Abstract

The imposition of sentences below the minimum sentence limit in narcotics cases is a serious problem in criminal law enforcement in Indonesia. This study aims to analyze the causes of disparities in judges' decisions in narcotics cases, examine the provisions for imposing sentences below the minimum sentence limit, and explore the basis for judges' considerations in Supreme Court Decision Number 3061K/Pid.Sus/2024. This study uses a normative juridical approach with decision analysis as a case study. The results show that judges' freedom to interpret the law can result in decisions that deviate from the minimum sentence stipulated by law, which ultimately can create legal uncertainty and reduce the deterrent effect in narcotics law enforcement.

Abstract

According to the Law of the Republic of Indonesia Number 22 of 2009 concerning Traffic and Road Transport, The Regulation of the National Police of the Republic of Indonesia (Perpol) Number 8 of 2021 governs the Handling of Criminal Acts Based on Restorative Justice. This regulation aims to resolve criminal cases by prioritizing the restoration of relationships between perpetrators and victims, as well as involving relevant parties to reach a fair agreement, rather than merely focusing on retaliation or punishment. Based on this, this research focuses on the formulation of problems that include: (1) how the regulation of restorative justice principles in handling assault cases at the Teluk Mengkudu Police Station; (2) how the implementation process of restorative justice principles during the investigation stage of assault cases at the Teluk Mengkudu Police Station; and (3) what obstacles and solutions exist in the implementation of restorative justice during the investigation of assault crimes in that area. Based on research findings, the implementation of a restorative justice approach in handling acts of violence at the Teluk Mengkudu Police Station can be applied to minor assault cases, particularly when there is a peace agreement between the victim and the perpetrator. The reconciliation process is facilitated through mediation by law enforcement officials and local community leaders. However, in practice, investigators face several obstacles, including: demands from the reporting party that exceed the perpetrator's capacity; the perpetrator being a recidivist of previous offenses; the victim refusing to reconcile; and a lack of cooperative attitudes from both parties. Furthermore, prior conflicts between the perpetrator and the victim also hinder the resolution of cases through restorative justice approaches.

Abstract

The content of the Red and White Cauldron video on the Bobon Santoso YouTube Channel on March 5, 2024, is entitled "Justice Is Not Here! Merah Putih Muyu Tribe, Boven Digoel. It conveyed an interesting message by raising issues among the people of South Papua. The intentions, goals, and discourses captured in the culinary content reflect sentiments and feelings about the state of the people of South Papua through materials, including cooking activities. This study aims to analyse three aspects of the conversation: text structure, social cognition, and social context. The analysis of the critical discourse of Teun A. Van Dijk was used in this study. Auditory observation and documentation procedures are used to examine the data after the dialogue of the episode is transcribed. The analysis findings reveal a text structure built on micro, super, and macro structures. These structures support the overall discussion and include stylistic, syntactic, rhetorical, and semantic components. The social cognition analysis explores the situation of the people of South Papua, which is part of the Republic of Indonesia, from various perspectives. And in the social context, this analysis conveys that the problem in South Papua has existed for a long time and has not been seriously resolved by the Government.

Abstract

Correctional Institutions (Lapas) are institutions that not only function as a place for carrying out criminal acts, but also as a place for fostering prisoners. However, the heterogeneity of social, cultural, and character backgrounds of prisoners often triggers conflicts within the prison environment. Conflicts between prisoners can disrupt security stability and hinder the fostering process that should run conducively. Therefore, the role of Correctional Institution officers is very important in preventing, handling, and resolving conflicts that occur. This article aims to analyze the role of prison officers in handling conflicts between prisoners and formulate strategies to optimize these roles. The research method used is qualitative with a literature study approach and interviews with a number of prison officers. The results of the study indicate that optimizing the role of officers can be done by improving communication competencies, mediation, and understanding of the psychological dynamics of prisoners, as well as the formation of a conflict management team in the prison environment. Thus, it is hoped that a safer and more conducive atmosphere will be created to support the fostering process within the prison.

Abstract

Penelitian ini bertujuan untuk merancang Kawasan Pelatihan Taktis Reserse Kriminal di Gorontalo dengan pendekatan arsitektur perilaku. Kawasan ini dirancang dengan tujuan sebagai fasilitas pelatihan yang mendukung pengembangan keterampilan dan bagi anggota Kepolisian yang bertugas sebagai reserse kriminal maupun anggota melalui simulasi berbasis skenario. Pendekatan arsitektur perilaku digunakan untuk menciptakan lingkungan pelatihan berbasis skenario terhadap kebutuhan aktivitas pelatihan, yang mendorong pengembangan kemampuan berpikir kritis dan pemecahan masalah di lapangan, dan pengambilan keputusan. Proses perancangan melibatkan analisis kebutuhan ruang berdasarkan perilaku pengguna, studi kasus fasilitas pelatihan serupa, serta wawancara dengan pihak kepolisian dan ahli terkait. Hasilnya adalah konsep desain yang mencakup elemen fungsional, psikologis, dan estetika. Desain ini juga memperhatikan aspek keamanan, juga melatih pemikiran, respon terhadap konflik, pengendalian emosi serta profesionalisme. Dengan pendekatan arsitektur perilaku, fasilitas ini diharapkan mampu meningkatkan kualitas pelatihan anggota, memperkuat koordinasi tim, serta mendukung efektivitas tiap individu yang mengikuti pelatihan untuk menyelesaikan tiap kasus kriminal dengan integritas, transparansi, dan ketegasan dalam penegakan hukum. Konsep ini juga berpotensi menjadi model bagi pengembangan fasilitas serupa di wilayah lain.

Abstract

Asma bronkial merupakan penyakit pernapasan kronis yang ditandai dengan serangan sesak napas yang berulang dan bersifat reversibel. Pengelolaan asma tidak hanya bergantung pada terapi farmakologis, namun juga memerlukan intervensi nonfarmakologis seperti teknik relaksasi napas dalam yang terbukti dapat meningkatkan ventilasi paru dan mengurangi kecemasan. Penelitian ini bertujuan untuk mengetahui efektivitas teknik relaksasi napas dalam terhadap penurunan sesak napas dan peningkatan kontrol asma pada pasien asma bronkial. Penelitian ini menggunakan desain quasi-eksperimen dengan pendekatan pretest- posttest one group. Populasi yang terdapat pada penelitian ini yaitu 43 responden dan teknik pengambilan sampel pada penelitian ini menggunakan purposive sampling sehingga sampel sebanyak 30 responden. Intervensi berupa teknik relaksasi napas dalam yang dilakukan selama 7 hari. Pengukuran dilakukan menggunakan skala borg untuk menilai tingkat sesak napas dan Asthma Control Test (ACT) untuk mengukur tingkat kontrol asma. Data dianalisis menggunakan uji Wilcoxon Signed Rank Test dan Korelasi Spearman rho. Hasil penelitian menunjukkan adanya penurunan signifikan pada skor Borg dari rata-rata 8,33 menjadi 1,27 (p < 0,001) dan peningkatan skor ACT dari rata-rata 8,67 menjadi 22,20 (p < 0,001). Terdapat hubungan negatif yang kuat antara skor borg dan skor ACT (r = -0,872; p < 0,001). Kesimpulannya, teknik relaksasi napas dalam efektif dalam menurunkan sesak napas dan meningkatkan kontrol asma pada pasien asma bronkial. Intervensi ini dapat direkomendasikan sebagai terapi pendamping dalam manajemen asma.

Abstract

Aceh is a province with special status in Indonesia that has special authority in the imple- mentation of Islamic law, as stipulated in Law No. 11 of 2006 concerning the Government of Aceh. One form of its implementation is Qanun Aceh No. 6 of 2014 on Jinayat Law, which regulates a number of offences, including maisir (gambling), with penalties in the form of flogging, fines, or im- prisonment. This study aims to examine the application of flogging for maisir offenders in Simeulue Regency, covering the legal basis, implementation procedures, and level of effectiveness. The research questions include: (1) how flogging is applied to maisir offenders; (2) what are the stages of implemen- tation; and (3) to what extent is it effective in reducing violations. The research uses a qualitative de- scriptive method with a socio-legal approach. Data was obtained through literature review, field obser- vation, and interviews with Satpol PP and Wilayatul Hisbah officials, the Sharia Court, the prosecutor's office, and community leaders. The findings show that the application of flogging has a strong consti- tutional basis and is in accordance with the principles of Sharia law. The punishment is carried out openly in accordance with criminal procedure law and under the supervision of medical personnel. Statistics from the last five years show a decline in gambling cases from 11 cases in 2020 to 3 cases in mid-2024, reflecting a deterrent effect and increased public awareness of the law. However, obstacles such as limited human resources, supporting facilities, and cultural factors remain challenges. Overall, flogging is considered effective in reducing gambling offences, but institutional strengthening, inter- agency coordination, and continuous legal socialisation are still needed.

Abstract

This study aims to analyze the application of the Integrated Assessment Team (TAT) to suspects suspected of being narcotics abusers at the National Narcotics Agency (BNNK) of Langkat Regency from a juridical perspective. TAT is a mechanism formed based on Law Number 35 of 2009 concerning Narcotics, by involving medical and legal elements to provide recommendations for appropriate treatment for narcotics abusers. The procedure for implementing TAT starts from submitting an assessment application by investigators, administrative examinations, medical and legal assessments, to determining recommendations in the form of medical and social rehabilitation or follow-up legal processes. The results of the study show that the implementation of TAT at BNNK Langkat in general is in accordance with the provisions of the law, where most suspected narcotics abusers are recommended to undergo rehabilitation. However, several obstacles were still found, including the limitations of rehabilitation facilities, differences in perception between TAT elements, and public stigma against narcotics abusers. Therefore, the existence of TAT is very important to realize more humane, proportional, and fair law enforcement, while supporting rehabilitation efforts for narcotics abusers in Lalat Regency.

Abstract

Indonesia as a country based on law based on Article 1 paragraph (3) of the 1945 Constitution provides special protection for children in conflict with the law. In this context, the Binjai Police Resort (Polres) has a strategic role in implementing Restorative Justice through different mechanisms as regulated in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. This study aims to analyze: (1) the application of Restorative Justice to juvenile criminal offenses at the Binjai Police Resort; (2) obstacles encountered in its implementation; and (3) the role of the Binjai Police Resort in realizing the goal of diversion. The research method used is empirical juridical with a qualitative approach. Data were obtained through document studies, direct observation, and in-depth interviews with the PPA investigation unit, victims, perpetrators, and community leaders. Data analysis was conducted descriptively-qualitatively with an emphasis on the effectiveness of the application of the law in practice. The results of the study show that the success rate of diversion at the Binjai Police is quite high, namely 72.7% in 2023 and 73.3% in 2024, although it decreased to 60% in 2025. Factors inhibiting the implementation of Restorative Justice include decreasing public understanding, resistance from victims, economic limitations of perpetrators, minimal child-friendly facilities, efforts to have certified human resources, monitoring, and suboptimal involvement.

Abstract

This study analyzes the implementation of water resource utilization licensing policies at the Cimanuk Cisanggarung River Basin Organization (BBWS Cimanuk Cisanggarung). The research was conducted through a 10-week Research and Practice (Ristik) program using direct observation, interviews, and documentation methods, applying a qualitative descriptive approach based on the theoretical framework of Edward III (1980), which states that the success of policy implementation is influenced by four key variables: communication, resources, disposition, and bureaucratic structure. The findings identify a major issue: a significant number of water resource utilization activities are carried out without official permits. This problem is linked to the lack of oversight by authorized parties and the insufficient dissemination of information regarding licensing obligations. The study proposes four comprehensive solutions: (1) strengthening communication strategies through continuous public outreach; (2) increasing the capacity and number of human resources; (3) fostering a proactive attitude among policy implementers; and (4) improving bureaucratic structures to support better coordination and supervision. The conclusion highlights that the implementation of water resource utilization licensing policies still faces several challenges, particularly related to the low level of public compliance with licensing regulations
