Abstract

The rapid development of information technology has created a complex and widespread digital ecosystem, where digital platforms are becoming massive collectors of personal data. This phenomenon poses a risk of data leakage and misuse that threatens individual privacy. In Indonesia, even though Law No. 27 of 2022 concerning Personal Data Protection (PDP Law) has been passed, its implementation still faces significant challenges, especially related to infrastructure readiness, law enforcement, and public awareness. Existing regulations tend to be normative and have not been able to keep up with rapid technological innovation, so the responsibility of digital platforms in maintaining data security is still weak and formalistic. This study uses a normative juridical approach to examine the effectiveness of the PDP Law in regulating the legal responsibilities of digital platforms. The results of the analysis show the need to strengthen supervision mechanisms, firm law enforcement, and increase technical capacity and human resources. Lessons learned from international standards emphasize the importance of independent oversight bodies and the application of privacy by design principles. With the synergy of adaptive regulations, reliable technology, and collective awareness, personal data protection can be realized effectively to protect users' rights and security in the digital era.

Abstract

Digital transformation in public services brings efficiency and transparency, but at the same time gives birth to new modes of corruption that are non-physical, complex, and transnational. Digitalization opens up opportunities for data manipulation, system engineering, and the elimination of traces of electronic transactions, which are difficult to handle with conventional criminal law instruments. Law No. 31 of 1999 and Law No. 20 of 2001 still dominantly use the classic paradigm that focuses on physical state losses, so it is not yet fully able to reach technology-based crimes. The limitations of these norms create legal gaps and the risk of impunity, especially when the principle of legality requires the formulation of clear criminal justices. On the other hand, proving digital corruption requires explicit recognition of electronic evidence, while the judicial system is still based on conventional evidence. This condition emphasizes the need for responsive criminal law reform, both through expanding the formulation of criminal offenses, strengthening the position of electronic evidence, and developing new sanctions relevant to digital crimes. This research uses a normative juridical method by examining positive law, legality principles, doctrines, and law application practices. The analysis shows that the effectiveness of eradicating digital corruption can only be achieved through regulatory harmonization, increasing the technological capacity of the apparatus, and integrating criminal law with the cyber and administrative law regime. Thus, criminal law is required to be adaptive so as not to be left behind from the dynamics of crime in the digital era.

Abstract

The open proportional electoral system implemented in Indonesia since the 2009 general election aims to improve political representation and strengthen democracy by giving voters more freedom to directly select legislative candidates. However, despite its good intentions, the system presents various challenges in practice, including high political costs, rampant money politics, and weak party control over legislative candidates. The main issue in this research is how the effectiveness of the open proportional system in achieving the goal of fair and stable political representation in Indonesia. This research uses a normative juridical approach to analyse the Constitutional Court's decisions related to the electoral system, as well as comparing with other electoral systems. The author argues that although an open proportional system can increase voter freedom, its negative impacts are greater, especially in terms of high political costs and money politics practices that undermine the integrity of elections. In addition, this system causes divisions within political parties, as legislative candidates focus more on personal votes rather than the collective interests of the party. The findings of this study suggest that although an open proportional system is more democratic in theory, its implementation in Indonesia tends to exacerbate political inequality and reduce political stability. Therefore, a mixed proportional system is suggested as a more effective solution to improve political representation and reduce the negative impacts.

Abstract

This study explores the role of interpersonal intelligence in mediating the influence of character strength and emotional intelligence on juvenile delinquency. Using a quantitative survey method, data were collected from 250 vocational high school students in Cianjur City through a validated questionnaire and analyzed using the SEM-PLS approach. The results showed that character strength had a negative and significant effect on juvenile delinquency, with a coefficient value of -0.321, indicating that increasing character strength can significantly reduce juvenile delinquency. In addition, emotional intelligence also showed a negative and significant effect on juvenile delinquency. This confirms that increasing emotional intelligence also contributes to reducing juvenile delinquency. Interpersonal intelligence negatively and significantly impacts juvenile delinquency, with a coefficient value of -0.161, indicating that better interpersonal skills can reduce the tendency for delinquent behavior. Furthermore, character strength and emotional intelligence were found to have a positive and significant effect on interpersonal intelligence, with coefficient values of 0.370 and 0.484, respectively. Another important finding is the significant negative indirect effect of character strength and emotional intelligence on juvenile delinquency through interpersonal intelligence. This shows that increasing character strength and emotional intelligence can reduce juvenile delinquency by improving interpersonal intelligence. This study concludes that strengthening students’ character and emotional intelligence and increasing interpersonal intelligence are essential strategies for reducing juvenile delinquency
