Abstract

The development of information technology has driven transformation in various aspects of life, including the field of notarial services. The concept of the Cyber Notary has emerged as a solution for efficiency and effectiveness of notarial services with digital technology. However, the implementation of the Cyber Notary in Indonesia still faces several challenges, particularly in ensuring legal certainty in electronic transactions. This study aims to analyze the effectiveness of the Cyber Notary in guaranteeing legal certainty in electronic transactions in Indonesia. The research method used is normative juridical, with statutory and conceptual approaches. The findings indicate that despite the great potential of Cyber Notary implementation, there are still legal voids and regulatory inconsistencies that hinder its application. Legal reform and regulatory harmonization are required, as well as improvements in infrastructure and notary competence in information technology, in order to realize legal certainty in electronic transactions through Cyber Notary.

Abstract

Penelitian ini menelaah peran Notaris dan Pejabat Pembuat Akta Tanah (PPAT) dalam mencegah praktik pencucian uang melalui sektor investasi properti. Sektor ini memiliki kerentanan tinggi terhadap penyalahgunaan dana ilegal karena nilai transaksi yang besar, penilaian harga yang subjektif, serta struktur kepemilikan yang kompleks. Melalui pendekatan yuridis normatif terhadap Undang-Undang Nomor 8 Tahun 2010 tentang TPPU, Peraturan Pemerintah Nomor 43 Tahun 2015, dan Permenkumham Nomor 9 Tahun 2017, penelitian ini mengkaji kewajiban hukum Notaris-PPAT dalam menerapkan Prinsip Mengenali Pengguna Jasa (PMPJ) dan melaporkan transaksi mencurigakan kepada PPATK. Hasil penelitian menunjukkan bahwa penerapan PMPJ secara efektif dapat menjadi instrumen pencegahan utama terhadap aliran dana ilegal di sektor properti. Namun, masih terdapat kendala berupa ambiguitas antara kewajiban kerahasiaan jabatan dan kewajiban pelaporan, serta keterbatasan kapasitas profesional dalam mengidentifikasi beneficial ownership. Oleh karena itu, peningkatan kompetensi dan koordinasi antar-lembaga diperlukan untuk memperkuat peran Notaris-PPAT dalam menjaga integritas sistem hukum dan sektor properti nasional. This study examines the role of Notaries and Land Deed Officials (PPAT) in preventing money laundering within the property investment sector. The sector is highly susceptible to illicit fund misuse due to large transaction values, subjective pricing, and complex ownership structures. Using a normative juridical approach to Law No. 8 of 2010 on Money Laundering, Government Regulation No. 43 of 2015, and Ministerial Regulation No. 9 of 2017, the study explores Notaries’ and PPATs’ legal duties in applying Customer Due Diligence (CDD) and reporting suspicious transactions to the Financial Intelligence Unit. Findings indicate that effective CDD implementation serves as a key preventive tool against illegal fund flows in property transactions. However, legal ambiguity between confidentiality and reporting duties and limited capacity in identifying beneficial  ownership  remain challenges. Continuous capacity building and inter-agency coordination are essential to strengthen the gatekeeping role of Notaries and PPAT in upholding integrity within Indonesia’s property sector.

Abstract

This study examines the urgency, challenges, and innovation models for digital-based sharia deed creation in Indonesia by examining its relationship with the Quran, Sunnah, fatwas of the National Ulema Council (DSN-MUI), the Notary Law (UUJN), and the Information and Electronic Transactions Law (UU ITE). The research method used is normative legal research with a legislative approach, which reviews relevant laws and regulations, such as the Criminal Code, the Law on the Status of Notaries (Law Number 2 of 2014), Law Number  1 of 2024 as the Second Amendment to Law No. 11 of 2008 concerning Information and Electronic Transactions, Government Regulation Number  71 of 2019, and the DSN-MUI fatwa on muamalah contracts, conceptual approaches, and literature. The results of the study indicate that the application of digital technology in the creation of sharia deeds requires regulatory adjustments to align with the provisions of the UUJN and utilize the legitimacy of documents and electronic signatures as regulated in the ITE Law. Regulatory integration, increased digital literacy, and strengthened technological infrastructure are necessary to ensure that digital Sharia deeds have the same legal force as conventional deeds and comply with Sharia principles.

Abstract

This concern arises because of a new technology that has become a phenomenon known as artificial intelligence machines or Artificial Intelligence (AI) which can be used in various activities, one of which is in the field of law because it can perform artificial intelligence like humans such as thinking, learning, and also self-development. This makes the role of the legal profession in providing legal services questionable. This study aims to determine the results of analysis of Artificial Intelligence (AI) machines that can potentially or not replace the role of legal practitioners and legal responsibility in the use of AI. The writing of this article uses normative research and uses conceptual and legislative approaches. Based on the results of the analysis conducted currently there is no special regulation that expressly regulates AI according to Indonesian law, AI itself is only a machine used in facilitating the work of legal practitioners and AI responsibility is imposed on the creator or user of AI because it is not a legal subject who can carry out legal actions consciously according to applicable provisions in Indonesia

Abstract

This study aims to analyze the legal protection of marital assets through a prenuptial agreement under Law Number 1 of 1974 and to examine the implications of the Constitutional Court Decision Number 69/PUU-XIII/2015 on the validity of prenuptial agreements in Indonesia. Using a normative legal research method with statutory, conceptual, and case approaches, this study focuses on doctrinal analysis and juridical argumentation. The findings indicate that a prenuptial agreement functions as a preventive legal protection instrument that provides legal certainty, fairness, and utility for both husband and wife in regulating the ownership and management of assets. Such agreements serve as a “law” for the parties, protecting personal property, inherited assets, and financial arrangements during marriage. The Constitutional Court’s decision expanded the scope of time for drafting such agreements, which were previously limited to before marriage, and now may also be made during the marriage. The implication of this ruling reinforces the principle of freedom of contract, ensures greater legal flexibility, and enhances the relevance of prenuptial agreements in addressing contemporary social and economic dynamics. Therefore, a prenuptial agreement is not merely a legal formality but a strategic legal instrument that safeguards marital assets in Indonesia.

Abstract

A notary is a public official who is given the mandate to make authentic deeds, one of which is through business contracts. In practice, business contracts often experience various updates for one reason or another. As part of a notary's duties to make business contract deeds, the notary also has the responsibility to ensure that all procedures and contract clauses do not conflict with the law. This research will discuss considerations about the role of notaries in preparing business contract documents, potential sources of disputes related to the implementation of business contracts and provisions for resolving disputes related to business contract deeds. To discuss this problem, an empirical juridical approach will be used through analytical descriptive research. The research concludes that the presence of a notary takes into account the interests of the parties when drafting business contract deeds so that they can anticipate possible conflicts that may arise. The authenticity of a notarial deed becomes absolute with the commitment of the parties concerned to continue to rely on consultation and agreement in resolving disputes that may arise.

Abstract

Penelitian ini mengkaji penyelesaian sengketa waris atas tanah adat di Indonesia dalam perspektif hukum agraria. Sengketa ini muncul akibat dualisme hukum antara hukum adat, yang menekankan nilai kekeluargaan dan musyawarah, dengan hukum agraria nasional yang menuntut legalitas formal. Status tanah adat dalam hukum agraria memiliki kompleksitas karena pengakuan hak ulayat dibatasi oleh kepentingan nasional. Pewarisan tanah adat mengikuti pola patrilineal, matrilineal, atau bilateral, dengan prinsip kekeluargaan yang kuat. Faktor penyebab sengketa meliputi perbedaan penafsiran hukum, ketiadaan dokumen kepemilikan, administrasi pertanahan yang kurang mendukung, serta konflik internal keluarga. Penyelesaian sengketa dapat melalui jalur non-litigasi (lembaga adat) atau litigasi (pengadilan negara). Alternatif penyelesaian sengketa (ADR) seperti mediasi berbasis komunitas menawarkan solusi cepat dan murah. Hambatan penyelesaian mencakup ketidakharmonisan norma hukum, lemahnya pengakuan hukum adat, kurangnya dokumentasi tanah, ketimpangan akses hukum, dan pemahaman aparat yang rendah. Solusi yang direkomendasikan adalah harmonisasi hukum, penguatan lembaga adat, pemetaan tanah partisipatif, serta pendidikan hukum. Metode penelitian melibatkan pendekatan yuridis normatif dan empiris, studi pustaka, serta studi kasus. Harmonisasi hukum adat dan agraria menjadi kunci penyelesaian sengketa yang adil dan berkelanjutan, memastikan perlindungan hak masyarakat adat sambil mendukung pembangunan nasional.
