Abstract

AbstractMarriage aims to form a sakinah mawaddah warrahmah family, constitutionality issues arise when social problems occur as a result of early marriage and discriminatory differences between the age requirements of men and women. The Constitutional Court through its Decision 22/PUU-XV/2017 decided that the distinction was unconstitutional, and was ultimately followed up by the legislators. But in reality, there has been a surge in the volume of applications for dispensation for marriage, especially for women, because the age requirement has been increased. Therefore, this paper discusses: What is the ratio legis of the Marriage Law and its relationship to the development of regulations regarding the minimum age requirement for marriage? To answer that, normative research methods are used, with primary and secondary legal materials. Conclusion: The minimum age requirement for child marriage is experiencing social and legal developments. In the past, there were differences, through the Constitutional Court’s decision, finally, both men and women were equated with marriage. It is based on considerations of human rights law, particularly regarding the principle of non-discrimination based on gender. In fact, these changes have not been effectively implemented because there is a marriage dispensation instrument so that whoever submits it will surely be accepted by the court. Precisely with the addition of the minimum age requirement for marriage, it has an impact on the high volume of submissions for dispensation for marriage. AbstrakPerkawinan bertujuan membentuk keluarga sakinah mawaddah warrahmah, persoalan konstitusionalitas muncul ketika terjadi masalah sosial dampak dari pernikahan dini dan diskriminasi pembedaan antara syarat usia laki-laki dan perempuan. Mahkamah Konstitusi melalui Putusan 22/PUU-XV/2017 memutuskan bahwa pembedaan itu adalah inkonstitusional, dan akhirnya ditindakalnjuti oleh pembentuk undang-undang. Tetapi realitanya, justru terjadi lonjakan volume pengajuan dispenasasi kawin, khususnya perempuan lantaran syarat usianya dinaikan. Maka dari itu, tulisan ini membahas: Bagaimana ratio legis dari UU Perkawinan dan hubungannya dengan perkembangan pengaturan tentang syarat usia minimum perkawinan? Untuk menjawab itu, digunakan metode penelitian normatif, dengan bahan hukum primer dan sekunder. Disimpulkan: Syarat usia minimum perkawinan anak mengalami perkembangan sosial dan hukum. Dahulu terdapat perbedaaan, melalui putusan MK akhirnya keduanya disamakan antara pria dan wanita yang hendak melakukan perkawinan. Hal itu didasarkan pada pertimbangan hukum hak asasi manusia, khususnya mengenai prinsip non-diskriminasi berdasarkan gender. Dalam kenyatannya, perubahan tersebut tidak kunjung efektif dilaksanakan karena terdapat instrumen dispensasi kawin sehingga siapaun yang mengajukan pasti akan diterima oleh pengadilan. Justru dengan adanya penambahan syarat usia minimum perkawinan itu berdampak pada tingginya volume pengajuan dispensasi kawin.

Abstract

Antara kewajiban yang diberikan undang-undang tentang desa untuk memberikan sanksi atas penyimpangan yang dilakukan kepala desa sesuai Pasal 115 dan batasan kewenangan dalam undang-undang tentang administrasi pemerintahan Pasal 14 ayat (7), bahwa seorang Pejabat Pelaksana Tugas tidak berwenang mengambil tindakan yang bersifat strategis yang berdampak pada perubahan status hukum pada aspek organiasi. Tujuan penelitian ini adalah untuk menganalisis tindakan hukum Pejabat Pelaksana Tugas Bupati Kabupaten Buton Tengah yang telah memberhentikan kepala desa Tolandona Matanaeo berdasarkan SK Nomor 307 tertanggal 16 mei 2017. Penelitian ini yuridis normatif dengan pendekatan kepustakaan, perundang-undangan dan pendekatan kasus. Hasil penelitian menunjukan bahwa pemberhentian kepala desa tolandona matanaeo dapat dibenarkan, sebab tindakan hukum tersebut didasarkan pada fungsi dengan pemaknaan bahwa keadilan prosedural tidak mengabaikan keadilan substantif. Hal itu relevan dengan ketentuan Pasal 10 ayat (3) undang-undang pembentukan kabupaten buton tengah, bahwa pengangkatannya karena memiliki kemampuan dan pengalaman jabatan dalam bidang pemerintahan. Selain itu sanksi yang diberikan tidak cacat prosedur dalam undang-undang tentang desa.

Abstract

The state has the power to collect taxes from its citizens. Article 23 A of the 1945 Constitution of the Republic of Indonesia is the constitutional basis for tax collection by the government, namely the "Central Government" and "Local Government". This study aims to (1) analyze and find out how the mechanism for determining the market value in the collection of BPHTB Inheritance by Bapenda in Malang City, (2) analyze and find out the legal certainty regarding the market value in collecting BPHTB Inheritance by Bapenda in Malang City. This research is normative juridical research. The results show that the collection of Inheritance BPHTB by Bapenda Malang City does not yet reflect the value of legal certainty because the legal rules regarding market value that are used as guidelines by Bapenda also do not have legal certainty.

Abstract

Dualisme penanganan masalah dugaan tindak pidana korupsi dalam bentuk   penyimpangan penyaluran dana ke masyarakat seringkali menjadi beban hakim Tindak Pidana Korupsi. Penyelesaian perkara sering terjadi silang pendapat dan  overlap antar peraturan perundang-undangan dalam hal sistem hukum mana yang digunakan. Sistem hukum pidana ataukah sistem hukum administrasi. Kajian ini berusaha mengungkap poin penting mana yang harus terlebih dahulu dikemukakan diantara kedua sistem hukum terse- but dan kemudian dicari solusi penyelesaian perkaranya. Oleh karenanya dalam kajian ini digunakan pendekatan kasus dan pendekatan perundang- undangan agar permasalahan dapat diungkap dengan jelas.Kata Kunci : Kasus, Penyimpangan, penyaluran dana, Hukum Adminis- trasi.

Abstract

The formation of legal products in the regions cannot be separated from the preparation of academic texts as the basis for their formation. However, the existence of alternative explanations/information as a substitute for academic texts has caused legal products at the regional level not to fully use academic texts. Based on this, it is necessary to elaborate on the urgency of academic papers in the formation of legal products at the regional level. In addition, further explanation regarding the mechanism for implementing academic papers in the formation of legal products at the regional level is the main research objective. The research method used in research is normative legal research or doctrinal legal research which bases arguments on theories, principles, concepts, and laws and regulations. The selection of the normative method is based on the existence of legal issues regarding the blurring of norms regarding the regulation of academic texts in the formation of legal products at the regional level. An explanation of this can only be obtained by conducting a doctrinal study. The results of the research lead to the conclusion that academic papers are needed as guidelines in drafting legal products at the regional level. Implementation of academic drafting should be carried out in the pre-legislative stage by identifying problems in society and elaborating them theoretically so that solutions can be formulated as outlined in the draft legal products at the regional level. The preparation of academic manuscripts also requires collecting data through interviews, observations, and literature studies to find solutions to problems in society. These results then go through a dissemination process in the form of FGDs with community representatives and parties related to the regional regulations that will be formed.

Abstract

On each social life will find a difference between behaviour with the law of norms. The discrepancy could cause dispute or tensions between each other that possibly also can happen in the family. The problems often arising during family Is the transition towards treasure in the form of grants from parents to their children. The settlement if there is a standoff over an object of the grant is forced to settle in a court. The Giving in a form of grant was conducted using an authentic deed as has been arranged in article 1682 Indonesian Civil Code. Public officials who given by statute an authority to make the deed of grants is land deed official. Related which for making such deed to as a basis for registration change as a result of a legal action the land. Related to the emergence of signs of a dispute over ownership under the grants, so In this case, every judge as milestone law enforcement have an interpretation of the difference against the rule of law in dispute resolution on the judicial process. In short, there is contradiction a norm between what has been decided by judges with the provision of article 1686 Indonesian Civil Code which the results of the uncertainty laws implementation of the article. Abstract

UU no. 30 of 2014 concerning Government Administration explicitly states that it is possible for Government Officials to be tested by the PTUN. This is of course in order to create good government. This research is normative juridical legal research. This research will analyze the legal position and right to sue the community regarding the Onrechtmatige Overheidsdaad dispute. The research results concluded three things; First, the public has sufficient requirements to file a lawsuit because the legal position and right to sue are regulated in the Decree of the Chief Justice of the Supreme Court Number 36/KMA/SK/II/2013, Law Number 5 of 1986 concerning Administrative Justice, and others. Second, UUAP No. 30 2014 also explicitly states that the government is prohibited from abusing its authority and the PTUN has the authority to decide whether there are elements of abuse of authority. This means that Law Number 30 of 2014 provides space for the public to file a lawsuit. The three definitions of 'Community Citizens' in UUAP No. 30 2014 must be changed after the publication of PERMA Number 01 of 2023 concerning Guidelines for Adjudicating Environmental Cases.

Abstract

This study aimed to analyze the types of audits in government goods/services procurement under Presidential Regulation Number 12 of 2021 and the legal consequences of the incomplete descriptions of audits in government goods/services procurement. The type of research used in this study was normative juridical with a statute approach, a concept approach, and a case approach. Data collection was done by using library research techniques. The data obtained were analyzed using law interpretation techniques. The results of the study showed that Presidential Regulation Number 12 of 2021 concerning Amendments to Presidential Regulation Number 16 of 2018 concerning Procurement of Goods/Services did not explain in detail the main tasks and functions of the Government Internal Supervisory Apparatus in carrying out audits of government procurement of goods/services. The legal consequences of incomplete audit rules in the procurement of government goods/services gave rise to multiple interpretations, so it was necessary to establish an internal regulation or a Regent's regulation related to the main tasks and functions of the Government's Internal Supervisory Apparatus.

Abstract

The purpose of this study was to analyze the authenticity of electronic deeds in terms of the Civil Code, Law Number 30 of 2004 in conjunction with Law Number 2 of 2014, and Law Number 19 of 2016 and analyze the urgency of making a notary deed electronically. This study used a normative juridical method with a statutory approach. Prescriptive analytical techniques analyzed primary legal materials and secondary legal materials. The results and discussion showed that the deed made electronically did not meet the exact requirements as stated in Article 1868 of the Civil Code, Article 1 point 7 and Article 16 of Law Number 30 of 2004 in conjunction with Law Number 2 of 2014, and Article 5 paragraph (4) of Law Number 19 of 2016. The urgency of making a notary deed electronically during the COVID-19 pandemic was that there were obstacles for the public to physically attend the notary's office due to physical distancing policies, so notaries were required to innovate in implementing cyber notary related to the making of deeds electronically.

Abstract

This study aims to analyze the legal considerations used by the head of the district court in the adjudicate the auction of execution. The other purpose is to analyze the legal implications related to the enactment of the Security Rights Law and the Minister of Finance’s Regulation on Instructions for Auction Implementation. This study uses normative juridical research with a statute approach and a case approach. The results show that there are three basic considerations used by the head of the district court in determining the object's limit value over the auction of security rights execution. The juridical implication that the head of the district court is wrong in applying Article 6 of the Security Rights Law. The determination of the limit value by the head of the district court contrary to the principle of the judge being passive and waiting.
