Abstract

According to Law No 21/ 2008, a Sharia Business Unit (SBU) owned by a Conventional Commercial Bank (CCB) is required to separate from its Parent Bank before 2023. Some Sharia Business Units have initiated a separation step from Conventional Commercial Bank. At the same time, they are required to keep the level of efficiency in running their business operations. This paper is intended to analyze the efficiency level of Sharia Business Units that have separated from its parent bank and compare the efficiency level before and after separation. The method used is Data Envelopment Analysis (DEA) and Paired Sample t-Test. T he results show that, based on the total average efficiency of all spin-off sharia banks (in this case four sharia banks namely BNI Sharia, BRI Sharia, BJB Sharia and Bukopin Sharia Bank), there is a decrease in technical efficiency and pure technical efficiency before and after the spin-off. This is a cost adjustment is needed in the early periods of spin-off. Sharia banks require a 'weaning' from their parents. Nevertheless, there is no statistically significant difference in the efficiency levels between before and after the spin-off.

Abstract

This study critically examines the Fatwa MUI No. 105 on sharia ruling of capital guarantee in a mudharabah contract in Islamic bank practices. Some opinions from sharia Fatwa which is issued by International Fatwa Issuing-Bodies and Classical Muslim Scholars were used to obtain the holistic view on mudharabah capital guarantee. This study employs qualitative approach to assess the opinion of sharia scholars and utilizes inductive approach to summarize the data or information that are collected. The main data of this study is fatwa MUI No.105, Muslim scholars’ opinion from Fiqh or Ushul Fiqh literature, and group of international fatwas that are issued by reputable fatwa-issuing body. The study found that the MUI Fatwa No.105 which is stated that mudharib can guarantee mudharabah capital voluntarily contradicts to majority of four mazaahib, International Islamic Fiqh Academy and AAOIFI that state the mudharib is not allowed to guarantee the capital of the mudharabah. In addition, the Fatwa was not included the aspect of Amanah in its stipulation. However, under sharia methodology of maslahah, mudharib is still allowed to provide capital guarantee in certain situations: first, if mudharib is doing negligently in business, second, mudharib willingly impose themselves to guarantee the mudharabah capital, third, afraid of loss of potential customer, and lastly, mudharib voluntarily guarantee only the capital not profit.

This research also tried to find which NB-IFI with the highest priorities to be improved. This research also tried to compare the priorities result based on two approaches-methods, there are AHP (Analytic Hierarchy Process) where the network connection is hierarchy, and ANP (Analytic Network Process) where the network connection is feedback. Indepth interview to some academician, practitioners, and regulators who has better knowledge related to Non Bank-Islamic Financial Industry was used to formulate AHP and ANP model. The result of this study indicates that the most priorities criterian to enhance the role of Non Bank-Islamic Financial Industry is tough, manageable, and steady NB-IFI. The most priorities of sub criteria ‘tough, manageable, and steady NB-IFI’ are strengthening the institutional system, modal aspect, and operational activity aspect and business capacity. The most priorities of sub criteria ‘NB-IFI and financial inculsion’ are NB-IFI products development based on the needs of society.
