Abstract

Crime or criminal act is a word that is familiar to the public. Crime is increasingly common in society and its presence is very disturbing to society, because the losses it causes are not only material losses, but also the loss of a person's soul or life. The provisions of Law Number 35 of 2009 concerning Narcotics (Narcotics Law) have also mentioned several terms that have the same essence as narcotics users themselves, including narcotics abusers, victims of abusers, former narcotics abusers and patients. There are examples of cases of implementing medical rehabilitation. and social issues regarding narcotics abuse in the jurisdiction of the West Pasaman District Prosecutor's Office. Where the West Pasaman District Prosecutor's Office stopped the prosecution or Restorative Justice of three narcotics case files with five suspects to undergo rehabilitation because the suspects were narcotics addicts, not dealers. The suspects are suspected of being users or addicts of class I narcotics, not methamphetamine, violating Article 127 paragraph (1) letter a of the Narcotics Law. The Problem Formulation is (1) How is the termination of prosecution of narcotics abuse cases as an implementation of restorative justice at the prosecution stage (Case Study at the West Pasaman District Prosecutor's Office) and (2) What are the obstacles in terminating the prosecution of narcotics abuse cases as an implementation of restorative justice at the prosecution stage (Case Study at the West Pasaman District Prosecutor's Office)?. The conclusions of this research are: (1) The implementation of restorative justice in cases of narcotics abuse has been implemented at the West Pasaman Prosecutor's Office for 4 (four) suspects. The West Pasaman Prosecutor's Office has implemented Prosecutor's Guidelines Number 18 of 2021 concerning the Resolution of Handling of Narcotics Cases through Rehabilitation with a Restorative Justice Approach as an implementation of the Prosecutor's Dominus Litis Principle. (2) In its implementation, of course the West Pasaman District Prosecutor's Office also experienced obstacles that affected the implementation of restorative justice in cases of criminal acts of narcotics abuse.

Abstract

Pengaturan tentang Perlindungan Saksi dan Korban diatur dalam Undang-Undang Nomor 31 Tahun 2014 tentang perubahan atas Undang-Undang Nomor 13 Tahun 2006 tentang Perlindungan Saksi dan Korban. Dalam penanganan tindak pidana korupsi, terkait dengan istilah saksi pelapor, terdapat istilah Whistleblower. Secara umum Whistleblower adalah orang-orang yang mengungkapkan dugaan pelanggaran, kejahatan, mal-administrasi maupun korupsi dan kejahatan yang terjadi di tempatnya bekerja. Para whistleblower ini takut untuk melaporkan dugaan tindak pidana yang terjadi karena rentan akan intimidasi dan ancaman. Dalam rangka memberikan perlindungan hukum terhadap saksi pelapor tindak pidana korupsi Lembaga Perlindungan Saksi dan Korban (LPSK) serta Kepolisian Daerah Sumatera Barat melakukan koordinasi.

Abstract

One form of delinquency that often occurs is student brawls, which are mass fights between groups of students. This phenomenon is increasingly concerning because it results in many injuries and fatalities. In the context of Indonesian law, the act of brawling is regulated in Article 170 and Article 358 of the Criminal Code, which provides criminal penalties for those involved in group violence. The research method used is empirical juridical by examining literature material first followed by interviews. Then, the data obtained is analyzed qualitatively with the nature of analytical descriptive research. The results of the discussion show that law enforcement against criminal acts of brawl by children has been enforced properly in accordance with the applicable criminal procedure law while still taking into account the rights and obligations of children. However, in its law enforcement, the Padang City Police Force experienced obstacles caused by several factors including statutory factors, law enforcement factors, facilities and infrastructure factors, community factors, and cultural factors. It is hoped that the government will make regulations that specifically regulate student brawls in Padang City and for the community, especially parents, to carry out maximum supervision of their children not to brawl. Abstract

The term "contract" in the construction services sector is known as a construction work contract. A construction work contract are included the category of innominate or unnamed contracts because it emerged and developed without specific regulation in the Indonesian Civil Code (Burgerlijk wetboek). Construction work contracts are specifically regulated under Law Number 2 of 2017 concerning Construction Services. According to Article 47, paragraph (1) of the Construction Services Law, one of the clauses that must be included in a construction work contract is the choice of dispute resolution for construction disputes. Furthermore, in the attachment to the Model Document Selection Regulation National Public Procurement Agency Number 12 of 2021, there are also provisions regarding the choice of dispute resolution clause in the general terms of contract and special terms of contract sections. The general terms of contract and special terms of contract are integral parts of a construction work contract, even though they are structurally separated into two different sections. However, in practice, there are still construction work contracts that do not include this clause. This study aims to analyze the validity of construction work contracts that do not include the choice of dispute resolution clause. The research method used is normative. The results of the study indicate that the presence of a construction dispute resolution choice clause is included as an element of naturalia. The naturalia element is an element in a contract/agreement that is still considered to exist and does not render the agreement invalid or non-binding on the parties who made it. If the choice of dispute resolution clause is not included in a construction work contract, it does not automatically render the contract invalid. The contract will remain valid as long as it meets the general requirements for the validity of a contract as stipulated in Article 1320 of the Indonesian Civil Code. However, it is important for parties involved in a construction work contract to include this clause because its presence can provide clarity and legal certainty in the execution of the construction work contract.

Abstract

Notaris Pengganti adalah seseorang yang diangkat untuk sementara sebagai Notaris untuk menggantikan Notaris yang cuti, sakit, atau tidak dapat melakukan tugasnya. Setelah Notaris Pengganti dilantik oleh MPW, Notaris dan Notaris Pengganti harus membuat berita acara serah terima protokol. Notaris yang menjalankan cuti harus menyerahkan Protokol Notaris kepada Notaris Pengganti, dan Protokol tersebut diserahkan ke Notaris Pengganti. Pokok permasalahan adalah bagaimana implementasi ketentuan tentang serah terima protokol notaris kepada notaris pengganti di Kota Pekanbaru dan bagaimana penerapan sanksi terhadap ketentuan tentang serah terima protokol notaris kepada notaris pengganti di Kota Pekanbaru. Penelitian hukum ini menggunakan pendekatan yuridis empiris yaitu suatu penelitian yang menggunakan metode pendekatan terhadap masalah dengan melihat norma-norma hukum yang berlaku kemudian dihubungkan dengan fakta-fakta hukum yang terdapat dilapangan. Dalam penelitian ini sumber data diperoleh dari penelitian kepustakaan dan penelitian lapangan. Teknik pengumpulan data dilakukan melalui studi dokumen dan wawancara terstruktur. Hasil penelitian, Implementasi ketentuan tentang serah terima protokol notaris kepada notaris pengganti di Kota Pekanbaru tidak sesuai dengan ketentuan yang seharusnya, karena tidak ada pengawasan yang cukup dari Majelis Pengawas. Sementara Pasal 67 dan 68 UUJN mengatur beberapa bentuk Majelis Pengawas, kurangnya pengawasan terhadap Notaris menyebabkan Notaris dan Notaris Pengganti tidak tahu tentang ketentuan Pasal 32 UUJN, dan kebiasaan menyebabkan berita acara serah terima Protokol Notaris tidak dilaksanakan secara hukum. Pengawasan ini tidak hanya bertujuan untuk menciptakan Kode Etik Notaris, tetapi juga untuk memastikan bahwa notaris mematuhi peraturan undang-undang dalam menjalankan tugas mereka untuk kepentingan masyarakat. Penerapan sanksi terhadap ketentuan tentang serah terima protokol notaris kepada notaris pengganti di Kota Pekanbaru hanya memberikan sanksi administratif berupa teguran secara lisan sesuai dengan ketentuan Pasal 85 UUJN. Penjatuhan sanksi yang dilakukan oleh Majelis Pengawas terkait Pasal 32 UUJN berdasarkan ketentuan Peraturan Menteri Hukum dan HAM Nomor 61 Tahun 2016 Pasal 5 huruf e. Sedangkan dalam hal kewajiban yang terdapat dalam Pasal 5 ayat (4) tidak dipenuhi dalam waktu yang ditetapkan atau melakukan kesalahan lain maka MPW dapat mengajukan usulan pemberhentian sementara kepada MPP berdasarkan ketentuan Pasal 6 ayat (1).

Abstract

Budi Said, as an individual, entered into a gold sale and purchase agreement with PT. Antam Tbk, which later became a dispute because PT. Antam Tbk failed to fulfill its obligations as per the agreement. The agreement in question was an underhand sale and purchase agreement. The issues to be examined in this case are as follows: first, the considerations of the judges in the Supreme Court decision related to the gold purchase dispute between PT. Antam Tbk and Budi Said; second, the responsibility of PT. Antam Tbk in this dispute based on Supreme Court decision number 1666 K/Pdt/2022; and third, how legal protection is provided to Budi Said regarding the unlawful actions of PT. Antam Tbk. This study employs a normative juridical approach with both a case approach and a statute approach. The data sources include secondary data consisting of primary, secondary, and tertiary legal materials. To analyze the first issue, the theory of legal certainty is applied, while the theory of responsibility is used for the second issue, and the theory of legal protection is used for the third issue. In this case, there is a discrepancy between the decisions of the lower courts (judex factie) and the Supreme Court (judex juris), which violates the principle of legal certainty. In Supreme Court decision number 1666 K/Pdt/2022, PT. Antam Tbk was found to have committed an unlawful act by failing to deliver the remaining 1.1 tons of gold from the total of 7 tons agreed upon, a failure that involved the company’s employees. PT. Antam Tbk was also held responsible for the losses suffered by Budi Said. Based on this Supreme Court decision, Budi Said received repressive legal protection, which applies after the dispute has occurred and is in the form of sanctions or compensation.

Abstract

Land acquisition plays an important role in development and requires the involvement of a notary to ensure the legality of the transaction. However, in practice, notaries can be involved in corruption crimes, such as falsifying documents and inflating prices. This study analyzes the criminal liability of notaries in the case of corruption in land acquisition of UIN Imam Bonjol Padang Campus with a normative juridical approach and case studies. The results of the study show that notaries who abuse their authority can be subject to criminal sanctions. Therefore, strict supervision and stricter regulations are needed to prevent corruption in land procurement and maintain the integrity of the notary profession

Abstract

A peace deed is a legal instrument that has binding force and permanent legal force, equivalent to a court decision that cannot be appealed or appealed. In the practice of resolving civil disputes, peace deeds play an important role in providing fast, simple, and low-cost solutions, especially in the context of simple lawsuits. This study aims to examine two main aspects, namely (1) how the implementation of the peace deed as a method of resolving civil disputes through a simple lawsuit at the Padang District Court, and (2) the legal consequences that arise if one of the parties commits a default on the content of the peace deed. Using an empirical juridical research method, this study processed primary and secondary data through literature studies and interviews with related parties. The results of the study show that the simple lawsuit mechanism provides efficiency in resolving civil disputes, both in terms of time and cost. In addition, if one party commits a breach of the peace deed, the other party can immediately submit an application for execution to the court without the need to file a new lawsuit. These findings confirm that peace deeds have a strategic function in accelerating the resolution of civil disputes and strengthening legal certainty for the parties to the dispute

Abstract

The application of the presumption of innocence in the press has long been a subject of attention and debate, both within the legal community and among journalists themselves. However, until now, the debate has not reached a consensus. Debates have started to arise regarding how the provisions in the Constitution (1945 Constitution) should be interpreted regarding applying the presumption of innocence in the press field. The debate continues to the level of analyzing how the legal regulations on the presumption of innocence should be applied in the field of press, and even the technical implementation in reporting. This paper utilizes normative legal research with a descriptive-analytical approach. Secondary data is sourced from legal regulations in the field of the press. Through qualitative analysis, the research yields the following results: Firstly, the presumption of innocence is incorporated into the Journalistic Code of Ethics with the hope that mass media, in their reporting, will not fall into the trap of "trial by the press," which involves reporting that tends to "judge" someone, violating the principles of a fair trial. Reporting that tends to express opinions on the guilt of a suspect not only violates the fundamental principles of the rule of law, namely judicial independence but also infringes upon an individual's human rights by diminishing their right to a legal defense.

Abstract

In the Coal Sale and Purchase Agreement Number 39/PJJ/PBR.12/01.2008 between PT Semen Padang and PT Berkala International, payment is made by Domestic Documented Letter of Credit or Letter of Credit.  For this reason, SKBDN Number MS 77106009548 was issued by PT Bank Mandiri in the amount of IDR 29,700,000,000.00,- to PT Berkala International. PT Berkala Internasional defaulted on not sending coal according to the agreed time. Using a case approach and normative juridical, primary data was obtained from PT. Semen Padang and secondary data are primary and secondary legal materials. To analyze the first problem, legal protection and contract theory are used, the second problem is dispute resolution theory. According to Article 1338 of the Civil Code, the consent made legally binding on the parties holding it, providing legal protection for PT Semen Padang to demand PT Berkala International, to do something, namely to deliver coal as stipulated in Article 1234 of the Civil Code. According to the contract theory, the agreement occurred after the party that received the offer, namely PT Berkala International, agreed to PT Semen Padang's offer to send coal. By filing a default lawsuit, the Padang District Court, the Padang High Court, and the Supreme Court, won PT Semen Padang.
