Abstract

Penelitian ini mengkaji Islam sebagai objek studi dan berbagai pendekatan keilmuan yang digunakan dalam menganalisisnya. Studi Islam mencakup berbagai objek kajian seperti al-Qur’an dan hadits, fiqh, sejarah peradaban Islam, tasawuf, serta aspek-aspek sosial-budaya masyarakat muslim. Dalam konteks global yang semakin kompleks, studi Islam telah berkembang dari pendekatan yang sebagian besar teologis menjadi bidang kajian yang lebih luas dan multidisipliner. Tujuan penelitian ini adalah mengidentifikasi dan menganalisis berbagai objek studi dalam kajian Islam, serta pendekatan-pendekatan keilmuan yang digunakan dalam mengkaji objek-objek studi tersebut. Metodologi yang digunakan adalah analisis literatur atau studi pustaka yang berkaitan dengan objek studi dan pendekatan keilmuan Islam. Hasil penelitian menunjukkan bahwa objek studi Islam telah berkembang meliputi tidak hanya aspek normatif-tekstual tetapi juga historis-kontekstual. Pendekatan keilmuan dalam studi Islam juga telah mengalami perkembangan meliputi pendekatan fenomenologis, antropologis, sosiologis, dan interdisipliner. Integrasi berbagai pendekatan ini membuka peluang untuk pemahaman yang lebih holistik tentang Islam dan objek-objek studinya.

Abstract

This research examines the existence of Islamic Law and Customary Law in Indonesia's national legal system which reflects legal pluralism in a country with high cultural and religious diversity. The purpose of the research is to explore the role and integration of Islamic Law and Customary Law within the national legal framework, particularly in the context of the application of sharia principles and the recognition of customary law communities. This research utilizes a qualitative descriptive method with analysis of documents, legal literature, and relevant legislation, as well as a historical approach to understand theories of legal acceptance such as Receptie and Receptie in Complexu. The results of the analysis show that Islamic Law has gained significant legitimacy, especially through the Compilation of Islamic Law (KHI) which regulates family law and inheritance. Meanwhile, Customary Law is also recognized in Article 18B of the 1945 Constitution as an important part of the national legal system, although its implementation faces modernization challenges. This research finds that the interaction between these two legal systems produces not only challenges but also opportunities to build a national law that is adaptive and responsive to the needs of society. Thenovelty of this research lies in the comprehensive analysis of the dynamics of harmonization of Islamic Law and Customary Law amidst the social and political complexities in Indonesia. This research emphasizes the importance of an inclusive and contextual approach in building a just and sustainable legal system, which accommodates local religious and cultural values.

Abstract

Islamic studies include the study of Islam as a religion and all aspects related to the lives of Muslims. Islam attracts the attention of both Muslims and non-Muslims to be researched from various points of view, thus making it an object of scientific study. Islamic sciences include branches that are directly related to Islamic teachings, such as Ulumul Quran, Ulumul Hadith, Kalam Science, Fiqh Science, and Sufism. Apart from that, there are natural sciences that were born from the Koran's encouragement to investigate the universe, such as biology, physics and astronomy, as well as social sciences and humanities that study humans and their relationships with each other, such as anthropology, sociology and psychology. This variety of study objects has given rise to diverse methods and approaches in the study of Islam. In conclusion, Islam has become a broad object of study because the Koran and Hadith are not only sources of teaching, but also the basic foundation of science.Some of these Islamic sciences are directly related to the implementation of the teachings of Islam as a religion contained in the Koran and the Hadith of the Prophet Muhammad. such as the Sciences of the Koran (Ulumul Quran), Ulumul Hadith, Kalam Science, Fiqh Science, Sufism; there are also those related to the universe as indicated by the Koran to pay attention to and investigate the universe created by Allah, which then gave birth to natural sciences, such as biology, physics, chemistry, astronomy, geography, and others. Abstract

Abstrak: Pendekatan reduksionistik dalam studi agama sering kali memisahkan dimensi-dimensi agama, sehingga gagal menangkap kompleksitas dan kedalaman pengalaman keagamaan. Artikel ini bertujuan untuk mengeksplorasi pentingnya pendekatan integralistik yang mengintegrasikan dimensi ritual, doktrinal, sosial, emosional, naratif, etis, dan material untuk memahami agama secara holistik. Penelitian ini menggunakan metode analisis hermeneutik dan fenomenologis dengan data primer dari literatur klasik, seperti karya William James dan Rudolf Otto, serta data sekunder dari kajian kontemporer. Hasilnya menunjukkan bahwa pendekatan integralistik mampu memberikan pemahaman yang lebih mendalam tentang hubungan antara pengalaman keagamaan dan ekspresinya, mendukung pluralisme agama, dialog antaragama, serta membangun harmoni sosial. Pendekatan ini relevan untuk menjawab tantangan studi agama di masyarakat modern yang kompleks dan pluralisticKata Kunci: Pendekatan, Integralistik, Holistik, Dimensi, Agama.

Abstract

This research aims to review the history of Islamic education in the 19th century in the fields of history, problems and contributions to civilization. To take positive values from the progress of Islamic education in the past and take ibrah/lessons from the factors that trigger the decline of Islamic education. Islamic education aims to form perfect humans, carry out religious teachings, create a generation that believes and is devoted to Allah SWT, does good deeds, has noble character, has knowledge and is able to compete with the progress of the times. This research uses a qualitative method, namely in-depth observation of the history of Islamic education in the 19th century, as well as revealing several figures who have succeeded in laying the foundations of Islamic civilization, in building the ummah, as well as the contributions that have been inherited in the world of education, such as: Muhammad Abdh, Rasyid Ridah, Jamaludin Al Afgani, Fathi al-Fawzan, as well as Indonesian national figures such as Syekh Ahmad Kahtib Al Minangkabawi, KH. Ahmad Dahlan, Hasyim al-'Asy'ari, Rahma El Yunusiyah and others. They were figures who contributed greatly to building Islamic civilization. Islamic education figures contributed to the development of Islam so that it was able to reach the peak of Islamic glory during the Abbasid dynasty as evidenced by the birth of famous Islamic figures such as Al Farabi, Ibnu Sina, Ibn Tufail and left a valuable legacy in science. The contribution of written works from Islamic figures becomes gold work and is very valuable as a reference in the world of education

Abstract

Islamic law is a legal system designed to meet the spiritual and social needs of Muslims. In this study, we will discuss the basis, sources, principles, scope and objectives of Islamic law which functions as a guide to Muslim life. This study aims to understand the role of Islamic law in creating a balance between the interests of individuals and society and achieving social justice. The basis of Islamic law relies on the Al-Qur'an and Hadith as the main sources, complemented by secondary sources such as ijma' (consensus of ulama) and qiyas (analogies) to answer various new problems that are not explicitly regulated in the sacred text. The principles of Islamic law, including the principles of justice, benefit, equality before the law, and individual responsibility, provide the ethical foundation for the just application of the law. The scope of Islamic law includes aspects of worship, muamalah, family law, criminal law, and international law, all of which aim to create a harmonious and just society. Meanwhile, the aim of Islamic law or maqashid al-syari'ah emphasizes the protection of religion, soul, mind, lineage and property, which reflects the primary interest in realizing the welfare of the people. Through a comprehensive understanding, this study hopes to provide in-depth insight into the importance of Islamic law in the context of contemporary life and its role in sustainable moral and social development.

Abstract

This journal article presents a comprehensive analysis of Al-Ahkam Al-Khomsah, a fundamental concept in Islamic jurisprudence that classifies actions into five legal categories: obligatory (wajib), recommended (mandub), permissible (mubah), disliked (makruh), and prohibited (haram). The study explores the traditional Islamic law perspective of these categories, which guide the ethical and legal conduct of Muslims. Additionally, the paper examines how these rulings are interpreted and applied in contemporary contexts, considering the challenges posed by globalization, technological advances, and social changes. The analysis highlights how Islamic scholars have adapted the understanding of Al-Ahkam Al-Khomsah to address modern issues, such as evolving social norms, new technological innovations, and legal systems. Through this exploration, the paper aims to provide a nuanced understanding of how Islamic law continues to shape both individual behavior and societal development in the modern world while remaining rooted in its classical principles. The findings underscore the dynamic nature of Islamic jurisprudence and its capacity to offer relevant guidance in addressing contemporary challenges.

Abstract

The transformation of Islamic justice in Indonesia reflects the dynamics between formal juridical norms and the socio-cultural realities of diverse societies. Religious Courts, as part of the national legal system, do not solely implement Islamic law in a normative form, but must also interact and negotiate with local values, social structures, and broader political and legal configurations. This research critically examines how the integration between Islamic legal norms and socio-cultural traditions occurs in judicial practice, as well as how these interactions affect the effectiveness and legitimacy of Islamic judicial institutions in Indonesia. The juridical-sociological approach is used to explore the relationship between legal norms and the context of society (living law), with an emphasis on aspects of social acceptance and substantive justice. The findings of the study show that although institutionally the Religious Courts have been strengthened, there is still tension between the spirit of codification of sharia law and the flexibility of local culture. In this context, the transformation of Islamic justice is not only a matter of legal reform, but also involves the repositioning of the role of religion, the state, and society in formulating and enforcing contextual justice. Thus, there is a need to strengthen an integrative paradigm in the reform of Islamic law that is able to bridge juridical norms with social reality, in order to strengthen the responsiveness and legitimacy of Islamic justice in the midst of the plurality of laws in Indonesia.

Abstract

This article examines the historical factors that have influenced the growth and development of Islamic law over time. Islamic law, as one of the rich and complex legal systems, is not only influenced by primary normative sources such as the Qur'an and Hadith, but also by the social, political, and cultural dynamics in various regions and historical periods. Through a historical-analytical approach, this research explores various crucial determinants in the evolution of Islamic law, including its interactions with other civilizations, the development of religious thought, as well as political and economic transformations. The findings of this study suggest that the development of Islamic law is not a static phenomenon, but rather an ongoing process that continues to evolve in accordance with its historical context. A deep understanding of these factors is essential for grasping the adaptive nature of Islamic law across different parts of the world, as well as its relevance in addressing contemporary legal challenges
