Abstract

ABSTRAKKerusakan hutan mengalami peningkatan luas kerusakan setiap tahun di Indonesia. Setidaknya, sekitar 857.756 hektare. Terdiri dari 630.451 hektar lahan mineral dan 227.304 hektar lahan gambut. Angka ini meningkat 160% dibandingkan sebelumnya yang luasnya sekitar 328.724 hektar. Situasi ini akan berdampak pada lingkungan secara keseluruhan, termasuk perubahan iklim pada kenaikan suhu udara. Pemerintah sudah banyak mengkampanyekan larangan kebakaran hutan dan illegal logging, namun kebakaran hutan dan illegal logging masih saja terjadi, sehingga perlu mengintensifkan instrumen lain. Yakni dengan memanfaatkan peran masyarakat adat, mereka memiliki banyak kebijakan lokal yang dapat dimunculkan dan dijadikan salah satu kebijakan nasional dalam rangka pencegahan terjadinya tindak pidana pembakaran hutan dan illegal logging. Metode penulisan makalah ini adalah penelitian non doktrinal, dengan wawancara mendalam kepada tokoh masyarakat adat, kemudian hasil wawanca-ra mendalam dianalisis untuk dijadikan rekomendasi temuan penelitian. Hasilnya adalah model penegakan hukum di masyarakat adat, dalam praktiknya sejalan dengan konsep hukum pidana administrasi. Konsep hukum ini menekankan pada prinsip penegakan hukum yang tidak berorientasi pidana sebagai pilihan utama. Masyarakat adat mengutamakan upaya pencegahan berupa larangan perusakan hutan, kemudian pembatasan mengambil kayu hutan, dan kewajiban menanam kembali pohon.Kata kunci: perusakan hutan; masyarakat adat; lampung; penebangan liar. ABSTRACT The area of Forest damage has increased every year in Indonesia. At least, about 857,756 hectares. It consists of 630,451 hectares of mineral land and 227,304 hectares of peat land. This figure is an increase of 160% compared to the previous area of about 328,724 hectares. This situation will have an impact on the environment, including climate change and the increase in air temperature. The government has made many campaigns for the prohibition of forest fires and illegal logging, but forest fires and illegal logging still occur, need to intensify other instruments, by taking advantage of the role of indigenous peoples, they have many local policies that can be brought up and used as one of the national policies in the context of preventing the occurrence of criminal acts of forest burning and illegal logging. The problem is what is the role of indigenous peoples in preventing forest fires and illegal logging? The method of writing this paper is non-doctrinal research, with in-depth interviews with indigenous community leaders, then the results of in-depth interviews are analyzed to be used as recommendations for research findings.The result is a model of law enforcement in indigenous people, which in practice is in line with the concept of administrative criminal law. This legal concept emphasizes the principle of law enforcement that is not criminally oriented as the main choice. Indigenous people prioritize prevention of forest destruction, then restrictions on taking forest wood, and the obligation to replant trees. Keywords forest destruction; traditional community; lampung; illegal logging.

Abstract

The urgency for criminal justice system reconstruction of the corruption is given the legal gap in eradicating corruption law if it is only carried out by the Regional Corruption Court, which is domiciled in the Capital Province. Because the Corruption Court’s working area is so broad, it is because many corruption cases to be tried, it will also require large fees and a large number of judges, and ideally, it will take a long time in the process of examining. Meanwhile, on the other hand, there is an obligation for the corruption case settlement by the Corruption Court to be carried out quickly, simply and at low cost. This paper’s problems are: (a) Why is it important to reconstruct the Corruption Criminal Justice System? (b) What is the ideal construction of the Corruption Criminal Justice System to support national development in Indonesia? The research method is qualitative with juridical normative and sociological approaches, especially in collecting primary data to reconstruct the corruption criminal justice system. This research shows that the ideal construction of the corruption court system is to support National Development, namely the relative competence of the Regional Corruption Court, which is not limited by the administrative area of a province. The Republic of Indonesia’s administrative area consists of various Provinces and Regencies/Cities. In these conditions, ideally, the relative competence of a Corruption Court can also examine corruption cases in districts/cities close to the Corruption Court, even though they are located in a different province from the domicile of a Corruption Court.

Abstract

In general, the people of North Raman District do not yet know and understand correctly about tackling trafficking. The people of North Raman Subdistrict have never received legal counsel regarding the crime of trafficking. Therefore, it is necessary to provide good knowledge and understanding through socialization and focus group discussions (FGD) to overcome the problems of partners related to the handling of trafficking in people in the North Raman Regency, East Lampung Regency. Efforts made in this activity are by providing knowledge and understanding of the law about tackling trafficking in people in the District of North Raman, East Lampung Regency. Then proceed with discussion and question and answer, and test the understanding of participants by giving a pre test and post test. The results of the activities show that the socialization activities and focus group discussions (FGD) are important to be carried out in order to increase knowledge, understanding and awareness of the legal community regarding tackling trafficking. How to cite:Anwar, M., Maroni, M., Dewi, E., Fathonah, R. Abstract

To create harmony and peace in society, every form of radicalism and terrorism must be abolished. Preventing radicalism and terrorism is not easy, because it requires a systematic and massive strategy. The role of the community is very necessary for preventing and overcoming radicalism and terrorism, for that it is important to provide understanding to the community, especially youth organizations. The activity, which was held in Batu Putuk, Teluk Betung Barat, Bandar Lampung, aims to educate and encourage the youth of Karang Taruna, Batu Putuk Village, to play an active role in preventing and overcoming radicalism and terrorism. This activity is carried out with a comprehensive method in the form of socialization, discussion, and clinical services. In line with the aim of the activity, namely educating and encouraging the youth of Karang Taruna in Batu Putuk Village to participate in efforts to prevent radicalism and terrorism, the benefits of this activity include increasing the ability of partners to recognize activities that lead to radicalism and terrorism, increasing the ability of partners to counteract the influence of radicalism and terrorism, as well as encourage the active role of partners in countering radicalism and terrorism.

Abstract

Restorative Justice is a policy that puts a focus on recovery rather than retaliation. The Restorative Justice implementation, considered more effective in terms of Justice and effectiveness, makes the Restorative Justice policy renewal of the criminal law system in Indonesia. The writing of this article uses a descriptive-analytical research method that prioritizes a normative juridical approach, with the formulation of the problem regarding the role of Restorative Justice as an effort to reform criminal law and the implementation of Restorative Justice as an alternative step in law enforcement for narcotics crimes. The result of this article is that the policy regarding Restorative Justice in its application is an update in law, especially criminal law. Conventional Justice Policies which are considered ineffective in their application are now being updated through the Restorative Justice policy; in addition to the context of the application, which is not only applied within the scope of general criminal law, in Narcotics crimes, a criminal settlement mechanism is also applied using Restorative Justice policies as stated in the Circular Letter of the Supreme Court Number 4 of 2010 concerning Placement of Abuse, Victims of Abuse and Narcotics Addicts into Medical and Social Rehabilitation Institutions (SEMA.4/2010). Rehabilitation of a Narcotics defendant can be carried out if it meets the requirements described in the regulation.

Abstract

The extent of the working area of the Regional District Court is equal to the provincial administration area consisting of Regency/city, while its position is in the provincial capital. This condition raises the legal gap in the eradication of corruption crimes, because on the one hand so the extent of the working area of the Court of Tipikor, causing many things corruption to be held, on the side will also require a large cost and a lot of judges power, and ideally will take a long time in the process of examination of a case. The study used qualitative research methods with normative and sociological juridical approaches.

Abstract

The aim of this study to understand efforts in combating crimes involving the use of sharp weapons and the inhibiting factors influencing underage individuals in misusing sharp weapons. The method used was a normative juridical approach and an empirical juridical approach with a qualitative research type. Primary and secondary data sources were used. The research results show that the police in preventing and dealing with crimes involving sharp weapon abuse committed by children use a pre-emptive approach, the police focus on identifying potential risks that could cause children to be involved in the misuse of sharp weapons. The preventive approach involves outreach and education activities in the community to increase public awareness about the negative impacts of sharp weapon abuse by children. This study is only related to tackling sharp weapon crimes committed by children. This research contributes by identifying and analyzing various risk factors that contribute to underage individuals engaging in the misuse of sharp weapons, aiding in the development of preventive strategies.

Abstract

This research aims to analyze efforts to overcome the law of abortion killings committed by children on unborn babies. The type of research used is yuridis normative doctrinal. Data sources were obtained from journal and library sources. The results of the analysis show that the crime of abortion murder was committed by a child. In this case, the judge sentenced the child perpetrator to imprisonment for 6 (six) months and 3 (three) months of work training. And whether the judge's decision is in accordance with the objectives of the sentence, what is certain is that in this case there are 3 theories that contain the judge's decision that fulfills the objectives of the sentence, namely the Absolute Theory, the Relative Theory and the Combined Theory.

Abstract

Infaq is an activity that is recommended for every Muslim. Giving Infaq can cause legal problems if the elements of the corruption crime are fulfilled. iAs happened in iCase Number i29/Pid.Sus-TPK/2022/PN iTjk. The Defendant was charged with article i5 paragraph I (1) of iLaw iNumber i20 of 2001 concerning the eradication of corruption, in conjunction with article i55(1) i1st iCriminal iCode, for giving in faq money amounting to IDR 250,000,000.00 to enroll his two nephews to the iFaculty iof iMedicine. iUniversity iof Lampung.An empirical juridical approach supports this research's informative juridical approach. The data are primary and secondary. Data collection is based on literature reviews and field studies. The data analysis method employed is qualitative analysis.
