Abstract

Digital transformation has significantly reshaped social interaction patterns, including how Muslim women express themselves after divorce. The period of 'iddah, which is traditionally understood in Islamic law as a waiting period that restricts women's public presence and activity, now confronts new realities: women's virtual presence through digital platforms such as Instagram. This study aims to examine the digital activities of Muslim women during 'iddah by analyzing the cases of content creators Ria Ricis and Natalie Holscher, and to compare these practices with the classical jurisprudential views of the four major Sunni schools of thought. Employing a qualitative approach, this research uses literature analysis and case study methods, framed by the principles of maqāṣid al-sharī'ah and Islamic gender justice. The findings reveal that classical Islamic jurisprudence generally emphasizes restrictions on women's mobility and appearance during 'iddah, yet offers no explicit guidance on digital behavior in modern contexts. Meanwhile, the digital practices of the selected figures do not necessarily contradict Islamic ethical values, especially when driven by productive motives and conducted within the bounds of modesty. Therefore, this study argues for a contextual and gender-sensitive reinterpretation of Islamic law to respond to the evolving digital realities faced by contemporary Muslim women.

Abstract

This study analyzes how Islamic legal communication is applied in the determination of wali adhal in Indonesia and Morocco using a comparative case study approach. The goal is to understand the implementation of maqasid al-sharia in both legal systems, especially regarding women's rights in marriage. Data was collected through case analysis, official documents, and interviews with religious court judges. The results show that Indonesia resolves the case of guardian rejection through the appointment of a guardian judge, which illustrates a reactive yet adaptive ijtihad-based legal response. In contrast, Morocco adopted structural legislative reforms by granting adult women the right to marry without guardianship, rooted in a maqasid-oriented reinterpretation of family law. This contrast shows two models of Islamic law reform: Indonesia's case-based judicial policy and Morocco's proactive law. This study contributes to Islamic legal theory by integrating maqasid al-sharia and legal communication to explain how state institutions mediate and transmit Islamic legal values in contemporary family law.

Abstract

Early childhood is aged 0-8 years, early childhood aged 4-6 years get formal education called early childhood education in Kindergarten / Raudhatul Athfal, this education has a function to provide a stimulus to early childhood so that Aspects of development and basic potential possessed by children develop so that they can become the initial fundamentals of children so that they can continue their further education. Educators play an important role in educational education about gender and gender in early childhood by adjusting the characteristics of early childhood. So that children at an early age can distinguish their roles and do not deviate from behavior according to their nature. This type of research is a qualitative research. There are 4 methods used, namely, habituation, storytelling, conversing and sociodrama. The media used is image media. The changing learning behavior of children includes children who are able to classify themselves and children understand how to look the right way as a boy and a girl. The results showed that the introduction of gender and gender is very important in learning so that children understand their responsibilities according to their roles and do not engage in deviant behavior.

Abstract

One of the strong beliefs among the Madurese community is the inevitability that the child of adultery will inherit the habits of the biological father who committed adultery. This study is called the heredity of the child of adultery. This view is rooted in a tradition that directly links the nature and character of children with heredity. This study uses an empirical legal method with a legal anthropology approach to examine in depth the practice of Madurese rejection of children resulting from adultery (children of adultery). Primary legal materials were obtained from observations and interviews with the Banyubunih Village community. Secondary legal materials were obtained from concepts relevant to the issues in the study. The results of this study identified that the Banyubunih community considers heredity as a very influential factor in determining the nature, character, and behavior of individuals, especially in children of adultery. This belief is based on the principles of biological determinism and hereditary essentialism, which argue that negative traits and deviant behavior are inherited through the "dirty blood" of parents. As a result, children born from extramarital relationships are placed in the lowest social position, without the opportunity to demonstrate their morals and behavior independently

Abstract

The socio-religious tradition of Tajdīd al-Nikāḥ is not merely a ritual, but rather a manifestation of administrative needs, spiritual beliefs, and efforts to strengthen the foundations of the household. This study aims to uncover the practice of Tajdīd al-Nikāḥ in the community, explore the motives behind its implementation, examine its impact on social life, and examine it through the perspective of Islamic law. This research is a qualitative study using empirical legal methods with a case study approach. Data collection techniques were carried out through observation, in-depth interviews with community and religious leaders, and documentation. Data analysis was carried out through data condensation, data presentation, and drawing conclusions. The results reveal that Tajdīd al-Nikāḥ in West Lantek Village is practiced by couples who have been married religiously but have not been registered with the Office of Religious Affairs (KUA). Its implementation is driven by administrative needs, strengthening household relations, and local beliefs regarding the blessings of re-wedding contracts. Within the framework of Islamic law, this practice is considered valid as long as it fulfills the pillars and requirements of marriage, and is in line with sharia principles. Analysis based on the Shafi'i School of Law, 'urf, and Maqashid al-Syari'ah shows that Tajdīd marriage can be accepted as a socio-religious mechanism to maintain lineage, family dignity, and societal stability.

Abstract

In Bangkalan Regency, there is a phenomenon of early engagement where children aged 0-6 years are matched by their parents or families without involving the children. This situation becomes problematic when individuals involved in adult engagements do not find a match, which often leads to the cancellation of the engagement. This cancellation can cause a rift between the couple and the family, and has negative impacts such as the loss of individual freedom, hindered education, and potential psychological trauma. This study highlights the potential risks associated with underage engagement to seek the law on early engagement as it occurs in Bangkalan from the perspective of the Shafi'i school of thought and positive law. The research method in this thesis uses a phenomenological method, to gain an understanding of the social reality that occurs in the community, then examined from the perspective of the Shafi'i school of thought and positive law. The results show that early engagement in Bangkalan Regency is considered halal according to the Shafi'i school of thought and positive law, as long as it meets two conditions: the relationship between a man and a woman who are not mahram, and the woman is not engaged to another person. Although legal, it is recommended that engagements not be conducted with minors to prevent potential detrimental risks.

Abstract

Batik adalah suatu hasil karya yang tidak asing lagi bagi masyarakat Indonesia.Di berbagai wilayah Indonesia banyak ditemui daerah-daerah pengrajin batik. Setiap daerah pembatikan mempunyai keunikan dan kekhasan tersendiri, baik dalam ragam hias maupun tata warnanya. Seiring perkembangan zaman, menurut Sudijono (2006), budaya batik tulis semakin terkikis karena semakin murahnya batik yang dating dari luar negeri dan semakin berkembangnya batik cetak yang bisa memenuhi kebutuhan masyarakat akan kebutuhan batik secara cepat. Tulisan ini bertujuan Untuk mengetahui gambaran Kelompok Ibu-ibu PKK di Desa Bringin, Kecamatan Wajak, Kabupaten Malang, peran, kendala yang dihadapi, dan upaya mengatasi kendala yang dihadapi pada Kelompok Batik Ibu-ibu PKK, Desa Bringin, Kecamatan Wajak, Kabupaten Malang. Kelompok batik Ibu-ibu PKK jika tidak ada permintaan ataupun ada event maka pengrajin tidak akan berproduksi. Program KKN adalah program Kuliah Kerja Nyata dimana mahasiswa diharapkan mampu mengimplementasikan ilmu yang diperoleh secara teoritis menjadi praktis dalam bentuk pengabdian dan pendampingan langsung terhadap masyarakat. dengan adanya potensi yang dimilki oleh Ibu-ibu PKK di Desa Brigin, maka program kerja yang disusun adalah Pelestarian Batik Era Modern untuk memecahkan masalah tersebut. Diharapkan mampu membantu para Ibu-Ibu PKK untuk memperkenalkan produknya dalam skala yang luas serta mengembangkan Batik sesuai dengan Era Modernisasi saat ini. Hal ini merupakan suatu upaya untuk memperkenalkan kepada masyarakat bahwa Batik merupakan ikon asli Indonesia yang harus dilestarikan.

Abstract

Pendidikan Al-Qur'an sangat penting untuk menghasilkan generasi Al-Qur'an yang berakhlak mulia. Penelitian ini dilakukan untuk meninjau penerapan metode Ngalah yang digunakan dalam membaca dan menulis Al-Qur'an di TPQ Al-Hidayah Dusun. Bode. Metode ini dipilih setelah menerapkan berbagai metode namun kurang efektif. Oleh karena itu, peneliti mengulas lebih dalam tentang metode Ngalah yang digunakan dalam kegiatan pembelajaran Al-Qur’an. Penelitian ini merupakan penelitian deskriptif kualitatif yang dilakukan dengan melakukan observasi dan wawancara. Dari observasi yang telah dilakukan dapat diketahui bahwa penerapan Metode Ngalah sangat efektif dalam menunjang kegiatan pembelajaran Al-Qur'an para siswa. Metode tersebut tepat dan cocok untuk meningkatkan kelancaran dan kemampuan dalam proses belajar membaca dan menulis Al-Qur'an di TPQ Al-Hidayah Dusu Bodean.

Abstract

This study highlights the practice of unregistered marriage (sirri marriage) and marriage registration among students of the Salafiyah ad-Damanhuri Islamic Boarding School, viewed from a sociological and Islamic legal perspective. This research is an empirical legal study at the Salafiyah ad-Damanhuri Islamic Boarding School, using unstructured observation and field interviews with respondents, informants, and sources as data collection techniques, data collection through observation and interviews, then analyzed using the interactive analysis model of Miles, Huberman, and Sadanana. The results of this study indicate that in practice, marriages at the Salafiyah ad-Damanhuri Islamic Boarding School are carried out with the female guardian authorizing the kiai to marry his daughter, accompanied by the presence of the guardian and witnesses so that it is religiously valid, but it is still classified as unregistered marriage in the perspective of positive law. The main motivation for carrying out the unregistered marriage is the desire to obtain blessings (tabarrukan). The students register their marriages after the unregistered marriage by performing tajdid nikah at the KUA. Tabarrukan in the marriage contract is permitted, but marriage registration remains essential. The most appropriate method to restore legal recognition of a sirri ‘secret’ marriage is through the marriage confirmation mechanism, ensuring that the marriage is recognized from the outset.

Abstract

Tax transparency is a crucial aspect of modern corporate governance, serving as an indicator of corporate accountability and reputation. This study develops a Tax Transparency Framework, a conceptual framework that integrates financial accounting indicators with Good Corporate Governance (GCG) principles to improve the quality of tax disclosure. The approach used is a literature-based conceptual one, with analysis of accounting standards, tax regulations, and previous research. The results of the study show that effective tax disclosure needs to include quantitative dimensions such as current and deferred tax expenses, fiscal reconciliation, and effective tax rates, as well as qualitative dimensions, including tax policy and regulatory compliance. The integration of accounting indicators and Good Corporate Governance principles produces a framework that functions as an internal control mechanism (agency theory) as well as a means of obtaining social legitimacy (legitimacy theory). This framework provides officers with practical guidance for companies in preparing comprehensive tax reports and serves as a regulatory reference for the development of tax disclosure standards, thereby increasing stakeholder trust and company reputation.
