Abstract

Implementasi Pasal 32 ayat (2) Permendagri Nomor 20 Tahun 2018 belum mencerminkan pelaksanaan kewenangan yang terdistribusi secara tepat antara Kepala Desa dan BPD. Berdasarkan temuan di enam desa, kewenangan penyusunan RAPBDesa masih cenderung terpusat pada Kepala Desa, sedangkan BPD sering hanya terlibat pada tahap persetujuan akhir. Kondisi ini menunjukkan belum tercapainya pelaksanaan teori kewenangan secara proporsional, yang menuntut adanya check and balance dalam penyelenggaraan pemerintahan desa. Metode yang digunakan yaitu penelitian hukum sosiologis. Dari perspektif penerapan hukum, struktur kelembagaan belum sepenuhnya selaras dengan ketentuan normatif, sehingga substansi hukum yang telah dirumuskan tidak terimplementasi optimal sesuai tujuan regulasi. Meskipun norma telah mengatur mekanisme secara jelas, pelaksanaannya masih menghadapi hambatan yang berdampak pada belum tercapainya kepastian hukum sebagaimana yang diharapkan. Faktor penghambat adanya kelemahan dalam internalisasi asas-asas umum pemerintahan yang baik. Minimnya pemahaman peran BPD terhadap regulasi, lemahnya kapasitas SDM, kurangnya pendampingan oleh pemerintah daerah, serta dominasi hubungan kekuasaan Kepala Desa menegaskan bahwa prinsip transparansi, partisipasi, akuntabilitas, dan profesionalitas belum diterapkan secara utuh. Hal ini menunjukkan adanya deviasi antara das sollen dan das sein, terutama dalam konteks penyelenggaraan pemerintahan desa yang demokratis dalam penganggaran keuangan desa. Praktik penetapan RAPBDesa tanpa kesepakatan dari BPD di enam desa Kabupaten Rokan Hilir menimbulkan implikasi hukum.

Abstract

Ekspansi perkebunan kelapa sawit membuka peluang kerja yang substansial sebanding dengan luasnya lahan di Rokan Hulu, potensi kesempatan kerja yang terbuka seharusnya sangat tinggi. Namun fakta menunjukkan ketidakselarasan antara permintaan dan penawaran tenaga kerja lokal sehingga tidak berkontribusi pada tingkat oengangguran terbuka yang ada di Kabupaten Rokan Hulu. Penelitian ini merupakan penelitian hukum sosiologis melalui wawancara dan observasi dan teknik analisis kualitatif. Penelitian ini menemukan bahwa kebijakan penempatan tenaga kerja lokal di Kabupaten Rokan Hulu sejak ditetapkannya Peraturan Daerah  munnjukkan peningkatan jumlah tenaga kerja lokal dalam tiga tahun terakhir seiring dengan ekspansi industri sawit. Pemerintah Daerah sudah melakukan tugasnya dalam rangka pengawasan melalui Wajib Lapor Ketenagakerjaan Perusahaan (WLKP) dan mendorong pembukaan lowongan kerja melalui Disnaker dan kantor desa. Lemahnya penegakan sanksi dan proses administratif yang tidak jelas menyebabkan kebijakan ini tidak efektif secara normatif dan struktur untuk mendukung penyerapan tenaga kerja lokal.

Abstract

Abstract General Background: Regional policy implementation frequently encounters structural and socio-cultural barriers, particularly in regulating public order within rural governance contexts. Specific Background: The implementation of Regional Regulation Number 3 of 2022 concerning livestock control in Moutong District, Parigi Moutong Regency, demonstrates persistent issues, including weak cross-agency coordination, low public legal awareness, inconsistent sanction enforcement, limited facilities, and reactive control patterns. Knowledge Gap: Although both top-down administrative mechanisms and bottom-up community initiatives have been introduced, their interaction has not been systematically conceptualized within an integrated cross-institutional synergy framework. Aims: This study aims to analyze the formation of cross-institutional synergy through the integration of top-down and bottom-up approaches in implementing livestock control policy and to identify determining factors shaping its implementation. Results: Using a descriptive qualitative method with interviews, observations, and documentation, the findings reveal that implementation remains suboptimal due to incidental coordination, dominance of hierarchical directives, uneven sanction application, limited resources, and fragile public trust. However, emerging collaborative practices—such as village livestock task forces, digital reporting mechanisms, vulnerability-based standard operating procedures, and community monitoring—indicate the potential of structured synergy. Novelty: This study constructs a dual-model synergy scheme that integrates hierarchical policy instruments with community-based participation to bridge the gap between normative regulation and social practice. Implications: The findings highlight the necessity of institutionalized coordination, consistent law enforcement, strengthened community engagement, and adaptive governance mechanisms to achieve sustainable livestock control within decentralized regional administration. Abstract

Amandemen ketiga Undang-Undang Dasar (UUD) 1945 diperkenalkan pasal-pasal baru yang mengatur tentang DPD. Wewenang DPD diatur dalam Pasal 22 D ayat (1), (2), dan (3) UUD 1945. Fungsi-fungsi DPD dapat disebutkan Fungsi Legislasi, Fungsi Pengawasan, dan Fungsi Nominasi. Semua fungsi yang dimiliki DPD berakhir dan bermuara pada DPR. Adapun Tujuan Penelitian ini adalah Untuk menganalisa Konsekuensi Tanggung Jawab Legislatif Dewan Perwakilan Daerah dalam Pembentukan Rancangan Undang-Undang Pemekaran Daerah di Indonesia. Metode penelitian menggunakan metode Penelitian Hukum Normatif sumber data dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tertier yakni menarik kesimpulan penalaran hukum yang berlaku namun pada kasus individual dan konkrit yang dihadapi. sehingga peranannya dalam proses pembentukan undang-undang, terutama terkait pemekaran daerah, hanya terbatas pada usulan dan partisipasi dalam pembahasan, Secara normatif dan praktis, kewenangan legislasi DPD dalam pembentukan kebijakan pemekaran dan penggabungan daerah masih bersifat terbatas dan non-determinatif, sehingga memerlukan penguatan regulatif dan institusional agar fungsi representatif DPD terhadap kepentingan daerah.Meskipun fungsi, tugas, dan kewenangan Dewan Perwakilan Daerah (DPD) telah diatur secara eksplisit dalam Pasal 22D Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, pelaksanaannya di lapangan menunjukkan berbagai kendala substantif. Keterbatasan kewenangan yang dimiliki DPD, khususnya dalam bidang legislasi, menjadikan lembaga ini tidak dapat menjalankan peran dan tanggung jawabnya secara optimal. Kesimpulan keterbatasan kewenangan DPD secara konstitusional yang tidak seimbang dengan DPR, serta kurangnya kapasitas legislatif DPD dalam menyusun RUU yang komprehensif dan sesuai dengan kebutuhan daerah. Saran dari penulis diperlukan Peningkatan Koordinasi Dan Sinergi Antar Lembaga. Kata Kunci : Kewenangan, DPD, Pemekaran Daerah

Abstract

Reliable determination of carbon (C) and sulfur (S) in tapping ferronickel is critical for metallurgical quality control and compliance with industrial specifications. Given the complex metallic matrix of ferronickel, verification of analytical performance is essential before routine application. This study verifies the GB/T 20123 standard method for the simultaneous determination of carbon and sulfur in tapping ferronickel using a High Carbon Sulfur (HCS-801) combustion–infrared analyzer. Method performance was assessed using accuracy, precision (repeatability), linearity, limit of detection (LOD), and limit of quantification (LOQ), in accordance with internationally accepted validation principles. Evaluation of recovery testing yielded 97.82 % for carbon and 99.04 % for sulfur, both within acceptable recovery ranges. Precision expressed as %RSD was 1.27% for carbon and 0.70% for sulfur, complying with the Horwitz criterion (% RSD < ½ CV Horwitz) and the general acceptance limit of 2 %. Excellent linearity was obtained across the calibration range, with correlation coefficients (r) of 0.998 for carbon and 0.9984 for sulfur. LOD and LOQ values, calculated based on the standard deviation of response and slope of calibration curves, were 0.0557% and 0.1855% for carbon, and 0.0123 % and 0.0409 % for sulfur, respectively. The results demonstrate that the GB/T 20123 method, when implemented with the HCS-801 analyzer, provides reliable analytical performance for carbon and sulfur determination in tapped ferronickel and is suitable for routine industrial applications.

Abstract

This study examines how integrating Islamic values, particularly halalan tayyiban, with vegan and cruelty-free principles in beauty products can serve as a tool to address islamophobia. Using a qualitative research design, this paper combines document analysis with expert consultations from halal certified advisors, academics, government regulatory bodies (BPJPH), industry associations (PERKOSMI), and leading halal beauty brand (Wardah), supplemented by exploratory consumer insights from 100 respondents across Indonesia, Malaysia, and Singapore, including 41 non-Muslim consumers from Buddhist, Christian, Hindu, and Confucian backgrounds. Situates within the frameworks of soft power, cultural diplomacy, and ethical consumerism. The findings reveal that halal beauty products, when aligned with global ethical trends such as sustainability and animal welfare, transcend their commercial role and act as cultural ambassadors, projecting a positive image of Islamic values. Consumer data indicate that 70% of respondents agreed halal products can shift perceptions of Islam, with non-Muslim consumers showing favorable attitudes when halal is framed through universal ethical narratives rather than religious signaling. Expert consultations confirm that while Indonesia faces governance challenges, limiting its global halal market share to 3.6%, industry stakeholders increasingly view halal certification as a competitive advantage that shapes international supply chain standards. The study concludes that halal beauty diplomacy operates through gradual, cumulative influence rather than dramatic perception shifts, and offers recommendations for policymakers, certification bodies, and industry stakeholders to expand the global presence of Islamic value-based beauty products as instruments of peace, inclusivity, and prejudice reduction.
