hukum yang terintegrasi untuk mewujudkan sistem ekonomi tersebut di Indonesia yang disebabkan belum adanya harmonisasi hukum dan belum adanya tata kelola kelembagaan yang efektif dan representatif. Saya merekomendasikan agar program ekonomi hijau, ekonomi biru dan eknomi sirkular sebagai prioritas Nasional Negara Indonesia, harmonisasi hukum, reformasi kelembagaan yang efektif dan representatif serta melakukan gerakan semesta seluruh rakyat Indonesia memperbaiki kebiasaan dan perilaku sehari-hari agar sesuai dengan prinsip-prinsip ekonomi hijau, biru dan sirkular.

Abstract

The birth of international law was a direct result of the emergence of civilized and independent states in the sixteenth century in Europe, known as the Enlightenment. So the need for a series of rules to regulate legal relations between these countries. However, until now, Asian and African countries are still fighting for their independence until new problems arise. The polarization of the international community is divided into two, namely developed and developing countries. Where international law is dominated by developed countries with European and American values and does not accommodate the values of local wisdom from developing countries that were former colonies. Indonesia as a developing country must be able to take appropriate steps to anticipate all changes and developments as well as global trends so that national goals can be achieved. One of the important steps taken is to promote and protect their communal rights. The concept of recognizing communal rights originating from developed countries and being accommodated in various international agreements such as The General Agreement on Tariffs and Trade (GATT) and Trade Related Aspects of Intellectual Property Rights (TRIPs) which are more in favor of the economic interests and investment of countries progress without paying attention to the disparity in the ability to master knowledge, technology, and information as intangible capital, especially communal rights. The monopoly of intangible capital by developed countries is not in favor of developing countries as owners of communal wealth that should receive appreciation and recognition, as well as economic benefits for developing countries. Indonesia as a developing country rich in natural resources, arts, and culture has various communal assets that require legal recognition and protection and are recognized internationally. Communal rights that are currently developing in Indonesia are a response to the hegemony of communal wealth controlled by developed countries to maintain national identity. The dynamics of the global economy that is driven by knowledge, creativity and technology must not ignore communal rights as part of the domestic economic system. Instead of being skeptical about this, Indonesia as a developing country must determine a strategy to utilize communal rights as intangible capital in economic development. By using a literature study, this paper describes the advantages and challenges in protecting communal rights and their benefits in Indonesia. Communal intellectual property is a form of recognition for the traditional culture of the Indonesian people to be preserved and generate economic benefits for the entire custodial community. In addition, communal intellectual property is protected by the state with unlimited protection which will provide welfare for indigenous peoples. However, there are still some shortcomings in the protection of communal intellectual property because there is still no written and systematic inventory of the traditional cultures produced by indigenous peoples, as well as the registration model and benefit sharing by the state to the custodian community. Government policies are needed to gradually provide effective and efficient protection in the form of defensive protection and the sui generis law.

Abstract

The International Seabed Authority (ISA) plays a crucial role in governing the vast expanses of the ocean floor that lie beyond national jurisdictions, referred to as "the Area" under the United Nations Convention on the Law of the Sea (UNCLOS). Although the ISA has established regulations for deep-sea exploration, it has encountered significant challenges in finalizing a comprehensive mining code for resource exploitation. This ongoing delay underscores the notion that legal development is often catalyzed by broader social changes. To comprehend the factors contributing to this delay, it is essential to consider the historical context of UNCLOS 1982, a framework established during a period when numerous developing nations were asserting their independence. The Third World Approaches to International Law (TWAIL) critiques highlight how international legal frameworks have frequently favored developed nations, complicating the pursuit of a just and equitable mining code. Furthermore, the recent Biodiversity Beyond National Jurisdiction (BBNJ) Agreement, which advocates for equitable access to marine resources, poses additional challenges for the ISA. Developed nations, equipped with advanced technologies, continue to dominate deep-sea resource exploitation, exacerbating the existing technological divide, as illustrated by Indonesia's collaboration with the U.S. NOAA in 2010 to explore its marine territory. Social change typically emerges not merely from value shifts but through the resolution of conflicts that lead to new agreements. This article will attempt to understand why the ISA mining code has been delayed and what this means for international law considering the TWAIL and BBNJ approaches.

Abstract

This study aims to analyze the role of village-owned enterprises (BUMDes) with legal entity status in driving village economic independence and supporting sustainable national development. The research focuses on identifying challenges faced by BUMDes, including regulatory complexity, administrative constraints, limited legal literacy, and weak governance practices, while exploring opportunities arising from their formal legal recognition. Using a qualitative normative approach, the analysis highlights how legal entity status strengthens institutional legitimacy, facilitates access to financing, encourages business partnerships, and promotes diversification of economic activities at the village level. Findings show that despite significant opportunities, implementation remains suboptimal due to structural, managerial, and technological barriers. The study emphasizes the need for capacity-building programs, harmonization of regulations, and stronger collaboration between government, academia, and local institutions to improve governance quality and maximize BUMDes’ potential. Strengthening BUMDes as legal entities can enhance community participation, create sustainable economic growth, and position villages as strategic actors within the broader national economy.
