Abstract

Transformasi digital dalam tata kelola pemerintahan telah mendorong intensifikasi pemanfaatan media digital sebagai sarana komunikasi publik yang strategis, dimana Government Public Relations (GPR) berperan sebagai instrumen vital dalam membangun kepercayaan masyarakat dan menjaga reputasi institusi pemerintah di tengah derasnya arus informasi. Krisis komunikasi publik di Indonesia kerap dipicu oleh penyebaran misinformasi serta keterlambatan klarifikasi resmi, sehingga kemampuan verifikasi, respons cepat, dan transparansi informasi menjadi faktor penentu legitimasi pemerintah di ruang digital (PR Indonesia, 2025; Dunan, 2020). Melalui analisis konseptual berbasis kajian literatur, penelitian ini menelaah dinamika krisis GPR dengan menekankan pengelolaan informasi krisis, pemanfaatan media sosial, serta penguatan kapasitas komunikasi institusi pemerintah, mengingat kegagalan respons yang cepat dan akurat berpotensi menurunkan kepercayaan publik sekaligus memperburuk eskalasi konflik informasi di ruang digital (Nurfalah et al., 2026; Gunadarma & Masitoh, 2024). Oleh karena itu, strategi komunikasi krisis berbasis digital yang adaptif dan responsif merupakan kebutuhan mendasar guna mendukung efektivitas fungsi GPR di era komunikasi publik yang semakin kompleks dan dinamis.

Abstract

Penelitian ini mengkaji politik hukum dalam penyelarasan peraturan daerah terhadap undang undang pokok di bidang pelayanan publik, dengan fokus pada dua rumusan masalah. Pertama, bagaimana peran politik hukum dalam penyelarasan tersebut. Kedua, apa saja faktor penghambat harmonisasi serta strategi penguatan politik hukum dalam proses legislasi daerah. Latar belakang penelitian menunjukkan bahwa otonomi daerah membawa konsekuensi banyaknya peraturan daerah yang bertentangan dengan peraturan perundang undangan yang lebih tinggi, termasuk Undang Undang Nomor 25 Tahun 2009 tentang Pelayanan Publik. Tujuan penelitian adalah menganalisis peran politik hukum sebagai instrumen preventif serta mengidentifikasi hambatan dan strategi penguatannya. Metode penelitian menggunakan pendekatan yuridis normatif dengan studi kepustakaan dan analisis putusan Mahkamah Agung serta laporan Ombudsman. Hasil penelitian menunjukkan bahwa politik hukum berperan sebagai instrumen preventif strategis yang bekerja pada setiap tahap legislasi daerah, yaitu perencanaan, penyusunan naskah akademik, pembahasan, hingga implementasi dan evaluasi. Namun, efektivitasnya dihambat oleh lima faktor, yaitu keterbatasan kapasitas sumber daya manusia daerah, dominasi kepentingan politik jangka pendek, partisipasi publik yang formalistik, koordinasi vertikal pusat daerah yang tidak optimal, serta lemahnya sanksi administratif. Strategi penguatan yang ditawarkan meliputi empat pilar simultan, yaitu peningkatan kapasitas legislasi daerah berbasis sertifikasi, penguatan partisipasi publik yang bermakna, optimalisasi peran pemerintah pusat sebagai pembina preventif, serta penataan kerangka hukum nasional melalui revisi terbatas undang undang dan pembentukan pengadilan khusus Perda. Kesimpulan menegaskan bahwa dengan penguatan politik hukum preventif, peraturan daerah di bidang pelayanan publik dapat berfungsi sebagai instrumen pemenuhan hak konstitusional warga negara atas pelayanan yang berkualitas, transparan, dan berkeadilan di seluruh Indonesia. Penelitian ini memberikan kontribusi teoretis dan praktis bagi pengembangan model legislasi daerah yang selaras dengan undang undang pokok.

Abstract

This study evaluates the effectiveness of the Financial Services Authority (OJK) in supervising leasing companies and identifies systemic challenges in consumer protection from an Administrative Law perspective. Employing a normative legal methodology with a contextual approach, the research analyzes primary regulations, including the OJK Law, Consumer Protection Law, Fiduciary Guarantee Law, and relevant Constitutional Court rulings, alongside documented field practices. Findings reveal a persistent implementation gap between formal regulatory mandates and practical enforcement. Despite measurable declines in consumer complaints, aggressive debt collection, unilateral fiduciary executions, and opaque contractual practices remain prevalent. From an administrative law standpoint, these shortcomings reflect vulnerabilities in applying legitimacy, proportionality, and accountability principles, compounded by regulatory fragmentation, limited institutional capacity, and weak inter-agency coordination. The study concludes that OJK’s supervisory framework requires structural reform to transition from compliance-based monitoring to outcome-oriented governance. Recommendations include harmonizing overlapping regulations, establishing joint enforcement task forces, integrating data-driven monitoring systems, and implementing sustained consumer literacy initiatives. Ultimately, aligning financial supervision with foundational administrative law tenets is essential to strengthen institutional credibility, ensure equitable consumer protection, and foster a resilient leasing sector in Indonesia.

Abstract

Abstrak Revisi Undang-Undang Cipta Kerja (Omnibus Law) melalui UU No. 6 Tahun 2023 telah memicu gelombang demo buruh nasional, khususnya aksi Konfederasi Serikat Pekerja Indonesia (KSPI) di Cikarang pada 2024, bersamaan dengan sengketa Upah Minimum Provinsi (UMP) 2025 yang digugat ke Mahkamah Konstitusi (MK). Pasca-Pemilu 2024, ketidakpastian regulasi ini mengancam stabilitas industrial relation dan target ekonomi RPJMN 2025-2029. Penelitian ini bertujuan menganalisis dinamika yuridis konflik tersebut, mengidentifikasi kelemahan hukum ketenagakerjaan, serta merumuskan rekomendasi reformasi. Penelitian menggunakan pendekatan yuridis normatif-empiris dengan analisis kualitatif. Data primer bersumber dari UU No. 11/2020, Putusan MK No. 90/PUU-XXI/2023, dan dokumen Kemnaker; data sekunder dari laporan KSPI, BPS, serta wawancara mendalam dengan 15 responden (pakar hukum UI, aktivis buruh, dan pejabat Kemnaker). Teknik analisis: deskriptif-komparatif dan content analysis. Demo KSPI mencatat 1.200+ kasus mogok kerja (2024), dipicu ketidakseimbangan hak buruh (Pasal 28 UU Cipta Kerja) versus fleksibilitas investor. Sengketa UMP 2025 menunjukkan kegagalan tripartit nasional, dengan inflasi 3,5% tidak tercermin dalam kenaikan upah riil. Konflik ini berpotensi rugi ekonomi Rp 50 triliun akibat downtime produksi. Hukum ketenagakerjaan pasca-omnibus law memerlukan reformasi melalui penguatan Dewan Pengupahan dan klausul mediasi wajib. Penelitian merekomendasikan revisi UU untuk harmonisasi hak mogok dan investasi berkelanjutan. Kata Kunci: Omnibus Law, UMP 2025, demo buruh KSPI, konflik ketenagakerjaan, judicial review MK, industrial relation, pasca-Pemilu 2024.   Abstract The revision of the Job Creation Law (Omnibus Law) via Law No. 6 of 2023 has triggered nationwide labor demonstrations, particularly the Indonesian Confederation of Trade Unions (KSPI) actions in Cikarang in 2024, coinciding with disputes over Provincial Minimum Wage (UMP) 2025 challenged at the Constitutional Court (MK). Post-2024 Election, this regulatory uncertainty threatens industrial relations stability and the 2025-2029 RPJMN economic targets. This study aims to analyze the juridical dynamics of these conflicts, identify weaknesses in labor law, and formulate reform recommendations. The study employs a normative-empirical juridical approach with qualitative analysis. Primary data are sourced from Law No. 11/2020, MK Decision No. 90/PUU-XXI/2023, and Ministry of Manpower documents; secondary data from KSPI reports, BPS statistics, and in-depth interviews with 15 respondents (UI legal experts, labor activists, and Manpower officials). Analysis techniques: descriptive-comparative and content analysis. KSPI demonstrations recorded over 1,200 strike cases (2024), driven by imbalances in workers' rights (Article 28 of the Job Creation Law) versus investor flexibility. The UMP 2025 dispute highlights tripartite mechanism failures, with 3.5% inflation not reflected in real wage increases. These conflicts risk Rp 50 trillion in economic losses from production downtime. Post-omnibus law labor regulations require reform through strengthened Wage Councils and mandatory mediation clauses. The study recommends UU revisions for harmonizing strike rights and sustainable investment. Abstract

The Free Nutritious Meal (MBG) program is a national strategic policy launched by the new administration as an effort to accelerate the quality of Human Resources (HR) towards the Indonesia Golden 2045 vision. As a massive nutritional intervention instrument, this policy aims to break the chain of stunting and enhance the cognitive capacity of students across Indonesia. Despite its strong welfare orientation, this policy has sparked legal and constitutionality polemics, particularly regarding its funding sources. A crucial debate arises when the MBG budget allocation intersects with the mandate of Article 31 Paragraph (4) of the 1945 Constitution, which requires the state to prioritize the education budget at a minimum of 20% of the State Budget (APBN). The use of the education function budget for nutritional fulfillment raises questions regarding the risk of distorting the core objectives of national education. This research employs a qualitative descriptive method with a normative legal approach. Data were collected through literature studies of various primary legal materials, such as the 1945 Constitution, the State Budget Law, and implementing regulations related to the National Nutrition Agency, as well as secondary legal materials including theories of the welfare state and public policy. The study finds that substantively, the MBG policy constitutes a fulfillment of human rights to health and welfare in accordance with Article 28H and Article 34 of the 1945 Constitution. However, procedurally and constitutionally, this policy risks being unconstitutional if not accompanied by a strict separation of budget structures to prevent the erosion of basic educational implementation needs. Without a legal framework at the Statutory (Law) level to ensure accountability and sustainability, this policy is vulnerable to being perceived as a pragmatic political tool that threatens the long-term fiscal stability of the education sector.

Abstract

Advances in artificial intelligence (AI) technology have given rise to the phenomenon of deepfakes, which pose a serious threat to the integrity of democracy. Political deepfakes—the manipulation of video, audio or images of political figures using AI technology—are capable of creating highly convincing fake content that is difficult to distinguish from the original. This phenomenon threatens the foundations of democracy, which are built upon the truthfulness of information and public trust in the political process. This study aims to analyse legal policy in the context of countering political deepfakes using a normative-empirical legal research method. The findings indicate that the existing legal framework in Indonesia is insufficient to comprehensively address the threat of political deepfakes. Effective legal policy must be progressive, integrating aspects of technology regulation, the protection of human rights, and the strengthening of public digital literacy. This study recommends the establishment of specific regulations governing the use of AI technology in a political context through a multi-stakeholder approach.

Abstract

The digital age has brought about a fundamental transformation in the dynamics of the relationship between government and society. On the one hand, digital technology provides broader access to information and greater government transparency; on the other hand, the digital age has also become a medium for the dissemination of information that can undermine public trust in government institutions. The crisis of public trust is a multidimensional phenomenon involving political, legal and social aspects. This study aims to analyse legal policy in the context of addressing the crisis of public trust in government institutions in the digital age, using a normative-empirical legal research method. The findings indicate that legal policy in this context must strike a balance between protecting the reputation of government institutions and upholding the right to freedom of expression and the right to public information. Effective legal policy must be progressive, participatory, and evidence-based. This study recommends a holistic approach that integrates regulatory, educational, and technological aspects in addressing the crisis of public trust.

Abstract

Advances in Artificial Intelligence (AI) technology have brought about significant transformations in modern governance, including in Indonesia. The use of AI in the public sector raises a range of complex legal challenges, ranging from the protection of personal data and algorithmic accountability to the transparency of automated decision-making. This paper analyses the legal policy regarding AI oversight in Indonesia’s public sector using an approach grounded in constitutional law and technology law. The research employs a normative legal research method with a conceptual and comparative legal approach. The findings indicate that the legal policy on AI oversight in Indonesia remains fragmented and reactive, dominated by a sectoral approach rather than a holistic one. This study recommends the need for a specific law on AI that integrates principles of algorithmic ethics, the protection of fundamental rights, and independent oversight mechanisms to ensure accountability in the use of AI within governance.

Abstract

Policies restricting imports of strategic commodities are an important instrument in achieving a nation’s economic sovereignty. In Indonesia, these policies face a range of complex political and legal controversies, particularly in the context of global economic integration and international trade obligations. This paper analyses the political and legal controversies surrounding policies restricting imports of strategic commodities from the perspective of economic sovereignty, using a normative legal research method supplemented by historical, conceptual and comparative legal approaches. The research findings indicate that there is a tension between the interests of protecting national economic sovereignty and the obligations of international trade liberalisation as stipulated in the General Agreement on Tariffs and Trade/World Trade Organisation. This legal-political controversy is reflected in the dynamics of legislative drafting, which is often ambivalent, inconsistent policy implementation, and selective law enforcement. This paper recommends the need for a reconstruction of legal policy that integrates the principle of economic sovereignty into the framework of international trade law through the utilisation of safeguard mechanisms, general exceptions, and industrial policies consistent with international trade commitments.

Abstract

President Prabowo Subianto’s policy to establish a Task Force (Satgas) for the Acceleration of Government Programmes to Support Economic Growth through Presidential Decree No. 4 of 2026 constitutes a strategic step within the architecture of national economic governance. This study analyses the legal basis for the formation of the task force from the perspective of administrative law, examines the President’s authority in forming task forces as policy instruments, and identifies the legal implications for the system of inter-governmental coordination. The research method employed is a normative legal approach utilising legislation, conceptual analysis, and case studies. The research findings indicate that the formation of the Task Force has a constitutional basis under Article 4(1) of the 1945 Constitution, which designates the President as the holder of executive power. However, the existence of a Task Force comprising 27 ministers and heads of agencies raises legal questions regarding the hierarchical relationship with ministries/agencies that are structurally under the coordination of coordinating ministers, as well as the potential for overlapping authority with other task forces that have been established previously. This study recommends the need for clear technical and operational regulations to minimise conflicts of authority and ensure accountability in the implementation of the Task Force’s duties within the framework of good governance.
