Abstract

ABSTRACT One problem arising from the use of narcotics and psychotropic substances by children addict. Children are protected by Law No. 3 of 1997 on the Juvenile Court in which action alternative sanction can be applied to children through the law. The question arises what if the addict child which distribute narcotics and psychotropic substances, whether punitive action is done through sanctions. These questions arise because the child is protected by law while the addict must be severely punished by law. Criminal offenses committed by a child should be seen and understood as a social phenomenon, meaning that one should not give a bad stigma or sign that the child is evil for committing a crime, but we must understand and give attention and affection to them. Judicial approach to the child who committed the crime should be closer to the approach persuasive, educational, psychological, which means as far as possible to avoid legal proceedings solely punitive, dropping mental (mental degradation) and face stigmatization that can inhibit the growth and maturity of a reasonable of children.

Abstract

ABSTRACT Law enforcement in narcotics which uses criminal instrument is not the only prioritized policy; the strategies of law enforcement in narcotics such as treatment strategy and rehabilitation strategy are also needed. One of the examples of social rehabilitation centers in North Sumatera is PSPP (Social Rehabilitation Center Pamardi Putra) ‘Insyaf’ of North Sumatera, under the aegis of the Social Ministry of the Republic of Indonesia. It is responsible for carrying out the mandate in the policy of criminal law on the implementation of rehabilitation for drug addicts. The policy of handling (criminal political) crimes was done by using “penal” (criminal law) and non-penal (outside criminal law) facilities. Therefore, penal policy is related to the functionalization in some stages: formulation, application, and execution. The application of the policy in criminal law in implementing rehabilitation for drug addicts is synchronized between written policy planning and service planning for drug addicts. The implementation of social rehabilitation gives legal benefit to drug addicts. Keywords : criminal politicy, criminal law, social rehabilitation, drug addicts

Abstract

ABSTRACT Motor vehicle theft problem in the community is no longer a new thing, because almost every day many cases moto vehicle theft. Location of motor vehicle thefts occur in many places, but generally the same modus operandi. Nowadays, these criminal motor vehicle theft, especially theft is increasing, because the sanction given to the offender the theft of a motor vehicle is considered less severe, so many actors are already free repeat such action. This research is important to know why the highest motor vehicle theft happened in the jurisdiction of Police Sunggal. Furthermore, the data also showed, Crime Settlement (PTP) in Sunggal Police also did not show significant numbers.

Abstract

ABSTRACT Business industry Multi Level Marketing (MLM) is a lucrative market society especially with the promised bonuses obtained upon the sale of its products. However, there are also business masquerading as MLM, low quality products but a bonus for members is very large, so as to make the public flocked to follow the program masquerading as MLM business. The issues raised in this study is whether there is legal provision that can ensnare actors masquerading as MLM business practice is, how do I determine the guise of MLM business practices or is actually MLM company that actually benefit from the sale of its products, and how the criminal responsibility of the perpetrators who commit impersonate MLM business practices whether liability or responsibility inpersoon legal entity (legal entity).

Abstract

ABSTRACT Corruption can take place anywhere, in state institutions, in private institutions, and also in daily life. Combating corruption requires treatment and prevention in an integrated manner with the proper functioning of the legal system of the law and legal institutions in the criminal justice system. Based on the results of this research criminal liability against corruption is the liability of the offenses committed by the offender. Someone will be held accountable for these actions when there is an element in the action against the law and there is no excuse and fault elements must be met in terms of combating corruption. This is due to the principle of liability in criminal law that is not tobe punishment if no fault. Criminal act and criminal liability for acts of corruption in the PKPS BBM-IP activities in Simalungun where to defendant has been proven legally and convincingly, the defendant is able to be responsible and there is no excuse any fault that may negate or justification which can eliminate the unlawful nature of the act, the criminal liability for acts of corruption in the form of sentencing of offenders as set forth in the Supreme Court decision on the appeal. Abstract

ABSTRACT Legislation, which regulates the authority of prosecutors in prosecuting tipikor cases, does not give full authority to prosecutors as the only prosecuting institution although KPK (Corruption Eradication Committee) also has the authority to prosecute tipikor cases. The implementation of handling tipikor cases after the establishment of Tipikor Court of Justice, Banda Aceh, has the implication on the slowness of the bureaucratic process in the District Court, Kuala Simpang, for obtaining the license of arresting, confiscating, searching, and detaining; besides that, it is costly. Progressive efforts made are as follows: budget is increased, hearing schedule is united, some witnesses’ testimony is read before in the hearing, the cases are handled by the same judges, witnesses are examined simultaneously, the number of prosecutors is reduced, and returning the loss of the State is relatively small. It is recommended that the District Attorney’s Office carry out their authority in prosecuting tipikor cases neutral and unbiased. The government should establish Tipikor Court of Justice in every District/Town, and progressive efforts should be focused on the increase in budget. Abstract

ABSTRACT Legal settlement of tax crime specified in section 44B of Act Number 28 of 2007 on the third amendment to the Law No. 6 of 1983 on General Provisions and Tax Procedures (UUKUP) is the grant of authority by law to the Minister of Finance by reason of the interest of the state revenue, requesting the Attorney General to stop the tax crime investigation process. KUP Law Article 44B shows that the actual application of the criminal law violations are not to be Primum remedium, but more oriented to remedium ultimum. This is stated explicitly, although the infringement lawsuit by the taxpayer has been declared complete, but the Minister of Finance can still ask the Attorney General to stop the investigation due consideration to the interests of state revenue, if it has not been declared complete means the Minister of Finance can be directly ruled Directorate General of Tax to stop it.   Keywords: Ultimum Remedium, Tax Crime.

Abstract

ABSTRACT Sanctions provided judges against juvenile offenders is in the form of sanctions measures and sanctions in prison, but within 30 (thirty) decision of the district court examined, the judges are more likely to sanction a prison, whereas criminal sanctions contrary to Child Protection Law. Of 30 (thirty) cases studied judge gives legal considerations through legal facts, facts trial, judgment based on a minimum of two (2) valid evidence, along with confidence, asking the opinion of the Board of Corrections and parents of children , and takes into account aggravating elements as a result of the defendant and the defendant relieve elements. The basic consideration in decisions to judges of juvenile offenders see in terms of the elements of the article have been met and other considerations is that such action can cause public unrest, as well as the obligations of judges in the decision to consider a report on the research community and the opinion of parents, as well as facts law and the facts in the trial are revealed, plus juridical considerations, this will give an overview to for the judge to make a decision that is fair.

Abstract

ABSTRACT Sexual exploitation of children is a serious violation of Human Rights. Handling of this problem is being the main destination countries in the world including Indonesia. Child marriage is one of sexual exploitation crimes againts children, specially to the girls. It has increased year by year. Decision of court with Number 690K/PID.SUS/2010 is one of sexual exploitation of children in the marriage. Based on the survey results revealed that the settings on the prohibition of sexual exploitation in the early marriage is not expressly regulated in the law, but the actions are prohibited. Judge's decision not to accommodate the implementation of the protection of children who are victims of sexual exploitation in the early marriage, because it is concentrated to criminal punishment only. Recommended to the government to immediately assess, formulate, and implement policies abolition of child marriages below the age of criminal sanctions is high, in order to create legal certainty. Revise the Marriage Act by raising the marriage age limit for women. Conduct an education and specialized training to judges on the application of the law of the child, as well as involving them in seminars or forums that discuss the issue of children, in order to create a child protection efforts.

Abstract

ABSTRACT   Formation basis of Restorative Justice’s concept in Indonesia originated from a variety of tribal customary law. As customary of Minangkabau, Mandailing, Toraja, Bali and others have done this concept known as the consensus agreement. Restorative Justice’s concept is also known in 1970 in Canada. Restorative Justice’s concept implemented in Article 7 of Law Number 11 of 2012 by using the Diversion way. Potencies are available when applying Restorative Justice’s concept is the Institutional and Professionals of Law Enforcement Officer substantively has been guaranteed in the Law Number  11 of 2012 added many people who support the implementation of Restorative Justice’s concept in Juvenile Justice System in the foreseeable future. Constraints that will be faced by law enforcement officer is the human resources who have not been able to fulfill what is mandated by law Number 11 of 2012, namely the existence of a Judge, Prosecutor and police for child which is a must in every agencies. Inadequate infrastructure in every law enforcement officer agencies is also an obstacle for the future implementation of the Restorative Justice’s concept, and the legal culture of society that many complained by law enforcement officer that can be complicate the implementation of Restorative Justice’s concept in the Juvenile Justice System.
