Abstract

The purpose of this research is to find out the benefits and meanings of communication technology for marriage according to Islamic law. The research method uses normative juridical research, namely library law research which is carried out by studying library materials or secondary data. The results of this study note that the benefits of communication technology for marriage according to Islamic law are (a) as a means to establish human relations, both friendly relations between relatives, relations with fellow friends, or work relations, (b) as a means of communication that can be used to improve the quality of relationships and harmony between family members/spouses and (c) facilitate the transfer of knowledge within a family. The meaning of communication technology for marriage according to Islamic law is to limit the personal sphere to blur, reduce interaction between families, waste time in vain and make partners jealous.

Abstract

Anak-anak memiliki hak yang sama baik dalam hal warisan maupun lainnya, pelanggaran yang dilakukan oleh kedua orangtua tidak boleh mempengaruhi anak-anak yang menjadi korban tindakan perselingkuhan atau perzinaan dari kedua orangtuanya. Setiap manusia pada umumnya memiliki kesamaan kebebasan menurut hukum, baik hukum Islam maupun hukum positif dan diatur dalam hukum sehingga dalam memutuskan status warisan seorang anak yang dilahirkan ke dunia dalam jangka waktu perkawinan paling lama 6 (enam) bulan, anak dapat mengikuti silsilah ayah dan memenuhi syarat untuk memperoleh harta. Dijelaskan pula dalam pasal 100 dan 186 KHI yang berarti bahwa anak akibat dari pezinaan dapat memilih hak waris apabila terlahir dalam dalam ranah perkawinan.

Abstract

This article describes contemporary problems that have been growing and are being asked to solve. This research is literature research with a casuistic approach and analyzed descriptively qualitatively. The results of the study show that a mujtahid must really study and review many legal issues decided and depending on the conditions and needs. Ijtihad is one of the methods of extracting Islamic law that logically and rationally in social change always tries to conduct research or experiments on increasing law in society, so it must be tested that the value of ijtihad can be justified by scientists and is objective. Ijtihad in issues of contemporary Islamic law is one method that makes Islamic law more dynamic and contextual in nature and not out of date.

Abstract

Islamic law, as inherent in legalizing a problem faced by society, is an interesting discussion in the reflection of religious law in society. How not, the problems faced by the community continue to grow and are always global, as a large current that must find a solution. The dialogue between the sociological aspect and the establishment of Islamic law is a discourse that continues to get attention and must get factual answers as a result of reformulation of Islamic law towards a better direction. This study is a conceptual study or literature review, which examines data from Islamic law books, books and journals that have relevance. The result of the research shows that, the constructive relation of Islamic law between the sociological aspect and its stipulation is something that cannot be separated. The determination of Islamic law, always considering the sociological aspects of society, shows that the law is for human beings, so it is not surprising that Islamic law is flexible and measurable. The implication that is born in the sociological aspect is the establishment of a sweet and elastic Islamic law determination while still paying attention to its normative and historical aspects.

Abstract

This article discusses the benefits and benefits of modern technology from a maslahah perspective which aims to provide an explanation regarding the benefits of modern technology on the development of Islamic law, and how it has a negative influence on the development of Islamic law. This article is a literature review sourced from several relevant references to the topic discussed. Data collection techniques come from researching relevant reference sources in the form of journals, articles, websites, books and other scientific works. Islam has full care and attention for its ummah so that it continues the process of exploring the potential of nature and the environment to become the center of a glorious civilization. In this context, there is no conflict between science and Islam, where both work in balance and harmony to create scientific treasure and human civilization that is better than before. Current technological advances cannot be separated from people's lives. We can now know various information that occurs in various parts of the world directly thanks to technological advances (globalization). Previously, we knew the saying "the world is not as wide as a moringa leaf", now that saying should be changed to today's world as wide as a moringa leaf, because the rapid access to information in various parts of the world makes this world seem narrower because we can see what is happening in America for example, even though we are in Indonesia.

Abstract

This study examines the role of the government in this case the Ministry of Religion of Barru Regency in overcoming problems related to religious affairs, one of which is the difference in the direction of Qibla in the community. Qibla direction is very important to know because it greatly affects the quality of worship (acceptance of prayer or not) that is done. In determining the Qibla direction, various methods are used, including using a istiwaini, compass, Qibla arc, and Qibla tracker. This research is classified as field research, with a normative (syar'i) and juridical theological research approach where the data that is considered relevant in the object of this research is studied in depth and then poured into a discussion in accordance with the existing problems, including those related to its existence in determining the Qibla direction and the implementation process in measuring the Qibla direction. Abstract

Humans live in plurality, which is an unavoidable phenomenon that can encourage conflict and has the potential to divide people. To realize unity based on existing differences, one of the values that must be upheld is the value of tolerance. This research aims to find out Islam's attitude towards plurality, what kind of tolerance is taught, and examples of its implementation. This research is qualitative literature research with a normative theological approach. The results of the research show that Islam's attitude towards plurality is to apply wise tolerance, not the excessive tolerance that is often applied in Indonesia. Wise tolerance means responding to religious plurality with each party continuing to follow its religion, upholding the principles of faith, which are the most basic things in religion, and not disturbing the existence of other parties. It is hoped that with wise tolerance, people can live in peace and tranquility without having to sacrifice the principles of faith that are embedded in their religion.

Abstract

Political ethics that are lacking in both government and society often create an environment where Corruption, Collusion, and Nepotism (CCN) can thrive unchecked. These CCN practices not only cause economic harm but also threaten social and political justice within the community. Injustice in wealth distribution and opportunity is another frequent consequence of this lack of political ethics. Furthermore, the Pancasila ideology, as the foundation of the Indonesian state, is often obscured in everyday political practice. This obscuration can hinder the democratization process and the achievement of social justice envisioned by the nation's founders. Nurcholish Madjid, an Indonesian Muslim intellectual, offers a pertinent perspective on improving political ethics. According to Madjid, good political ethics should be based on the principle of equitable justice for all citizens and promote inclusive and participatory democracy. Madjid also emphasizes the importance of transparency in the political process, where the public has broad access to information and government decisions. Referring to Madjid's thoughts, efforts to enhance political ethics in Indonesia can be achieved by emphasizing values of justice, democracy, and transparency. This not only reduces CCN practices and injustice but also creates greater space for the recognition and implementation of Pancasila values in Indonesian political and social life as a whole. Nurcholish's political thoughts, if applied in national life, especially in the current context, are highly relevant because Indonesia still needs a better and more just political system and order. It is time for Indonesia to reform and reshape not only a more democratic and socially just political framework but also to realize political ethics as described above, which tend to be neglected.

Abstract

The religious authoritative institution of the Indonesian Ulema Council (MUI), is facing infiltration by members connected with acts of terrorism. This leads to public demands for its dissolution under the banner of "Joint Enemy Terrorism". Therefore, this study aimed to assess the possibility of dissolving MUI by reviewing the root causes of terrorism within the religious institution. Through the lens of Islamic political analysis and a critical examination of various data sources, it became evident that the discourse advocating for the dissolution centered around the hashtag #BubarkanMUI#. This hashtag campaign was initiated to frame the participation of MUI members in extremist activities, thereby posing a threat of criminal terrorism. MUI, on the other hand, was beyond dispute due to its strong and legally entrenched position. In this context, the prospect of the dissolution became irrelevant, impractical, and challenging to materialize primarily due to membership issues. The existence of MUI was strengthened and secured through several laws mandating its engagement, including the certification of halal products and regulation of Sharia banking. This showed the religious institution must embark on a thorough evaluation and enhancement of both its structural framework and membership recruitment processes. Regarding the authority to dissolve non-political institutions and organizations, this prerogative should be entrusted to the Constitutional Court, serving as a judicial entity responsible for safeguarding democracy, human rights, and constitutional principles.

Abstract

Ibn Taymiyyah is known as the inspiration of the Wahhabi movement that aims to the purification of the teachings of Islam. This movement departs from the separation between the ‘ubūdiyyah and un-‘ubūdiyyah teachings, which are also inspired by Ibn Taymiyyah's thought. In 'ibādah, Ibn Taymiyyah holds the rule that as long as there is no ordered argument it should not be done. However, the notion of ibādah according to Ibn Taymiyyah is not limited to mahdlah worship but more broadly. Whereas in mu'āmalah, he holds the rule of allowing doing anything as long as there is no prohibition against it. In shaping the concept of 'ibādah and mu'āmalah, at first, Ibn Taymiyyah accepted it as something normative from the thought of Ahmad ibn Hanbal. But when he saw the social reality with the number of deviations' in ibādah done by Muslims, the concept that has been obtained normatively from the thought of Ahmad ibn Hanbal is reaffirmed and expanded to become a sociological concept, in addition to being normative.
