Abstract

Abstract: This paper aims to analyze the uncertainty over the legal force of homologation decisions on the confiscation of company assets suspected of being the proceeds of money laundering crimes, focusing on the main issues related to legal uncertainty in the context of the implementation of homologation decisions (amicable agreements in bankruptcy proceedings) and how it affects the confiscation of assets suspected of being involved in money laundering crimes. This journal explores the conflict between bankruptcy law and criminal law, particularly in situations where the assets of the company involved in the homologation are suspected to be proceeds of crime. This research uses the normative method, namely legislation. The results show that the homologation decision needs to take precedence before the process of confiscating company assets suspected of originating from money laundering crimes. This is because the process of criminal confiscation events that occur against company assets suspected of being the proceeds of money laundering has clashed with the principle of Ultimum Remedium.Keywords: Bankruptcy Law, TPPU, Homologation.

Abstract

Abstract: This study examines the practice of nominee agreements in Indonesia's capital market, which, while offering flexibility to foreign investors, poses significant legal risks for the involved parties. The analysis focuses on the potential legal impacts, implications for legal certainty, and transparency challenges arising from such agreements. Findings reveal that nominee arrangements often violate Article 33 of Law No. 25 of 2007, leading to nullification and detriment to beneficiaries who lack legal recognition. Additionally, the practice creates loopholes for tax evasion and money laundering, undermining market integrity. The study recommends strengthening regulations through technologies like blockchain, stricter law enforcement, and the adoption of beneficial ownership principles to enhance transparency. These reforms aim to make Indonesia's capital market more competitive, secure, and reliable on an international scale. Abstract

Abstract: In this paper, the author will examine legal issues regarding law enforcement against website hacking In this paper, the author will examine legal issues regarding law enforcement against website hacking committed by online gambling syndicates, where lately crimes related to website hacking are increasingly widespread, this is clearly seen from the many cases that continue to occur, hacking itself is included in cybercrime, In some cases that occur regarding hacking cases, it has not explained in detail about how the regulation, enforcement, legal consequences, obstacles, shortcomings and so on, so the author feels the need to discuss it all to then clarify how the enforcement of hacking crimes committed by online gambling syndicates. Here, the author uses a normative research method, which is a research method that uses norms or laws and regulations as its source. This kind of research is also known or called the library research method because it uses secondary data, namely laws, journals, books and so on and uses a normative juridical approach. Abstract

This research focuses on examination or testing and public judgment, because examination aims to encourage law enforcers, such as judges and prosecutors to uphold the law based on good judgment, the research used is normative, through secondary data such as laws and regulations, court decisions, expert opinions and legal norms. So the author is interested in examining Pretrial Decision Number 1/Pid./2022/PN Sos at the Soasio District Court of Tidore Islands, North Maluku, this case involves Ailen Goeslaw, as Head of the Youth and Sports Office (KADISPORA), to see if it is in accordance with the legal process in Pretrial regarding the Determination of Suspects, at that time suspected of committing Corruption Crime related to the Construction of the Maba City Stadium, East Halmahera, North Maluku. Ailen Goeslaw was named as a suspect by the East Halmahera District Attorney's Office because it was deemed sufficient to fulfill two pieces of evidence related to the State financial losses incurred. Through his attorney, Ailen Goeslaw then filed a pretrial to test whether the determination as a suspect was in accordance with legal procedures. However, the judge of the Soasio District Court, Tidore Islands, North Maluku. Abstract

Abstract: In running a business, entrepreneurs are required to follow several written regulations established by the government and regulated by law. In the pharmaceutical industry, entrepreneurs must register their products with a specific agency, namely BPOM. The government has created regulations regarding the supervision of cosmetic circulation to protect consumers and ensure the safety of cosmetic products. These regulations are designed to address the sale of cosmetics without trading permits. This research aims to understand how supervision is implemented and why it is ineffective in protecting consumers. The methods used are normative, and the research specification is descriptive analytical. The results indicate that the supervision conducted does not meet cosmetic supervision regulations and does not encompass the stage of consumer protection. The ineffectiveness of supervision is caused by law enforcement officials who cannot follow existing government regulations, as well as low public awareness.Keywords: BPOM, Cosmetics, Consumen Protection

Abstract

The 2016 Patent Law Article 19 Paragraph (1) provides legal protection in the form of exclusive economic rights to patent holders, allowing them to gain economic benefits from their inventions. These rights include licensing to third parties in exchange for royalties. The use of patents beyond the licensing period without permission is considered a violation of the patent holder’s economic rights. This study examines the legal protection of Nokia’s economic rights for patents produced by Guangdong Oppo and Realme Chongqing and Nokia’s efforts to safeguard these rights. The research uses normative and descriptive methods with primary and secondary data analyzed qualitatively through deductive reasoning. The result and conclusion is the government provides patent holders with exclusive rights, including economic rights. Disputes arising from violations can be resolved through litigation or non-litigation. Nokia filed a compensation claim against PT Bright Mobile Telecommunication, but the claim was deemed inadmissible (niet ontvankelijk verklaard). Eventually, the matter was resolved through cross-licensing agreements with Guangdong Oppo and Realme Chongqing.

Abstract

Batik is the art of writing or painting on cloth. Yogyakarta batik has now become one of Indonesia’s national batik symbols and identities. If traced, the early existence of Yogyakarta Batik is closely related to the batik tradition that gew and developed during the mataram kingdom. The problem’s formulation raised is how the regulation of the protection of expression of folklore of Yogyakarta Batik. The writing of this journal uses a normative research type that is normative analytical in nature using the law approach and prioritizing secondary data. Considering the research’s finding, it can be concluded that the regulation of the protection of Yogyakarta Batik as a Expression of folklore is based on Law No. 28 of 2014 concerning Copyright, the Law on the Promotion of Culture, and Regional Regulation Number 13 of 2019 in relation to the Development and Maintenance of Batik Jogja. However, based on these regulations, there is no regulation related to maximum protection if there is Batik Jogja claimed or recognized by foreign parties so that a firmer and more comprehensive policy is needed as well as close cooperation between the central and regional governments.

Abstract

Jurnal ini membahas penerapan pidana bersyarat bagi pelanggar kekarantinaan kesehatan selama pandemi Covid-19 dengan fokus pada kasus selebgram Rachel Vennya dan ketua FPI (Front Pembela Islam) Habib Rizieq Shihab, berdasarkan teori sistem hukum Lawrence M. Friedman. Pendahuluan menggambarkan permasalahan dalam penerapan sanksi pidana kekarantinaan di Indonesia, yang meskipun telah diatur oleh Undang-Undang Nomor 6 tahun 2018 tentang Kekarantinaan Kesehatan, praktik pelanggaran masih terjadi. Metode penelitian menggunakan pendekatan normatif dengan menganalisis putusan pengadilan yang relevan untuk menilai efektivitas hukum yang berlaku. Hasil dan diskusi menunjukan bahwa meskipun regulasi dan penegak hukum tersedia, penerapan hukuman dinilai tidak konsisten dan cenderung ringan, yang mengurangi efek jera bagi pelanggar. Aspek struktur hukum juga perlu ditingkatkan untuk menjamin bahwa tindakan hukum dilakukan tanpa pandang bulu, Kesimoulan menjelaskan pentingnya kesadaran hukum di kalangan masyarakat dan penegak hukum melalui edukasi dan penegakan hukum yang tegas, sehingga budaya hukum dapat tercipta lebih baik lagi kedepannya.Kata Kunci: Covid-19, Kekarantinaan kesehatan, Penegakan hukum, Lawrence M Friedman, Pidana bersyarat

Abstract

Brand rights are one part of intellectual property rights that have an important role in the business world of trading of goods and services, especially in maintaining healthy business competition. The research method in this writing uses a normative juridical type of research. Normative legal research is also called literature law research. The approach used in this study is the Statue Approach method. The results of this research include the settlement of brand disputes can be resolved in two ways, namely through litigation and non-litigation. Judges are expected to have the ability to translate the values of justice in matters faced by him through his decisions. Settlement of trademark disputes in court is expected to be guided by the principles of justice, so that the settlement of trademark disputes can create legal certainty. Lawsuits in court or alternative dispute resolution such as arbitration. Furthermore, the legal implication for the decision may be to regulate "the cancellation or deletion of the registration of the Mark carried out by the Minister by striking out the mark concerned by giving defects about the reason and date of such cancellation or deletion". Dispute resolution through alternative dispute resolution is resolved in a direct meeting by the parties and the results are set forth in writing. The ideal concept in trademark dispute resolution in Indonesia, the author expects legal certainty for trademark dispute resolution in the Commercial court, District Court and State Administrative Court as well as in arbitration. The suggestions include the guarantee of a sense of justice and legal certainty in resolving brand disputes, both litigation and non-litigation. The Directorate General of Intellectual Property must be more careful and thorough through a more efficient trademark registration data collection system so that trademark ownership disputes do not occur.

Abstract

The purpose of writing this journal is to analyze and understand the Government's policy on the Implementation of risk-based business licensing in relation to the exploitation of natural resources in order to accelerate the investment climate in Indonesia. The concept of a permit after the passage of the Job Creation Law is approval from the central government or regional government for the implementation of business activities that must be fulfilled by business actors before carrying out their business activities. The formation of the Job Creation Law using the omnibus law concept is a solution offered by the Government to overcome complex overlapping regulations, including in the field of business licensing in Indonesia so that this effort is expected to encourage domestic investment activities. Risk-based business licensing is currently carried out through the Online Single Submission - Risk Based Approach (OSS-RBA) system, this system is a form of digitalization of public service mechanisms created by the government for business actors. OSS-RBA is expected to provide benefits because business actors can access the system anywhere and anytime, besides that the system is expected to increase and accelerate investment in Indonesia. Through a risk-based licensing concept, it not only makes it easier for investors to enter the Indonesian economic system, but also provides a structured system for the Government to carry out supervision with the aim of preventing misuse of issued permits. By emphasizing on the theory of law as a social engineering tool put forward by Roscoe Pound, Law is not only intended to provide regulation but Regulations provided by Law must be able to shape and create a climate of social life that is desired
