Abstract

The existence of exploitation of forest resources that are dangerous for the survival of the forest is illegal logging activities carried out without going through a selection or selective logging process and permission from the government. So related to this, this scientific article discusses the "Authority of Illegal Logging Timber Auctions," using normative juridical research methods. The normative juridical research approach is a legal research with a literature approach that is carried out by conducting research on library materials or mere secondary data. As for what is studied in this scientific article is about the mechanism of auctioning confiscated wood from illegal logging outside the conservation forest of Jambi Province. So based on this, it is obtained data that related to the auction of confiscated wood from illegal logging outside the conservation forest of Jambi Province, those who have authority in cases of confiscated wood are the forestry service and investigators/public prosecutors. However, there are also contradictions in the rule of law related to the auction of illegal logging results, namely between Article 23 number (1) of the Minister of Finance Regulation Number 213/PMK.06/2020 and Article 4 Number 2 of the Minister of Forestry Regulation Number P. 47/Menhut-II/2009 regarding the Amendment to Regulation of the Minister of Forestry Number P.48/Menhut/2006.

Abstract

Sebagai dampak prinsip pharmaceutical care peran apoteker diharapkan lebih optimal pada praktiknya. Fakta di lapangan sering ditemukan sebaliknya, dimana pembebanan berat tugas selalu dibebankan kepada tenaga teknis kefarmasian. Sehingga dalam penulisan ini ingin melihat bagaimana batasan tugas tenaga teknis kefarmasian sesuai peraturan kefarmasian yang berlaku saat ini terutama dalam praktik pelayanan kefarmasian. Hasil serta kesimpulan bahwa berdasarkan aturan diuraikan: Pertama, Tenaga Teknis Kefarmasian merupakan tenaga yang masih terbatas secara keahliannya sehingga masih diperlukan adanya tenaga yang lebih profesional dalam hal ini apoteker. Kedua, Tenaga Teknis Kefarmasian tidak dapat melakukan praktiknya secara mandiri pada sebagian besar fasilitas kefarmasian tanpa adanya pengawasan dari Apoteker. Ketiga, terdapat pengecualian bagi tenaga teknis kefarmasian melakukan praktiknya secara mandiri hanya apabila dalam hal di daerah terpencil tidak terdapat Apoteker. Keempat, tenaga teknis kefarmasian dapat menerima pelimpahan pekerjaan kefarmasian dari tenaga apoteker dengan tetap di bawah pengawasan pemberi pelimpahan yakni apoteker. Kelima, tenaga teknis kefarmasian dapat melakukan kegiatan mandiri pada toko obat.

Abstract

Community Service Activities to Build a Law Aware Village is an Independent Learning Independent Campus activity owned by the Law Study Program. The problem that partners have is the inability to compile village regulations and academic texts and determine the priority scale of what village regulations will be prepared by the village. So with the initial problem, the Community Service Team made a proposal by conducting counseling and mentoring through 6 (six) students involved in the Merdeka Belajar Kampus Merdeka Integrated Work Lecture. In addition to counseling carried out by competent teams and resource persons, students are given knowledge and skills to be able to assist the village in the preparation of academic manuscripts and draft village regulations. Through this mentoring activity, two draft village regulations related to Customary Villages and Tourism Villages were obtained.

Abstract

This study further highlights the relevancy between patent rights and human rights. The impact of the availability and accessibility of essential medicines necessary for Public Health is significant. This study primarily aims to analyze and examine the relationship of patent rights on medicines and pharmaceutical products with human rights and to criticize and evaluate whether the Indonesian government has a policy configuration in the field of essential drugs and the pharmaceutical industry following the principles that support human rights. This research employed qualitative and normative-juridical methods supported by conceptual, statutory, and legal political approaches. Using the theories of legal objectives, utility, and justice, this research focuses on understanding economic law and human rights.  Through in-depth analysis, this study highlights how the patent system for drugs and pharmaceutical products encourages innovation and faces criticism due to limited access for economically vulnerable groups. Hence, the right to health is hampered while the state is responsible for universal access to affordable health care.   The findings of the study indicate that the Patent Rights on drugs and pharmaceutical products are exclusive rights that intersect with human rights in the drug patent system. Several parameters can be used to examine the relationship between human rights and intellectual property. It is necessary to reform the drug patent system to protect the balance and human rights. The findings contribute to a complex understanding of the relevance of patents to human rights while providing a basis for inclusive and sustainable policy development in the global health domain.

Abstract

Tujuan penelitian ini menjelaskan efektifitas kewenangan DIY berdasarkan Undang-Undang Keistimewaan. Pendekatan penelitian ini dilakukan secara kualitatif yang menghasilkan data deskriptif, yaitu data dari responden secara tertulis atau lisan dan perilaku nyata. Berdasarkan hasil penelitian dapat dijelaskan setiap kebijakan yang dibuat oleh Sri Sultan hanya akan menjadi catatan-catatan elit, jika tidak diimplementasikan oleh badan-badan administrasi maupun agen-agen pemerintah di tingkat bawah. Implementasi desentralisasi asimetris di DIY belum terlaksana secara maksimal dikarenakan masih terdapat beberapa amanat UUK DIY yang belum diterapkan dalam hal: Pertama, dalam hal penyerapan dana keistimewaan, belum diimplementasikan dengan baik dikarenakan penyaluran anggaran pada tingkat Kuasa Pengguna Anggaran (KPA) berefek pada keterlambatan transfer anggaran dan mundurnya agenda-agenda yang telah direncanakan oleh masing-masing KPA. Kedua, dalam hal kebudayaan belumlah optimal dikarenakan Pemerintah DIY dan pihak Dewan Perwakilan Rakyat Daerah (DPRD) belum menyelesaikan Perdais tentang Kebudayaan. Kesimpulan penelitian ini bahwa Pasal 7 Ayat (2) Undang-Undang Keistimewaan DIY mengenai 5 (lima) kewenangan belum dilakukan secara maksimal, karena baru dapat diselesaikan tiga Perdais tentang pengisian jabatan gubernur dan wakil gubernur DIY, tentang rencana tata ruang wilayah dan tentang kelembagaan. Namun, pada saat penelitian ini dilakukan ada 2 (dua) Raperdais yang belum selesai, yaitu tentang kebudayaan dan pertanahan.

Abstract

Tujuan penelitian untuk menjelaskan analisis program CSR Pertamina dalam menunjang pengembangan masyarakat di Kecamatan Sungai Gelam Provinsi Jambi tahun 2015-2016. Metode penelitian bersifat deskriptif-analitis dengan metode yuridis-empiris. Hasil penelitian bahwa program CSR yang dilakukan PT Pertamina EP Field Jambi salah satunya di Kecamatan Sungai Gelam, merupakan bentuk pertanggungjawaban perusahaan kepada lingkungan perusahaan. Kegiatan CSR yang dilakukan oleh Pertamina EP Field Jambi pada tahun 2015-2016 sangatlah bermanfaat dan berguna untuk masyarakat dimulai dari TOGA, Posyandu, kegiatan penanggulangan kebakaran hutan dan penanaman jagung pada lahan tidur di Desa Kebun Sembilan dan Desa Talang Belido. Kegiatan ini mampu menunjang dan memperbaiki perekonomian warga secara baik bila dilakukan secara berkelanjutan oleh PT Pertamina EP Field Jambi.

Abstract

Management rights over emergent land on the banks of the Batanghari River Watershed in Penyengat Rendah District, Jambi City have been practiced by the local community for generations without formal ownership as of this study. This article examines the legality of land tenure under Indonesian law and the rights to manage land emerging along the Batanghari riverbanks, aiming to advise the local government on the crucial need for legal recognition of these rights. Utilizing an empirical research method involving direct community engagement, the study finds that community management of this land is driven by longstanding residency and utilization, the scarcity of available land for agriculture in Jambi City supporting the local economy, high land prices, and historical reliance on riverbank land use. Despite continuous management, these activities lack permanent legal status as outlined in Article 16, Paragraph (1) of the Basic Agrarian Law.

Abstract

This community service initiative aimed to increase environmental awareness among residents of Pelayang Raya Village, Indonesia, through a socialization program focused on the establishment of a community-based waste bank. The activity involved 60 participants, including village officials, women’s groups, youth organizations, and traditional leaders. The program introduced key concepts of waste management based on the 3R principles—reduce, reuse, and recycle—while also outlining the operational mechanisms for forming and managing a waste bank. As a result, participants reached a consensus to formally establish a waste bank and agreed to follow up with student-assisted implementation through the MBKM KKN-T program. The project succeeded in fostering collaboration between community stakeholders, raising awareness, and laying a foundation for sustainable waste governance. However, the initiative was limited by its one-time implementation, uneven community participation, and the absence of a formal legal framework. Future programs should include ongoing training, regulatory support, and strategies for waste valorization to maximize the impact. Overall, the activity demonstrated the potential of participatory, community-driven environmental initiatives to build sustainable local systems and support rural circular economy models.

Abstract

Batang Sangir Village is a village located in Kayu Aro District, Kerinci Regency. However, it is regrettable that until now Batang Sangir Village does not have an official website which is the gateway to the availability of information in the village and can be accessed by the entire community. To find out the organizational structure of the village government, village potential, village regulations, and all matters related to the openness of public information that the community can access. In this Community Service activity, the team provided material related to the mandate of Article 24 of the Village Law, which contains 11 principles in implementing village government including those related to openness and accountability in implementing village government. This is also reinforced in Article 26 paragraph (4) letter (f) and letter (p) related to providing information to the village community. The village community is also given legal certainty as contained in Article 68 paragraph (1) related to obtaining information from the village government. This must be done because the village is a public body, following Article 1 number 3 of the Information Commission Regulation concerning Village Public Information Service Standards. Participants in this activity consisted of all village officials, neighborhood association heads, youth organizations, and all neighborhood association heads in Batang Sangir Village. With this activity, it is hoped that the village government will immediately create a website for the sake of openness of village information that can accessed anywhere by the community.

Abstract

This study aims to analyze judges' decisions related to forest fire cases. More specifically, it seeks to analyze the judges' reasoning based on the principles of justice, legal certainty, and public interest, as well as the application of the principle of in dubio pro natura in environmental damage cases. Forest and land burning for plantation purposes continues to increase, and legal efforts and law enforcement face numerous obstacles in terms of evidence. As a result, many forest and land burning cases go unpunished. The decision No. 233/Pid.b/Lh. 2020/Pn.Pbu and the cassation decision No. 3840 K/Pid.Sus.Lh/2021 acquitted the defendant PT S of liability for the forest and land fire incident. To analyze this case, the study uses Gustav Radbruch's theory of the purpose of law, which includes justice, legal certainty, and utility. The decisions of the first-instance court and the cassation court failed to adequately consider the principles of justice and utility, particularly regarding environmental protection. Although the principle of “in dubio pro natura” was applied, the judges' decision relied more on the logic of legal certainty, which only determines the decision based on evidence presented in court rather than the actual facts on the ground where the forest fire occurred. The principle of precaution was ignored by the defendant and overlooked by the judges.
