Abstract

Social and Environmental Responsibility is a form of company commitment in supporting sustainable development by considering social, economic, and environmental aspects. As one of the State-Owned Enterprises, it has implemented a pattern as part of a sustainable business strategy. This study aims to analyze the effectiveness of the implementation of social and environmental responsibility carried out by PTPN VI Jambi in economic, environmental, and legal and governance aspects. In the economic aspect, TJSL PTPN VI focuses on improving community welfare through Small and Medium Enterprises empowerment programs and increasing access to education and health. From the environmental side, the company implements policies that are oriented towards sustainability, such as reforestation programs, waste management, and carbon emission reduction. Meanwhile, in the legal and governance aspects, PTPN VI ensures compliance with applicable regulations, transparency in reporting, and strict program evaluation. The results of the analysis show that the TJSL program that has been implemented has had a positive impact on the surrounding community, increased environmental awareness, and strengthened more accountable corporate governance. With transparent reporting and wide accessibility of information, TJSL PTPN VI can be an effective implementation model for other companies in carrying out their social responsibilities.

Abstract

This article examines applying the general principles of good governance within the framework of administrative law as a strategy to promote more efficient and accountable regional budget management in the era of fiscal decentralization. This research aims to analyze how the General principles of good governance, as codified in Indonesian administrative legislation, can serve as a legal foundation to overcome normative and administrative barriers in realizing budget efficiency at the regional level. Using a normative legal research method through statutory and conceptual approaches, this article identifies key legal and institutional challenges, including overlapping regulations, weak bureaucratic capacity, and limited digital infrastructure. The study emphasises the implications of Presidential Instruction No. 1 of 2025 on the Efficiency of State and Regional Budget Expenditure, which mandates stricter fiscal discipline and performance-oriented budget allocation. The analysis focuses on several key regulations, including Law No. 30 of 2014 on Government Administration, Law No. 23 of 2014 on Regional Government, Law No. 1 of 2022 on Central Regional Fiscal Relations, and Government Regulation No. 12 of 2019 on Regional Financial Management. It also includes an examination of the role of digital systems, such as the regional government information system and the regional financial accounting information system. The findings affirm that the consistent implementation of the general principles of good governance, particularly transparency, accountability, legal certainty, and proportionality, when supported by regulatory harmonization, technological innovation, and inclusive public oversight, can significantly improve the effectiveness of regional financial governance and foster a democratic, accountable, and sustainable government administration

Abstract

State asset management is a fundamental component of public financial governance, aimed at ensuring transparency, accountability, and efficiency. In Indonesia, the legal foundation for state asset administration is established under Law Number 1 of 2004 on State Treasury. In the context of globalization, aligning domestic regulations with international legal standards, such as the International Public Sector Accounting Standards (IPSAS), has become imperative. Discrepancies between national and international regulatory frameworks may result in legal inconsistencies, inefficiencies, and challenges in securing state assets abroad. This scholarly article employs a doctrinal legal research approach to evaluate the conformity of Indonesia’s legal framework with international standards. It identifies key challenges, including the inadequate implementation of IPSAS, deficiencies in technological infrastructure, and limited institutional capacity. Additionally, protecting state assets in foreign jurisdictions remains complex due to disparities in legal systems, bureaucratic constraints, and insufficient international legal cooperation. To address these challenges, Indonesia must reinforce its legal framework, integrate advanced technological solutions, and enhance cross-border legal collaboration. The adoption of internationally recognized best practices in state asset management will strengthen legal certainty, mitigate financial risks, and ensure compliance with global governance principles. This article contributes to the legal discourse by analyzing the complexities of state asset management in an increasingly interconnected world and proposing regulatory and institutional reforms to enhance its effectiveness.

Abstract

Studi ini bertujuan untuk meneliti kebijakan Pemerintah Daerah dalam memberikan pelayanan kesehatan untuk lanjut usia. Dalam penelitian ini Provinsi Jambi melakukan penyelenggaraan pelayanan kesehetan lanjut usia mengacu pada Peraturan Daerah Provinsi Jambi Nomor 16 Tahun 2019 tentang Penyelenggaraan Kesejahteraan Lanjut Usia. Penelitian ini menggunakan metode penelitian yuridis-normatif. Hasil dari penelitian ini yaitu, Pertama, Pelayanan Kesehatan pada lanjut usia mengacu pada beberpa peraturan seperti Undang-Undang Nomor 13 Tahun 1998 tentang Kesejahteraan Lanjut Usia, Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan, Undang-Undang Nomor 40 Tahun 2004 tentang Sistem Jaminan Sosial Nasional, dan Peraturan Menteri Kesehatan Nomor 67 Tahun 2015 tentang Penyelenggaraan Kesehatan Lanjut Usia di Pusat Kesehatan Masyarakat. Kedua, terdapat kekaburan norma pada Pasal 11 ayat (1), Pasal 11 ayat (3) huruf a dan d, dan Pasal 11 ayat (4) Peraturan Daerah Provinsi Jambi Nomor 16 Tahun 2019 tentang Penyelenggaraan Kesejahteraan Usia Lanjut dimana terjadi potensi multitafsir pada beberapa pasal tersebut terkait penyelenggaraan pelayanan kesehatan untuk lanjut usia yang menyebabkan ketidakjelasan pada proses pelaksanaannya.

Abstract

The digital transformation has reshaped the landscape of freedom of expression, creating new opportunities for participation while also exposing women to structural, normative, and cultural challenges. In Indonesia, although Article 28E of the 1945 Constitution guarantees these rights, the digital environment remains unsafe due to weak legal safeguards, gender-blind regulations, and entrenched patriarchal norms. Online gender-based violence or OGBV, including cyber harassment, doxing, and non-consensual image distribution, continues to silence women, while the misuse of the Electronic Information and Transactions (ITE) Law has frequently criminalized victims instead of providing protection. This article employs a normative-conceptual and comparative legal approach to assess these gaps. Case studies, such as the criminalization of women under the ITE Law, reveal how existing frameworks fail to address gender-specific vulnerabilities. A comparative perspective with the European Union’s General Data Protection Regulation (GDPR) and Australia’s Online Safety Act 2021 highlights best practices for safeguarding women’s digital rights through strong data protection and proactive victim-centered mechanisms. The study argues for gender-responsive digital constitutional reform in Indonesia, including legal clarification, enhanced digital literacy, strengthened data protection, and progressive constitutional interpretation. Such reforms are essential to transform formal guarantees into substantive protections and ensure that women’s freedom of expression is meaningfully realized in a democratic digital society. This article offers a unique contribution by integrating Indonesian case studies of women’s criminalization under the ITE Law with comparative perspectives from the EU’s GDPR and Australia’s Online Safety Act. Unlike existing literature that remains largely descriptive, this study provides a prescriptive-analytical framework for gender-responsive digital constitutional reform. It bridges constitutional law, digital rights, and gender justice, presenting concrete pathways to transform formal guarantees into substantive protections for women’s freedom of expression.

Abstract

The enactment of Law No. 15 of 2019, which established the Post-Legislative Scrutiny (PLS) institution, marked a pivotal shift in the formation of laws and regulations (PUU) in Indonesia. This legislation ushered in a comprehensive cycle for PPU, fundamentally altering the landscape of legislative processes. Despite this progress, a prevailing assumption persists that the PLS mechanism is solely within the purview of the People's Representative Council (DPR) concerning national laws, while oversight of Regional Regulations (Perda) falls under the authority of the Regional People's Representative Council (DPRD), with limited discourse on the latter's role in academic circles. This study endeavors to elucidate the theoretical underpinnings of PLS within international parliamentary frameworks, analyze the regulatory framework of PLS Perda as delineated in Law No. 23/2014 and PP No. 12/2018, scrutinize its implementation in Provincial DPRD Rules of Procedure, and advocate for bolstering the DPRD's role in conducting PLS Perda. Findings reveal a lexicon of PLS terminology within Indonesian legislative context, alongside a bifurcation of PLS Perda oversight between the DPD and DPRD. Alarmingly, a staggering majority (93.10%) of Provincial DPRDs nationwide have yet to formalize PLS procedures in their Rules of Procedure, with only the DIY Provincial DPRD demonstrating comprehensive implementation among the 34 surveyed. The imperatives for empowering DPRD's Bapemperda include evaluating Regional Regulations' efficacy, fostering legal coherence, preempting discriminatory legislation, enhancing legislative quality through experiential learning, and resolving the institutional dualism between DPD and DPRD in PLS Perda oversight. These measures not only fortify legislative processes but also mitigate jurisdictional ambiguities, ensuring robust governance at both national and regional levels.

Abstract

Religious tourism areas in Kudus Regency, Indonesia particularly the Tomb of Sunan Muria and the Tomb of Sunan Kudus are visited by thousands of pilgrims every day, creating significant transportation flows and contributing to air pollution. This study aims to evaluate the environmental quality and legal implications of air pollution caused by transportation activities in these two religious tourism sites. Using an empirical legal research design with a qualitative approach, primary data were collected through interviews and supported by results from Internet of Things (IoT) based air pollution detection devices that measured oxygen (O₂), temperature, and carbon dioxide (CO₂) levels. The results were then analyzed using the mean formula. The findings reveal differing environmental conditions between the two locations. The highland area of Sunan Muria generally shows air quality levels within Indonesia’s permissible standards, while the urban environment of Sunan Kudus records higher CO₂ and temperature levels exceeding the national air pollution threshold. These findings indicate that urban religious tourism faces more severe environmental challenges. The discussion emphasizes the urgent need for legal and policy reform toward a green transportation framework in Kudus Regency. This research contributes to demonstrating how IoT-based monitoring can serve as an empirical foundation for evidence-based environmental policymaking in Indonesia’s tourism sector.

Abstract

The effectiveness of Indonesia’s State Administrative Courts is increasingly under scrutiny, particularly regarding the dismissal procedures that often lack transparency and accountability. This research explores the urgent need for reform in these procedures to foster greater public trust in the judicial system. In a country where citizens’ rights and access to justice are vital to democratic governance, the lack of clarity and fairness in dismissal decisions can undermine confidence in the court’s integrity. The novelty of this study lies in its focus on dismissal procedures as a critical yet often overlooked area of judicial reform. By examining current practices, legal frameworks, and case law, the research identifies key weaknesses in the system, proposing innovative reforms aimed at enhancing procedural transparency, consistency, and accountability. A comparative analysis with international best practices highlights practical solutions that could be adopted to improve the fairness and efficiency of dismissal processes. This research makes a significant contribution by offering a targeted framework for reform that prioritizes the protection of citizens’ rights, ensuring that judicial decisions, particularly dismissals, are made with clarity, fairness, and public scrutiny. It calls for systemic change to align administrative justice with democratic principles of openness and accountability.

Abstract

Pelayanan publik merupakan wujud nyata dari kewajiban negara dalam memenuhi hak-hak dasar warga negara, termasuk pada tingkat pemerintahan desa yang berinteraksi langsung dengan masyarakat. Penelitian ini bertujuan untuk menganalisis kualitas pelayanan publik aparatur Desa Bukit Mulya berdasarkan sepuluh dimensi Servqual serta menilai kesesuaiannya dengan prinsip-prinsip hukum pelayanan publik sebagaimana diatur dalam Undang-Undang Nomor 25 Tahun 2009. Penelitian ini menggunakan pendekatan hukum empiris dengan metode kualitatif melalui wawancara mendalam dan observasi langsung terhadap lima orang warga yang dipilih secara purposive. Hasil penelitian menunjukkan bahwa pelayanan publik di Desa Bukit Mulya cukup baik pada aspek kesopanan, kejujuran, dan daya tanggap, namun masih lemah pada keandalan, kompetensi teknologi, serta fasilitas inklusif. Dari perspektif hukum, kondisi tersebut menunjukkan bahwa pelayanan publik belum sepenuhnya memenuhi prinsip kepastian waktu, akurasi, dan pemerataan akses. Temuan ini mengimplikasikan perlunya peningkatan kapasitas aparatur, penguatan sistem pengawasan kualitas dokumen, serta penyediaan fasilitas inklusif untuk mewujudkan pelayanan publik yang lebih efektif, adil, dan sesuai dengan prinsip hukum

Abstract

This study aims to evaluate how the coordination function of the Ministry of Forestry has been strengthened following its separation from the Ministry of Environment. This separation seeks to ensure that the Ministry of Forestry does not cultivate sectoral egos that hinder forest conservation efforts in Indonesia, thereby promoting a modern bureaucracy, mutual oversight, and balanced management of forestry as a crucial and strategic government priority, especially in light of the ongoing transition of forests to non-forestry uses since the reform era. Weak coordination can significantly affect forest protection, which is inherently tied to legal and justice issues. The “Merah Putih” Cabinet is the most significant cabinet since the New Order Era through the reform era, likely resulting in numerous vertical and horizontal coordination challenges that could obstruct the effective management of various tasks, functions, and ministerial roles. This research employs a normative juridical method with legislative, conceptual, and historical perspectives. In conclusion, there is a need to evaluate internal and external strengthening among ministries. The structure of an independent forestry ministry is not adequately aligned with its responsibilities and functions in managing Indonesia’s forest resources and potential natural wealth as a prosperous nation. It is vital to assess the role of the coordinating minister overseeing the Ministry of Forestry, as placing forestry issues under the Coordinating Ministers for Food, Maritime Affairs, and Economic Affairs does not sufficiently address forestry challenges, which are more related to the laws governing the conservation of living organisms and their intact, integrated ecosystems.
