Abstract

Indonesia in this era of globalization was made as a country that can include foreigners in carrying out activities in the form of industry, tourism and commerce in Indonesia. The development of technological science, allows people to be more consumptive in using it. Viewed from a psychological perspective, it is often found that foreign tourists have deviant behavior from legal norms that exist in Indonesia. One of the deviant acts is the criminal treatment of persecution of a foreign citizen to Indonesian citizens who are in the Republic of Indonesia. There is also a problem statement. The purpose of this study is to determine criminal liability and criminal sanctions given to foreign citizens who commit criminal acts of persecution. This study uses a normative method because there are still vague norms, based on the opinions of legal scholars and the Law. One person can have a personality in criminal liability if some things or actions made by someone in violating positive law, if one can eliminate the sense of responsibility in someone who found an element of a person's ability to lose responsibility.

Abstract

Sale and purchase is usually done by an agreement or what is known as a sale and purchase agreement, based on customary law a sale and purchase agreement is a real agreement, meaning that the delivery of the goods agreed upon is an absolute requirement fulfilled for the existence of an agreement. This research aims to find out about the arrangement of the land purchase agreement and find out the legal consequences of the land purchase agreement if there is a default. The method used in this research is the normative legal method with the statutory approach (satute aproach) and the conceptual approach. There are two types of data used, namely Primary (Laws and Regulations) as primary data and secondary data (sources of literature, books and research journals). Data analyzed are presented in the form of descriptions. Research results show that the sale and purchase rights of land rights are regulated in article 1457. The Civil Code which determines that buying and selling is an agreement between the buyer and the seller in an agreement where the legal terms of the agreement must meet subjective and objective conditions, with the consequence that the agreement is not can be canceled unilaterally because it must be implemented in good faith. Then, due to the Default Law for the Parties In Canceling the Deed of Agreement on the Sale and Purchase of Land Rights, it is regulated in Article 1366 of the Civil Code which stipulates that everyone is responsible not only for losses caused by his actions, but also for losses caused by negligence or indifference careful. Article 1366 of the Civil Code explains the responsibility of someone who has done harm to another person / other party, either because of his own actions or due to negligence and carelessness that causes other parties to suffer losses from him.

Abstract

The declining quality and quantity of green open space in urban areas has caused a decrease in the quality of the environment. Therefore, it is necessary to conduct a research on the Green Open Spatial Planning, especially in Denpasar City the legal provisions of which has been regulated in Regional Regulation No. 27 of 2011. This research analyzes the planning for the use of Green Open Spatial and the mechanism for changing the Green Open Spatial to change its function to become Spatial Settlement. The method used in this research was a normative research method, in which legal data collection was carried out by recording library studies, document studies, information and explanations obtained both from the Laws, Government Regulations and other Regulations that can be further examined which related to this problem. Data analysis in this research was carried out systematically by classification of legal materials to facilitate the analysis work, then Legal materials obtained are then subjected to discussion and grouping into certain sections. The results found that the Green Open Space is an area dominated by plants that are built for protection functions. The pattern of spatial use as a basis for the Denpasar City Government sets Green Open Spaces namely Settlements and Public Facilities. Changes in the pattern of utilization of green open spaces have changed the function resulting in the realization of optimal urban spatial planning. This happened because of the weak awareness of the people of Denpasar City.

Abstract

The granting of Communal Rights Certificates is done according to Article 18 of the MATR / KBPN regulation No. 10/2016, if it has been decided that by the Governor, the Regent / Mayor in that place there are indeed indigenous peoples, the Officer will report to the Ministry of National Land Agency (hereinafter abbreviated as BPN) so that it is not changed and the registration of Communal Rights for the land contained therein in that area. This study aims to determine the mechanism for granting communal land rights certificates for customary law associations and also to identify tenure rights with communal rights based on agrarian arrangements. This research is a normative legal research with a statutory approach and analysis approach and legal concepts. The results of this study indicate that the Decree of the Minister of Land said that if the results of the research there were indigenous peoples and their land, the inauguration of the indigenous peoples was decided by the ministry of MATR / BPN of the region to determine and register communal rights over their land in the region's BPN. The communal rights being applied for will be issued in the future the communal rights certificate of the customary law community. After the Communal Rights Certificate is issued from the BPN on behalf of the customary community, the use and use can be cooperated with a third party, in this case if there is a party who is applying for a Cultivation Right on the communal right, then the customary law community may negotiate with the applicant, in order to get the same benefits. The conclusion is that the mechanism for granting communal land rights certificates to customary law associations starts from the report of the customary head to the Regent / Mayor and the granting of Building Use Rights on Communal Rights land is allowed as long as Communal Rights as long as the customary community wants to relinquish these rights or exchange with other land.

Abstract

Education is something that is important can provide knowledge that can improve the characteristics of life, both in personal life, community life, and state life. A New Student Admission, often referred to as PPDB, isan annual activity which is the selection stages for prospective new students organized by school-level committees under the supervision and coordination of the Office of Education. This year, PPDB uses a new system, the zoning system, which aims to equalize students. The purpose of this study was to describe how the implementation of Permendikbud number 14 in 2018 and what are the factors inhibiting the implementation of Permendikbud number 14 in 2018 on the admission of new students based on zoning. This research was designed using an empirical legal research approach. The results of this study indicated that the implementation of Permendikbud No. 14 of 2018 in High Schools / Kejuraan especially in the South Kuta area has not been running effectively because there was one school that received protests from students' parents which resulted in the process of hiring new students being hindered. In addition, this study also showed that the inhibiting factors for the implementation of Permendikbud No. 14 of 2018 on the admission of new students based on zoning consisted of internal factors, namely the committee was less selective in examining student requirements and the application provided was experiencing interference, and external factors namely location, community mainset, and domicile certificate.

Abstract

Village-Owned Enterprises (BUMDes) are village business entities that are managed by the community and village government in an effort to strengthen the village economy and are formed based on the needs and potential of the village. One of the villages in the Sub-district of Badung is Gulingan Mengwi. It already has an enterprise named BUMDes Samkriya Werdhi Guna. This study examines two issues: the regulation of Village Owned Enterprises of Samkriya Werdhi Guna to bear a crucial role in the efforts to increase the Village Original Revenue of Mengingan Gulingan and the implementation of BUMDes based on the Regional Regulation of Badung Regency No. 1 of 2015 concerning the Establishment and Management of Village-Owned Enterprises in Gulingan Mengwi Village. To achieve the objectives, empirical legal research method was used. The results of the study showed that the Regulation of the Samkriya Werdhi Guna Village Owned Enterprise had an important role in the effort to increase the Original Revenue of the Gulingan Mengwi Village to support the development program in the village. The implementation of the BUMDes in conjunction with the Regional Regulation of Badung Regency No. 1 of 2015 concerning the Establishment and Management of Village-Owned Enterprises in the the Mengwi Mengingan Village is in accordance with the principles of the Statutory Regulations. In addition, the participation of the Government of Badung Regency is also ideal for developing the BUMDes, especially in BUMDes of the Samkriya Werdhi Guna of Gulingan Mengwi Village.

Abstract

Seeing the number of vehicles with police numbers outside the area operating in Bali, in the Bali Provincial Regulation No. 4 of 2016 concerning the Implementation of Traffic and Public Transportation it is explained that vehicles from outside the Bali area can only be in Bali for 3 consecutive months if they exceed that time. then must do Transfer of Name Duty. This research is formulated to determine the imposition of motor vehicle tax in Bali Province, and to determine the intensification of motor vehicle tax imposition on police numbered vehicles from outside Bali. This research uses empirical law research type. The results of this study indicate that the collection of Motor Vehicle Tax in Bali Province can be carried out by taxpayers by following the procedures for implementing Motor Vehicle Tax collection as contained in the Regional Regulation of the Province of Bali Number 1 of 2011 concerning Regional Taxes. Regarding vehicles with police numbers outside the Bali Region, they cannot be taxed because there are no regulations governing these vehicles. This has also led the Bali Provincial Government to plan several efforts for vehicles outside the Bali region that have passed the time to reverse name.

Abstract

The Indonesian state adheres to the Presidential system of government. In running the government, a president is assisted by his staff. We call this line of government. The government that we often know as Civil Servants. The position of civil servants has an important role carrying out government functions in a country. Based on this there are formulations of the problem as follows: (1) How to regulate the use of official vehicles in government agencies (2) How to monitor the use of official vehicles in Government Agencies. This type of research used is the type of normative legal research, the discussion conducted by the study of legal materials. Analysis of legal material uses legal interpretation, namely providing interpretation in terms of law. Based on the results of the study that regulations related to the use of official vehicles in government agencies are regulated in ministerial regulations and further regulated by each region in the form of governor regulations or regional regulations and Supervision of vehicle use in government agencies is carried out by Direct and Indirect Supervision . In addition to paying attention to the products of the laws and regulations, also pay attention including official vehicles, are not misused.

Abstract

Denpasar City is the center of government, population center, tourism center, trade center, economic activity and center for other activities so you can imagine how busy Denpasar City is in handling all aspects of people's increasingly complex life. An incident that looks easy but few people care about, one of which is waste, so many effects can be obtained from disposing of the residual use of fragrances and screen printing, which are often found, but without a clear response to allow the accumulation of waste. Even though the government has regulations and sanctions related to these problems, they are often ignored by owners or entrepreneurs engaged in screen printing. Environmental pollution, which has often occurred since a long time ago, is a community disease that is difficult to eliminate. The researcher has a problem formulation covering 1) How is the legal arrangement regarding criminal acts against environmental pollution by screen printing and dyeing waste in Denpasar City? 2) What are the criminal sanctions against the perpetrators of criminal acts of environmental pollution by screen printing and dyeing waste in Denpasar City? The research was carried out by reviewing books on law and not deviating from the problems studied and the current positive law as well as studies in the library, this research is often called normative research. The results of this study state that criminal sanctions against perpetrators of environmental pollution by screen printing and dyeing waste in Denpasar City are in the form of fines and imprisonment. The act of environmental pollution carried out by NHY by disposing of screen printing waste into the river has violated Article 58 paragraph (2) of the Regional Regulation on the City of Denpasar Number 1 of 2015.

Abstract

Illegal levies are a form of crime that is very familiar to the public. Basically, illegal levy and corruption are the same acts where the two acts use power for the purpose of enriching themselves by violating the law. Based on the background of this problem, this research was conducted with the aim of describing the implementation of public services at Pangsan Village office, Petang District and the effectiveness of illegal levies eradication on public services at Pangsan Village office, Petang District. This study employed an empirical legal research method. The results of this study indicated that the implementation of public services at Pangsan Village office, Petang District has met technical indicators in accordance with work procedures. In Pangsan Village, the standard procedures also have the function of forming an orderly, systematic, and accountable work system and workflow. the effectiveness of illegal levies eradication on public services at the Pangsan Village office, Petang District has been very effective through the efforts made to prevent illegal levies in administrative services.
