This paper examines the legal certainty of state administrative dispute resolution in taking governmental measures. How is the existence of administrative efforts? What is the judge's legal consideration of not carrying out administrative effort? The results of this study indicate that administrative efforts must be made consisting of administrative objections and appeals unless otherwise stipulated by a law. Based on the judge's legal considerations regarding state administration disputes that do not and/or take administrative measures but are not in accordance with the provisions of Law Number 30 of 2014 concerning Government Administration juncto Supreme Court Regulation Number 6 of 2018 concerning Guidelines for the Settlement of Government Administrative Disputes After Taking Administrative Efforts then the lawsuit is declared not accepted (niet ontvankelijkverklraad).

Untuk menunjang pelaksanaan penyelenggaran kegiatan partai politik tidak terlepas dengan adanya dukungan dana yang besar. Dalam proses perjalanan partai politik, dana partai politik berasal dari iuran para politisi partai, sumbangan yang sah sesuai dengan ketentuan hukum; serta bantuan keuangan dari APBN dan APBD dari pemerintah. Melalui dana yang dihasilkan maka diperlukan sebuah pelaporan yang akuntabel dan transparan kepada publik agar menciptakan kepastian hukum (legal certainly) dan mencegah tindakan korupsi yang berasal dari dana partai tersebut. Maka melalui penelitian ini penulis menggaris bawahi terhadap 2 (dua) rumusan masalah yang penting untuk dibahas. Pertama, apa yang menjadi urgensitas keterbukaan informasi keuangan partai politik dalam pencegahan praktik budaya korupsi di Indonesia? Dan Kedua, bagaimana pertanggungjawaban dana keuangan partai politik yang bersumber dari dana APBN dan APBD di Indonesia? Penelitian ini menggunakan jenis penelitian yuridis normatif. Data yang dipakai dalam penelitian berasal dari bahan hukum primer, bahan hukum sekunder dan studi kepustakaan dari berbagai literatur. Hasil penelitian ini mencatat bahwa bentuk pelaporan keuangan partai politik harus mencatat semua sumber penerimaan dana terhadap partai dan tidak hanya mempertanggungjawabkan terhadap dana yang bersumber dari APBN dan APBD saja, kemudian berkaitan dengan sanksi harus ada tindakan tegas dilakukan oleh pemerintah tidak hanya pemberian sanksi administratif yang dikenakan terhadap suatu partai.

Forests are one of the valuable assets owned by the Indonesian people. Since a long time ago, forests have been the life support of the surrounding communities, including Customary Law Peoples. In fact, in forest management, the rights of Customary Law Peoples have been determined by the constitution, precisely Article 18B paragraph (2) and Article 33 paragraph (3) of the 1945 NRI Constitution which was later affirmed by derivative rules. Unfortunately, in reality, the use of forests by Indigenous Peoples often contradicts government policies which have implications for the emergence of forestry disputes involving Indigenous Peoples. This study aims to analyze regulations on the rights of Customary Law Peoples (MHA) in managing forests, find factors that trigger the birth of disputes and offer a pattern of protection of MHA rights in forest management. Empirical juridical approach with analytical destriptive nature is the method chosen by the author to examine the problems in this study. The data used consists of two types, namely primary data and secondary data. Then, the collected data will be analyzed qualitatively. The location of this research is focused in West Sumatra Province, precisely in the Mentawai Islands and Nagari Malalo. The results of this study prove that MHA's forest management rights protection arrangements already exist, but have not been able to guarantee MHA's rights protection. This then also became one of the factors triggering the dispute. Therefore, to answer this problem, a pattern of protection is needed by strengthening and consistency in regulating MHA rights in forest management and simplifying the mechanism for recognition of MHA customary forests by the government. It is hoped that the pattern offered can create certainty and legal order in order to achieve legal justice for MHA for forest management.

Agreements are one of the domains regulated through private legal instruments. However, agreements are not always governed by private legal instruments. Sometimes, public legal instruments also regulate an agreement, especially when it involves government entities. This study aims to examine the extent to which an addendum to a Public Private Partnership Agreement in Infrastructure Provision can be carried out, considering one of the specifications of the procurement mechanism for implementing business entities in the Public Private Partnership scheme, which includes attaching a draft agreement in the Request for Proposal (RfP) document. After a winning Business Entity is selected, the draft agreement is finalized, with the rule that the substance that has been completed cannot be changed. This research focuses on determining the limitations in making an addendum to the Public Private Partnership Agreement in Infrastructure Provision during the draft agreement's finalization and implementation phase. The research method used in this study is empirical legal research, which utilizes primary and secondary data. KPBU agreements are controlled by private legal instruments and regulated through public legal instruments. Even though some provisions do not allow changing the substance being competed for, these provisions are not norms that can be categorized as lex imperfect because if these provisions deviate, they will automatically injure the principles of procurement. Therefore the procurement is not following the principles regulated in the laws – invitation and may result in a failed auction condition.

The basic concept of land buying and selling is clearance and cash. If this concept cannot be fulfilled, it does not mean that the transactions cannot be carried out. In this situation, notary may use another instrument that is by making Commitment of Sale and Purchase Agreement (PJB). The Commitment can be made through the Commitment of PJB which is not fully paid and the agreement of the Commitment of PJB full payment. In the case the seller with the authority to sell, passed away before the signing of Commitment, the problems will arise. The first how is the process of completion of The Commitment of PJB? The second, how is the law protection on the buyer in the process of title transfer of the certificate of ownership based on The Commitment of PJB.? The third how is the title transfer of the certificate of property rights based on The Commitment of PJB? The results showed that the process of completion of the sale and purchase of land through The Commitment of PJB in which the seller passed away is carried out by tracking down the heirs, the protection of law against buyers in the process of title transfer of property certificates is done by filing a court suit to obtain a court decision. The process of title transfer of the property certificate in The Commitment of PJB agreement in can be executed by tracking down the heirs and / or by court decision

The Law Number 11 of 2020 on Job Creation (currently amended by Law Number 6 of 2023 on the Determination of Government Regulations in Lieu of Law Number 2 of 2022 on Job Creation becoming Law) is accompanied by its implementing regulations, Government Regulation Number 18 of 2021 on Management Rights, Land Rights, Apartment Units, and Land Registration, as well as Minister of Agrarian and Spatial Planning/Head of the National Land Agency Regulation Number 18 of 2021 on Procedures for Determining Management Rights and Land Rights. These regulations state that the designation of ulayat rights as management rights is a form of recognition of customary law communities. The granting of management rights to customary law communities indirectly makes ulayat land one of the objects of land registration. Currently, the Ministry of Agrarian and Spatial Planning has made efforts through collaboration with the Ministry of Home Affairs, local governments, and universities to implement a pilot project for the determination of management rights on ulayat land. From this pilot project, 6 (six) certificates of management rights on ulayat land have been issued, but as of now, there are no technical regulations related to the determination of management rights on ulayat land. This study will examine the regulatory vacuum and several factors that need to be considered in the formulation of technical regulations for the registration of ulayat land in an effort to support orderly land administration.Keywords: Land Registration, Customary Land, Customary Law Communities, Management Rights

Pada praktiknya jual beli perumahan dengan KPR sering menimbulkan permasalahan, baik konflik yang bersumber dari pelaku pengembang, dimana banyak terjadi sengketa disebabkan oleh pelaku pengembang yang tidak menepati janjinya sehingga konsumen dirugikan oleh pelaku pengembang akibat buruk dari komitmen yang diajukan saat menawarkan produk tidak diindahkan oleh pelaku pengembang tersebut. Hal ini tentu menyalahi ketentuan Pasal 42 ayat 2 Undang – Undang Nomor 1 Tahun 2011 Tentang Perumahan Dan Kawasan Permukiman tersebut. Adapun rumusan masalah dalam penulisan ini adalah: Bagaimana perlindungan terhadap konsumen (pembeli) dalam hal pengembang ingkar janji (wanprestasi) atas kewajibannya berdasarkan PPJB di Kota Medan? Dan bagaimana proses penyelesaian jual beli tanah dan rumah melalui KPR berdasarkan PPJB di Kota Medan, sehingga konsumen (pembeli) dapat memperoleh tanah dan rumahnya serta sertipikat hak atas tanahnya?.Adapun metode penelitiannya adalah metode pendekatan yuridis empiris (emphrical legal research), sifat penelitian ini bersifat deskriftif analitis. Adapun kesimpulannya Ketidaksesuain tersebut meliputi ketidakjelasan informasti yang diberikan tentang identifikasi dan deskripsi tentang prasarana, sarana dan utilitas umum yang ada. dengan realita pembangunan dan keterlambatan waktu proses pembangunan. Penyelesaian sengketa konsumen dapat ditempuh melalui pengadilan atau di luar pengadilan berdasarkan pilihan sukarela para pihak yang bersengketa. Usaha mempercepat penyelesaian sengketa konsumen, khususnya melalui BPSK, yang putusannya dinyatakan final dan mengikat namun UUPK masih membuka kemungkinan pihak yang keberatan atas putusan tersebut, untuk mengajukan keberatan kepada Pengadilan Negeri, hanya saja pihak yang tidak puas atas putusan Pengadilan Negeri tersebut, tidak dapat lagi mengajukan upaya hukum banding ke Pengadilan Tinggi.

The Natural Resources Conservation Agency (BKSDA) has one function, namely monitoring the illegal trade in wild animals, especially protected wild animals. The implementation of monitoring of illegal trade in protected wild animals by the West Sumatra BKSDA aims to protect protected wild animals from the danger of extinction and prevent trade in protected animals. However, the implementation of this function has not gone well, judging from temporary observation data showing that there is still a lot of trade in protected wild animals, especially pangolins. So, based on this, the author is interested in conducting research with the title Monitoring the Illegal Trade in Pangolins by the West Sumatra Natural Resources Conservation Agency (BKSDA).

Article 15 paragraph (2) letter a of Law Number 2 of 2014 Amendment to Law Number 30 of 2004 concerning the Position of a Notary that the Notary in his/her position has the authority to ratify signature and determine the exact date of the letter under hand, by registering it in a special book. A debt acknowledgment letter that already contains an element of default and gives rise to legal consequences can be executed with a deed of power of attorney to sell. 1) What is the process for making a debt acknowledgment letter as collateral for a debtor's debt in Padang City? 2) Why does the making of debt acknowledgment letters in Padang City tend to still be done privately and therefore require legalization by a notary? 3) What is the position of a power of attorney to sell that has been legalized by a notary regarding making a power of attorney deed to sell in the event of a dispute in Padang City? By using empirical juridical research methods, this research concludes that the process of legalizing a debt acknowledgment letter in Padang City is that the debt acknowledgment letter must be in the form of a private deed and can be agreed upon by the parties, then the debt acknowledgment letter is signed by the parties and legalized before a notary, the contents of which are the responsibility of both parties in the principle of agreement/consensus, the signing is ratified before a notary, the contents of which are the responsibility of both parties. In the process of legalizing a debt acknowledgment letter, the notary only witnesses the signing of the private letter on the same day, date, month and year at the time of legalization and then provides a legalization number, affixes a stamp/position seal to each page and records it in the private letter reportorium book. confirmed. The reasons debt acknowledgment letters in Padang City tend to still be done privately are: Factors from the community and Factors from the Notary. The position of a debt acknowledgment letter legalized by a notary regarding the making of a power of attorney deed to sell in the event of a dispute in the city of Padang, namely, a debt acknowledgment letter legalized by a notary can be used as evidence in court if a civil case occurs, and the additional guarantee of the sale power deed made before a notary is null and void. law if one of the parties to the agreement dies. As explained in Article 1813 of the Civil Code regarding the end of the grant of power of attorney.
