Abstract

This study aims to (1) determine and analyze the factors that cause incest by the biological father and (2) review and analyze legal and social efforts to prevent the occurrence of incest victims by their biological father in Buleleng Regency. The research method used is empirical legal research with qualitative descriptive method. Data were collected through in- depth interviews with police officers and social workers, as well as through the study of legal documents, literature, and related secondary sources. Non-probability sampling and purposive sampling techniques were applied for the selection of subjects, so as to obtain a comprehensive picture of the incest phenomenon. The results revealed that (1) children's vulnerability to incest by biological fathers in Buleleng Regency is influenced by their young age and lack of understanding of bodily rights, so they are unaware of physical and psychological abuse. Divorce and sole custody create emotional and economic dependency, making victims reluctant to seek help. Closed family environments and minimal supervision make early detection of abuse difficult. Lack of sex and rights education at home and school adds to the abuse gap. Patriarchal norms and cultural stigma force victims to remain silent. (2) Legal protection of child victims of incest in Buleleng is designed through prevention and decisive action with the principle of victimology. Prevention includes education of parents, educators, community leaders, and officials about children's rights, body privacy, and criminal sanctions. Repressive actions by the Buleleng Police Women and Children Protection Unit include investigation, prosecution and investigation, along with psychosocial rehabilitation services from the Social Affairs Office. This approach ensures comprehensive protection of victims' rights, providing restitution, compensation and mental recovery, while preventing repeated and ongoing violence.

Abstract

This research aims (1) to find out the implementation of Permendikbud Ristek No. 30 of 2021 in universities in Buleleng Regency as a form of legal protection for victims of sexual violence; (2) to find out the obstacles faced in the implementation of Permendikbud Ristek No. 30 of 2021 in universities in Buleleng Regency; (3) and to find out efforts at universities in Buleleng Regency to overcome challenges and obstacles in the implementation of Permendikbud Ristek No. 30 of 2021. The results showed that (1) The implementation of Permendikbud Ristek No. 30 of 2021 in universities in Buleleng Regency reflects a systematic effort to protect victims of sexual violence, despite the challenges of socialization, patriarchal culture, and lack of facilities, and requires the synergy of all parties so that the policy runs effectively and fairly; (2) Implementation of Permendikbud Ristek No. 30 of 2021 in universities in Buleleng Regency. 30 of 2021 in universities in Buleleng Regency faces obstacles in the form of a lack of understanding of gender, weak reporting mechanisms, lack of victim assistance, and the potential for abuse of academic power, so that legal protection for victims of sexual violence has not been optimal and transparent; (3) Universities in Buleleng Regency are trying to overcome obstacles to the implementation of Permendikbud Ristek No. 30/2021 through periodic counseling, the formation of the PPKS Task Force, and psychological assistance for victims, in order to create an academic environment that is safe, responsive, and in favor of the protection and recovery of victims of sexual violence.

Abstract

Broadcasts broadcast via television broadcasts have developed rapidly by presenting internet-based broadcasts or broadcasts. Looking at what currently exists in Indonesia, one of them is Vidio.com. Indonesia itself strongly adheres to the norms of politeness in social life, where internet-based broadcasting often displays scenes or words that are not in accordance with the norms of politeness that Indonesia currently adheres to. Article 13 paragraph (2) of Law No. 32 of 2022 regulates broadcasting services in Indonesia consisting of radio broadcasting services and television broadcasting services. Here it can be seen that the KPI does not have the authority to carry out supervision regarding internet-based broadcasting services. The authority possessed by KPI is attribution authority which originates from the law in carrying out broadcasting supervision in Indonesia. provisions of Bill C-11 and Law no. 32 of 2002 both regulate Broadcasting, but there are differences between these two provisions, Indonesia is limited to Radio and Television Broadcasting Services, while Bill C-11 Broadcast which has been revised, supervision covers Radio Broadcasting Services, Television, Providers Telecommunications and Internet Services. The internet in this case in Bill C-11 includes online streaming services. The supervision carried out by the CRTC is actually similar to that carried out by the KPI.

Abstract

The purpose of this study is to (1) analyze the legal protection of victims of the sale of goods resulting from the crime of theft in Buleleng district. (2) find out what are the obstacles faced by the Buleleng Regency Police in providing legal protection to victims of the sale of goods resulting from the crime of theft in Buleleng Regency. This type of research is empirical legal research with a descriptive nature of research. The location of this research was conducted in Buleleng Regency. Data collection techniques used are document studies, observations and interviews. The technique of determining the subject used is a purposive sampling technique. Data processing and analysis techniques were carried out qualitatively. The results of the study indicate that legal protection for victims of the sale of goods resulting from the crime of theft in Buleleng Regency has not gone well. This is reflected in the fact that the status of the person buying the goods resulting from the crime of theft is uncertain, so that the legal protection provided is also less than optimal. The obstacle faced by the Buleleng District Police in providing legal protection to victims of the sale of goods resulting from the crime of theft in Buleleng Regency is the problem of the status of the buyer of the stolen goods being uncertain so that the protection provided is only a protection mechanism as a witness.

Abstract

Penelitian ini bertujuan (1) mengetahui dan menganalisis proses penegakan hukum di tingkat kepolisian terhadap tindak pidana penyalahgunan narkotika yang dilakukan pegawai negeri sipil di kabupaten Buleleng, serta (2) mengetahui dan menganalisis akibat hukum terhadap pegawai negeri sipil yang melakukan tindak pidana penyalahgunaan narkotika di kabupaten Buleleng. Jenis penelitian yang digunakan adalah penelitian hukum empiris. Lokasi penelitian di Kepolisian Resor Buleleng serta Badan Kepegawaian dan Pengembangan Sumber Daya Manusia Buleleng. Teknik pengumpulan data yang digunakan adalah, observasi, studi dokumen, dan wawancara. Teknik pengolahan dan analisis data secara kualitatif. Hasil penelitian menunjukan bahwa (1) Peran Kepolisian dalam hal penegakan hukum dimulai dari penyelidikan, dan ditingkatkan ke penyidikan. Kemudian kepolisian membuat surat balasan, yang menjadi dasar bagi pihak instansi yang bersangkutan untuk melakukan pengurusan terkait pemberhentian sementara, (2) Akibat hukum selama proses penegakan hukum berupa pemberhentian sementara dan Tim Pertimbangan Kepegawaian dapat memproses pelanggaran disiplin ketika terdapat putusan pengadilan yang berkekuatan hukum tetap. Abstract This research aims to (1) find out and analyze the law enforcement process at the police level regarding criminal acts of narcotics abuse committed by civil servants in Buleleng district, and (2) find out and analyze the legal consequences for civil servants who commit criminal acts of narcotics abuse in the district. Buleleng. The type of research used is empirical legal research. The research location is the Buleleng Police Department and the Buleleng Personnel and Human Resources Development Agency. The data collection techniques used were observation, document study and interviews. Qualitative data processing and analysis techniques. The research results show that (1) The role of the Police in law enforcement starts from investigations, and is escalated to investigations. Then the police make a reply letter, which becomes the basis for the agency concerned to carry out arrangements related to temporary dismissal. (2) The legal consequences during the law enforcement process are in the form of temporary dismissal and the Personnel Consideration Team can process disciplinary violations when there is a court decision that has permanent legal force.

Abstract

Perkembangan teknologi kecerdasan buatan (Artificial Intelligence/AI) telah melahirkan fenomena deepfake, yaitu teknologi manipulasi digital berbasis algoritma deep learning yang mampu menciptakan konten audio-visual sintetis dengan tingkat realisme tinggi. Meskipun memiliki potensi positif dalam bidang seni dan hiburan, deepfake juga membuka ruang penyalahgunaan, khususnya dalam tindak pidana pencemaran nama baik. Penelitian ini bertujuan untuk menganalisis pertanggungjawaban pidana pengguna teknologi deepfake dalam konteks hukum pidana Indonesia, serta mengkaji urgensi reformulasi kebijakan pidana sebagai respons terhadap perkembangan teknologi tersebut. Metode yang digunakan adalah penelitian yuridis normatif dengan pendekatan doktrinal, melalui studi terhadap peraturan perundang-undangan seperti KUHP dan UU ITE, serta literatur hukum dan teknologi AI. Hasil penelitian menunjukkan bahwa meskipun tindak pencemaran nama baik telah diatur dalam KUHP dan UU ITE, belum terdapat pengaturan khusus terhadap bentuk-bentuk kejahatan digital berbasis AI, sehingga menimbulkan kekosongan hukum dan kendala dalam penegakan hukum. Oleh karena itu, diperlukan reformulasi kebijakan pidana yang meliputi kriminalisasi eksplisit terhadap penyalahgunaan deepfake, perluasan pertanggungjawaban pidana, serta penguatan instrumen pembuktian digital. Reformulasi ini bertujuan untuk menjamin perlindungan terhadap kehormatan, privasi, dan hak asasi manusia dalam ruang digital, sekaligus memastikan bahwa sistem hukum pidana Indonesia adaptif terhadap kemajuan teknologi yang disruptif

Abstract

The use of lie detectors (polygraphs) in Indonesia’s criminal procedure raises juridical issues, as such devices are not explicitly recognized as valid evidence under Article 184 paragraph (1) of the Criminal Procedure Code (KUHAP). Although theoretically, the polygraph can be classified as electronic information pursuant to Article 5 of Law No. 11 of 2008 on Electronic Information and Transactions (ITE Law), its application encounters normative obstacles, particularly the vagueness of Article 13 paragraph (2) letter d of the National Police Regulation No. 10 of 2009, which requires that the subject be “not under pressure” without providing objective indicators. This normative ambiguity potentially violates constitutional rights of suspects, including the principles of non self-incrimination and due process of law. This research employs a normative juridical method with statute, conceptual, and case approaches. The analysis is conducted qualitatively in an analytical-prescriptive manner by examining the Denpasar District Court Decision No. 708/Pid.B/2015 and the East Jakarta District Court Decision No. 229/Pid.Sus/2014. The findings indicate that the lie detector cannot yet serve as an independent means of evidence due to the absence of a clear legal basis and its potential to infringe human rights. Therefore, legal reform is necessary through revising the Police Regulation, improving Supreme Court Regulations (PERMA), and introducing new provisions in the revised KUHAP and ITE Law to establish a comprehensive legal framework that ensures the protection of rights within the criminal justice process.

Abstract

Indonesia sebagai negara hukum menuntut agar setiap bentuk kewenangan publik tunduk pada prinsip pertanggungjawaban hukum. Tindak pidana korupsi dikualifikasikan sebagai kejahatan luar biasa karena dampaknya yang sistemik terhadap keuangan negara, kepercayaan publik, dan tata kelola pemerintahan yang baik. Penelitian ini bertujuan untuk menganalisis kedudukan Bendesa Adat sebagai penyelenggara negara dalam arti fungsional berdasarkan Pasal 12 huruf e Undang-Undang Nomor 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi, khususnya dalam konteks penyalahgunaan kewenangan dan pemerasan. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Bahan hukum yang digunakan meliputi peraturan perundang-undangan, putusan pengadilan, serta doktrin dan pendapat para sarjana hukum. Hasil penelitian menunjukkan bahwa meskipun Bendesa Adat tidak secara eksplisit dikualifikasikan sebagai penyelenggara negara, kewenangan publik dan kekuasaan faktual yang dijalankannya dalam pengelolaan pemerintahan adat, sumber daya, dan kepentingan masyarakat memungkinkan pengkualifikasian Bendesa Adat sebagai penyelenggara negara fungsional. Selain itu, norma kabur dalam Pasal 12 huruf e membuka ruang penafsiran hukum yang memungkinkan pertanggungjawaban pidana terhadap tokoh adat yang menyalahgunakan kewenangan publik. Penelitian ini menegaskan pentingnya penafsiran hukum yang adaptif untuk menjamin kepastian hukum dan akuntabilitas dalam sistem hukum plural di Indonesia.

Abstract

Penelitian ini bertujuan untuk (1) mengetahui dan menganalisis Peran Jaksa Pengacara Negara Dalam Memberikan Bantuan Hukum Litigasi Terhadap Badan Usaha Yang Melakukan Tunggakan Iuran BPJS Ketenagakerjaan di Kabupaten Gianyar; dan (2) mengakaji dan menganalisis Hambatan dalam Pelaksaan Bantuan Hukum Secara Litigasi Terhadap Badan Usaha Yang Melakukan Tunggakan Iuran BPJS Ketenagakerjaan di Kabupaten Gianyar. Penelitian ini menggunakan pendekatan hukum empiris yang dikombinasikan dengan metode deskriptif. Pendekatan ini bertujuan untuk memahami dan menggambarkan secara faktual dan sistematis peran serta hambatan yang dihadapi dalam praktik bantuan hukum oleh Jaksa Pengacara Negara. Adapun data yang digunakan terdiri dari data primer, yang diperoleh secara langsung dari hasil wawancara dan observasi di lapangan, serta data sekunder yang meliputi bahan hukum primer (seperti peraturan perundang-undangan), bahan hukum sekunder (hasil kajian dan literatur), dan bahan hukum tersier (kamus hukum, ensiklopedia, dan lainnya). Teknik pengumpulan data yang digunakan dalam penelitian ini meliputi studi kepustakaan, observasi atau pengamatan langsung di lapangan, dan wawancara mendalam dengan pihak-pihak terkait. Hasil dari penelitian ini mengungkapkan dua fokus utama, yaitu: (1) bagaimana peran Jaksa Pengacara Negara dalam memberikan bantuan hukum secara litigasi kepada BPJS Ketenagakerjaan terkait penanganan tunggakan iuran oleh badan usaha di Kabupaten Gianyar; dan (2) berbagai hambatan yang dihadapi dalam pelaksanaan bantuan hukum litigasi tersebut, termasuk kendala dalam pelacakan aset, minimnya itikad baik dari pihak tergugat, serta posisi pemilik usaha yang berada di luar wilayah domisili badan usaha. Temuan ini diharapkan dapat memberikan kontribusi nyata bagi penguatan kebijakan penegakan hukum dan peningkatan efektivitas kerja sama antara BPJS Ketenagakerjaan dan Kejaksaan dalam menjamin perlindungan sosial bagi tenaga kerja.

Abstract

Praktik surrogate mother berkembang seiring dengan kemajuan teknologi reproduksi berbantu dan menimbulkan persoalan hukum yang kompleks, khususnya ketika dilakukan secara komersial. Di Indonesia, praktik tersebut belum diatur secara eksplisit dalam peraturan perundang-undangan, sehingga menimbulkan kekosongan hukum dan potensi eksploitasi terhadap perempuan. Dalam praktik commercial surrogate mother, perempuan yang berada dalam kondisi sosial dan ekonomi rentan direkrut untuk mengandung dan melahirkan anak bagi pihak lain dengan imbalan tertentu. Penelitian ini bertujuan untuk menganalisis pengaturan tindak pidana perdagangan orang menurut Undang-Undang Nomor 21 Tahun 2007 serta mengkaji apakah praktik commercial surrogate mother dapat dikualifikasikan sebagai tindak pidana perdagangan orang. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan perbandingan hukum. Hasil penelitian menunjukkan bahwa praktik commercial surrogate mother berpotensi memenuhi unsur tindak pidana perdagangan orang, khususnya dalam hal perekrutan, penyalahgunaan posisi rentan, dan eksploitasi untuk memperoleh keuntungan. Dengan demikian, meskipun belum diatur secara eksplisit, Undang-Undang Nomor 21 Tahun 2007 dapat digunakan sebagai dasar hukum melalui pendekatan interpretasi yang progresif
