Abstract

Law Number 17 of 2023 concerning health has regulated the position of MKDKI in resolving medical disputes. The MKDKI's authority in the Health Law has been expanded to relate to violations of doctor's discipline, enforcing decisions regarding unlawful acts that can be subject to criminal sanctions, and enforcing accountability for actions/deeds that cause civil harm to patients. Based on this authority, MKDKI is similar to an institution that acts on the principles of fast, simple and low-cost justice. To study the MKDKI model, normative juridical research or doctrinal research is used. The study that will be discussed concerns the interpretation of the legal principles of law enforcement regarding alleged medical malpractice which contains violations of criminal law. The results of the research state that the MKDKI's authority, which is based on the process of resolving medical disputes using the principles of fast, simple and low cost, is less effective. Supreme Court Decision Number: 890K/Pid.Sus/2017 is an example of a legal solution that actually harms doctors. It is necessary to transform MKDKI into a strong institution, with a pattern of resolving medical disputes using fast, simple and low-cost principles. A medical dispute resolution model based on the principles of fast, simple and low cost will only emerge if a Medical Court is established. MKDKI as Medical Justice aims at enforcing acts that violate criminal law and enforcing responsibility for actions/deeds that cause civil harm. The MKDKI's independence, such as independent judicial power, to the MKDKI's objection filing system which adopts an appeals filing system within the judiciary, further emphasizes the need to transform the MKDKI as a judicial institution.

Abstract

The West Java Child Special Penitentiary (LPKA) noted that in 2020 there were 241 juvenile detainees and 429 juvenile prisoners. Criminal behaviour in children is related to low social control such as attachment, responsibility, involvement, and the belief that the higher the social control, the lower the possibility of a child violating the law. The main issue in the settlement of juvenile criminal cases is the criminal justice system that does not take sides with children because the handling in this system has not implemented a restorative justice policy. Children who commit crimes ideally need to be returned to their original condition, not just punished for their actions. In fact, data on juvenile detainees and juvenile prisoners show an indication of suboptimal restorative justice policies. The purpose of this study was to determine the role of social control over children as perpetrators of criminal acts and to determine the policy of restorative justice in the process of resolving cases. This research is a descriptive study, using qualitative data analysis techniques with normative and empirical juridical approaches. The research subjects were 22 juvenile prisoners and detainees in one of the Penitentiaries of the West Java region. The results of the study indicate that social control plays a role in children as perpetrators of criminal acts, as well as the settlement of child criminal cases based on restorative justice policies, is not optimal. There are many diversion failures and a fairly high percentage of prison sentences that should be a last resort. There is also a large public stigma against the statement that children who violate the law should be imprisoned. On the other hand, trauma due to the examination process, prison life, and stereotypes as ex-convicts will greatly affect the psychological function of children. This can lead to low self-confidence, feeling worthless, and becoming the cause of recidivists because they feel unforgivable even though they have served their sentence.

Abstract

Cases of sexual violence against women are still a serious threat in Indonesia. Rape victims take a long time to overcome the traumatic experience, and some never return to normal as before. A further impact as a result of sexual rape is that it causes rape victims to experience unwanted pregnancies. Those pregnancies that lead to rape victims have abortions or abortion provocatus. This study aims to find out how legal protection is for rape victims who commit abortions and to analyze how long the health law should allow for an abortion according to medical criteria. This study uses normative legal research methods. This study concludes that the Health Law regarding abortion is a realistic rule based on health aspects. It's just that it is necessary to reconstruct the article on abortion regulations related to rape. Provisions which allow abortion if the gestational age is 6 (six) weeks or 40 (forty) days. Age is calculated from the first day of the last menstruation. This research uses a normative juridical method supported by the reality that exists in today's society, so that the results of this research are expected to make a positive contribution in the field of law, especially for victims of rape in order to get the justice they should.

Abstract

Penelitian ini memiliki tujuan untuk mengkaji dan menganalisa pertanggungjawaban pidana pengelolaan dan pembuangan limbah yang dilakukan tanpa izin  dan mengkaji dan menganalisa penerapan pidana penjara dan pertanggungjawaban pidana terhadap pelaku pembuangan limbah tanpa izin. Penelitian ini menggunakan penelitian yuridis normatif dengan data sekunder berupa bahan hukum primer, sekunder, dan tersier. Hasil penelitian menunjukkan adanya ketentuan yurisprudensi Putusan MA Nomor 862/K/Pid.Sus/2010, seakan menjadi celah hukum bagi oknum-oknum lainnya untuk memanfaatkan yurisprudensi Putusan Mahkamah Agung Nomor Nomor 862/K/Pid.Sus/2010 tersebut untuk lolos dari pertanggungjawaban pidana. Sudah selayaknya, terhadap perusahaan yang melakukan pengelolaan maupun pembuangan limbah B3, yang tidak dikelola maupun diolah berdasarkan standar pengelolaan maupun pembuangan limbah B3 sebagaimana diatur dalam Undang-Undang Nomor 32 Tahun 2009 untuk dapat menerima banyak sanksi yang layak, mulai dari denda yang besar, pencabutan izin usaha, penutupan usaha, sampai dengan pidana penjara terhadap seluruh pihak yang bertanggungjawab atas pengelolaan maupun pembuangan limbah B3 yang dilakukan secara melawan hukum.

Abstract

The profession of a doctor with its scientific tools has unique characteristics. This specificity can be seen from the justification given by law, namely from the permissibility of carrying out medical actions on the human body in an effort to maintain and improve health status. Medical actions against the human body such as surgery, transplantation, removal of certain parts of human organs carried out by doctors are not classified as criminal acts. Conversely, if the action is not carried out by a doctor, it will be classified as a crime. The medical profession is positioned as a noble profession (afficium mobile) similar to the advocate profession. This profession has a noble mission to help people who are experiencing difficulties. The purpose of this study was to analyze the legal responsibility of doctors for alleged medical malpractice for surgical procedures based on Law Number 29 of 2004 concerning Medical Practice and procedures for resolving reports of alleged medical malpractice from an internal view of the medical profession. The term malpractice in the health service sector has recently begun to be widely discussed by the public from various parties as a result of the many complaints of cases that are suspected of being malpractice according to the designations and terms in society against the medical profession which is considered to have harmed patients in doctors treating a patient. As for this research, it uses a normative juridical method supported by an approach to events or phenomena that occur in society. The promulgation and enforcement of legal norms on the limits of medical malpractice are best contained in the Law on Medical Practice, which is now in effect in Law Number 29. 2004 concerning the Implementation of Medical Practice and how accountability should be carried out in accordance with positive law in force in Indonesia.

Abstract

Abstract Financial technology innovation that occurs nowadays leads to accelerated changes in the financial sector. However, these developments are like double-edged swords, on the one hand they provide convenience for consumers, on the other hand pose risks for consumers related to the confidentiality of their personal data. Money lending business through Peer to Peer lending (P2P lending) system often results in consumers receiving threats when they are late making payments. This paper presents several cases that result in consumers experiencing personal data theft, receiving threats directed at relatives or acquaintances. Even committing fraud by taking money from borrowers or customers without following the regulations made by the Financial Services Authority (OJK). The research data is carried out in a qualitative normative way where the data is translated based on legal norms and uses legal theory that can explain and answer existing legal problems. Keywords: Consumer Protection, Peer to Peer lending (P2P lending), Private Data Protection Abstrak Inovasi teknologi keuangan yang terjadi saat ini mengarah pada akselerasi perubahan di sektor keuangan. Namun perkembangan tersebut ibarat pedang bermata dua, di satu sisi memberikan kemudahan bagi konsumen, di sisi lain menimbulkan risiko bagi konsumen terkait kerahasiaan data pribadinya. Bisnis money lending melalui sistem Peer to Peer lending (P2P lending) seringkali mengakibatkan konsumen mendapat ancaman ketika mereka terlambat melakukan pembayaran. Makalah ini menyajikan beberapa kasus yang mengakibatkan konsumen mengalami pencurian data pribadi, menerima ancaman yang ditujukan kepada kerabat atau kenalan. Bahkan melakukan penipuan dengan mengambil uang dari debitur atau nasabah tanpa mengikuti ketentuan Otoritas Jasa Keuangan (OJK). Data penelitian dilakukan secara normatif kualitatif dimana datanya diterjemahkan berdasarkan norma hukum dan menggunakan teori hukum yang dapat menjelaskan dan menjawab permasalahan hukum yang ada. Abstract

Indonesian strategic archipelago allows rapid migration of goods and services to its neighbor countries. Along with goods and services, the wide coastal area also facilitates migrant worker to enter and exit Indonesia through several ports. First and foremost interference on the borderless coastal boundary is Illegal, Unreported and Unregulated (IUU) Fishing. The IUU foreign fishing vessels frequently transporting illegal migrant worker obtained through human trafficking, people smuggling, forced labor, child exploitation, torture, and discrimination. This practices can then be categorized as one of the transnational organized crime at sea. This paper focuses on the studies of notorious cases of human trafficking on IUU Fishing. This journal will also observe the lack of prevention measure of transnational crime on UNCLOS and utilization of bilateral and multilateral treaties on IUU Fishing.

Abstract

The crime of sexual violence in Indonesia is in an emergency phase. The massive number of reports of cases of sexual violence has created its own paranoia for the community, especially in terms of the process of handling cases of sexual violence in Indonesia. This study aims to analyze cases and phenomena of sexual violence in Indonesia and to carry out a normative approach as a study of handling cases of sexual violence. The research method used is normative legal research and the method of analyzing literature and case studies of sexual violence in Indonesia. The results of this study indicate that cases of sexual violence have evolved along with the times. The emergence of gender-based cyber sexual violence (KSBG), abortion cases, and efforts to handle cases using the Alternative Dispute Resolution (ADR) system are injustices to victims. Settlement of cases of sexual violence must be in accordance with Law Number 12 of 2022 concerning Crimes of Sexual Violence, namely the implementation of a legal judicial process.

Abstract

Corruption crimes committed by civil servants or state apparatus are thoroughly correlated to the abuse of authority and state losses. The authority given to organize and carry out burdens and errands for the assistance of the public is misused by enriching oneself or personal groups. However, there is an alteration in the mistakes made by civil servants or state apparatus which can cause losses to the public, specifically in the field of civic administration, in this case the gaining of goods and facilities. This error is referred to as an administrative error. This study discusses the differences in legal responsibility for state losses in acts of corruption with state losses in state administration law and regarding the return of state losses by goods and services procurement officials to be able to remove punishment. The difference between state losses in acts of corruption is intentional losses to enrich oneself or a group, while state losses in state administrative law are carried out without any element of intentional committing a crime. Returning state losses within a period of 10 (ten) days for administrative errors committed by bureaucrats for the obtaining of goods and facilities can remove the punishment that was originally classified as a illegal turn of corruption because this was done as part of an unintentional mistake and not to augment oneself or a particular assembly.

Abstract

The role of women in academic and structural positions in tertiary institutions is an important part of achieving gender equality, particularly in the educational sphere. The purpose of this research is to investigate the perceptions of women lecturers’ career success, participation, and representation, and to determine the factors that impede them or serve as barriers for women’s career success, participation, and representation in tertiary institutions. The research used a mixed methods approach, namely quantitative surveys that were analyzed using descriptive statistics, while qualitative data and descriptive statistical results were used to carry out model gender analysis of Sara H. Longwee’s "Women's Capability Framework," which emphasizes the importance of development for women. Respondents were selected from Bhayangkara Jakarta Raya University, a private university based in Jakarta, Indonesia. Results show that women perceived that their career success, participation, and representation in tertiary institutions were adequate. On the other hand, the barriers that impede the women’s career success, participation, and representation in tertiary institutions were both internal and external barriers, with internal barriers such as domestic affairs, psychological and emotional, ego and arrogance, and time management, playing a bigger role as impediments. Hence, it is recommended that tertiary institutions in Indonesia develop and enforce firm gender mainstreaming policies to support women in the workplace to overcome these barriers that hinder their career success, participation and representation.
