Abstract

This research aims to analyze the legal considerations of judges in legal protection for buyers in good faith when buying and selling land rights which are confirmed by court decisions and the Supreme Court decision. The research method used in this research is a normative juridical approach research method, the author summarizes the Selong District Court Decision, the Mataram High Court Decision and the Supreme Court Decision. Based on the results of the research, it shows that the meaning of good faith is a buyer who buys and sells land using valid procedures/procedures and documents as determined by statutory regulations and is careful by examining matters relating to the land object being agreed upon. Legal protection for buyers with good intentions is that the Panel of Judges decides the validity of the sale and purchase carried out by the buyer. Before carrying out a land sale and purchase transaction, every prospective buyer must check the land they want to buy to ensure that there are no disputes regarding the object, ensure that the seller is the original owner of the object, it would be better for the House of Representatives to make clear regulations regarding the criteria for buyers in good faith. and firm.

Abstract

In this trading activity, it is hoped that there will be a balance between the rights and obligations of business actors and consumers. For this reason, studying the implementation of private responsibilities of business actors in fulfilling consumer rights in terms of positive law in Indonesia is an interesting thing to study. The objectives of this research are 1) to find out and analyze the private responsibility of employees and companies for consumer losses in terms of positive law in Indonesia; and 2) to find out the judge's legal reasoning regarding consumer dispute decisions in the PN.Sel decision Number 9/Pdt.G.S/2020/PN.Sel. This study uses doctrinal normative legal research, namely a process for finding legal rules, legal principles, and legal doctrines to answer the legal issues faced. The approach used to obtain data for analysis is first, the statutory approach, second, the legal case study approach, third, the conceptual approach. This study uses qualitative data analysis, where the data is analyzed using descriptive analysis methods. From the results of the discussion, it was concluded that 1) The private responsibility of employees and companies for consumer losses in terms of positive law in Indonesia should be rejected from the start because Defendant I is a subject domiciled in Jakarta who should be a co-Defendant, and Defendant II became Defendant I, where Defendant one had no legal relationship because Defendant I was only the employer of Defendant II. The defendant cannot make an exception in accordance with the provisions of Article 20 of Supreme Court Regulation Number 4 of 2019 concerning Amendments to Supreme Court Regulation Number 2 of 2015 concerning Methods for Settlement of Simple Claims; and 2) The decision in case Number 9/Pdt.G.S/2020/PN.Sel should be rejected, because Defendants one and two are unclear in accordance with the Plaintiff's claim and there is a discrepancy regarding the position of Defendants I and Defendants II, so that the Panel of Judges handling this case must be based on the concept of Legal reasoning.

Abstract

Iron sand mining in the Dedalpak Block began in 2009 where the authority to grant mining permits ranging from mining business permits (IUP) exploration to mining business permits (IUP) for production operations was issued by the Regent of East Lombok by adhering to article 37 of Law Number 4 of 2009. However, with the enactment of Law Number 32 of 2014 Challenging Regional Governments, the authority of the iron sand mining permit was taken by the NTB Provincial Government, then with the presence of Law Number 3 of 2020 the authority for iron sand mining business licenses by PT. AMG was taken over by the Centre. In its implementation, iron sand mining by PT. AMG with the enactment of Law Number 3 of 2020 has a significant impact on the mining licensing process for iron sand production in the Dedalpak block of East Lombok, where the central government through the Director General of Energy and Mineral Resources requires thirteen conditions so that the IUP for production operations can be obtained by PT. AMG. The company, however, has not been able to meet five requirements, so its license was suspended. Another impact, the community in the Dedalpak block circle resisted by going to race through a series of protests for the mining to be closed, because it caused a large environmental impact.

Abstract

An ethics-based information security system based on Immanuel Kant's transcendental legal paradigm can give a strong foundation for tackling moral quandaries in AI, hacking, and information systems. Lavanya Singh highlights the necessity of instinctive ethics based on philosophical literature and presents a Kantian ethics application that adheres to the philosophical tradition. Meanwhile, Sanchita Saha et al. address ethical hacking as a method of disclosing vulnerabilities in information systems for the benefit of society, emphasizing ethical concerns in cybersecurity operations. Furthermore, Flávia Maria Santoro and Rosa Maria Esteves Moreira da Costa underline the significance of examining information systems via an ethical lens in order to negotiate conceptual conflicts and make informed judgments in delicate situations, which is consistent with Kant's moral philosophy. Using doctrinal research methodologies with legal material sources derived from literature studies and qualitative descriptive analysis. This study discovered that by incorporating Kant's concepts into information security systems, the transcendental legal paradigm may guide ethical decision making and promote responsible technological advancement. The Ethics-Based Information Security Systems Act, modeled after Immanuel Kant's Transcendental Paradigm, would prioritize universal ethical principles, respect for human autonomy, duty-bound behaviors, transparency, accountability, and a structured regulatory framework. The law will guarantee that information security is maintained not just through technological means, but also via a solid ethical foundation that respects the dignity and rights of all those concerned.

Abstract

Cases of violations of child protection. Of the reports received, 837 cases occurred within the education unit, including: Children who were victims of bullying or harassment: 87 cases, Children victims of educational policies: 27 cases, Children victims of physical and/or psychological violence: 236 cases and Children victims of sexual violence: 487 cases. From data collected by the Indonesian Child Protection Commission (KPAI) and the Federation of Indonesian Teachers' Unions (FSGI), bullying cases are still a terror for children in the school environment. Meanwhile, the types of bullying that victims often experience are physical bullying (55.5%), verbal bullying (29.3%), and psychological bullying (15.2%). Meanwhile, regarding educational level, elementary school students were the most victims of bullying (26%), followed by middle school students (25%), and high school students (18.75%). The aim of this service is to provide education to participants in community service activities so that bullying does not occur at school. The method used is a socialization method carried out face to face. The results are 50%. Orphaned children do not understand the limits of bullying itself, and their rights as children and citizens, despite the social and economic disparities they have. Some of the orphanage children are still insecure about their condition of not having parents, or having incomplete parents. So they tend to tolerate what happens to them, because they are not aware of these rights and also their own condition.

Abstract

Alat bukti adalah segala sesuatu yang dapat dipakai untuk membuktikan. Dalam hukum acara perdata didasarkan oleh Pasal 164 HIR dan 284 Rbg serta Pasal 1886 KUHPerdata. Sementara Alat Bukti Elektronik dapat dihadirkan dalam persidangan sebagai alat bukti yang sah dan telah diatur tersendiri dalam UU ITE. Namun, dalam Hukum Acara Perdata belum diatur secara legalitas formilnya. Tujuan dilkaukannya penelitian ini adalah untuk mengetahui bagaimana kedudukan Alat bukti elektronik dalam perkara perdata dan Bagaimana jaminan kepastian hukum Alat Bukti Elektonik dalam Hukum Acara Perdata. Jenis penelitian yang digunakan yaitu yuridis normatif. Kesimpulan dari penelitian ini adalah: (1) kedudukan alat bukti elektronik dalam Hukum yang ada di Indonesia sah, juga kekuatan alat bukti elektronik dipersamakan dengan dokumen yang dibuat diatas kertas. dan (2) Undang-Undang No. 19 Tahun 2016 Tentang Informasi dan Transaksi Elektronik (UU ITE) yang hanya memberikan kepastian hukum sebatas pengakuan eksistensi Alat Bukti Elektronik sebagai alat bukti yang sah. Harus ada pengaturan yang ideal mengenai Alat Bukti Elektronik dalam Hukum Acara Perdata untuk menjamin kepastian hukum tata cara penyerahan dan keberlakuannya ialah: pertama, dengan mekanisme pembaharuan HIR dan RBg. Kedua, pihak yang berwanang menetapkan Surat Edaran Mahkamah Agung mengenai cara para pihak mengetahui dan melihat Alat Bukti Elektronik dan tata cara penyerahan Alat Bukti Elektronik.

Abstract

ABSTRACT  Purpose of study: This study aims to analyze the conflict of norms in the Regulation of the Minister of Manpower Number 18/2022 and Government Regulation Number 36/2022 on the Minimum Wage Determination Method. As a result of the conflict, losses will be borne by business actors on the increasing minimum wage based on Government Regulation Number 36/2021 and the Regulation of Minister of Manpower Number 18/2022. This creates legal uncertainty for business actors and laborers. Methodology: This study was conducted using the normative (doctrinal) research method with the approach of legislation and legal reasoning. Data sources were taken from primary legal materials, secondary legal materials, and tertiary legal materials using descriptive analysis and analytical critical thinking. Results: The Regulation of the Minister of Manpower contradicts the Law on Manpower in conjunction with Law on Job Creation. The conflict rose because the Manpower Law in conjunction with the Job Creation Law, has limited some of the additional advances of the Wage Determination Law to only the Government Regulation level. Special subjects are: 1) the procedure of the minimum wage regulation; and 2) the formula of the minimum wage calculation. On the judicial review, the judges declared the objection to the judicial review of the petitioner unacceptable. The lawsuit was deemed premature because the Regulation in lieu of Job Creation Law has not reached inkracht (permanent legal force). Applications of this study: This will be useful and beneficial for the development of legal science, especially aspects of legal reasoning involving court decisions. The results are also practical for businesses and laborers when using the methods of determining the legal and fair minimum wage. Novelty/Originality of this study: Judge's Legal reasoning in decision number 72 P/HUM/2022 on Minimum wage was not one of the objection points of the petitioners or the answer to them. A judicial decision outside of a lawsuit, or so-called ex parte decision, is a decision taken by the court without involving the parties to the trial. Keywords: Characteristics of Judge's Decision, Judicial Review, Minimum Wage Method  ABSTRAK  Tujuan: Untuk menganalisis pertentangan norma pada Permenaker Nomor 18/2022 dengan PP Nomor 36/2021, materi pokoknya terkait metode penetapan upah minimum. Akibat pertentangan tersebut, maka kerugian bagi pelaku usaha terhadap perbandingan kenaikan upah minimum berdasarkan PP 36/2021 dengan Permenaker 18/2022. Hal tersebut berdampak kepada ketidakpastian hukum bagi pelaku usaha dan pekerja. Metodologi: Metode penelitian normative doctrinal, dengan pendekatan Perundang-undangan, dan pendekatan penalaran hukum. Sumber data berasal dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Menggunakan analisis deskriptif analitis dan critical thinking. Temuan: Ketentuan Permenaker bertentangan dengan UU Ketenagakerjaan juncto UU Cipta Kerja. Pertentangan tersebut, karena UU Ketenagakerjaan juncto UU Cipta Kerja telah membatasi beberapa pengaturan lanjutan dibawah UU terkait pengupahan hanya pada tingkat PP. Berlaku materi muatan yaitu: 1) tata cara penetapan upah minimum; dan 2) formula perhitungan upah minimum. Pada uji materiil, putusan Hakim, Menyatakan permohonan keberatan hak uji materiil dari Para Pemohon tersebut tidak dapat diterima. Gugatan dianggap masih premature, karena Perpu Cipta Kerja belum incrah. Kegunaan: Berguna dan bermanfaat bagi pengembangan ilmu hukum, khususnya aspek penalaran hukum dengan objek kajian putusan pengadilan. Berguna bagi pelaku usaha dan pekerja dalam pemilihan metode penetapan upah minimum, yang berkepastian hukum dan berkeadilan Kebaruan/Orisinalitas: Legal reasoning hakim pada putusan nomor 72 P/HUM/2022 tentang Upah Minimum, bukan merupakan salah satu poin keberatan para pemohon maupun poin jawaban dari termohon. Putusan Hakim, diluar gugatan atau disebut ex parte decision, yaitu keputusan yang diambil oleh pengadilan tanpa melibatkan para pihak dalam persidangan.   Kata Kunci: Karakteristik Putusan Hakim, Uji Materiil, Metode Upah Minimum

Abstract

The decision is a written legal text made by an authorized judge, and its legal product is categorized as a crown. However, despite being considered a crown, a judge's decision is not exempt from examination by legal scholars. The optics used in the examination process are based on various perspectives, including hermeneutics as the fundamental basis for interpreting the text (decision). Substantively, hermeneutics has three main streams of thought, namely as a theoretical (methodological), philosophical, and critical hermeneutics, each with different understandings. Hermeneutics as a method focuses more on the effort to capture and reveal the meaning of the text, while philosophical hermeneutics goes beyond that and emphasizes "capturing meaningful meaning," implying that the meaning of the text can be continuously produced through a dialectical process. On the other hand, critical hermeneutics focuses on the aspect of disclosing the meaning of the author's ideological interests. This research aims to examine the legal reasoning in Decision No. 272 / PDT.G / 2017 / PN.BDG regarding the Government Procurement Contract Guarantee Claim from the perspective of Hans Georg Gadamer's Hermeneutic Circle. The research type is normative doctrinal, using secondary data sources consisting of primary, secondary, and tertiary legal materials with a conceptual approach, statutory approach, and case study. The research findings suggest that the process of claiming a bank guarantee through the judicial institution can be carried out by the Procurement Committee (PPK) as long as they obtain authorization from the Budget User, who is the owner of the work (bouwheer). This is due to the hybrid nature of government procurement contracts, which distinguishes them from private contracts, and the clarity of the scope of authority of the Budget User serves as the establishment of formal justice, acting as a bridge (epistemology) toward substantive justice.

Abstract

Tujuan penelitian adalah untuk mengetahui dan memahami Kebijakan Hukum Pidana terhadap Proses Merariq dalam Perspektif KUHP 2023. Bagaimana Aspek kepastian hukum proses merariq berdasarkan KUHP 2023 dan bagaimana proses merariq pada Masyarakat sasak dan kaitannnya dengan perbuatan pidana, Penelitian dilakukan denganm pendekatan yuridis normatif. Kesimpulan dari penelitian ini adalah: 1 Di dalam hukum pidana ada 2 (dua) hukum yang berbeda yang digunakan oleh masyarakat yaitu hukum pidana yang bersumber pada peraturan tidak tertulis (hukum pidana adat) dan hukum yang bersumber pada KUHP dan peraturan undang-undang yang tertulis lainnya. 2 Hukum pidana adat mengatur tindakan yang melanggar keadilan dan keamanan di tengah masyarakat sehingga menyebabkan terganggunya ketentraman serta keseimbangan masyarakat untuk memulihkan ketentraman dan keseimbangan tersebut maka dibutuhkan suatu aturan yang mengatur tentang delik adat. Hukum pidana adat adalah hukum yang hidup (living law) dan akan terus hidup selama ada manusia dan budaya dan tidak akan dapat dihapus dengan peraturan parundang-undangan yang tertulis. Andaikata ada undang-undang yang menghapus peraturan hukum pidana adat maka hukum pidana perundang-undangan akan kehilangan sumber kekayaannya oleh karena hukum pidana adat lebih erat hubungannya dengan antropologi dan sosiologi daripada perundang-undangan.

Abstract

The rapid development of global tourism involves various social aspects, including the local wisdom of a nation. In tourism, local wisdom holds a dual role: on one hand, it adds cultural depth and uniqueness to tourism promotion; on the other, it faces the threat of degradation due to the influence of Western values brought by foreign tourists. This study investigates the role of local wisdom in the development of tourism law in Lombok, a region designated as a National Strategic Project in tourism. The research was conducted in the Kuta Mandalika Special Economic Zone, Central Lombok, and analyzed using a normative-empirical approach. The results showed that local wisdom can significantly influence tourism law, particularly in legal substance, structure, legal culture, and dispute resolution mechanisms. Implementing tourism law development policies based on local wisdom can help preserve tourism assets, transform local wisdom into regional regulations, resolve disputes, and improve tourism safety and order. This research is expected to contribute significantly to future legal frameworks, underscoring the importance of integrating local knowledge into formal legal systems, ensuring cultural heritage preservation and sustainable tourism advancement.
