Abstract

Ratification of a legal entity based on the issuance of a Decree of the Minister of Law and Human Rights requires a process that is not brief. Meanwhile, corporation which has not been ratified as a legal entity does not rule out the possibility that the promotors of corporation will carry out legal actions in the name of corporation. This journal aims to provide an explanation of the extent to which the liability of corporation and promoters on contracts made before corporation becomes a legal entity. The research methods in this study are conceptual approach and statute approach. Law Number 40 of 2007 concerning Limited Liability Companies in Indonesia currently regulates the liability of promotors before corporation becomes a legal entity. From this journal, it will be known that liability which appears from pre-incorporation contract lies on promotor before corporation becomes a legal entity, but when the legal action has been approved by the General Meeting of Shareholders or has been stated in the deed of establishment, it will become corporate's actions, therefore the liability is also attached.

Abstract

AbstractThis study aims to firstly analyze clerical errors in court decisions that have permanent legal force and secondly analyze related legal remedies for clerical errors in court decisions that have permanent legal force. This research is a doctrinal research with a statute approach, a conceptual approach, and a case approach. The results of this study are that first, a clerical error in a court decision that has permanent legal force is an error that is minor in nature or in the form of an accident and is not related to the substance of the judge’s legal considerations and this error can be corrected by the court, even after the judge makes a decision. . Second, legal remedies that can be filed against typos in decisions that have legal force consist of various kinds, but generally the right one is through an application. It is based on nature, complexity, time, cost, and evidentiary.Keywords: Clerical Eror; Non-Executable Judgement; Legal Action. AbstrakPenelitian ini bertujuan untuk pertama menganalisis kekeliruan pengetikan (clerical eror) dalam putusan pengadilan yang berkekuatan hukum tetap dan kedua menganalisis terkait permohonan terhadap adanya kekeliruan pengetikan (clerical eror) dalam putusan pengadilan yang berkekuatan hukum tetap. Penelitian ini adalah penelitian hukum (doctrinal research) dengan pendekatan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), dan pendekatan kasus (case approach). Adapun hasil dari penelitian ini adalah pertama kekeliruan pengetikan (clerical eror) pada putusan pengadilan yang berkekuatan hukum tetap adalah kesalahan yang sifatnya ringan atau berbentuk ketidaksengajaan dan tidak berkaitan dengan substansi pertimbangan hukum hakim dan kesalahan ini dapat diperbaiki oleh pengadilan, meskipun setelah hakim menjatuhkan putusan. Kedua, exit plan yang dapat diajukan terhadap adanya kekeliruan pengetikan pada putusan yang berkekuatan hukum terdiri dari beraneka ragam, namun umumnya yang tepat adalah melalui permohonan. Hal ini didasarkan pada hakikat, kompleksitas, waktu, biaya, dan pembuktian. Kata Kunci: Clerical Eror; Putusan Non-Executable; Exit Plan.

Abstract

This article aims to analyze the juridical implications of not registering marriages for legal protection for the community, because the existence of the PKDRT Law has not been fully able to guarantee legal protection. The writing method used is juridical-normative using a reform-oriented research typology, namely evaluating applicable rules by providing recommendations on these rules. This study concludes that there is a blurring of legal subjects that can be protected in the PKDRT Law due to differences of opinion regarding the validity of marriage based on the provisions in Article 2 of the Marriage Law. Moreover, there are differences in judges’ views on the validity of a marriage which are not recorded in several decisions of cases of domestic violence causing legal uncertainty. However, there is still an alternative for self-protection for victims of domestic violence whose marriages have not been registered, namely using the articles in the Criminal Code.

Abstract

The Constitutional Court Decision No. 118/PUU-XX/2022 redefined the paradigm of the statute of limitations for document forgery offenses in Indonesia. Previously calculated from the date of the offense, it is now determined based on when the forged document is discovered, used, and causes loss. This article examines the legal implications of the court decision on the state of limitations to legal certainty and law enforcement practices, particularly those carried out by the Indonesian National Police. A conceptual and statutory approach is employed to analyze the amendments to Article 79(1) of the Indonesian Criminal Code and the Court’s legal reasoning. The findings indicate that this change enhances legal protection for victims and requires investigators to cumulatively evaluate the elements of “discovery,” “usage,” and “loss” to determine the statute of limitations. The decision has erga omnes effect and serves as a binding precedent and guideline for investigating document forgery cases in Indonesia.
