Abstract

The integration of the Indonesian Standard Quick Response Code (QRIS) is a crucial strategic step for Micro, Small, and Medium Enterprises (MSMEs) to modernize their payment infrastructure, thereby catalyzing the acceleration of the digital economy amid widespread digital transformation. This standardized payment system represents a foundational technological breakthrough, establishing a universal framework for QR-based non-cash transactions. Crucially, MSMEs are empowered to consolidate various payment platforms—spanning digital wallets, electronic money applications, and mobile banking services—under one unified QRIS logo. This eliminates the necessity for enterprises to manage multiple proprietary codes. The widespread implementation of QRIS furnishes smaller enterprises with a streamlined, highly effective mechanism to successfully transition towards a cashless operational model, significantly enhancing the fluidity and overall efficiency of financial exchanges. An analysis derived from a targeted investigation conducted in the Tlogmas area of Malang City, Indonesia, indicates that the assimilation of QRIS yields varied outcomes for local MSMEs. The findings underscore the system's inherent capacity to boost operational productivity and open up new market avenues, provided it is complemented by robust technological infrastructure and greater entrepreneurial literacy regarding its full scope of advantages. These observations necessitate proactive policy intervention aimed at heightening MSME proficiency and participation in the utilization of QRIS. It is incumbent upon governing bodies and associated entities to escalate outreach efforts and conduct extensive informational campaigns detailing QRIS benefits. Furthermore, targeted capacity building programs are essential to ensure MSME proprietors possess comprehensive technical mastery, enabling them to optimally leverage this digital payment technology not just for transactional expediency, but as a robust driver for business continuity and long-term sustainable expansion.

Abstract

Abstract

Introduction to the Problem: The problem explored in this study is that the Indonesian legal system does not provide any legal protection for ‘Good Samaritan’ acting to aid others’ in grave danger. This legal vacuum might cause a shift in humans' good nature. Purpose/Study Objectives: The purpose of this study is to examine how other jurisdictions regulate Good Samaritan immunity in civil disputes, addressing the research gap in Indonesia where no protection exists, and how such frameworks may be adapted. Design/Methodology/Approach: Normative juridical research combining statute, conceptual, comparative, and case approaches across Indonesia, Canada, and China to map immunity/liability rules in emergency civil disputes and extract transferable principles relevant to international law debates on protecting life and enabling bystander aid. Findings: The study finds that implementing a Good Samaritan Doctrine in Indonesia addresses the current legal vacuum by providing immunity to individuals who render aid in emergencies. Comparatively, Canada grants civil immunity for Good Samaritans acting in good faith, while China’s Civil Code provides similar protection with limitations. These models demonstrate that clear immunity provisions can encourage voluntary assistance without exposing helpers to liability. In the Indonesian context, the idea of having legal immunity and liability for ‘Good Samaritans’ could be achieved in the short term through advocation clarifying judicial interpretation of Article 1354 of the Indonesian Civil Code, and in the long term through dedicated legislation establishing Good Samaritan protection.  Paper Type: Research Article

Abstract

This study aimed to reconceptualize good faith in Indonesia's public-private partnership infrastructure contracts from a welfare-state perspective. Public-Private Partnership in Indonesia can accelerate the provision of infrastructure to meet the state's welfare obligations. Still, legally it remains an instrument of public policy, not a transfer of the state's constitutional obligations. Using normative legal methods through legislative and conceptual analysis, as well as limited comparison, this article finds that PPP contracts should be understood as administrative contracts (bestuurscontract) that derive from public authority and are oriented towards service and the public interest. Therefore, good faith should not be viewed merely as a moral norm at the time of signing, but rather as an ongoing obligation and corrective principle (redelijkheid en billijkheid) throughout the project cycle. The normative contribution of this article is a reform model that codifies the obligation of good faith, oriented towards the public interest, in laws and their implementing regulations, including cooperation, disclosure of information, and renegotiation. This aims to prevent abuse of authority, protect the public interest, and strengthen legal accountability for project failures.
