Abstract

This study examines the application of material law in resolving Islamic banking disputes following the Constitutional Court Decision No. 93/PUU-X/2012 through a review of normative-jurisprudential literature. The Constitutional Court's decision affirmed the absolute authority of religious courts in Islamic banking disputes, but the practice of applying material law by judges shows problematic dynamics. The objectives of this study focus on three things: the consistency of judges' normative references, the dominant sources of material law used, and the suitability of their application to the principles of maqashid al-shariah. The method used is normative juridical with a literature approach, which involves a review of laws and regulations, court decisions, DSN-MUI fatwas, the Compilation of Islamic Economic Law (KHES), and relevant academic documents. The results of this study indicate that although the authority for dispute resolution has formally shifted to religious courts, the application of substantive law in practice remains inconsistent with the ideals of Islamic economic law. Judges tend to rely more on the Civil Code as the primary reference, while the KHES and DSN fatwas are used to a limited extent and are more complementary. Furthermore, the substance of decisions still relies heavily on a formalistic approach, so that the values of maqashid al-shariah, such as justice, benefit, and protection of rights, have not been optimally internalized. Theoretically, this study enriches the discourse on the importance of integrating maqashid al-shariah into the practice of Islamic economic jurisprudence. Practically, these findings imply the need to strengthen the capacity of judges through training, the development of more applicable technical guidelines, and the strengthening of the position of KHES and DSN fatwas as primary sources of law, in order to realize a more substantive, just, and beneficial sharia justice system

Abstract

This study explores the strategies employed by ELSI teachers in managing talkative students within an English-only classroom environment. Talkative students can bring positive energy and active participation into classroom interaction, yet excessive talkativeness may disrupt lessons and limit quieter students’ chances to speak. This research aimed to reveal how teachers transform such behaviour into meaningful learning opportunities that promote motivation and engagement. A qualitative case study design under a post-positivist paradigm was applied, involving classroom observations and interviews with an experienced teacher at ELSI Padang. The data were analysed thematically using Self-Determination Theory (SDT) as the analytical framework to understand how teachers fulfil students’ psychological needs for autonomy, competence, and relatedness. The findings revealed six major strategies: balancing participation, motivating students through recognition and competition, fostering a supportive and enjoyable English-only environment, adapting teaching methods to learner diversity, maximizing peer influence, and maintaining positive perceptions toward talkative students. These strategies allowed the teacher to transform talkative behaviour into a motivational asset that enhanced students’ participation and confidence in speaking English. The study provides valuable insights for teachers and practitioners in non-formal English education contexts on managing active classroom dynamics effectively.

Abstract

This study aims to analyze teacher’s strategies in providing direct and indirect written feedback through semi structured interview, and to analyze students’ responses in their cognitive, affective, and behavioral responses through questionnaire and focus group discussion. The research was conducted at SMP Negeri 12 Padang with 65 ninth-grade students who came from class IX-2 and IX-4, and 1 English teacher. Descriptive quantitative research approach was employed because the main goal was to describe the existing phenomenon of students’ responses statistically through frequencies and percentages. From the results, it showed that most of students preferred direct feedback with the percentage 88.8% rather than indirect feedback with the percentage 70.75%. The results indicated that the teacher provided both of the feedback, but direct feedback was more frequently and consistently used. Most students preferred direct feedback as it is clearly showed their mistakes, enable immediate correction, and helped them understand. However, some students appreciated indirect feedback because they thought it encouraged them to think critically, searched for the answers independently, and less dependent on the teacher. In the affective responses, 80.7% students said that written feedback made them feel confident, 87.6% said that they were motivated to write better. In behavioral responses, 64.6% students tried to ask teacher if there was something that they did not know, and 75.3% students tried to correct the mistakes that the teacher had marked. The study concludes that combining direct and indirect written feedback can enhance students’ writing skills and increase their motivation in writing.

Abstract

This study aims to analyze the role of village head leadership in enhancing community participation for village development in Talle Village, South Sinjai District. The methodology employed is a qualitative approach with data collection techniques through interviews, observations, and documentation. The findings indicate that effective village head leadership can encourage active community participation in all stages of development, from planning to implementation. The research reveals that participatory decision-making and good communication between the village head and the community are crucial for enhancing citizen engagement. However, the main challenge faced is the low attendance rate of the community in planning forums, which results in a lack of input and aspirations from the community in development planning. The conclusion of this study emphasizes the need for efforts to raise awareness and motivation among the community to become more actively involved. More sustainable and innovative strategies are required to create a conducive environment for community participation in village development.

Abstract

The level of tax literacy among students remains relatively low, even though early understanding of taxation is a crucial foundation for shaping aware and compliant taxpayers in the future. This community service program aims to enhance the understanding of taxation among Senior High School (SMA) students through an interactive and practical educational approach. The implementation methods included socialization, workshops, role-playing simulations, and tax case discussions designed to foster students' interest and comprehension of the function of taxes in national development. The results of the program showed a significant increase in students’ enthusiasm and understanding of basic tax concepts, tax administration, and their implications for public welfare. Positive responses from schools further indicated the potential sustainability of this program as part of a financial literacy extracurricular activity. Collaboration between universities, schools, and tax authorities is a strategic step to sustainably strengthen tax awareness among the younger generation.

Abstract

Penelitian ini bertujuan untuk menganalisis peran manajemen laba dalam memediasi hubungan antarabeban pajak tangguhan dan tax avoidance. Penelitian ini menggunakan pendekatan kuantitatif dengandata sekunder berupa laporan keuangan perusahaan manufaktur yang terdaftar di Bursa EfekIndonesia (BEI) selama periode 2020-2024. Sampel penelitian diperoleh melalui teknik purposivesampling yang menghasilkan 95 perusahaan dengan total 475 observasi. Analisis data dilakukanmenggunakan regresi data panel dan uji mediasi dengan pendekatan Baron dan Kenny. Tax avoidancediproksikan dengan effective tax rate (ETR), beban pajak tangguhan diukur dengan rasio beban pajaktangguhan terhadap total aset, dan manajemen laba diukur menggunakan discretionary accruals. Hasilpenelitian menunjukkan bahwa beban pajak tangguhan berpengaruh positif terhadap tax avoidancedan manajemen laba. Manajemen laba juga berpengaruh positif terhadap tax avoidance serta terbuktimemediasi secara parsial hubungan antara beban pajak tangguhan dan tax avoidance. Temuan inimenunjukkan bahwa fleksibilitas akuntansi pajak dimanfaatkan manajemen sebagai saranapenghindaran pajak, sehingga memberikan implikasi penting bagi otoritas pajak dan investor.
