Abstract

This study aimed to analyze the aspects of legal accountability as well as formulate legal aspects of legal protection for notaries in making an authentic deed on the perspective of Article 65 of Law Number 2 of 2014 concerning the Notarial Department (UUJN). This type of research was normative juridical research (normative legal research) that used a statue approach and conceptual approach. This study was analyzed by grammatical and systematic interpretation methods. The results showed that the notary was fully responsible in the making of the official deed (willingly), while in the making of the deed the notary party was not fully responsible when it had carried out its duties and obligations to properly include (compile) the information of the parties into the deed. Protection for notaries in making authentic deeds, namely preventive legal protection in the form of UUJN, as well as repressive protection in the form of the provisions of Article 66 UUJN as a form of settlement efforts if the notary is in question before the law.

Abstract

This study aimed to analyze the legal validity of the DMO policy which was based on the Minister of Energy and Mineral Resources Letter 2783/32/MEM.B/2018 dated April 19, 2018, and the legal implications of the DMO quota transfer policy on mining companies. This research was a normative study using a statute approach. The results showed the coal DMO quota transfer policy was a policy that recognized its existence and had binding legal force. The DMO quota transfer policy had implications for fulfilling quotas for mining companies that contract with State Electricity Enterprise and mining companies that did not contract with State Electricity Enterprise. Mining companies that contract with State Electricity Enterprise could buy and sell coal which was more than the 25% coal DMO obligation with State Electricity Enterprise. Quota transfers made by mining companies that did not contract with State Electricity Enterprise had an uncertain price.

Abstract

Indonesia sebagai negara yang menganut sistem negara kesatuan dengan prinsip dasar pemerintahan yang berdaulat. Namun, konsep negara kesatuan yang dianut Indonesia tetap menerapkan desentralisasi. Pemberian kewenangan terhadap daerah dimaksudkan agar mampu mengendalikan dan mengelola rumah tangganya. Sebagai cara untuk memperkuat semua peluang ekonomi yang dapat dijadikan sebagai Pendapatan Asli Daerah (PAD). Sumber Pendapatan PAD terdiri dari pendapatan pajak daerah, pendapatan retribusi daerah, pendapatan dari badan usaha milik daerah, dan pendapatan dari pengelolaan kekayaan daerah lainnya, serta pendapatan lain yang sah. Pengaturan terkait dengan pajak dan retribusi daerah telah mengalami beberapa kali perubahan hingga pada tahun 2022, disahkanlah Undang-Undang Nomor 1 Tahun 2022 tentang Hubungan Keuangan Antara Pemerintah Pusat dan Pemerintahan Daerah, sebagai peraturan yang dimaksudkan untuk merevitalisasi regulasi pajak dan retribusi daerah. Dengan adanya pembaruan terhadap regulasi pajak daerah dan retribusi daerah memiliki tujuan yang hendak di capai dengan adanya penyesuaian rezim UU HKPD, sebagai salah satu upaya untuk menciptakan hubungan keuangan yang efektif, efisien, transparan, akuntabel, dan adil antara pemerintah pusat dan pemerintah daerah.

Abstract

The government as a legal subject that has the authority to carry out legal acts can actually be tested whether there is no authority approved by the State Administrative Court. This trial can of course be triggered by demands from certain parties who feel disadvantaged by the Government's actions. This research will examine the legal position and right to sue an organization in the Onrechtmatige Overheidsdaad Dispute. This research is normative juridical legal research. This research analyzes the legal position and right to sue the community regarding the defense of the Onrechtmatige Overheidsdaad. The research results concluded three things; First, organizations have sufficient requirements to file a lawsuit because their right to sue is regulated in Law Number 32 of 2009 concerning Environmental Protection and Management (UU 32/2009), and other regulations. Second, UUAP No. 30 of 2016 also regulates the authority to decide whether or not there are elements of authority exercised by Government Officials. This means that Law Number 30 of 2014 provides space for the public to file a lawsuit if there is a rejection of a permit permitted by the government. Third, there is a need to add the word 'organization' and add 'organizational requirements for filing a lawsuit' in UUAP No. 30 of 2014 explicitly.

Abstract

Local governments have undergone various regulatory developments since Indonesia's independence 75 years ago. Various aspects underlying the development and changes in local government policies can be analyzed using several approaches, such as historical, philosophical, and sociological. This paper will discuss how the legal politics of the development of local government implementation, especially in terms of decentralization. Furthermore, the author will explain about the opportunities for implementing decentralization based on regional capacity to promote welfare of society. This research is normative juridical research using historical approach, conceptual approach, and legal approach. It can be said that the implementation and development of local government implementation is strongly influenced by various aspects other than the legal factor itself. Furthermore, there is still the possibility of implementing decentralization based on regional capacity as an effort to promote social welfare.

Abstract

This study aims to reconceptualize the dispute resolution model for Pilkades, which has traditionally been handled by regents/mayors (Bupati/Walikota), a mechanism criticized for being prone to political interference and lacking principles of justice and independence. The election of village heads (Pilkades) represents a form of local democracy, reflecting community participation in village governance. However, its implementation is often marred by disputes over election results, leading to social tensions and conflicts. Using normative and empirical legal approaches, this research analyzes the weaknesses in the existing dispute resolution procedures and proposes an alternative model that is fairer and more transparent. The findings reveal that entrusting dispute resolution authority to regents/mayors poses significant challenges, such as political bias, unclear legal mechanisms, and insufficient community involvement. Therefore, an independent and neutral institution is required to handle Pilkades disputes by emphasizing the principles of justice and transparency. This study recommends the establishment of a special body through regional regulations to manage dispute resolution independently, involving community elements and utilizing digital technology to enhance process transparency. By reconstructing the Pilkades dispute resolution model based on the principles of justice, transparency, and independence, this approach is expected to strengthen village democracy and prevent prolonged conflicts.

Abstract

This study aims to analyze the evolution of legal politics in Indonesia’s legislative framework following the amendment of Law No. 12/2011 through the enactment of Law No. 13/2022. This amendment introduced the omnibus method as an innovative approach to drafting regulations. Employing a qualitative methodology rooted in doctrinal legal research and normative analysis, the study examines legal texts, judicial decisions, and other legislative materials. The methodology emphasizes the analysis of legal principles and norms to ensure alignment with constitutional directives and international legal standards. The findings indicate that the implementation of the omnibus method enhances efficiency in the legislative process by consolidating overlapping regulations into a cohesive legal framework. This approach facilitates efforts to address regulatory overload and promotes greater legal certainty. Nevertheless, the study identifies challenges such as resistance within the legislative process and the necessity for continuous oversight to maximize the benefits of this approach. In conclusion, the enactment of Law No. 13/2022 represents a pivotal advancement toward a more responsive and efficient legislative framework in Indonesia. This research provides a valuable contribution to understanding the political dynamics of legal reform and the broader implications of adopting the omnibus method in the national legislative system.

Abstract

This study aims to examine the application of Income Tax (PPh) on the transfer of rights to land/buildings through a Joint Rights Division Deed (APHB) due to inheritance, focusing on the injustices arising from the Circular Letter of the Directorate General of Taxes 20/PJ/2015. Although Indonesian tax law stipulates that inheritance is not subject to tax, Circular Letter 20/PJ/2015 exempts tax liability only for heirs in a direct bloodline. This research employs a normative legal approach with an analytical perspective. The findings indicate that Circular Letter 20/PJ/2015 contradicts the principle of justice outlined in the Income Tax Law (UU PPh) as amended by the Harmonization of Tax Regulations Law (UU HPP), wherein all heirs should be entitled to PPh exemption without discrimination. This distinction not only leads to legal uncertainty but also creates administrative discrimination that can disadvantage heirs who are not in a direct bloodline.

Abstract

Based on the issues related to the lease of reward land between the village chief and a private party that exceeds the chief's term, this paper aims to analyze the legality of the lease agreement for reward land between the village chief and a private party that extends beyond his term of office. In this paper, the researcher uses a normative juridical method, along with a legislative and case study approach. Then, with this analysis, the researcher can address the raised issue about the legality of the lease agreement for reward land between the village chief. From these issues, it can be concluded that the legality of the lease agreement for reward land between the village chief and a private party is regulated in Permendagri Number 1 of 2016 concerning the Management of Village Assets, with the maximum lease limit for reward land being a maximum of 3 (three) years. If there is a lease agreement for reward land between the village chief and a private party that exceeds the chief's term of office, then the agreement is legally void.

Abstract

A competitive auction consists of a public sale managed by a second manager, where sellers and buyers exchange assets as specified in mutual documents. According to the provisions of Article 38(c) of the Financial Regulation No. 4662; these officials cannot purchase goods directly or indirectly in their presence, in accordance with the Secondary Officials Law No. 189/PMK.06/2017. However, the fact that the legislation does not specify specific conditions regarding the concept of "direct or indirect purchase" causes confusion. This ambiguity raises concerns about abuses such as buy-side consultants participating in money laundering (TPPU). This study examines two important issues: the limitations of the term "buyer" in Section 38(c) and the legal benefits provided to employees associated with the buyer-owner. Remain loyal to the judicial system, use law and techniques to analyse the interpretation of the law. The study ends with the clarification of the scope of the ban and the investigation of the legal consequences of non-compliance with the ban. These findings can form the basis for recommendations to the relevant authorities on resolving legal issues and preventing abuse of the auction process, complying with legislation and ethical rules
