Abstract

The authority of the Constitutional Court in Indonesia’s constitutional system has shifted from merely being a negative legislator to a tendency toward becoming a positive legislator. This phenomenon is reflected in various decisions that not only invalidate norms that contradict the Constitution but also establish new legal norms. This study aims to examine the urgency of limiting the Constitutional Court’s authority in acting as a positive legislator and to formulate a limitation model that prevents the Court from exceeding legislative boundaries. This research uses a normative legal method with statutory, case, and conceptual approaches and is analyzed prescriptively and critically based on primary and secondary legal materials. The findings show that the Constitutional Court’s expansive role as a positive legislator has the potential to lead to judicial supremacy and juristocracy, which are inconsistent with the principle of separation of powers. Therefore, limiting the Constitutional Court’s authority is necessary to maintain the constitutional balance among branches of state power. This study proposes the use of Mahfud MD’s “Ten Limiting Guidelines” as a normative framework, complemented by two original models: the Constitutionally Bounded Interpretation Protocol, which emphasizes that judicial interpretation must remain confined to the text, structure, and principles of the Constitution; and the Institutional Dialogue Model, which encourages legislative involvement in the follow-up to Constitutional Court decisions. These models aim to ensure that the Constitutional Court remains within its constitutional role as guardian of the Constitution, without encroaching upon the legislative domain

Abstract

Berdasarkan dengan hal tersebut serta sesuai dengan ketentuan Pasal 18 ayat (6) UUD NRI Tahun 1945, Kabupaten Magetan perlu untuk menyusun Peraturan Daerah di bidang penanganan orang dengan gangguan jiwa (ODGJ). Urgensi penyusunan Peraturan Daerah a quo adalah (1) sebagai instrumen kebijakan Kabupaten Magetan dalam pemenuhan hak orang dengan gangguan jiwa (ODGJ) untuk memperoleh penanganan yang lebih baik; (2) sebagai dasar penyelenggaraan penanganan orang dengan gangguan jiwa di Kabupaten Magetan; (3) sebagai upaya untuk mengoptimalkan penanganan orang dengan gangguan jiwa; (4) sebagai upaya untuk meminimalisir orang dengan gangguan jiwa (ODGJ) yang terlantar; (5) sebagai jawaban dan solusi terhadap berbagai persoalan empiris dan sosial di bidang penanganan orang dengan gangguan jiwa (ODGJ). Abstract

This study aims to analyze the impact of the digitalization of the Core Tax Administration System (CTAS) on tax law enforcement, with a particular focus on the application of the ultimum remedium principle. The research method employed is normative legal research, involving an in-depth analysis of tax law literature, relevant regulations, and case studies of CTAS implementation. The urgency of this research lies in addressing inefficiencies, inequities, and the lack of transparency in traditional tax law enforcement through the utilization of digital technology. The findings reveal that CTAS digitalization enhances efficiency, transparency, and data management in tax administration while strengthening law enforce ment processes through improved oversight and compliance. However, this digitalization also presents challenges, including data security risks, privacy concerns, and compliance with applicable regulations. The novelty of this research lies in integrating the ultimum remedium principle within the digital framework, advocating for a proportional approach to tax violations by prioritizing voluntary compliance and corrective measures before escalating to more severe enforcement actions. This study provides strategic contributions to legal policy development, offering essential insights for policymakers, legal practitioners, and system developers in designing a tax law enforcement system that is fair, transparent, and responsive to the demands of the digital era.

Abstract

Plenty aspect of human life across various regions, also Indonesia, utilizes electronic systems for a multitude of activities, and involving digital platforms. The concept of Digital Platform Powerplay is linked to the digital market and personal data protection. In Indonesia, the regulatory framework governing digital markets and personal data primarily relies on Law No. 11/2008 concerning Electronic Information and Transactions, which has undergone two amendments: Law No. 19/2016 amending Law No. 11/2008, and Law No. 1/2024 amending Law No. 11/2008 for the second time and Law No. 27/2022 concerning Personal Data Protection. As a implementation regulation Government Regulation No. 80/2019 concerning Electronic Commerce and Government Regulation No. 71/2019 concerning the Implementation of Electronic Systems and Transactions further elaborate on these regulations. These legal provisions are intended to provide legal certainty for users. It is essential to review all regulations related to electronic systems and digital platforms by comparing them with the regulatory frameworks in the European Union. The study addresses two primary issues: 1) the legal regulation of digital markets from the perspective of Indonesian positive law, and 2) the legal regulation of digital markets from the perspective of European Union law. This research employs normative legal research methodologies, utilizing both statutory and comparative approaches. The findings of this study suggest that Indonesia should consider adopting the European Union's Digital Markets Act and Personal Data Protection regulations by amending Law No. 11/2008 concerning Electronic Information and Transactions and its amendments, with particular emphasis on aspects related to Digital Platform Powerplay.

Abstract

Geographically, it is located in a strategic urban area with quite rapid development, both in terms of infrastructure development and population growth. The heterogeneous composition of its population, both in terms of education level, livelihood, and cultural background, provides both potential and challenges in efforts to create an empowered community and actively participate in sustainable environmental management. In general, most residents of Nginden Jangkungan Village work in the informal sector, such as street vendors, rental services, grocery stores, and transportation services. This is exacerbated by the community's limited technical knowledge regarding waste management based on the principles of reduce, reuse, recycle (3R), as well as the absence of an integrated and sustainable empowerment model. The implementation method of this Community Service activity is designed with a participatory and collaborative approach, prioritizing synergy between academics, the village government, community groups, and beneficiary residents. Nginden Jangkungan Village has adequate social and institutional potential to implement a civil society empowerment program in sustainable environmental management. However, this area still faces serious challenges related to the management of household liquid waste, which has not been handled optimally, so it has the potential to pollute groundwater and waterways and cause environmental health impacts.

Abstract

UUD NRI 1945 is the highest law in Indonesia's hierarchy of rules and regulations. One of the principles adopted by the UUD NRI 1945 is the principle of constitutionalism. Proof that the UUD NRI 1945 adheres to the principle of constitutionalism can be proven by the existence of Article 7, Article 23E, Article 24A, Article 24B, and Article 24C of the UUD NRI 1945. Meanwhile, the DPR, one of the state institutions mentioned in Chapter VII of the UUD NRI 1945, does not regulate term limits. This research explains the urgency of regulating term limits for DPR members from a constitutionalism perspective. This research is normative legal research using a statutory, conceptual, case, and comparative approach. The results of this research show that the absence of regulations regarding term limits for members of The House of Representative in the UUD NRI 1945 is not in accordance with the principles of constitutionalism adopted by the UUD NRI 1945. The urgency of limiting the terms for members the House of Representative is to: (1) uphold the principles of constitutionalism, (2) prevent arbitrary actions, (3) realize legal certainty, (4) improve the implementation of democracy in Indonesia, (5) prevent authoritarianism, and (6) Carrying out regeneration.

Abstract

The purpose of this study is to analyse the authority of autonomous regions in geothermal management and to find a fair redesign of the division of geothermal management authority to autonomous regions. This study is a legal study with a statute, conceptual, and case approach. The primary and secondary legal materials that have been collected are then analysed normatively. The results of the study found that through the principle of the broadest possible autonomy, the central government decentralizes some concurrent government affairs to autonomous regions. One of the concurrent affairs is geothermal affairs. However, Law No. 23 of 2014 regulates the centralization of geothermal permit issuance, so that it only becomes the authority of the Central Government. In fact, this centralization is strengthened by the Constitutional Court Decision Number 11/PUU-XIV/2016. In fact, this causes injustice to autonomous regions. After all, it is contrary to Article 18 paragraph (2) and paragraph (5) and Article 18A paragraph (1) and paragraph (2) of the 1945 Constitution of the Republic of Indonesia and is inconsistent with Law No. 23 of 2014 because it only uses the principle of national strategic interests. Therefore, as an effort to provide justice for the regions, the regulation needs to be redesigned by dividing the authority to grant geothermal permits among the regions. The division of authority is carried out using the principles of accountability, externality, and efficiency by considering the location/place of the geothermal permit, users, and benefits/negative impacts of granting geothermal permits, as well as efficiency in the implementation of granting geothermal permits.

Abstract

Administrative Decisions of Government, also referred to as State Administrative Decisions (Keputusan Tata Usaha Negara/KTUN), are written decisions issued by Government Bodies and/or Officials in the administration of government affairs. This definition is stipulated in Article 1 point 7 of Law Number 30 of 2014 on Government Administration (UUAP). The regulation also amended the meaning of negative fictitious decisions as regulated in Article 3 of Law Number 5 of 1986 on State Administrative Courts (UUPTUN) into positive fictitious decisions as provided in Article 53 of the UUAP. A negative fictitious decision means that the silence of a government official regarding an application submitted by the public, after the lapse of the statutory time limit, is deemed as a rejection. Meanwhile, a positive fictitious decision means that the silence of a government official regarding an application submitted by the public, after the lapse of the statutory time limit, is deemed as an approval. Following the enactment of Law Number 6 of 2023 concerning the Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 on Job Creation into Law (UUCK), the regulation continues to recognize the concept of positive fictitious decisions. However, it abolishes the authority of the State Administrative Court (PTUN) to adjudicate fictitious State Administrative Decisions, which consequently gives rise to legal certainty issues for the public, particularly since the implementing Presidential Regulation has not yet been issued.This research employs a normative legal research method with a prescriptive approach. The results are expected to provide prescriptions regarding the legal issues examined.

Abstract

Perkembangan Artificial Intelligence (AI) dalam layanan kesehatan telah membawa perubahan signifikan melalui peningkatan akurasi diagnosis, percepatan layanan, serta peningkatan efisiensi tenaga medis. Namun, penerapan AI juga memunculkan potensi risiko kelalaian (negligence), khususnya ketika terjadi kesalahan pada rekomendasi klinis atau pengambilan keputusan yang dihasilkan sistem. Kondisi ini menimbulkan pertanyaan penting mengenai konstruksi tanggung jawab pidana, mengingat sistem hukum pidana Indonesia pada dasarnya berorientasi pada perbuatan manusia dan belum memiliki kerangka normatif yang secara spesifik mengatur karakteristik AI yang bersifat otonom, adaptif, dan tidak sepenuhnya dapat diprediksi. Penelitian ini bertujuan menganalisis model pertanggungjawaban pidana atas kelalaian AI dalam sektor kesehatan serta menilai urgensi pembentukan regulasi khusus untuk memberikan kepastian hukum dan perlindungan optimal bagi pasien. Penelitian menggunakan metode yuridis normatif dengan memadukan pendekatan perundang-undangan, konseptual, dan komparatif untuk menilai kesesuaian norma hukum positif dengan tantangan teknologi kesehatan berbasis AI. Hasil kajian menunjukkan bahwa ketiadaan regulasi khusus (lex specialis) menimbulkan ketidakjelasan dalam menentukan standar kehati-hatian, hubungan kausalitas, serta siapa pihak yang harus dimintai pertanggungjawaban apakah pengembang, penyedia layanan kesehatan, tenaga medis, atau operator sistem. Ketidakpastian ini membuka potensi risiko hukum, termasuk kemungkinan kriminalisasi yang tidak tepat ketika kegagalan keputusan lebih disebabkan keterbatasan algoritma AI daripada kesalahan manusia. Oleh karena itu, penelitian ini menegaskan pentingnya merumuskan regulasi khusus yang menetapkan standar kehati-hatian, mekanisme pengawasan, serta batas tanggung jawab pidana guna memastikan penggunaan AI yang aman, etis, dan akuntabel dalam pelayanan kesehatan di Indonesia.

Abstract

Kekuasaan kehakiman di Indonesia merupakan salah satu cabang kekuasaan negara yang bersifat independen dan berfungsi untuk menegakkan hukum serta keadilan. Kekuasaan ini dijalankan oleh berbagai lingkungan peradilan, salah satunya adalah peradilan militer. Berdasarkan Pasal 9 Undang-Undang Nomor 31 Tahun 1997 tentang Peradilan Militer, peradilan militer memiliki kewenangan untuk memeriksa, memutus, dan menyelesaikan sengketa Tata Usaha Militer. Kewenangan tersebut merupakan bentuk perlindungan hukum bagi prajurit maupun pihak lain yang berhubungan dengan keputusan administrasi militer. Namun, hingga saat ini belum terdapat Peraturan Pemerintah sebagaimana diamanatkan dalam Pasal 353 Undang-Undang Nomor 31 Tahun 1997 yang mengatur hukum acara sengketa Tata Usaha Militer. Ketiadaan peraturan tersebut menimbulkan kekosongan hukum yang berdampak pada ketidakpastian hukum bagi para pencari keadilan. Tanpa adanya hukum acara yang jelas, proses pemeriksaan dan penyelesaian sengketa berpotensi berjalan tidak seragam dan tidak terukur. Penelitian ini bertujuan untuk menganalisis dampak ketiadaan peraturan hukum acara terhadap kepastian hukum, serta mengkaji urgensi pembentukan peraturan pemerintah dalam menjamin pelindungan hukum bagi pihak yang berperkara. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa ketiadaan pengaturan hukum acara secara khusus menghambat penerapan asas due process of law dalam penyelesaian sengketa Tata Usaha Militer. Kondisi ini juga tidak sejalan dengan asas kepastian hukum sebagaimana dijamin dalam Pasal 28D ayat (1) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Oleh karena itu, pembentukan Peraturan Pemerintah sebagai pelaksanaan amanat Pasal 353 merupakan suatu keharusan guna menciptakan kepastian hukum, menjamin pelindungan hak konstitusional setiap orang, serta memperkuat sistem peradilan militer yang berkeadilan.
