Abstract

This research aims to analyze the management of ASWAJA based local content curriculum to build the character of students who are faithful, devout and noble. This is a case study approach descriptive qualitative research, carried out in religious-based educational institutions. Data were collected through interviews, observations, and documentation studies, then analyzed using data reduction. Result of research showed that at the planning stage, the curriculum was designed by determining Aswaja-based subjects, selecting competent teachers, and providing relevant learning resources. Curriculum implementation involves developing a syllabus, preparing lesson plans, and implementing learning methods that integrate Aswaja values. Evaluation is carried out reflectively and summatively to measure the success of curriculum implementation. However, several obstacles such as the lack of innovative learning methods and teacher rotation are challenges that needed to be overcome. This research confirmed that Aswaja values have strategic potential moderate, inclusive, based on local wisdom. For optimization, synergy is needed between educational institutions, the community and the government in ensuring the sustainability of local content curricula as a solution to face the moral crisis in the modern era.

Abstract

Sengketa waris sering kali muncul di Pengadilan Agama akibat ketidakjelasan pemisahan antara harta pewaris dan harta pasangan yang ditinggalkan. Penelitian ini bertujuan untuk menganalisis kedudukan harta bersama dalam sistem kewarisan Islam di Indonesia dengan membandingkan pandangan ulama klasik dan regulasi hukum positif (Kompilasi Hukum Islam). Meskipun dalam literatur fiqh klasik konsep harta bersama (syirkah abdan atau gono-gini) tidak dibahas secara spesifik dalam bab kewarisan, praktik hukum di Indonesia menempatkan harta bersama sebagai elemen krusial yang harus diselesaikan sebelum pembagian warisan dilakukan. Metode penelitian yang digunakan adalah yuridis-normatif dengan pendekatan komparatif. Hasil penelitian menunjukkan adanya sinkronisasi antara nilai-nilai keadilan dalam fiqh dan praktik hukum di Indonesia, di mana penetapan setengah harta bersama sebagai hak pasangan yang ditinggalkan merupakan bentuk perlindungan hak ekonomi dalam keluarga. Pengakuan harta bersama di Indonesia bergeser dari keadilan formal menuju keadilan distributif. Hukum menganggap bahwa keberhasilan suami dalam mencari nafkah tidak terlepas dari dukungan, doa, dan pengelolaan rumah tangga oleh istri. Kesimpulannya, pengakuan harta bersama di Indonesia tidak bertentangan dengan prinsip kewarisan Islam, melainkan merupakan ijtihad hukum yang memperkuat kesejahteraan keluarga. Penetapan bagian harta bersama merupakan ijtihad yang sah menurut syariah melalui prinsip maslahah mursalah (kemaslahatan umum).

Abstract

The problem is how to resolve disputes over post-divorce women's rights through the courts, of course there are pros and cons. The point of view studied is KHI (Islamic Law Collection) Articles 105 and 156 as well as Law No. 1 of 1974 which was changed to Law No. 16 of 2019 and Law No. 23 of 2002 concerning the rights of women and children by analyzing the report on the divorce suit decision as of January in 2023 by the Garut Religious Court. The analytical method used is empirical with a qualitative approach. Primary and secondary sources as well as observations are used at all times. In conclusion, the implementation of court decisions is not all carried out effectively and as expected, this is because the level of husband's economic ability is uncertain and even dominated by absenteeism in solving problems. the consequences will be the same, namely it will not be realized. From the research, it is known that 78% have carried out the decisions set by the Court with the results of the Verstek Decision, but there are some who have not carried out in accordance with the Court's provisions, due to economic factors and the current situation after the pandemic. And one of the decisions in the case with Number. 5034/Pdt.G/2022/PA.Grt with the result of the judge's consideration decision, which is granted in part and Custody of one of the children is with the Plaintiff but for joint assets it is still in a temporary decision or under review.

Abstract

This study analyzes the contribution of Abu al-A'la al-Maududi's thought related to Islamic morality in the Islamic economic system. The background of this study departs from the failure of the conventional economic system that is materialistic and independent of moral values, so that the concept of Islamic economics that integrates ethics and spirituality is needed. With the method of literature study and the approach of Maqāṣid al-Syarī'ah, this study examines al-Maududi's works and compares them with relevant literature. The results of the study show that morality in al-Maududi's thought is not just an additional norm, but the main foundation of Islamic economics that emphasizes justice, balance, and social responsibility. These findings confirm the fundamental differences between Islamic and conventional economics, while providing practical implications that the implementation of modern Islamic economics must prioritize the integration of moral values in economic policies and practices.

Abstract

Islamic education is a form of manifestation of the ideals of Muslims to preserve Islamic values for the next generation, so that the cultural-religious values aspired to can function and develop in society, so that Islamic educators try to form Muslim personalities that are in accordance with Islamic education goals. Islamic education is also based on the highest goal, which is to want students to be a blessing to all creatures. With this grace, it is expected to be able to spread the values of compassion by always advising one another on truth and patience. This research method uses library research and is descriptive, analytic and comparative. Source of data used in this research comes from primary and secondary data. Islamic education as in general education, trying to shape the human person must go through a long process, with results that cannot be known immediately. Many Islamic education experts provide an understanding of the purpose of education. There are those who formulate that the goal is something that is expected to be achieved after a business or activity is completed. While others say that the goal may point to futurity that is located at a certain distance that cannot be achieved except by trying to go through a certain process.

Abstract

Tasamuh is an attitude of respect for others to exercise their rights. We must not look down on ethnicity, religion, or other regional cultures, let alone contempt, hate, or antagonize them. Besides that, the meaning of tasamuh can also be interpreted as being patient in facing other people's beliefs, their opinions and their deeds even though they are contrary to beliefs and vanity in their eyes, and may not attack and criticize with reproaches that make that person sick and tormented by his feelings. Religious tolerance must be understood as a form of our acknowledgment of the existence of religions other than our own with all forms of systems and procedures for worship and giving freedom to carry out their respective religious beliefs. This research method is library research and is descriptive, analytic and comparative. Source of data used in this research comes from primary and secondary data. In collecting data using library books, journals, magazines, articles, interviews and documentation methods. The concept of tasamuh in the perspective of the Koran may not look down on ethnicity, religion, or other regional cultures, let alone contempt, hate, or be hostile towards them. In addition, the meaning of tasamuh can also be interpreted as being patient in facing other people's beliefs, their opinions and their deeds even though they are contrary to their beliefs and vanity in their eyes, and may not attack and criticize with reproaches that make the person sick and torment his feelings.

Abstract

This article aims to discuss two different interpretations in the last verse in surah al-Fatihah, to be precise in the pronunciation of Al-Maghdu and Ad-Dhollin. This research uses a qualitative method, by using a literature study approach. The research in this article guides the reader in comparing two different interpretations. Among the discussions are the profiles of the two interpreters and the comparison of their exegesis. The conclusion shows that the meaning of lafadz Al-Maghdu and Ad-Dhollin from Muhammad Asad’s view is to mankind in general and specifically to non-Muslims. In contrast, the interpretation of Al-Qurthubi is to Muslims, where Al-Maghdu were people who were heretical and Ad-Dhollin were people who did not follow the sunnah of the Prophet.
