Abstract

Restitution for victims of human trafficking has become a fundamental aspect of criminal compensation within the criminal procedure system. While compensation is crucial in aiding victims' recovery, its implementation remains suboptimal. In practice, fines intended for victims often end up being paid to the state rather than serving their original compensatory purpose. This research aims to examine the challenges in fulfilling restitution rights and propose an effective legal framework to ensure that compensation reaches victims as intended. This research employs a normative legal research method, utilizing a legislative synchronization approach and a case-based analysis. The findings indicate that offenders frequently evade their responsibility to pay fines, opting for imprisonment as an alternative sanction. This situation highlights the need to reassess the role of fines and restitution in the penal system to ensure victims' rights are upheld. To enhance the effectiveness of restitution as a penal mechanism, this research recommends the establishment of a standardized victim compensation system. A strategic approach is necessary, incorporating asset tracing and restorative justice principles to enforce offenders’ financial obligations. Law enforcement officers, particularly prosecutors, should adopt a dual strategy of coercion and negotiation to ensure compliance. By implementing asset verification and structured settlements, offenders can be encouraged to fulfill their obligations, thereby fostering a legal system that is balanced, efficient, and victim-centered.

Abstract

The sovereignty over natural resources in Indonesia faces challenges due to foreign corporate ownership, which can undermine national control over these resources (Cotula, 2016). Article 33 of the 1945 Constitution, however, asserts that the management of these resources must prioritize the welfare of the people and be under state control (Miranda, 2012). Illegal mining activities, particularly in Mandailing Natal Regency, have become a serious concern, as they are carried out without proper government permits and contribute to significant environmental degradation (Jacob & Gunadi, 2023). This study aims to examine the factors contributing to illegal mining in the region and the effectiveness of current policies aimed at curbing these activities. Using qualitative methods, including interviews with local miners, this research explores the economic, social, and legal aspects influencing illegal mining. The findings indicate that economic factors, lack of socialization about legal mining regulations, and weak law enforcement are the primary drivers behind illegal mining. The study suggests that raising public awareness and strengthening legal frameworks could significantly mitigate illegal mining activities. Ultimately, this research contributes to improving policy formulations that address illegal mining and its associated impacts on the environment and local economie

Abstract

Human trafficking is a serious global crime, including in Indonesia, where restitution, as financial compensation for victims, plays a crucial role in their recovery and reintegration. This study uses bibliometric analysis to explore research on law enforcement and restitution in human trafficking, aiming to identify trends, key themes, and gaps. Data was gathered from the Scopus database, covering publications from 2000 to 2024. The analysis revealed a rise in human trafficking-related publications, primarily scientific articles. Seven thematic clusters were identified, focusing on law enforcement, victim protection, and sexual trafficking. However, restitution remains underexplored, with only minimal coverage in one weakly connected cluster. Bibliographic coupling and co-citation analysis highlighted key studies and journals in the field. The study concludes that restitution deserves further attention, particularly in terms of policy, challenges, and its impact on victims, to enhance protection and justice efforts.

Abstract

Unsur mensrea dalam penyidikan tindak pidana sangat berperan besar dalam menentukan unsur-unsur tindak pidana dan bukan menjadi unsur pokok yang harus bisa diungkapkan oleh penyidik dalam melakukan penyidikan. Jika unsur mensrea tidak ditemukan bukan berarti kasus tindak pidana harus dihentikan sebagaimana yang telah terjadi dalam penyidikan terhadap tindak pidana KDRT dalam Putusan Pengadilan Negeri Medan Nomor. 84/Pid.Pra/2016/PN Mdn. Tujuan penelitian ini adalah untuk menganalisis kedudukan unsur mensrea dalam proses penyidikan. Metode penelitian ini menggunakan jenis penelitian hukum normatif atau doktriner. Metode pendekatannya menggunakan pendekatan Undang-Undang (status approach) dan pendekatan kasus (Case Approach) dan dianalisis dengan metode analisis data kualitatif. Hasil penelitian menemukan bahwa kedudukan unsur mensrea dalam proses penyidikan di Indonesia adalah sangat penting untuk menentukan Pasal yang tepat yang disangkakan pada pelaku. Unsur kesalahan dapat terpenuhi jika unsur mensrea dapat ditemukan dalam tindak pidana yang dilakukan. Adapun indikator untuk mengukur unsur mensrea pelaku tindak pidana dapat dilihat dari indikator tujuan (purpose/intent), pengetahuan (knowledge), kecerobohan (recklessness), kelalaian (negligence).
