Abstract

This study aims to analyze the application of child rights protection in divorce decisions at the Cirebon Religious Court and explore ways to optimize this protection using the maslahah approach. Divorce significantly impacts the physical and mental development of children, often resulting in a weakened next generation due to the lack of fulfillment of children's rights post-divorce. The research employs a normative juridical method, incorporating statute, case, and conceptual analyses to provide a comprehensive understanding of the current legal landscape and its shortcomings. The findings reveal that while the inclusion of children's rights in divorce decisions is crucial, it remains optional rather than mandatory. This oversight leaves many children vulnerable, as their rights are not consistently safeguarded in the aftermath of their parents' separation. Currently, no regulation mandates the inclusion of children's rights in divorce decrees, limiting judges to act only on explicit petitions. This study highlights the effectiveness of the Maslahah approach in ensuring that children's rights are prioritized, recommending significant legal reforms to make the inclusion of these rights mandatory in divorce rulings. Such reforms would provide a robust legal foundation to safeguard children's human rights post-divorce, covering aspects such as education, health, and protection from parental conflict. By implementing these recommendations, we can enhance the well-being of children affected by divorce and ensure their rights are consistently protected.

Abstract

Divorce mediation has emerged as a practical approach to resolving marital disputes, transforming the desire for divorce into an opportunity for reconciliation within contemporary Islamic jurisprudence and cultural contexts. This process highlights the growing importance of integrating cultural values into legal dispute-resolution mechanisms, particularly in Muslim societies where local traditions significantly influence family dynamics. This article assesses the effectiveness of divorce mediation in Indonesia, focusing on its role in reducing conflict, fostering post-divorce cooperation, and supporting the psychological well-being of couples involved. A mixed-methods approach combines quantitative surveys of 111 couples who participated in mediation with in-depth interviews with three professional mediators. Reconciliation was evaluated based on participants' perceptions of post-divorce interactions, particularly their communication and co-parenting abilities. The study acknowledges limitations, such as purposive sampling, which restricts generalizability, and reliance on self-reported data that may introduce bias. Results show that 75% of couples experienced reduced conflict, 95% were satisfied with the outcomes, and 60% reported continued cooperation three years post-divorce. The study emphasizes the role of mediators, structured negotiation processes, and cultural values in successful mediation, recommending improved mediator training and culturally sensitive approaches.

Abstract

This research aims to analyze the tarbawi verses in surah al-Baqarah according to Tafsir al-Misbah by M. Quraish Shihab and examine their relevance to the objectives of Islamic education in surah al-Baqarah verses 21, 30, 200, and 247 which contain fundamental educational values ​​in Islam. Using a qualitative-descriptive approach with literature study methods and content analysis. Tafsir al-Misbah is used as the main source in interpreting the meaning and values ​​of education. The results of the research show that these verses contain the basic principles of Islamic education, such as instilling faith and devotion to Allah SWT, becoming a caliph/leader, achieving happiness in the afterlife, forming Muslims with strong and noble morals. These values ​​are in line with the goals of Islamic education which include the formation of people who believe, have noble character, and are able to carry out the duties of the caliphate on earth. Thus, according to Tafsir al-Misbah, Surah al-Baqarah is relevant as a conceptual and practical basis in formulating the goals of Islamic education.

Abstract

This study examines Islamic concepts of 'Iddah (waiting period for a divorced wife) and how the Feminists view it. The aim is to comprehend the different perspectives and try to put the problem in the right position. This research is purely library research using a socio-philosophical approach. Data were obtained from literature, books, and available documents. Based on the results of the study, it can be concluded that in Islamic teachings 'iddah is intended to determine the status of the womb, whether pregnant or not, to avoid mixing the lineage of the expecting baby. This is different from the view of the feminists who think that the provision regarding 'iddah is a product of a patriarchal culture that marginalizes women as it only applies to women, and not to men. This feminist view is based on the spirit of equality before the law which demands equal rights and obligations. The view, however, needs to be reviewed as the provision of 'iddah does not necessarily mean ignoring the principle of equality between men and women. Men and women by nature are created with different physical and emotional characters according to their respective roles. Even if such a view is applied, new problems will arise and damage the order of human culture universally

Abstract

This article explores the role of Islam in fostering social harmony within the diverse community of Nagajuang Subdistrict, Mandailing Natal Regency, where the population is predominantly non-Muslim. This research employs a qualitative method with a case study design and a descriptive-analytical approach. The study investigates social interactions between Muslims and Christians and identifies key factors that support peaceful coexistence. The research data were collected from the community of Nagajuang Subdistrict, Mandailing Natal Regency, North Sumatra, which represents a valuable case of interfaith harmony. The data consist of interview transcripts with religious leaders, traditional leaders, and community members; field notes from participatory observation of daily interactions; and textual data from local archives and reports on interfaith relations. These data were collected through purposive sampling based on the informants’ involvement in interreligious and community activities. Thematic analysis was employed, involving data reduction, categorization into themes such as harmony factors, challenges, and the role of Islam, followed by conclusion drawing. The findings reveal that Islamic values of moderation, such as rahmatan lil ‘alamin and wasatiyyah, are practiced to promote tolerance and unity. Local cultural traditions emphasizing mutual cooperation (gotong royong) further strengthen social bonds across religious lines. Despite this harmony, challenges like religious intolerance and socio-economic inequality persist. This study highlights the significance of combining Islamic values with local cultural wisdom to support multicultural coexistence. It offers practical recommendations for strengthening multicultural education and promoting collaboration among government bodies, religious institutions, and communities. Nagajuang serves as a model of successful interfaith harmony, contributing valuable insights into social integration in diverse societies.

Abstract

According to the theory of effectiveness, the findings found by researchers have not reached the benchmark for the effectiveness of protected forests as confirmed in Law 41 of 1999 Article 47 on Forest Protection. The problem that occurs is the problem that is the main supporter of achieving the effectiveness of forest protection. The effectiveness of law no. 41 of 1999 Article 47 concerning benchmarks for effectiveness in the supervision of protected forests in order to maintain their sustainability. where there are problems faced by the agency responsible for the preservation of protected forests. factors inhibiting the effectiveness of law no. 41 of 1999 concerning Forest Protection is a budget cut since COVID-19 which hinders Forest Protection, then lack of public awareness of forest preservation, and lack of legal firmness from law enforcement officers. Abstract

This study discusses the implementation of Law No. 22 of 2009 article 115 concerning the prohibition of racing with other motorized vehicles in the city of Padangsidimpuan. This research is motivated by the number of teenagers who are racing with motorcycles, especially on Jl. Gen. Besar A Haris Nasution in the city of Padangsidimpuan causing problems of security, order and public comfort on Jl. Gen. Besar A Haris Nasution This research is a field research using qualitative descriptive analysis method. Wild racing has become a teenager’s habit that is hard to leave. The data collection method in this study was by interview and documentation in accordance with the provisions contained in Government Regulation Number 22 of 2009 article 115 concerning the prohibition of racing with other motorized vehicles. Abstract

Children's education patterns are often related to the methods and processes carried out. The continuous mentoring model is a very good method. Along with this method, the process of approaching children will run smoothly. Children in Parupuk Julu village in North Padang Lawas Regency have very little assistance in the form of learning outside of school. The Service Team from the STAIN Mandailing Natal Campus carried out service activities by assigning a group of Real Work Study students to the village. This is done to provide assistance to school age children in enhancing their learning experience. The method used is intense mentoring carried out by students with the concept of group learning in the Pesantren Kilat event. The results of the service show that intensive mentoring increases children's motivation in learning. They have been able to instill every practical task of worship taught at Pesantren Kilat activities, such as writing hijaiyah letters, reading iqra, reading the Koran, performing prayer movements and reading. So, the intense mentoring method carried out by STAIN Mandailing Natal KKN students resulted in increasing the motivation and religious practice of children in Parupuk Julu village.

Abstract

Boarding programs have long been an integral part of formal education in many countries. In addition to providing housing for students, the boarding program also has an important role in moral development. Moral formation through boarding programs involves developing strong moral, ethical, and personality values, which can shape the character of students to become responsible and ethical individuals. One of the main benefits of boarding programs in moral formation is to create an environment that supports positive personal growth. In a boarding environment, students learn to live together with people from different backgrounds, broadening their understanding of diversity, tolerance, and cooperation. This study looked at how the boarding program was carried out at the Darul Ikhlash Islamic Boarding School using qualitative research methods. From this research, the results of several excellent programs implemented at the Darul Ikhlash Islamic Boarding School were found, namely: congregational prayer, reading the Qur'an, book recitation, Tabligh, Muzakaroh, night study.

Abstract

Education has aspects that are more complex than merely learning, teaching, or transferring knowledge. Education must have clear concepts, objectives, methodologies, and programs. Islamic education aims to develop human potential, both outwardly and inwardly, to form a fully integrated Muslim personality. Laduni knowledge is the type of knowledge obtained through divine inspiration after the purification of the soul. As explained by Imam Al-Ghazali in Ihya Ulumuddin, laduni knowledge is described as knowledge from God that directly enters the human heart without any intermediary. This knowledge is considered the most profound and full of wisdom compared to knowledge gained through ordinary learning processes. The education of laduni knowledge is inseparable from Islamic education, which is based on the Qur'an and the Sunnah. The objectives of laduni knowledge education include the formation of noble character, nurturing the soul, instilling virtues, fostering politeness, and preparing humans for both worldly and eternal life. Islamic education also balances spiritual and worldly orientations, including cultivating scientific enthusiasm and curiosity. There are two methods of acquiring knowledge: human instruction (at-ta’allum al-insaniyyah) and divine instruction (at-ta’allum ar-rabbaniyyah). Those who attain laduni knowledge tend to require little effort, face no significant difficulties in learning, and achieve great results with minimal effort.
