Abstract

Muhammadiyah has a tradition of maintaining political independence as a civil society organization, while simultaneously playing an active role in Indonesian national life. In the post-reform context, the involvement of Muhammadiyah elites in PAN presents a dialectic between the principle of organizational neutrality, the dynamics of political elites, and the practice of structural accommodation within the party. This relationship is important to examine to understand the patterns of interaction between civil society organizations and political parties in Indonesia's democratic system. This study uses a qualitative descriptive design with the aim of clarifying in depth, detail, and intensively Muhammadiyah's political activities and movements within PAN. Data are analyzed through the paradigms of civil society and political party relations. This approach is strengthened by the theory of political relations as the main framework and the theory of the relationship between religion and state as a supporting foundation. The results show that Muhammadiyah's neutral stance towards political parties, as decided at the 38th Congress in Makassar in 1971, continues to be maintained. In post-reform political practice, Muhammadiyah views PAN as a strategic partner through collaborative or participatory relations. PAN implements a structural accommodation strategy by involving Muhammadiyah cadres in the central level management of around thirty percent, as well as cultural accommodation through religious, educational and social activities that are in line with the party's Articles of Association, while simultaneously carrying out the functions of communication, political education and controlling social conflict.

Abstract

Pelayanan publik di tingkat kelurahan sangat dipengaruhi oleh kualitas sumber daya manusia (SDM), khususnya dalam aspek komunikasi layanan kepada masyarakat. Aparatur kelurahan berperan sebagai ujung tombak pelayanan publik yang dituntut memiliki kemampuan komunikasi yang tidak hanya efektif, tetapi juga empatik dan humanis. Namun demikian, masih ditemukan pola komunikasi aparatur yang bersifat formal dan kaku, sehingga interaksi dengan masyarakat belum sepenuhnya mencerminkan pelayanan yang ramah dan responsif. Kegiatan Pengabdian kepada Masyarakat (PKM) ini bertujuan untuk memperkuat peran SDM aparatur Kelurahan Kedaung, Kecamatan Sawangan, Kota Depok melalui peningkatan pemahaman, kesadaran, dan keterampilan komunikasi layanan yang humanis. Metode pelaksanaan kegiatan dilakukan selama tiga hari dengan pendekatan partisipatif dan interaktif yang meliputi penyuluhan, pelatihan, simulasi, serta evaluasi. Materi kegiatan mencakup konsep komunikasi empatik, etika pelayanan publik, teknik komunikasi efektif, serta strategi menghadapi karakter masyarakat yang beragam. Hasil kegiatan menunjukkan adanya peningkatan pemahaman aparatur terhadap pentingnya komunikasi humanis serta perubahan sikap dalam pola komunikasi yang lebih ramah, terbuka, dan berorientasi pada kepuasan masyarakat. Kegiatan ini diharapkan mampu mendorong terwujudnya pelayanan publik yang profesional, efektif, dan berlandaskan nilai-nilai kemanusiaan.

Abstract

Corruption is an extraordinary crime that requires a progressive legal approach, including in the process of legal discovery by judges. The complexity of the methods and the development of state losses mean that the application of laws does not always provide certainty in resolving cases. Therefore, legal reasoning is a crucial instrument for emphasizing the principles of justice, certainty, and expediency. This study aims to analyze the legal discovery model in corruption cases and how judges construct legal arguments in their decisions. The research method uses a normative legal approach through analysis of laws, legal principles, and court decisions. The results of the study indicate that legal discovery is necessary in corruption cases involving legal loopholes, multiple interpretations of state losses, and indirect evidence. Legal reasoning can strengthen the legitimacy of decisions and serve as the basis for responsive legal development.

Abstract

The narcotics problem in Indonesia continues to rise, with one-third of inmates convicted of drug offenses. This study analyzes the implementation and challenges of the rehabilitation program at the Class IIB Correctional Institution of Lubuk Pakam using a normative-empirical juridical approach. The program follows relevant regulations through WHO-ASSIST screening, assessment, staged rehabilitation, and post-rehabilitation. Cooperation with the Titian Harapan Indonesia Foundation has proven effective, with 85% of participants experiencing improved quality of life. Main obstacles include limited qualified personnel, infrastructure, coordination, and funding. Optimization requires capacity building, infrastructure improvement, partnership expansion, and increased financial support.

Abstract

Artikel ini mengkaji penalaran hukum hakim dalam menafsirkan unsur melawan hukum pada tindak pidana korupsi sebagaimana diatur dalam Undang-Undang Nomor 31 Tahun 1999 jo. Undang-Undang Nomor 20 Tahun 2001. Unsur melawan hukum memiliki peran sentral dalam pembuktian perkara korupsi, dan seringkali menimbulkan perdebatan karena cakupannya yang meliputi dimensi formil maupun materiil. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Hasil penelitian menunjukkan bahwa hakim dalam putusan tindak pidana korupsi menggunakan variasi metode penalaran hukum seperti penafsiran sistematis, historis, dan progresif dalam menilai terpenuhinya unsur melawan hukum, khususnya ketika perbuatan dilakukan melalui penyalahgunaan kewenangan. Penalaran hukum tersebut memberikan implikasi yang signifikan terhadap pembuktian unsur melawan hukum, memperluas ruang pembuktian bagi jaksa, namun tetap menuntut konsistensi pertimbangan hakim untuk memastikan kepastian hukum dan keadilan dalam praktik peradilan.

Abstract

This study aims to analyze the application of the Integrated Assessment Team (TAT) to suspects suspected of being narcotics abusers at the National Narcotics Agency (BNNK) of Langkat Regency from a juridical perspective. TAT is a mechanism formed based on Law Number 35 of 2009 concerning Narcotics, by involving medical and legal elements to provide recommendations for appropriate treatment for narcotics abusers. The procedure for implementing TAT starts from submitting an assessment application by investigators, administrative examinations, medical and legal assessments, to determining recommendations in the form of medical and social rehabilitation or follow-up legal processes. The results of the study show that the implementation of TAT at BNNK Langkat in general is in accordance with the provisions of the law, where most suspected narcotics abusers are recommended to undergo rehabilitation. However, several obstacles were still found, including the limitations of rehabilitation facilities, differences in perception between TAT elements, and public stigma against narcotics abusers. Therefore, the existence of TAT is very important to realize more humane, proportional, and fair law enforcement, while supporting rehabilitation efforts for narcotics abusers in Lalat Regency.

Abstract

The content of the Red and White Cauldron video on the Bobon Santoso YouTube Channel on March 5, 2024, is entitled "Justice Is Not Here! Merah Putih Muyu Tribe, Boven Digoel. It conveyed an interesting message by raising issues among the people of South Papua. The intentions, goals, and discourses captured in the culinary content reflect sentiments and feelings about the state of the people of South Papua through materials, including cooking activities. This study aims to analyse three aspects of the conversation: text structure, social cognition, and social context. The analysis of the critical discourse of Teun A. Van Dijk was used in this study. Auditory observation and documentation procedures are used to examine the data after the dialogue of the episode is transcribed. The analysis findings reveal a text structure built on micro, super, and macro structures. These structures support the overall discussion and include stylistic, syntactic, rhetorical, and semantic components. The social cognition analysis explores the situation of the people of South Papua, which is part of the Republic of Indonesia, from various perspectives. And in the social context, this analysis conveys that the problem in South Papua has existed for a long time and has not been seriously resolved by the Government.

Abstract

The enactment of Law No. 27 of 2022 on Personal Data Protection (PDP Law) marks a significant milestone in efforts to strengthen legal protections for consumers’ personal data in Indonesia. These regulations on personal data protection are expected to bring Indonesia on par with developed nations that have implemented personal data protection laws, such as the European Union with its General Data Protection Regulation (GDPR). This will further promote and strengthen Indonesia’s position as a trusted business hub, which is a key strategy in Indonesia’s national economy. The obligation to implement adequate security measures is a crucial aspect of e-commerce platforms’ responsibilities, encompassing the implementation of technical, organizational, and administrative security measures. Technically, e-commerce platforms are required to implement data encryption, multi-layered authentication systems, real-time security monitoring, regular data backups, and incident response mechanisms. Prior to the enactment of Law No. 27 of 2022 on Personal Data Protection (PDP Law), Indonesia faced a legal vacuum in regulating the specific responsibilities of digital platform operators regarding personal data security. Reliance on Law No. 11 of 2008 on Electronic Information and Transactions (EIT Law), which is of a general nature, has proven inadequate to address the complexities of data protection issues in the digital era.
