Abstract

Commercial players have greater and more comprehensive resources, marketing and relationships than consumers. It can even be said that consumers have relatively limited legal awareness and their rights as consumers, so that perpetrators are often treated unfairly against companies. The injustice in question can be observed in one of the advertisements. Entrepreneurs are not clear in the legislation on consumer protection, the structure of legal responsibility for advertising that harms consumers. This study aims to examine the philosophical nature of consumer legal protection in relation to harmful advertising. The method used in this study is a type of legal normative research method. Based on the results of the study, this study indicated that consumer protection arrangements in Indonesia are still not optimal considering that contracts do not cover the legal responsibilities of economic actors who broadcast products advertised by advertising companies. Of course, the philosophical aspects involved in looking at the Pancasila perspective are Precepts 2 and 5 which contain elements of human rights. The principle of fairness regarding the rights and obligations of entrepreneurs is therefore not balanced. More appropriate action is needed to strictly control the advertisements on broadcasters. This can become legal knowledge for consumers, law enforcement officers, businesses or broadcasters to pay attention to the advertisements that are broadcast so as not to cause consumers to lose right.

Abstract

The paradigm shift in Legal Education in Indonesia is currently being felt by academics, practitioners, students and the public, namely the technology-based learning pattern. As previously known, the pattern of learning in Indonesia is still done conventionally and conventionally on reading literacy. However, under current conditions, academics, practitioners and the public in Indonesia are expected to be able to adapt to current technological developments. The aims research to know how is the application of technology and information in providing information and legal education to the younger generation and society and to know how will the e-learning development model as a digital-based forum and source of legal information contribute to increasing public knowledge and legal awareness in the future development of national law. The research method used in this study is the normative legal method. obtained are by developing digital-based e-learning which is expected to be able to help the younger generation and the Indonesian people to understand and be aware of existing laws. In addition, the development of e-learning methods can be used as a forum for the presentation of digital-based legal information and provide a space for the community to search, research, analyze and share information effectively and efficiently. The public will quickly receive ideas and information about the law and the educational process that needs to be developed, and quality human resources in print who understand the existing laws and are able to use the technology necessary to compete in the current and future era of globalization.

Abstract

The current development of information and communication technology has an impact on people's economic activities, one of which is the activity of borrowing money. Borrowing and borrowing money that was originally carried out conventionally, now many have switched to online lending and borrowing activities. However, in its activities, there are problems experienced by creditors (lenders) related to settlement of obligations if the debtor (lender) dies before the repayment period. This happens because in the observed online lending and borrowing money agreements, many do not include the form of settlement of obligations if the debtor (loan recipient) dies. The issues raised in this study are how legal protection is for creditors in online money lending agreements in the event that the debtor dies and what forms of dispute resolution efforts are made in online money lending and borrowing agreements in the event that the debtor dies. This research method uses a normative legal research type with a statutory approach and a conceptual approach. The results of this study indicate that the form of legal protection for creditors in online money-lending agreements in the event that the debtor dies is through preventive protection (applying the 5C principle and every transaction using an escrow account and virtual account), while repressive protection (organizers help through billing units, assist in mediation, make complaints). And efforts to resolve disputes can be done through non-litigation (outside court) and litigation (in court).

Abstract

In the modern world, the role of banking in the economic progress of a country is very large. Almost all sectors related to various financial activities must always require bank services. One of the services offered by the bank is the cash pick up service. In practice, this cash pick up service not only provides convenience to customers, but can be used by certain individuals to commit crimes. This study aims to find solutions and solutions to the vagueness of norms in Article 20A of Law Number 4 of 2023 concerning the Development and Strengthening of the Financial Sector Jo. Law Number 10 of 1998 concerning Banking as well as seeking legal certainty and providing comprehensive protection for the parties involved. The formulation of the problems raised are: 1. What is the philosophical basis for regulating customer transactions in cash pick up service by banks in positive law in Indonesia?; 2. What is the concept of customer protection in transactions through cash pick up service based on the bank's prudential principle as a manifestation of legal certainty?; 3. What is the pickup service cash agreement model that accommodates the bank's prudential principles in an effort to reduce risk and provide protection for parties based on legal certainty in the future? The research method used is normative legal research with the type of statutory approach, conceptual approach, case approach and philosophical approach. The results showed that the philosophical basis for regulating customer transactions in cash pick up service by banks is based on trust, bank prudential principles, and legal certainty. The concept of protection for customers in transactions through cash pick up service reflects the concepts of bank prudence, fairness, transparency, privacy, complaint resolution, trust and legal certainty. A cash pick up service agreement model that accommodates the bank's prudential principles in an effort to reduce risk through the formulation of clauses containing the principles of prudence, risk management, force majeure, legal certainty, cash service specifications, operational provisions, responsibilities, dispute resolution, cash ownership, confidentiality, duration, and closing.

Abstract

The growth of tourism has encouraged the development of non-bank money changers. However, there are non-bank money changer practices without a business license, which allows the circulation of counterfeit currency to consumers. Due to the absence of rules regarding the legal certainty of consumers related to the liability of businesses for the loss of consumers who obtain counterfeit money. The formulation of this research problem, namely: 1) How is the regulation of legal protection for consumers in non-bank money changer activities? 2) How is the liability of business actors money changer non-bank for the loss of consumers who get counterfeit money from the exchange of foreign currency?. The research method used is normative legal research with a statutory approach and conceptual approach. The results showed that the regulation of non-bank money changer only based on Bank Indonesia Regulation No. 18/20/PBI/2016. If consumers suffer losses due to counterfeit money, then consumers can request compensation in accordance with Article 19 of the GCPL and if the business refuses to provide accountability, consumers can claim their losses by suing the business according to Article 1365 and 1366 of the Civil Code.

Abstract

BUMDes is a pillar of economic activity in the village that functions as a social and commercial institution. The development of the welfare of rural communities requires strategies that are in accordance with regional conditions which cover all aspects of the potential of the region or village. Based on this background, this research discusses the role of BUMDes in increasing local revenue in Baha Village, Badung Regency and how BUMDes efforts overcome obstacles in increasing PAD in Baha village, Badung Regency by using an empirical legal research method that examines law that is conceptualized as real treatment. The formation of BUMDes is a way to take advantage of laws that give authority to village governments to innovate in village development. The establishment of village-owned enterprises is accompanied by efforts to strengthen capacity and is supported by regional (district/village) policies that participate in facilitating and protecting village community businesses from the threat of competition from large investors. villages independently, so that they can improve the village economy, and can improve the welfare of the community. The existence of BUMDes is expected to reduce poverty levels so that the community's economy can increase.

Abstract

Perusahaan Uluwatu Collective Company merupakan sebuah nama perusahaan di Badung, yang bergerak di bidang gymnasium yang terletak di Kabupaten Badung. Dalam hal ini dapat diketahui bahwa pekerja di perusahaan tersebut belum mendapatkan upah sesuai dengan UMR. Hal tersebut tentu bertentangan dengan Undang-Undang Nomor 13 Tahun 2003 tentang ketenagakerjaan, khususnya pada pasal 8 yang mengatur mengenai perencanaan tenaga kerja dan informasi ketenagakerjaan. Peneliti berpandangan adanya kesenjangan antara peraturan perundang-undangan yang berlaku dengan prakteknya. Tujuan penelitian ini adalah untuk mengetahui pelaksanaan sistem pengupahan bagi pekerja di Uluwatu Collective Company dan perlindungan hukum terhadap pekerja yang mendapat upah tidak sesuai UMR di Uluwatu Collective Company. Metode penelitian yang digunakan adalah tipe penelitian hukum empiris dengan jenis pendekatan konseptual dan sosiologis. Berdasarkan hasil yang didapatkan terhadap pelaksanaan sistem pengupahan adalah perusahaan membayar upah pekerjanya setiap tanggal 7 pada minggu pertama, upah lembur dibayar per-jam. Perlindungan hukum terhadap pekerja yang mendapatkan upah tidak sesuai UMR, yakni pekerja yang sudah bekerja selama 3 bulan atau lebih mendapatkan BPJS.

Abstract

Perjanjian kerja yang didasarkan pada komunikasi lisan kerap kali memunculkan masalah hukum ketika pekerjatidak menyadari status pekerjaannya dengan pengusaha atau perusahaan tempat ia bekerja. Maka dari itu, pekerjadalam hubungan kerja seperti ini mungkin tidak sepenuhnya mengetahui hak-hak mereka sebagai pekerja.Masalah dengan penelitian ini adalah bagaimana dilakukan ketentuan syarat sah perjanjian kerja yang dibuatsecara lisan antara perusahaan dengan pekerja dan bagaimana akibat hukum dari hubungan kerja yang berdasarkanpada perjanjian kerja secara lisan. Menggunakan metode secara normatif dan juga melakukan pendekatan secaraberkonsep dan juga melalui peraturan perundang – undangan. Hasil penelitian menunjukan bahwa persyaratanuntuk membuat perjanjian kerja secara lisan antara pekerja dan perusahaan memegang kekuatan hukum yangpenting karena diakui keabsahannya oleh hukum, selama adanya pemenuhan syarat yang ada dalam Pasal 52Undang-Undang Ketenagakerjaan dan juga adanya Pasal 1320 KUH Perdata berjalan secara satu tujuan dansahnya ketentuan sudah dilaksankan. Adanya kewajiban harus membuat surat pengangkatan untuk secara harfiah,perjanjian kerja yang memenuhi persyaratan Pasal 63 ayat (1) Undang-Undang Ketenagakerjaan. Meskipunperjanjian kerja lisan memiliki kekuatan hukum yang sama dengan perjanjian tertulis, perusahaan harus tetapmengeluarkan surat pengangkatan untuk membuktikan hubungan kerja antara karyawan dan perusahaan.

Abstract

The 1945 Constitution of the Republic of Indonesia clearly states that the State of Indonesia is a state of law. If an invention or work, it must be identical to a patent that is then filed by an Intellectual Property Consultant. What is meant by this patent is that it must belong to the inventor or creator. Therefore, researchers want to know more about the above, which can be formulated. The problem is about the legal arrangement of the position of intellectual property rights consultants in the registration of patent rights according to patent law and legal consequences if there is a violation by an intellectual property rights consultant in the registration of patent rights. This research uses a normative type, namely research by analyzing literature based on the legal materials used. The legal basis for intellectual property rights consultants is regulated in the Government Regulation of the Republic of Indonesia Number 2 of 2005 concerning Intellectual Property Rights Consultants. The use of a person's patent rights without permission has an impact on legal consequences and can be entangled in accordance with the articles in Law Number 13 of 2016 concerning Patents.

Abstract

Banks providing credit do not want non-performing loans, banks take preventive measures to prevent non-performing loans. Bank's efforts to settle non-performing loans by taking over the collateral for bad loans, either partially or wholly based on Article 12A paragraph (1) of the Banking Law. The purpose of the study was to determine the position of BPRs taking over bad credit collateral through auctions or outside auctions. The type of research is normative legal research with a statutory and conceptual approach. Legal materials consist of primary, secondary and tertiary legal materials, the collection of which is by literature study. Analysis with descriptive techniques, evaluation and argumentation. The results show that the position of BPR is not entitled to take over collateral either partially or completely through auction or outside the auction, the Banking Law only gives authority to Commercial Banks and legal consequences for BPRs that take over bad credit collateral through auction or outside the auction after the decision after the decision of the Constitutional Court no. 102/PUU-XVIII/2020 as referred to in Article 12 A paragraph 1 of the Banking Law which has been declared to have no binding legal force or is no longer valid, so that the authority of BPR is equal to that of Commercial Banks which can take over the collateral, either partially or completely, as collateral for bad loans. a form of equalization and legal protection for BPRs in carrying out banking activities
