Abstract

Health law is a field that has a strategic position in ensuring the protection of human rights, especially in the context of modern health services that continue to develop. The development of medical technology, improving the quality of services, and strengthening the rights of patients have increasingly complex ethical, moral, and regulatory implications. This study aims to analyze health law from the perspective of legal philosophy by reviewing the concepts of values, principles of justice, equality, and morality that are the foundation of its regulation. Through a theoretical approach, this study discusses how health law is positioned as a system of norms that protect patients, direct the practice of health workers, and balance the relationship between professional obligations and the interests of society. In addition, the analysis is focused on the application of health law in daily life, including service ethics, patient rights, medical confidentiality, and legal protection mechanisms through regulations such as the Health Law No. 17 of 2023. The results of the study show that strengthening professional ethics, the integrity of health workers, and the legal system that favors patient safety is the key to improving the quality of health services. Thus, health law not only functions as a regulatory instrument, but also as a moral and philosophical pillar in maintaining human dignity and the quality of health services.

Abstract

This study aims to analyze legal discovery regarding the normative void (vacuum of norm) of informed consent for pediatric patients within healthcare service practices in Indonesia. Normative legal research is employed, focusing on positive legal norms, legal principles, and evolving legal doctrines in health law. The research utilizes a statute approach and a conceptual approach. Based on the normative and conceptual analysis, it is concluded that Indonesian positive law still contains voids and ambiguities regarding informed consent for pediatric patients. The lack of synchronization between health law, child protection law, and civil law results in legal uncertainty in healthcare practices, particularly in determining the capacity of children to provide medical consent.

Abstract

The 2023 Indonesian Criminal Code reform introduces the criminalization of cohabitation under Article 412, raising concerns regarding its implications for the civil status of children and vital administrative procedures. Although cohabitation is criminalized as a complaint-based offense, the provision may lead to misinterpretation among healthcare providers and civil registry officers, particularly regarding the issuance of birth certificates. Employing a normative juridical method with statutory, conceptual, and case approaches, this study examines the interaction between Article 412 of the Criminal Code, the Marriage Law, Constitutional Court Decision No. 46/PUU-VIII/2010, the Population Administration Law, and the 2023 Health Law. The findings indicate that the criminalization of cohabitation does not alter the civil status or rights of children, which remain protected through recognition mechanisms and identity rights. However, regulatory gaps persist due to the absence of clear implementation guidelines, posing risks of administrative barriers. Regulatory harmonization and technical directives are therefore necessary to ensure that children’s rights remain fully protected regardless of their parents’ legal circumstances.

Abstract

Community health centers serve as the frontline of primary health care in Indonesia, yet their ability to deliver quality services in remote areas is often limited by gaps between legal mandates and daily practice. This study examines the implementation of health law at Health Center, and identifies practical strategies to improve service quality and legal compliance. The research combined juridical-normative analysis of relevant national laws and regulations with empirical data collected through observation, in-depth interviews with the head of the health center, staff, and patients, and document review at the health center. Thematic analysis was applied to assess alignment between legal standards and actual practice. Findings reveal that the health center consistently applies standard operating procedures, maintains active promotive-preventive-curative-rehabilitative programs, and provides accessible complaint mechanisms. However, persistent personnel shortages, inadequate infrastructure, and low legal awareness among staff and community members continue to hinder full compliance with minimum service standards. Management responds through regular internal training, gradual infrastructure improvement using operational funds, and cross-sectoral collaboration with local leaders and village cadres. These efforts demonstrate that service quality in remote areas can be strengthened through continuous capacity building and community involvement.

Abstract

This article examines the tension between legality and legitimacy within the procedural justice framework of Indonesia’s Law No. 17 of 2023 on Health. While the law formally satisfies the positivistic criteria of legality as outlined in statutory drafting guidelines, its legislative process raised substantial concerns regarding transparency, participation, and deliberative inclusiveness. These issues highlight the broader philosophical problem of whether legal validity based solely on procedural formality is sufficient to constitute legitimate lawmaking in a democratic state governed by the rule of law. Using theoretical perspectives from Habermas, Fuller, and Rawls, this study analyzes the degree to which the formation of the Health Law reflects or departs from the ideals of procedural justice. Habermasian discourse theory underscores the importance of communicative participation and rational–public deliberation, both of which appear limited in the law’s formation. Fuller’s principles of internal morality reveal inconsistencies related to clarity, openness, and procedural integrity. Meanwhile, Rawls’s notion of fairness emphasizes the need for equitable inclusion of affected stakeholders, particularly healthcare professionals and the wider public. The findings show that although the law may be legally valid, its legitimacy remains contested due to insufficient adherence to philosophical standards of just procedure. This paper concludes that bridging legality and legitimacy requires strengthening deliberative mechanisms, enhancing participatory routes, and reaffirming moral–procedural principles in legislative processes.

Abstract

Penelitian ini membahas kekosongan regulasi hukum pidana dalam penggunaan teknologi kecerdasan buatan (Artificial Intelligence/AI) pada layanan kesehatan di Indonesia. Pemanfaatan AI yang semakin luas dalam diagnosis dan perawatan medis belum diimbangi dengan pengaturan hukum pidana yang memadai, sehingga menimbulkan accountability gap ketika terjadi kesalahan diagnosis atau dugaan malpraktik yang melibatkan sistem AI. Penelitian ini bertujuan untuk mengidentifikasi kesenjangan hukum dalam pertanggungjawaban pidana penggunaan AI di bidang kesehatan, merumuskan model pertanggungjawaban pidana yang jelas dan aplikatif, serta menyusun rekomendasi kebijakan bagi pembentukan regulasi khusus AI kesehatan. Metode penelitian menggunakan pendekatan mixed methods dengan desain sequential explanatory. Penelitian dilakukan melalui kajian hukum normatif terhadap peraturan perundang-undangan terkait, serta didukung oleh penelitian empiris melalui wawancara dengan dokter spesialis radiologi di RSCM Jakarta, dokter spesialis patologi anatomi di Rumah Sakit Pendidikan Universitas Airlangga, dan studi dokumen di BPOM RI serta RS Siloam pada periode 2023–2024. Data dianalisis secara kualitatif dengan pendekatan tematik. Hasil penelitian menunjukkan bahwa hukum pidana Indonesia masih berorientasi pada manusia dan belum mampu mengakomodasi sifat otonom serta black box dari teknologi AI. Penelitian ini juga menghasilkan Layered Liability Model yang meliputi pertanggungjawaban strict liability terbatas bagi pengembang AI, vicarious liability bagi rumah sakit, dan professional negligence bagi tenaga kesehatan. Penelitian ini menyimpulkan bahwa model pertanggungjawaban berlapis tersebut dapat mengatasi accountability gap sekaligus menjaga keseimbangan antara perlindungan pasien, kepastian hukum, dan inovasi teknologi kesehatan.

Abstract

Rekonstruksi kasus pidana merupakan bagian penting dari proses penyidikan yang berfungsi untuk menguji kembali kebenaran keterangan saksi, tersangka, dan barang bukti secara sistematis, guna memperjelas kronologi terjadinya tindak pidana. Dalam praktiknya, kegiatan rekonstruksi kerap menarik perhatian publik dan media, karena dianggap sebagai bentuk transparansi penegakan hukum. Namun demikian, publikasi rekonstruksi secara terbuka melalui media massa maupun media sosial menimbulkan problem etis dan yuridis yang kompleks. Konflik muncul antara hak masyarakat untuk memperoleh informasi sebagai wujud kebebasan pers dan hak asasi manusia, dengan hak tersangka atas perlindungan harkat, martabat, serta asas praduga tak bersalah. Ketidakseimbangan antara kedua hak tersebut berpotensi mengakibatkan pelanggaran terhadap prinsip-prinsip dasar hukum pidana dan hak asasi manusia di Indonesia. Artikel ini bertujuan menganalisis secara mendalam kerangka hukum nasional yang mengatur publikasi rekonstruksi kasus pidana, dengan menelaah Kitab Undang-Undang Hukum Acara Pidana (KUHAP). Metode yang digunakan adalah yuridis normatif dengan pendekatan konseptual dan perundang-undangan, didukung oleh kajian pustaka dan kode etik jurnalistik sebagai instrumen analisis normatif. Hasil penelitian menunjukkan bahwa hingga kini belum terdapat pengaturan khusus mengenai batasan publikasi rekonstruksi perkara pidana. Oleh karena itu, diperlukan pedoman etik nasional yang mengatur tata cara publikasi rekonstruksi, termasuk mekanisme izin penyidik, persetujuan pihak terkait, dan perlindungan identitas tersangka.

Abstract

In remote Indonesian islands with scarce doctors, nurses often perform physician-level medical procedures to maintain urgent patient care. These necessary actions expose them to legal risks if viewed as exceeding their authority. This study examines legal protection and accountability for nurses undertaking such tasks under government duties at a regional general hospital in a remote island setting. The research maps existing legal safeguards for nurses and the forms of responsibility they hold under Indonesian law. A qualitative study combined normative legal analysis with empirical field data from all thirty-six nurses, using questionnaires, interviews, observations, and document review. Descriptive analysis contrasted legal standards with actual practice. Nurses show reasonable awareness of basic legal foundations and hospital tools like standard operating procedures and delegated authority. However, delegation is frequently undocumented, competency checks are irregular, and understanding of dispute safeguards is limited. Accountability is well-defined across administrative, civil, and criminal levels, yet practical administrative support remains inconsistent. Stronger regional policies, regular legal training, mandatory written delegations, and accessible legal assistance are urgently needed to reduce vulnerability, build confidence, and ensure safer, more equitable healthcare in isolated areas.

Abstract

Stunting remains a serious public health problem in Indonesia, affecting children’s physical growth, cognitive development, and long-term productivity. The central government issued Presidential Regulation No. 72 of 2021 on the Acceleration of Stunting Reduction, targeting a national prevalence rate of 14% by 2024. However, a gap persists between das sollen (normative regulation) and das sein (implementation reality), where local governments face challenges such as limited budgets, weak cross-sectoral coordination, and suboptimal institutional capacity. Gowa Regency, as one of the priority loci for stunting reduction, is essential to study in the context of synchronization between national and local regulations. The main problem addressed in this study is the suboptimal synchronization between national and local regulations in accelerating stunting reduction in Gowa Regency. This condition leads to inconsistencies between national policy directions and program implementation at the local level, potentially hindering the achievement of national targets. This study aims to assess the alignment between Presidential Regulation No. 72 of 2021 and Gowa Regent Regulation No. 5 of 2023 using a normative juridical method with vertical and horizontal synchronization approaches. The results indicate that the synchronization of regulations in Gowa Regency is high in normative aspects but remains limited in technical implementation. Although stunting prevalence decreased from 33% in 2022 to 17% in 2024, the figure remains above the national target. The study suggests strengthening adaptive synchronization through cross-sectoral data integration, performance-based budgeting, and institutional capacity enhancement to accelerate sustainable stunting reduction.

Abstract

The Evolution of Legal Discovery in Indonesia’s Judicial System.Object penelitian ini adalah praktik penemuan hukum dalam sistem peradilan Indonesia. Objektif penelitian yaitu menganalisis dinamika perkembangan penemuan hukum serta pergeseran pola penafsiran hakim dari pendekatan positivistik yang kaku menuju kerangka yang lebih progresif dan berorientasi pada keadilan. Methods yang digunakan berupa pendekatan kualitatif normatif melalui telaah literatur akademik dan putusan pengadilan. Hasil penelitian (Results) menunjukkan bahwa hakim di Indonesia semakin berperan sebagai penafsir nilai-nilai sosial, bukan sekadar pelaksana undang-undang secara tekstual. Pendekatan hermeneutika hukum memungkinkan penafsiran yang lebih kontekstual sehingga respons peradilan terhadap perubahan sosial menjadi lebih adaptif. Efektivitas penemuan hukum dipengaruhi oleh kompetensi hakim, ketersediaan doktrin, dukungan kelembagaan, serta dinamika sosial-politik. Secara keseluruhan, praktik penemuan hukum di Indonesia berkembang menuju paradigma yang lebih humanis dan responsif, meskipun konsistensi metodologis dan penguatan kapasitas hakim tetap diperlukan agar penafsiran progresif selaras dengan tujuan keadilan substantif dan kepercayaan publik terhadap hukum.
