Abstract

Pada bulan Maret 2020, Food and Agriculture Organization (FAO) melalui laporannya memberikan peringatan tentang ancaman krisis pangan global akibat Pandemi Coronavirus Disease 2019 (Covid- 19). Untuk mengatasi tantangan tersebut, pemerintah Indonesia telah mengeluarkan kebijakan melalui program strategis nasional (PSN) yang salah satunya adalah food estate. Dalam sejarahnya food estate telah empat kali dilaksanakan di Indonesia dan seluruhnya dinyatakan gagal. Namun Presiden Joko Widodo tetap menginisiasi pembentukan program food estate 2020-2024. Oleh karena itu penelitian ini memfokuskan analisis terhadap upaya perlindungan hukum terhadap hak masyarakat hukum adat di kawasan hutan dalam  food estate sebagai program ketahanan pangan nasional. Untuk menjawab fokus kajian, penelitian ini menggunakan metode penelitian yuridis normatif melalui studi kepustakaan. Hasil penelitian ini menyimpulkan bahwa dalam pembangunan food estate, MHA menjadi kaum yang termarjinalkan. Hal ini dikarenakan kawasan hutan MHA menjadi objek dalam pembangunan food estate, namun dalam pengaturan terkait food estate, tidak sama sekali ditemukan pengaturan berupa perlindungan kepada MHA sebagai pihak yang akan terdampak. Sehingga, hal ini berimplikasi kepada kesewenang-wenangan pemerintah dalam menetapkan kawasan hutan adat untuk pembangunan food estate. Sehingga dari hasil tersebut, pemerintah selaku pembuat kebijakan, dalam mengupayakan apapun bentuk pembangunan dengan tujuan sebesar-besarnya kemakmuran rakyat, tidak boleh bertentangan dengan hak-hak yang telah dilindungi oleh konstitusi, termasuk hak MHA.

Abstract

If we define the provisions of Article 5 and General Elucidation number III (1) of Law Number 5 of 1960 on the Basic Agrarian Principles (UUPA), it can be concluded that the applicable Agrarian law is customary law, as long as it does not conflict with national and state interests. In the context of West Sumatra, according to Minangkabau Customary Law, all land and forests from a single tree, a single stone to a single blade of grass, from the height to the sky and the depth to the bowels of the earth are ulayat. This means that ulayat rights can be in the form of natural resources including land to the underground and space above the territory of indigenous peoples. Article 19 paragraph (1) of Law Number 5 of 1960 concerning Basic Agrarian Principles has actually instructed from the beginning that to ensure legal certainty by the Government, land registration is carried out throughout the territory of the Republic of Indonesia according to the provisions regulated by Government Regulations, including here, namely tanah ulayat. Government Regulation No. 18 of 2021 concerning Management Rights, Land Rights, Flat Housing Units, and Land Registration opens up opportunities for tanah ulayat to be registered and granted management rights over it. To uphold this regulation, in 2021 the Ministry of ATR/BPN in collaboration with the Faculty of Law, Universitas Andalas organized an inventory and identification of tanah ulayat nagari in West Sumatra Province and was then followed up with Pilot Project activities that are currently underway, one of those activities is in Nagari Sungayang, Tanah Datar Regency. This activity aims to provide legal certainty to the tanah ulayat of the indigenous people of Nagari Sungayang, Tanah Datar Regency so that the rights of indigenous people are protected.

Abstract

Land and Building Tax (LBT) in the Plantation sector is a tax on land and buildings that are owned, benefited from, owned, or controlled by an individual or legal entity located in the area stated in the plantation business permit and plantation business use rights. The management is the authority of the Central Government. In the plantation business, every business actor with a particular land area must have a plantation business permit issued by the Regional Government. The results of this LBT collection are handed over entirely to the regional government through profit-sharing funds. The Problems that will be studied are: How is the management of LBT for plantation businesses in West Sumatra; How is the financial relations between the Central Government and the Regional Governments in managing LBT of Plantation businesses in West Sumatera; and How to delegate the management of LBT in the Plantation Sector to the Regional Government in West Sumatera. The author uses empirical juridical research methods and an analytical description in this writing. The research results concluded that the management of LBT for plantation businesses in West Sumatra is managed by The Central government in the LBT Plantation Sector and The Regional Government in the form of LBT for the Rural-Urban Sector. The Financial relationship between the Central Government and Regional Governments in managing LBT for plantation businesses is to transfer funds to the regions through Tax Profit Sharing and Palm Oil Profit Sharing Funds. Management of LBT in the Plantation Sector should be delegated to The Regional Government, and the Regional Government is capable and ready to manage it.

Abstract

The affirmative policy allowing the State to do more to the unrepresented group within the framework of equality and justice is enshrined in Article 28 H (2) of the Constitution of the Republic of Indonesia of 1945 which states that everyone is entitled to special facilities and treatment for equal opportunities and benefits in order to equity and justice. In the government procurement through providers, the Papua Special Autonomy Act forms the basis for the affirmative policy to be established. The study aims to analyze the existence of affirmative policy of government procurement through providers and to examine the content of the article according to the hierarchy of the regulations. The study uses a normative and descriptive approach, legal research to describe and test applicable norms or provisions. Research results: First: the affirmative policy of government procurement through providers requires the existence of the participation of papuan economic operator directly in government procurements through providers in the territory of Papua, where the criteria of Papuan economic operator have also been set out in the regulations. Secondly, in the content of Article 2 of the Papua Governor Regulation Number 46 of 2021 on Government Procurement in Papua Province, it is explained that the scope of application of the governor's regulation includes the government procurement financed by the State Budget Funds. This is contrary to the content of article 4 Paragraph (1) letter a of the Regulation of the Minister of Public Works and Housing No. 1 of 2023 on the Guidelines for the Supervision of the Maintenance of Construction Services Implemented by the Provincial Government, the District, and the City which explains that the authority of the local government of the provinces, the districts and the towns in supervising the maintenance of the construction services, including the process of government procurement, is limited only to the activities of construction financed with the Regional Budget Funds.

Abstract

Penelitian ini membahas jual beli tanah Pusako Tinggi Kaum di Kota Padang yang sudah terdaftar berdasarkan Perjanjian Pengikatan Jual Beli (PPJB) melalui notaris. Tanah Pusako Tinggi, yang pada dasarnya tidak dapat diperjualbelikan menurut hukum adat Minangkabau, menunjukkan fakta di mana proses jual beli tetap terjadi. Penelitian ini menggunakan pendekatan yuridis sosiologis untuk mengkaji proses pendaftaran tanah Pusako Tinggi, pelaksanaan jual beli melalui PPJB, dan perubahan nama Sertipikat Hak Milik (SHM) tanah tersebut. Hasil penelitian menunjukkan bahwa sertifikat tanah kaum tetap mencantumkan representasi kaum sebagai pemilik berdasarkan kesepakatan, meskipun prosedurnya mirip dengan sertifikasi tanah individu. Namun, berdasarkan pepatah adat, hak milik komunal tanah tidak dapat dialihkan sepenuhnya melalui jual beli. Proses pengikatan jual beli ini juga menunjukkan adanya konflik antara penerapan hukum adat dan hukum positif, terutama terkait pengakuan hak kolektif masyarakat adat Minangkabau. Penelitian ini diharapkan dapat memberikan kontribusi terhadap pemahaman hukum agraria, hukum adat, dan mekanisme jual beli tanah ulayat di Indonesia. Lebih jauh, penelitian ini memberikan rekomendasi agar ada pengaturan yang lebih jelas dan tegas dalam harmonisasi hukum adat dan hukum nasional untuk mengurangi konflik terkait tanah ulayat.

Abstract

Pendaftaran Tanah Sistematis Lengkap (PTSL) merupakan program strategis nasional yang bertujuan memberikan jaminan kepastian hukum atas tanah melalui sertifikasi dan mendorong tertib administrasi pertanahan di seluruh Indonesia. Salah satu lokasinya adalah kawasan sempadan Danau Maninjau, Sumatera Barat, yang ditetapkan sebagai Danau Prioritas Nasional. Meskipun memiliki nilai ekologis dan ekonomi strategis, larangan penerbitan sertifikat tanah di kawasan sempadan ini menimbulkan ketidakpastian hukum dan ketidakpuasan masyarakat adat. Konflik antara pelestarian lingkungan dan pengakuan hak atas tanah menjadi tantangan utama dalam pelaksanaan PTSL. Penelitian ini menggunakan pendekatan yuridis empiris dengan metode deskriptif analitis. Hasil penelitian menunjukkan kendala utama meliputi evaluasi lokasi PTSL yang belum memadai, prosedur pendaftaran tanah yang ambigu, dan ketidaksinkronan peraturan pusat serta daerah terkait pengakuan hak ulayat. Namun, tanah ulayat tetap dapat diakui selama tidak bertentangan dengan fungsi konservasi. Penelitian ini memberikan rekomendasi untuk penyusunan regulasi yang lebih jelas dan implementatif serta memperkaya studi hukum agraria terkait pengelolaan sumber daya alam dan hak masyarakat adat, demi mewujudkan kepastian hukum yang berkeadilan di kawasan sempadan Danau Maninjau.

Abstract

Women in Minangkabau culture are the heirs of traditional land, but in its arrangement and management, women are not significantly involved. At the level of implementing land registration, privately owned land has run smoothly, but problems often arise in managing customary land, both community customary land and Nagari customary land. This research aims to analyze women's involvement in managing Nagari traditional land. The research was conducted in Nagari Sungai Kamuyang, Limapuluh Kota Regency, using a qualitative approach. The analytical tool used is Anthony Ginddens' structural theory. The research results show that women's involvement in managing communal land is greater during consensus deliberation events. Women were more involved at the beginning of the activity, but men mostly carried out the implementation. In discussing the agreement to make Nagari Sungai Kamuyang a pilot project, women were invited to occupy the bundo kanduang position there as nagari officials. Women are no longer involved in determining boundaries in the field, and there is polarization in the division of labor between men and women. At the same time, discussions in forums ranged from socialization activities to building an agreement to make Nagari Sungai Kamuyang one of the pilot project locations for customary land management. The women present met and joined in the conversation. When a field assistance team was formed to determine land boundaries and land measurements by BPN, BPN was involved for a longer time.

Abstract

Reducing Emissions from Deforestation and Forest Degradation (REDD+) is a strategy to reduce greenhouse gas emissions from deforestation and forest degradation. Through this scheme, Indonesia is vital in implementing ratified commitments through national legislation. The methodology used in the research employed normative juridical techniques characterized by descriptive research parameters and underwent analysis through comprehensive literature exploration. The results found that Indonesia has supported sustainable development by issuing REDD+ arrangements to realize climate change mitigation. Through the REDD+ scheme, Indonesia is expected to provide answers to global warming problems that occur throughout the world by providing protection, preventing degradation, and providing an increase in the quality of forest cover and carbon stocks.

Abstract

This research discusses the challenges of implementing Free, Prior, and Informed Consent (FPIC) for indigenous peoples in national legal arrangements in Indonesia. FPIC is a principle that gives indigenous peoples the right to give consent to policies that affect their territories and resources freely, prior to full information, and without pressure. Although the FPIC rights of indigenous peoples are implicitly described and regulated in various national regulations, such as the 1945 Constitution, Forestry Law, Village Law, and environmental regulations slot zeus, these arrangements do not necessarily guarantee the protection of indigenous peoples' rights over their customary territories. Explicit legal arrangements are needed to guarantee indigenous peoples' FPIC rights over their customary territories. This is because in its implementation, the application of FPIC rights still faces various challenges such as conflicts of interest with the State's Right to Control (HMN), low understanding in the field, and gender injustice being the main obstacles. This study uses a normative juridical approach to identify differences between international and national legal arrangements, and offers recommendations to improve the protection and implementation of FPIC in Indonesia. The research emphasizes the importance of explicit legal arrangements to achieve justice, prosperity and harmony between indigenous peoples and the government.

Abstract

Land rights are rights giving authority to the right holder to use the and get the benefit from it.the rights holders is limited by the regulation. Those who may obtain property citizens only and legal entities indonesia based on government reg­ulation. Ownership of the land is hereditary right, strongest and fullest that can be held above the land. But often the ownership of the land has created problems in the communities. One of them is due to the occurrence of a inter-marriage would have an impact on the property over the land for inheritance in marriage a mixture. The law which occurs because the inheritance which causes the transfer of ownership of land did not require nationality, but the provisions of land restrict the ownership of property for land gave it to transfer a land rights over land inherited by foreigners. Then problem identification discussed in research is as follows: (a) how the process of intermarriages according to marriage law? ( b ) how the transition of ownership of the land because the inheritance in intermarriages? ( c ) how strong of property rights of the land because the inheritance in intermarriages? Research methodol­ogy used juridical approach is empirical research. Juridical empirical method, the research use approach to the problem, connected with the facts and law happens on the field. The research results show that the process was done based on marriage mingling law from the marriage was done. To ownership rights due to intermediate of the inheritance in marriage a mixture is the same with the transfer ownership rights as the other land inheritance. Along heir who performs marriage intervening who make a break to property by having them land rights.To the heirs who in mar­riage a mixture still heritage having land rights. If the heirs was for foreigners, they should release at most the due in a year time
