Abstract

Of the title "The Legal Paradigm of the properties on the strata title ownership built above the land with the Right to Cultivate Ownership" research objectives to    be at said is knowing why the legal construction of the right material from the strata title built on land rights, attached to the Rights of material the building as common property rights and know how reconstruction material rights on the Strata titles  built on building rights or rights of use that reflects justice and legal certainty. With the concept of methodologies theories and research approaches, as well as of the problems of this study concludes that there are a couple of things. First by sticking the land rights of the unit, then Strata titles have a dependency on the bottom right HGB as with all buildings owned and also can weaken the property rights of apartment units as the strongest and most, but became assessors of HGB. This situation raises a negative implication in the community and has created legal uncertainty and considered unfair, weakening the material rights of Strata titles caused dualism applicable law, the law of the land, building law and the law of objects. It affects the mutual intervention and debilitates the material rights as stipulated in the rules of the law of things, namely; droit de suite, droit de preverent, and droit de levering. In construction law, state that debilitates the legal certainty and justice, it can be reconstructed from the perspective of the development of the legal system of the building against the law of the land, or to the development of HGB as of right down with some simulations and restoration of existing government regulations, or reconstruct the principal laws agrarian related lease rights, land rights, and the rights of use by developing existing government regulations become law, so the law on the new ground by adding the rights of others. In a reconstruction of the law of the land, which is more competitive and create legal certainty and fairness.

Abstract

ABSTRACTIndonesia is known to have a good resource potential. Nevertheless, it has turned out it is not enough to attract investors. All that should be coupled with the ease of the procedure, the availability of law and good services to investors. This study attempted to correlate between the government's policies of home ownership for foreign with efforts to increase investment. It is expected to be answered on how the residential home ownership for foreigners in Indonesia? and how the concept of home ownership for foreigners in order to accelerate the increase in investment in Indonesia ?. using scientific principles the results of this study explained that the application of positive law pertaining to houses and buildings have ignored the principle of horizontal separation adopted in BAL and customary law, in practice the ownership of homes and buildings tend to use the principle of sticking always attach rights to land with the house or building that is on it, this has resulted in WNA difficult to get home because the houses built over the right to use is limited. To overcome this problem needs to be realized registration of houses and buildings by awarding certificate proof of right to a home or building or property that can be transferred, charged to a right of material, to realize the ideals Article 8 UUBG by Presidential Decree as mandated in Article 12 paragraph 4 of the Indonesian Government Regulation No. 36 Year 2005 concerning the Implementing Regulations of Law BG. Thus the application of the principle of horizontal separation adopted in BAL and customary law, in practice the ownership of homes and buildings will allow foreigners have a house to attract foreign investment to invest in Indonesia. Finally with the ease is expected to have an impact on increased investment in Indonesia until this is less good, especially when compared with neighboring countries.

Abstract

In realizing the general welfare, the acceleration in the construction sector more incentive. One of them is the development in the field of economy and trade, such as traditional markets. An integral part of the market is a kiosk which is a merchant selling. In implementing the needed development funds are not small so this should be a concern of government, given the limited funds of APBN / APBD. One alternative to overcome the limitations of these funds is through cooperation with the private sector with a system Build Operate and Transfer (BOT). Example analyzed is an agreement between the Government of Bogor Regency with PT. Fortunindo Artha Perkasa to revitalize Ciawi market in 2006. The aim of this study is to determine the actualization of the results of development cooperation agreements with the BOT system Ciawi market as well as to determine the legal certainty of ownership of a kiosk in a legal perspective objects. The method used in this research that the Juridical Sociological (Empirical), namely law as phenomena of society, as institutional, or behavior that develop. The technique of data collection is through a method Interview (interview) and Questionnaire Method. Based on the results of research conducted Writer that actualizing the result of cooperation with the BOT system between Bogor Regency with PT. Fortunindo Artha Perkasa is a mutually beneficial cooperation. The partnership is agreed in the contract that contains the rights and obligations of the parties. The agreement provides advantages, both for the Bogor Regency, PT. Fortunindo Artha Perkasa as well as for merchants. Concerning legal certainty, kiosks in law objects categorized as immovable property and have caused material rights to it, namely, the right material that gives pleasure and the right material that has the properties provide warranty. But, market stalls, if used as a credit guarantee of the legal protection for the debtor itself is weak because the market stall cannot be bound by the guarantee institution in Indonesia.

Abstract

Use Rights Certificate Business Place (SHPTU) is proof of ownership of the right to use business premises (shop) in a market that is owned by market traders. SHPTU have a fairly high economic value. Therefore expected SHPTU can be used as loan collateral. SHPTU have a common element of the lease, as in article 1548 of the Civil Code. Because SHPTU not the right material, then SHPTU can not be guaranteed by using a material guarantee institutions. This thesis research methods with the added element of normative juridical empirical, with the analysis of qualitative data. From the analysis it can be concluded that SHPTU not the right material, but given SHPTU has economic value and can be transferred, it is expected that the government can immediately respond to the needs of society (the Merchants Market) to the existence of a guarantee institution which can accommodate SHPTU shop as loan collateral. Resulting from the rigidity of the legal material to deliver the right material on business premises or SHPTU recommended for use kaedah contained in Article 48-49 of the legislation Flats by issuing Certificates of Building Owners and Building (SKBG), where the issuance of the certificate is the same between Local government in this case the Department of Public Works and the Department of Housing, while still managing PD Pasar Jaya as it has been running for this. Issuing authority on the issuance of a certificate is not PD Pasar Jaya but agency in charge of publishing the SKBG. When referring to the Building Act SKBG publishing at the Department of Public Works, and when referring to the Law on Housing, the publishing SKBG by the Department of Housing. That way it is assured of legal certainty as mandated by state law, as well as the grand theory of Hans Kelsen. SKBG is way out proof of ownership of the store, which is very expensive because of the value it needs the necessary legal certainty regarding the right material.

Abstract

Endowments in Indonesia have abundant potential. However, the potential of waqf has not been able to contribute to solving the problem of poverty, because the management of waqf assets in Indonesia has not been widely used productively due to the still conservative pattern of public thought. Using the Juridical-Normative method, this study tries to provide a literary explanation of the views of the Fuqhas on how the legal status of the development of the productivity of waqf property? and how is the model that can be used to develop the productivity of the waqf property? According to Al-Kamal bin Al-Hammam, the authors of the books Fathul Qadir and Al-Mirginani, the authors of the book Al-Hidayah, said that they could build buildings that were already known that the building could be useful for the ummah, and many models could be used. delivery (BGS) or build operate transfer (BOT).

Abstract

Undang-Undang Rumah Susun (UURS) mewajibkan pelaku pembangunan untuk memisahkan Rusun atas satuan Rusun, bagian bersama, benda bersama, dan tanah bersama, ketika pelaku pembangunan membangun suatu Rusun. Untuk itu  pembentukan pengembangan kelembagaan Perhimpunan Pemilik Dan Penghuni Satuan Rumah Susun (P3SRS) diharapkan dapat memberikan perlindungan bagi pemilik dan penghuni rumah susun. Untuk itu perlindungan bagi pemilik dan penghuni satuan rumah susun perlu di perjuangkan untuk melindungi hak atas pengelolaan rumah susun. P3SRS seharusnya difasilitasi oleh pengembang dengan melakukan sosialisasi, sehingga tidak ada Pemilik dan Penghuni yang merasa dirugikan. Kewajiban Pelaku Pembangunan rumah susun tidak sepenuhnya ikut campur dalam proses pembuatan P3SRS namaun sebagai fasilitator para Pemilik dan/atau Penghuni Rusun.

Abstract

AbstractThe main issue causing difficulties for low income people to get decent housing is the paradigm they have that owning a house means owning the land.  This Study used quantitative and qualitative approach. Results showed that the community paradigm of separated ownership of house and land was low.  this study resulted in a formulation of development model of community paradigm of house ownership separated from land ownership.  Based on this model, it was concluded that community paradigm of house ownership separated from land ownership could be developed if there were interesting compensations to eliminate people hesitance about having an apartment.  IntisariPersoalan utama yang menyebabkan masyarakat berpenghasilan rendah di Indonesia sulit memperoleh rumah adalah adanya paradigma masyarakat tentang kepemilikan rumah yang bermakna kepemilikan tanah. Studi ini menggunakan pendekatan kualitatif dan kualitatif. Hasil penelitian menunjukkan bahwa paradigma masyarakat tentang kepemilikan rumah yang terpisah dari tanah  masih rendah. Masyarakat lebih menyukai tinggal di rumah yang menyatu dengan tanah dibandingkan dengan tinggal di rumah susun. Penelitian ini juga menghasilkan rumusan model pengembangan paradigma masyarakat bagi kepemilikan rumah yang terpisah dari tanah. Berdasarkan model tersebut, paradigm masyarakat dapat dikembangkan jika terdapat konpensasi menarik dari kepemilikan rumah susun.

Abstract

Pancasila as a state’s foundation of Indonesia has been evaluated, criticized, and reviewed intensively in the reformation era. Islam as a way of life of most Indonesian people also took a part in this very important step. By using contemplation method, wicth is based on philosophy or tafakkur. Pancasila has been found as parallel to Islam or tauhid point of view. The reason of this can be traced to the history where Islamic principle has been accommodated greatly in the process of Pancasila emergence. On the other hand, by contemplating Pancasila over aqidah, syariah, muamalah, and akhlaqul karimah that integrated in tauhid principle is a part to understand Indonesia’s pluralist that parallel with achievement to kaffah as a muslim and the stronger Indonesia as well

Abstract

Tulisan ini akan membahas Pengembangan Hak Kekayaan Inteleklektual di bidang hak cipta sebagai obyek jaminan fidusia  untuk mendapatkan kredit perbankan di Indonesia . Hak Kekayaan Intelektual merupakan hak eksklusif yang diberikan negara kepada para pencipta, kreator, inventor  atas hasil kreasi atau temuannya yang mempunyai nilai komersial, baik langsung secara otomatis atau melalui pendaftaan pada instansi terkait sebagai penghargaan. Hasil kajian ini dilaksanakan untuk menentukan Hak Cipta  sebagai  Obyek Jaminan Fidusia sebagai mana diatur dalam Pasal 16 ayat (3)Undang-undang Nomor 28 Tahun 2014 Tentang Hak Cipta, dan  Undang-undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia, Yang menunjukan bahwa Hak Cipta dapat menjadi objek jaminan fidusia karena adanya hak eksklusif, yaitu hak ekonomi di samping hak moral yang dimiliki pemilik hak cipta. Penjaminan secara fidusia dari Hak Cipta akan mengikuti tata cara yang telah diatur oleh undang-undang Nomor 42 tahun 1999. Namun nilai ekonomis dari hak cipta akan ditentukan dari pemanfaatan hak ekonomi dari obyek ciptanya berupa imbalan atau royalti yang diterima oleh pemegang hak cipta. Penelitian ini menggunakan metode pendekatan Yuridis Normatif, dengan Spesifikasi penelitian deskriptif analisis. Penelitian ini dilaksanakan melalui beberapa tahap, pertama dilaksanakan dengan melalui tahap studi kepustakaan, tahap kedua melalui analisis data dilakukan secara normatif kualitatif. Hasil Kajian menunjukan bahwa hak cipta dapat dibebani Fidusia selama pembebanan fidusia bukan dilakukan kepada bendanya, tetapi kepada nilai ekonominya. Hak cipta tersebut harus didaftarkan ke Direktorat Jenderal Hak Kekayaan Intelektual agar dapat dijaminkan. Pendaftaran ini sangat penting sebagai bukti  pemegang Hak Cipta untuk mendapatkan perlindungan hukum dan kepastian hukum mengenai hak atas ciptaannya. Perkembangan masyarakat global, Hak Cipta Karya Musik dan Lagu akan di jadikan collateral(agunan) untuk mendapatkan kredit perbankan.. Untuk mewujudkan konsep hukum ini diperlukaan peraturan  yang mengatur substansi pembebanan, pengikatan dan pedaftaran Hak Cipta sebagai collateral(agunan) untuk mendapatkan kredit perbankan di Indonesia.

Abstract

In the last two decades there has been a paradigm shift where for masters of law can be from non-law graduates, so that the postgraduate education system of law school will have multidisciplinary students input.  On the other hand, students who are not from legal studies have limited knowledge of legal principles, theories, concepts, ways of thinking, and do not even know the laws and regulations as the basis for legal research.  In particular, normative juridical research requires sharp intuition of the law, which unfortunately for non-law students conducts research that mostly does not touch the substance of the philosophy of legal study.  The research questions posed in this paper are: How to improve the quality of Law Graduate Program students with non-law backgrounds? This paper aims to provide solutions to obstacles in quality and effective postgraduate law education both in society and for the development of legal science itself.  Furthermore, it is concluded that it is not easy to transform the nature of legal science to non-law students who enter legal education, given the weak understanding of principles, rules, institutions and legal processes. Thus, it is recommended from this study that: 1). Graduates with non-law backgrounds may not be leaders in drafting laws and regulations, especially those working in any government agency, and 2). Postgraduate Law must rearrange the curriculum for students who are not graduates of Law, for example by providing basic matriculation of law within two semesters or stopping multidisciplinary programs altogether.
