Abstract

This study examines criminal law policies in protecting and recovering victims of Online Gender-Based Violence (OGBV) within the Indonesian criminal justice system from a victimology perspective. Although several legal instruments, such as Law Number 12 of 2022 concerning Sexual Violence Crimes and Law Number 19 of 2016 concerning Electronic Information and Transactions, provide a normative basis for addressing OGBV, their implementation has not yet ensured effective protection and recovery for victims. This research employs normative legal research using statutory, conceptual, and comparative approaches to evaluate existing legal frameworks and assess their effectiveness in preventing secondary victimization. The findings reveal that the Indonesian criminal justice system remains predominantly offender-oriented, resulting in limited access to victim recovery services, weak institutional coordination, and the absence of an effective compensation mechanism. These structural weaknesses contribute to the persistence of secondary victimization experienced by OGBV victims. Based on these findings, this study proposes a victim-centered criminal law policy model that integrates victim recovery mechanisms, compensation schemes, capacity building for law enforcement officers, and stronger collaboration with digital platforms in handling OGBV cases. The study contributes to the development of criminal law policy by offering a victimology-based framework for the protection and recovery of OGBV victims, which may serve as an academic reference for strengthening victim-oriented approaches within Indonesia’s cybercrime and gender-based violence policies.

Abstract

This study examines the legal status of recordings obtained without consent as evidence in adultery cases, particularly in relation to the tension between legal certainty and the right to privacy. The main problem lies in the absence of clear legal standards governing the admissibility of such evidence, which creates uncertainty in judicial practice. This research aims to analyze the validity of unauthorized recordings as evidence and to assess their implications for privacy protection within the Indonesian legal framework. The study employs a normative juridical method using statutory and conceptual approaches, focusing on relevant regulations such as the Criminal Procedure Code, the Electronic Information and Transactions Law, and the Personal Data Protection Law, as well as constitutional court decisions. The findings indicate that although such recordings may be considered as supporting evidence under certain conditions, their use raises serious concerns regarding violations of privacy rights. The lack of consistent legal interpretation further complicates their admissibility in court. Therefore, clearer legal guidelines are necessary to balance evidentiary needs with the protection of fundamental rights.

Abstract

The enactment of the National Criminal Code through Law Number 1 of 2023 aims to achieve codification and legal certainty within the Indonesian criminal law system, including the regulation of abortion as a criminal offense. Nevertheless, normative issues remain, particularly concerning the legal status and protection of the fetus as the object of the abortion offense. This study aims to analyze the regulation of abortion crimes following the implementation of the National Criminal Code from the perspective of legal certainty, as well as to examine the implications of the unclear legal status of the fetus on criminal liability and law enforcement practices. This research employs a normative legal research method using statutory and conceptual approaches. The findings indicate that the National Criminal Code has not explicitly defined the legal status of the fetus, nor has it clearly regulated its relationship with the prevailing Health Law. This situation results in uncertainty regarding the limits of criminal liability and creates the potential for divergent interpretations in law enforcement practice. Therefore, normative clarification regarding the legal status of the fetus in the regulation of abortion crimes is necessary to ensure consistent legal certainty following the enactment of the National Criminal Code.

Abstract

This study aims to analyze the various forms of hidden sexual exploitation of women in Indonesia’s informal sector and to examine the ideal model of legal protection for victims from a criminal law perspective. This phenomenon emerges as a result of gender inequality, patriarchal structures, and economic pressures that place women in subordinate and vulnerable positions susceptible to abuse of power. Within informal labor relations, women are often exploited through seemingly legitimate service or employment arrangements that conceal coercive or manipulative practices. In Indonesia’s positive law, Law No. 21 of 2007 on the Eradication of Human Trafficking and Law No. 12 of 2022 on Sexual Violence do not explicitly address covert or non-physical forms of sexual exploitation occurring in informal work environments. This study employs a normative legal research method through statutory, conceptual, and case approaches. The findings reveal a normative vacuum and insufficient legal protection for women in the informal sector, caused by a positivistic and gender-neutral orientation in criminal law. Therefore, a comprehensive criminal law reform is urgently required—one that is gender-sensitive, human rights-based, and oriented toward substantive justice. This research contributes conceptually to the development of a more responsive and humanistic criminal law system that recognizes structural inequality and protects women from hidden sexual exploitation in informal labor contexts.

Abstract

This research discusses about the authority of the Indonesian National Police regarding law enforcement in modifying motorized vehicles that are roadworthy on road. The problem of this research is how is law enforcement enforced against perpetrators who modify motorized vehicles? and what are the criminal sanctions against motorists who modify vehicles that are not roadworthy? The purpose of this research is to find out the authority of the police in enforcing the law and criminal sanctions related to modifying motor vehicles that are unfit for the road. In this research used a normative legal research method, namely by reviewing or analyzing several legal materials from several literatures and statutory regulations that are related. It is hoped that the research carried out by researchers will provide theoretical and practical benefits. Theoretical usefulness means that the results of this research are useful for developing knowledge and the practical usefulness of this research means that it has good benefits for the government, related institutions or society at large. The results of this research are that the police enforcing traffic laws, especially modifying vehicles that do not pass the roadworthy test, are in line with government regulations and the role of the Indonesian National Police in carrying out their duties and obligations to curb traffic violations is in accordance with legislation in Law Number 22 of 2009 on Road Traffic and Transportation. Criminal sanctions in traffic have been regulated in Law Number 22 of 2009 on Road Traffic and Transportation.

Abstract

This study examines these issues within the framework of Indonesia's criminal law development, focusing on the film Sang Penari. Through the character Srintil, the film vividly portrays how cultural practices can entrap women in cycles of exploitation that are legitimized by societal expectations. Although Indonesia has adopted various progressive legal regulations such as Law No. 21/2007 on the Eradication of Trafficking in Persons and Law No. 23/2004 on the Elimination of Domestic Violence, implementation in the field still faces significant challenges. Lack of effective law enforcement, lack of public awareness, and socio-economic factors, such as poverty, contribute to the vulnerable situation for women. Therefore, to protect women from exploitation and violence, a multidimensional approach is needed that includes aspects of law, education and economic empowerment. This research emphasizes the need for integration between law, culture and social awareness so that women like Srintil can live with dignity and be protected from violence and exploitation.

Various laws and regulations that were created as a substitute for the previous rules, have not guaranteed success in eradicating corruption in Indonesia. The existence of several laws that regulate the authority and obligations of each law enforcement officer such as the Police, Prosecutors, Judges and the KPK so that it creates a blurring of their authority or there is an overlap of authority granted by the state creates a wrong perception, for example, the police as investigators feel they are authorized to carry out criminal investigations. corruption in addition to prosecutors and the KPK. The purpose of this study is to analyze the regulation of the authority of police investigators in conducting investigations into cases of criminal acts of corruption and what obstacles are faced by police investigators in conducting investigations into criminal acts of corruption. This research is a normative legal research type with a conceptual approach and a statutory approach. The legal sources used are secondary legal materials. The method of collecting legal material sources used in this study is the categorization of legal material sources. The legal materials that have been collected, then during the discussion will be processed and analyzed with legal interpretations and legal arguments, deductively then poured descriptively. The results of the study indicate that there is no cooperation in the form of legislation between police investigators and other law enforcement parties such as the Prosecutor's Office and the KPK, it is necessary to immediately establish a law that regulates clearly and in detail about the authority, cooperation and coordination in conducting criminal investigations. corruption, this needs to be done in order to be more effective and can be realized.

Abstract

This study examines the criminogenic factors that influence theft offenses leading to murder and analyzes the criminal liability of the offender based on Decision of the Denpasar District Court Number 619/Pid.B/2025/PN Dps. The research focuses on the escalation of theft into violent crime resulting in loss of life, which reflects the complex interaction between individual and environmental factors in criminal behavior. This research aims to identify the criminogenic factors underlying the crime and to evaluate their relation to criminal responsibility under Indonesian criminal law. The study employs normative legal research using statutory, case, conceptual, and analytical approaches. Legal materials were collected through library research and analyzed descriptively and qualitatively. The findings show that economic pressure, unstable psychological conditions, and situational circumstances significantly contributed to the offender’s actions. Although the offender initially intended to commit theft, the situation developed into fatal violence during the commission of the crime. Nevertheless, the offender remains criminally liable because the element of fault is fulfilled under criminal law. Criminogenic factors may be considered by judges in sentencing, but they do not eliminate criminal responsibility.

Abstract

Pariwisata berkelanjutan di Bali, khususnya melalui pemberdayaan Subak Uma Lambing, menghadapi tantangan signifikan seperti minimnya kesadaran hukum, keterbatasan infrastruktur, dan kurangnya kolaborasi antar pihak. Studi ini mengeksplorasi peran regulasi dan kebijakan daerah dalam mendukung pengembangan green tourism di Subak Uma Lambing, serta strategi untuk meningkatkan kesadaran hukum masyarakat. Regulasi yang berlandaskan pada teori Ecological Modernization dan Responsive Regulation, serta insentif fiskal dari teori hukum ekonomi, dapat mendorong keberlanjutan lingkungan dan pengembangan ekonomi lokal. Untuk meningkatkan kesadaran hukum, diterapkan teori Legal Consciousness dan Communicative Action melalui program edukasi dan kampanye informasi yang melibatkan berbagai pemangku kepentingan. Hasil pengabdian masyarakat menunjukkan bahwa integrasi kebijakan dan edukasi hukum yang efektif dapat memperkuat pelestarian budaya dan keberlanjutan lingkungan di Desa Sibang Kaja. Saran meliputi penguatan regulasi lingkungan, dukungan terhadap sertifikasi green tourism, dan penyediaan layanan konsultasi hukum gratis untuk masyarakat.

Abstract

Perlunya sebuah media promosi suatu pariwisata agar industri pariwisata di Bali semakin dikenal oleh seluruh masyarakat Indonesia hingga mancanegara, selain itu media promosi juga mempengaruhi eksistensi industri pariwisata tersebut agar tetap hidup. Industri pariwisata di Bali memerlukan suatu branding yang tidak hanya branding konvensional tetapi juga digital branding yang memerlukan media sosial untuk mempromosikan branding tersebut. Hasil dari kegiatan pengabdian masyarakat ini tersebut adalah branding adalah sebuah upaya atau proses aktif untuk membangun brand dan termasuk salah satu hal yang terpenting dalam memasarkan produk apalagi yang berkaitan dengan destinasi wisata dan termasuk juga salah satu prioritas pariwisata nasional karena mempengaruhi pangsa pasar domestik dan internasional. Adanya sebuah digital branding dimasa kini adalah bagian dari pemasaran suatu objek wisata melalui foto dan video yang diunggah ke media sosial sebagai sarana memperkenalkan dan mempertahankan eksistensi suatu industri pariwisata khususnya di Desa Taro, Kecamatan Tegalalang, Kabupaten Gianyar. Abstrak harus diakhiri dengan komentar tentang pentingnya hasil atau kesimpulan singkat.
