Abstract

Pasal 27 ayat 2 Undang-Undang Dasar 1945 menjelaskan bahwa setiap warga Negara berhak atas pekerjaan dan penghidupan yang layak bagi kemanusiaan. Dalam hal ini penyandang disabilitas juga termasuk bagian dari warga Negara Indonesia yang mana sangat berhak memperoleh kedudukan, serta pemberdayaan sosial yang sama dan memiliki hak untuk kehidupan yang layak. Namun pada kenyataannya, keberadaan dari penyandang disabilitas kadangkala sering dikucilkan dalam kehidupaan dimasyarakat, dan selain itu tidak mendapat hak dan kesempatan yang sama seperti warga masyarakat lainnya, dan bahkan kurang mendapatkan kebutuhan hidup yang layak. Oleh karena itu butuh suatu Lembaga dari pemerintah yang dapat menjadi suatu badan yang menangai segala kebutuhan dan pemberdayaan dari penyandang disabilitas, dan yang berperan dari Lembaga pemerintah dalam hal ini yakni Dinas Sosial. Dalam hal ini Dinas Sosial memiliki peran sebagai salah satu unsur perangkat daerah yang memiliki lingkup tugas untuk memberdayakan penyandang disabilitas. Tujuan penelitian ini untuk mengetahui pemberdayaan penyandang disabilitas dari segi pemenuhan bantuan Kesehatan serta dalam bidang ekonomi pada Dinas Sosial Kota Cirebon. Penelitian ini berfokus pada segala kegiatan dan program kerja pada dinas sosial untuk menangani segala sesuatu yang berkaitan dengan penyandang disabilitas. Hasil penelitian ini menunjukan bahwa Dinas Sosial Kota Cirebon dalam pemberdayaan penyandang disabilitas pada pemenuhan Kesehatan dan ekonomi telah berperan cukup baik namun belum secara maksimal dikarenakan ada beberapa hambatan diluar teknis pelaksanaan.

Abstract

This article examines Tawkil Wali bil Kitabah as a legal-administrative instrument through which the state governs Islamic marriage within Indonesia’s marriage registration system. The study addresses the tension between classical fiqh munakahat requirements, particularly the presence of a marriage guardian, and contemporary social realities marked by mobility and administrative demands. This research is primarily framed as normative-doctrinal legal research with a descriptive-analytical approach, supported by an analysis of statutory regulations, marriage registration guidelines, and relevant scholarship on Islamic family law, as well as limited field-based information from Kantor Urusan Agama (Office of Religious Affairs, KUA) practice in Cirebon as an illustrative example. The findings show that Tawkil Wali bil Kitabah functions not merely as an administrative formality but as a state-recognized legal instrument that standardizes the delegation of guardianship authority, ensures procedural order, and strengthens legal certainty in Islamic marriage. The study also shows that this mechanism reflects the harmonization of fiqh, the Compilation of Islamic Law, and state administrative practice in the governance of marriage. It concludes that Tawkil Wali bil Kitabah represents an evolving model of governing Islamic marriage in Indonesia, in which religious norms are operationalized through legal-administrative procedures without displacing their normative foundations.

Abstract

This study analyzes the Governor of West Java Circular Letter Number 43/PK.03.04/KESRA of 2025 concerning the Nine Steps of Educational Development toward Gapura Panca Waluya from the perspectives of State Administrative Law and fiqh siyasah. The study is based on issues related to educational costs, weak character formation, and the need for regional policies that are responsive to the practical needs of educational institutions. This research employed a qualitative method with a case study approach at SMAN 1 Sumber, Cirebon Regency. Primary data were collected through observation, semi-structured interviews, and documentation, while secondary data were obtained from laws and regulations, the circular letter, books, and scholarly journals. The data were analyzed qualitatively through data reduction, data display, and conclusion drawing. The findings show that the circular letter functions as an administrative policy instrument that is administratively valid but normatively limited. At the school level, the policy is fairly effective in directing character building, discipline, healthy habits, and controlling school activities that burden parents. From the perspective of fiqh siyasah, the policy is consistent with the principles of justice, public benefit, equality, proportional freedom, and deliberation at the implementation stage. This study concludes that the circular letter can serve as an effective administrative guideline, although stronger formal regulatory support is still needed to ensure more optimal and sustainable implementation.

Abstract

This article examines whether murābaḥah regulation and practice in Indonesia embody Islamic justice as a substantive ethical principle or remain confined to procedural sharia compliance. Existing studies on murābaḥah largely emphasize contractual validity, regulatory structure, and institutional compliance, but pay limited attention to justice as an ethical standard for evaluating how Islamic consumer finance operates in practice. Using a normative-conceptual method, this study analyzes primary legal and regulatory materials, including OJK regulations, statutory instruments, DSN–MUI fatwas, and internal supervisory guidelines, complemented by an interview conducted in November 2025 with an Assistant Manager at the OJK Regional Office in Cirebon. The analysis employs Sayyid Qutb’s framework of Islamic justice—mīzān, ḥurriyyah, and takāful ijtimāʿī—to assess the legal construction, regulatory objectives, and operational logic of murābaḥah within Indonesia’s Islamic financial system. The study finds that although murābaḥah has been regulated in a systematic and comprehensive manner to ensure legal certainty, prudential governance, and formal sharia compliance, such regulatory coherence does not automatically realize substantive Islamic justice. Market-oriented margin structures, debt-like operational features, and limited social orientation reveal a normative gap between procedural conformity and ethical justice. This article contributes to Islamic governance scholarship by offering a justice-centered evaluative framework for murābaḥah and by providing normative insights for strengthening Islamic consumer finance regulation beyond technical compliance toward a model that better integrates legal certainty, social justice, balanced risk allocation, and collective welfare.

Abstract

Dakwah adalah proses untuk mempengaruhi dan mengajak umat mengikuti ajaran Islam dalam seluruh sendi kehidupan. Wakaf tunai merupakan amal jariah yang pahalanya bisa terus mengalir kepada wakif selama harta wakaf masih bisa dimanfaatkan. Penelitian literatur ini mengkaji mengenai bagaimana konsep dakwah, konsep dan fungsi masjid, konsep wakaf tunai, potensi wakaf tunai, dan pengembangan wakaf melalui dakwah berbasis masjid. Penelitian ini memakai metode deskriptif kualitatif dengan sumber data berasal dari buku, artikel jurnal, undang-undang, website, dan referensi lain yang terkait. Hasil penelitian menunjukkan bahwa pengembangan wakaf tunai dapat dilakukan melalui sosialisasi yang secara rutin dilakukan di masjid seperti pada waktu menjelang khutbah Jumat, saat khutbah, pada ceramah keagamaan, atau pada berbagai kesempatan lainnya. Pengembangan wakaf perlu didukung oleh berbagai pihak mulai dari pemerintah, khususnya Kementerian Agama, Pemerintah Daerah, Badan Wakaf Indonesia, Dewan Masjid Indonesia, Badan Koordinasi Majelis Taklim Masjid, Badan Komunikasi Pemuda Remaja Masjid Indonesia, organisasi masyarakat Islam, dan seluruh lapisan masyarakat. Pengetahuan tentang wakaf tunai berbasis masjid bisa memberi pengaruh positif bagi kesejahteraan umat Islam.

Abstract

Bank Syariah Mandiri (BSM) merupakan salah satu lembaga keuangan dengan kontribusi besar pada perekonomian Indonesia. Pandemi Coronavirus Disease-19 (COVID-19) menyebabkan berbagai sektor khususnya ekonomi terdampak.  Studi pustaka ini bertujuan untuk mengetahui efek pandemi terhadap ekonomi Indonesia, dampak pandemi terhadap BSM, dan peran BSM bagi perekonomian di masa pandemi. Hasil penelitian menunjukkan bahwa pandemi berdampak pada sektor investasi, perdagangan, transportasi, dan pariwisata. Kegiatan intermediasi BSM mengalami peningkatan dan berhasil menghasilkan laba. Pandemi berdampak postif bagi transaksi digital BSM seperti peningkatan jumlah pengguna Mandiri Syariah Mobile, peningkatan transaksi digital, dan peningkatan pembukaan rekening online. Peran BSM di masa pandemi meliputi restrukturisasi pembiayaan nasabah, bantuan sosial, pemaksimalan program corporate social responsibility (CSR), penerapan protokol kesehatan, dan pengalihan kegiatan bank menjadi berbasis digital. Kata Kunci: BSM, Pandemi COVID-19, Ekonomi, dan Indonesia.

Abstract

AbstrakKontribusi Lembaga Amil Zakat sangat diperlukan untuk menangani masalah ekonomi diakibatkan oleh pandemi Covid-19. Zakat, Infak, Sedekah (ZIS) memegang peranan penting bagi umat Islam baik dari sisi ibadah maupun pembangunan ekonomi. Melalui studi kepustakaan ini penulis mengkaji mengenai urgensi ZIS menurut perspektif Maqasid Syariah dan bagaimana upaya BAZNAS Kota Cirebon dalam menangani dampak pendemi terhadap ekonomi. Hasil penelitian menunjukkan bahwa adanya ZIS pada masa Pandemi Covid-19 sesuai dengan empat dari lima nilai Maqasid Syariah yaitu untuk menjaga agama, jiwa, akal, dan harta. Berbagai program yang disusun oleh BAZNAS Kota Cirebon sesuai dengan kebutuhan yang ada dan tidak bertentangan dengan hukum Islam dan hukum positif. BAZNAS Kota Cirebon melaksanakan program BAZNAS MEMBUMI (Membantu Dampak Pandemi) bersama pemerintah Kota Cirebon untuk memberikan semangat optimis kepada masyarakat untuk mampu menghadapi pandemi.Kata Kunci: ZIS, Pendemi, dan Maqasid Syariah.

Abstract

AbstractZakat is a pillar of Islam that has a religious dimension as well as a social dimension. The utilization of zakat has an impact on increasing welfare. This study examines the effect of productive zakat on MSME empowerment and its influence on Mustahiq's Economic Sustainability at BAZNAS Cirebon City. This research uses mixed concurrent methods, namely combining qualitative and quantitative methods. The results of the study show that: 1) There is a positive and significant influence between productive zakat (X) on MSME empowerment (Y1) by BAZNAS Cirebon City with =3,6387 and =1,9997, it can be seen that >  means variable X has a positive and significant influence on variable Y1; and 2) There is a positive and significant influence between productive zakat (X) on the economic sustainability of mustahiq (Y2) BAZNAS Cirebon City with =15.375 and =1.9997, it can be seen that >  means that variable X has a positive influence on variable Y2. The results of the research prove that the hypothesis is accepted. The better the distribution of productive zakat, the better the quality of empowered MSMEs that support economic sustainability.Keywords: Productive zakat; MSME empowerment; Economic sustainability.

Abstract

Conventional economic theory, which began with Adam Smith's seminal work on the free market and the 'invisible hand,' evolved through the contributions of Keynesianism and monetarism, focusing on government intervention and money supply control, respectively. In contrast, Islamic economic thought is deeply rooted in the Qur'an and Sunnah, with early Islamic scholars like Ibn Khaldun emphasizing justice, balance, and social welfare as core economic principles. After a period of dormancy, Islamic economics was revived in the 20th century, presenting an alternative that integrates moral and ethical values within the economic system. This research examines the integration of conventional and Islamic economic principles, particularly their role in the development of Islamic law (Sharia) and its economic applications. By adopting a comparative and integrative approach, the study analyzes both systems' concepts, principles, and practices, relying on data from books, journals, articles, and other scholarly references. The findings highlight both the similarities and differences between conventional and Islamic economics and identify complementary elements that facilitate the creation of a more just and sustainable hybrid economic model. Integrating core Islamic economic values, such as the prohibition of usury (riba) and wealth redistribution (zakat), with conventional economic frameworks can promote a more equitable and sustainable economic system. This research concludes that the synthesis of conventional and Islamic economics, underpinned by Sharia principles, can lead to the development of a more efficient, ethical, and socially just economic model..Keywords: Conventional Economics; Islamic Economics; Comparison; Economic Integration; Economic Sustainability

Abstract

The purpose of this research is to examine juridically the urgency of establishing the Honorary Court of the People’s Consultative Assembly (Majelis Permusyawaratan Rakyat / MPR) as an ethical supervisory body in order to strengthen a clean, accountable, and integrity-based constitutional system. The method applied is a normative juridical approach through analysis of laws and regulations, relevant legal decisions, and ethical principles as stated in MPR Decree Number VI/MPR/2001. The novelty of this study lies in its focus on the MPR, which unlike the House of Representatives (DPR) with its Honorary Council, has not yet institutionalized an ethical body, thus leaving a legal and institutional gap that requires urgent attention. The findings of this study show that the establishment of the MPR Honorary Court is a crucial need to create an ethical supervision system that is both preventive and repressive toward its members, thereby enhancing institutional accountability. In conclusion, the existence of such an institution is expected to strengthen the legitimacy and public trust in the MPR’s representative function, with the main recommendation being the drafting of internal regulations that define the structure, authority, and working mechanisms of the Honorary Court as an integral part of legislative institutional reform.
