Abstract

Divorces is often lead to multiple violations of children's rights due to parental conflicts. Therefore, this research reviewed maqāsid al-syarī'ah on the fulfillment of children's rights after divorce in Budi Aji Village, Simpang Pematang District, Mesuji Regency. It was field research and employed a descriptive qualitative method. Data were gathered by observation, in-depth interviews, and documentation, and accompanied by inductive analysis. Subsequently, this research found that the fulfillment of children's rights following parental divorce in the village has been sub-optimal. The majority of fathers are unemployed and unable to fulfill their obligations of providing a living, attention, and affection for children. The contributing factor is the fathers’ irresponsibility, which impedes the achievement of maintenance benefits to the children’s life (hifz an-nafs). These findings may have implications for the need to increase the understanding of divorced parents regarding the fulfillment of children's rights and the importance of the role of the extended family in ensuring offspring are not neglected.

Abstract

The all time, perpetual or all year round prayer schedule so it is called because the schedule can be used for a very long period of time. Even for centuries, this schedule is still accurate. The schedule is usually disputed by the Falak experts with regard to certain time zones that need to be adjusted.

Abstract

Mahar merupakan pemberian dari mempelai pria kepada wanita yang berupa materi, baik berupa seperangkat alat salat, cincin, uang atau barang berharga lainnya. Belakangan ini hafalan al-Qur’an juga kerap digunakan sebagai mahar pernikahan, dengan berbagai alasan; mahar yang meringankan, mengikuti tren, dan keinginan pribadi. Fenomena ini tidak sama dengan kasus Sahl bin Said al-Sa’idi. Tinjauan hukum Islam, dan teori maqasid al-syariyah sangat tepat digunakan dalam menentukan kepastian hukum dari fenomena tersebut. Penelitian ini merupakan kajian pustaka (library research) dengan menggunakan metode deskriptif analisis.

Abstract

This article examines the mechanisms of inheritance resolution in cases of different religions in several regions of Indonesia, namely North Sumatera, Central Java, Bengkulu, and East Java, focusing on integrating customary law, religious law, and state law in inheritance distribution. This research employs a descriptive qualitative approach with a case study method, where data is gathered through interviews, observations, and literature reviews on the practice of inheritance among families with different religions. The findings reveal that family deliberation remains the primary principle in resolving inheritance disputes despite the religious differences among heirs. Social and cultural values such as kinship, mutual assistance, and interfaith tolerance play a significant role in the inheritance process, with each region having its own ways of accommodating religious differences within families. The legal pluralism approach, which combines customary law, religious law, and state law, forms the foundation for developing a fair and inclusive national inheritance law. This article suggests strengthening the principle of deliberation, creating an adaptive legal unification, and formulating inclusive regulations for interfaith inheritance rights to create a harmonious and just inheritance system that aligns with the spirit of Indonesia's cultural diversity. AbstrakArtikel ini mengkaji mekanisme penyelesaian waris beda agama di beberapa wilayah di Indonesia, yaitu Sumatera Utara, Jawa Tengah, Bengkulu, dan Jawa Timur, dengan fokus pada integrasi hukum adat, agama, dan negara dalam pembagian warisan. Penelitian ini menggunakan pendekatan kualitatif deskriptif dengan metode studi kasus, di mana data diperoleh melalui wawancara, observasi, dan kajian literatur mengenai praktik waris beda agama dalam masyarakat. Hasil penelitian menunjukkan bahwa meskipun terdapat perbedaan agama di antara ahli waris, musyawarah keluarga menjadi prinsip utama dalam penyelesaian sengketa waris. Nilai sosial dan budaya seperti kekeluargaan, gotong royong, dan toleransi antaragama berperan penting dalam proses pembagian warisan, dengan setiap daerah memiliki cara-cara tersendiri dalam mengakomodasi perbedaan agama dalam keluarga. Pendekatan pluralisme hukum yang memadukan hukum adat, agama, dan negara menjadi landasan dalam pengembangan hukum waris nasional yang adil dan inklusif. Artikel ini menyarankan penguatan prinsip musyawarah, unifikasi hukum yang adaptif, serta penyusunan aturan inklusif untuk hak waris lintas agama, guna menciptakan sistem kewarisan yang harmonis dan adil sesuai dengan semangat keragaman budaya Indonesia.

Abstract

This study explores the legal dynamics between financial responsibility and marital property in the context of marriage in Indonesia, with a specific focus on reconciling the normative gap between Islamic law and Indonesia’s national legal system. While Islamic law places full financial responsibility (nafaqah) on the husband, Indonesian civil law applies a gender-neutral approach by recognizing joint marital property acquired during marriage, regardless of who earned it. This normative legal research employs a qualitative approach using statutory, conceptual, and comparative analyses of both Islamic legal texts (Qur’an, Hadith, and classical fiqh) and national legal instruments such as the Marriage Law No. 1 of 1974 and the Compilation of Islamic Law (KHI). The findings reveal a fundamental inconsistency: Islamic jurisprudence emphasizes the husband's economic duty, whereas civil law presumes equal ownership, potentially leading to legal ambiguity in divorce and inheritance cases. The study concludes that this dualism requires a contextual reinterpretation of the joint property regime that respects Islamic ethical values while adapting to modern socio-economic realities, including the increasing financial contributions of women. It is recommended that legal reforms recognize differentiated spousal roles without undermining gender justice. This research contributes academically by proposing an integrative legal framework that bridges the gap between normative Islamic obligations and the state’s egalitarian legal principles. Such a framework offers a more just, ethical, and socially relevant model for regulating financial responsibility and property rights in Muslim marriages within Indonesia’s plural legal system.

Abstract

This research aims to reveal the enforcement of the mbasuh dusun tradition in cases of pregnancy outside marriage in Bengkulu City, Indonesia. This type of research is field research. The nature of this research is descriptive analytic. Data collection techniques in this study used observation, interviews, and documentation. The data obtained was analyzed using descriptive qualitative methods to obtain conclusions and research findings. The result of this study is that: the implementation of the mbasuh dusun tradition is a customary sanction for pregnant women outside of marriage in Bengkulu City, as al-'urf al-shahih and has an effective impact. This mbasuh dusun tradition is carried out by slaughtering a goat, and the perpetrator must be present to be aware and must apologize. Then give charity  (and ask for prayers) at the place where the goat was slaughtered or outside the house. Unlike customary sanctions in other regions, the implementation of the mbasuh dusun tradition has a goal and purpose, so that the perpetrator is ashamed and does not repeat the act again, so that it can effectively reduce and even deter the perpetrator. The application of this customary sanction in the context of developing marriage law in Indonesia, it is necessary to review the legalization of marriage of pregnant women outside of marriage in the Compilation of Islamic Law (KHI), and it turns out that the provision of sanctions for pregnant women outside of marriage has a significant impact on creating a deterrent effect and bringing benefits to the community.

Abstract

Pemerintah DKI Jakarta membuat suatu kebijakan yang mewajibkan setiap masyarakatnya yang hendak menikah harus melakukan pemeriksaan kesehatan. Surat pemeriksaan kesehatan menjadi salah satu syarat dilangsungkannya perkawinan yang mencakup imunisasi TT, tes HIV/AIDS, IMS, dan Hepatisis yang dilakukan oleh puskesmas dan/rumah sakit setempat, kemudian hasilnya berupa Sertifikat Layak Kawin. Rumusan masalahnya adalah bagaimanakah tinjauan maslahah terhadap Pergub DKI Jakarta No. 185 Tahun 2017 tentang Konseling dan Pemeriksaan Kesehatan Bagi Calon Pengantin dalam konteks pengembangan hukum keluarga Islam di Indonesia? Penelitian ini berjenis library research dan bersifat deskriptif analitis. Data primernya Pergub DKI Jakarta No. 185 Tahun 2017 sedangkan data sekundernya terdiri dari literatut terkait. Penelitian ini menggunakan kajian teori maslahah dan pendekatan Ushul Fiqh. Analisis dan penarikan kesimpulan dilakukan secara deduktif. Kesimpulannya, kebijakan ini merupakan upaya preventif, dalam rangka mencegah hal-hal seperti: penyebaran penyakit menular, perceraian, KDRT, kematian ibu dan bayi yang disebabkan karena faktor kesehatan, dan penyakit turunan. Kebijakan ini sejalan dengan tujuan dari hukum Islam yang disebut dengan maqāsid syarī’ah yaitu demi hifz al-nafs (menjaga jiwa antar calon pengantin dari penyakit menular, menjaga jiwa bagi ibu hamil juga pada bayi yang dikandungnya). Kebijakan ini memberikan kemaslahatan bersama khususnya bagi calon pengantin dan anak keturunannya sebagai generasi penerus bangsa.

Abstract

Studies on marriage dispensation in Indonesia have predominantly focused on the factors underlying the approval of applications and the social reasons contributing to child marriage practices. Previous research tends to position marriage dispensation as a legal solution to social and moral pressures, while studies that specifically examine the rejection of marriage dispensation and its implications for strengthening child protection within the framework of Islamic family law remain relatively limited. This condition reveals a research gap, particularly concerning the shifting paradigm of religious court decisions that increasingly prioritize the best interests of the child as a primary consideration. This study aims to analyze the judges’ legal reasoning in rejecting a marriage dispensation application in the Decision of the Pringsewu Religious Court Number 51/Pdt.P/2024/PA.Prw and to examine its conformity with the principles of Islamic family law. Employing a normative juridical approach with qualitative descriptive analysis, this research examines court decisions, relevant statutory regulations, and the doctrine of maqāṣid al-sharī‘ah. The analysis focuses on the implementation of Law Number 16 of 2019 and Supreme Court Regulation (PERMA) Number 5 of 2019 in the context of child protection. The findings indicate that the rejection of the marriage dispensation was based on considerations of child protection, continuity of education, psychological readiness, and reproductive health. From the perspective of Islamic family law, the decision reflects the application of maqāṣid al-sharī‘ah, particularly the protection of lineage (ḥifẓ al-nasl). This study concludes that marriage dispensation is not an absolute legal right, but a conditional legal policy that must prioritize public welfare and the best interests of the child.
