Abstract

The regulation of village existence through Law no. 6 of 2014 must be acknowledged as providing opportunities for the growth of village autonomy. A number of pressures in several articles provide discretion that allows village autonomy to grow along with several conditions that must be considered by the village government, village communities. UU no. 6 of 2014 at least encourages its autonomy to make all affairs that have been recognized and respected by the state, plus local scale affairs not just for display, but the accumulation of all assets that allow the village to get richer with the capital it has. This research uses a qualitative approach with case studies as a research strategy. Data were obtained from interviews and Focus Group Discussions (FGD) by presenting key informants and also supporting informants from the village government, community leaders and also traditional and religious leaders in Padangsidempuan City. The concept of village development, known as bottom-up development, places the village as a pillar of national economic development. This concept then forces the village to continue to prepare itself in order to achieve village autonomy and independence. Institutional strengthening can be seen from community institutions being given space in planning and implementing development in the village. This shows that Law no. 6 of 2014 has provided space for the community in determining the direction of village development.

Abstract

This article aims to demonstrate that bilateral inheritance is a system of inheritance that is intended to embody the principles of equal justice in Islamic family law. Hazairin, the pioneer of bilateral inheritance, has initiated the implementation of these principles. However, there are still some issues that need to be addressed in some circumstances. This study employs a juridical legal approach, examining it through the lens of John Rawls' theory of justice and Mubādalah Faqihuddin Abdul Kodir's theory. The studied material consists of notions and perspectives concerning the distribution of inheritance in Islamic law, derived from the Qur’an, hadith, and the viewpoints of ulama and legal professionals. The article's conclusion demonstrates that, according to John Rawls's theory of justice and Mubādalah Faqihuddin Abdul Kodir's theory, bilateral inheritance, when interpreted in a mutually equitable manner, establishes equal positions for men and women in terms of both lineage and inheritance, based on their individual circumstances. Under circumstances where women, like men, can inherit all assets as sole heirs without contravening the explicit restrictions of the text, Furthermore, the allocation of inherited assets can be executed without any complex calculations or meticulous planning, since these assets can be fully utilized without any surplus or diminishing the portion received by the heirs. This essay aims to highlight Hazairin's innovative proposal for ensuring fair treatment in inheritance disputes while also addressing the theological issues that have been overlooked. Consequently, it is possible to examine Hazairin's thesis by employing Rawls' theory of justice and Mubjadi Faqihuddin's theory.

Abstract

One of the ways taken to develop oneself is to get out of the comfort zone by studying outside the city of birth or migrating, but this faces challenges in interacting because it finds a different situation from life in the place of origin. The purpose of the research is to find out the socioconstruction of migrant students according to Peter L. Berger's view. This research uses a qualitative approach with the research subjects being overseas students in the city of Yogyakarta. Data collection methods through observation, interviews and documentation. According to Peter L. Berger, reality is born along with knowledge, this happens due to the real social construction in human daily life. There are three stages of social construction according to Peter L. Berger, namely Externalization, Objectivation and Internalization. In the process of externalization, overseas students try to interpret and adapt to the language, customs and habits of the people of Yogyakarta in accordance with the stock of knowledge that exists in themselves. In this process, it appears that there are some students who have difficulty adjusting to the sociocultural environment in Yogyakarta. At the objectivation stage, overseas students try to understand and absorb the language, customs and habits of the people of Yogyakarta by discussing, forming study groups or cultural organizations that involve people from various backgrounds so that new knowledge and understanding of the life and habits of the people of Yogyakarta emerge. And this internalization process over time, the knowledge values that already exist in each overseas student from the results of objectivation are able to be manifested in actions, language, or expressions, so that overseas students are able to interact with the socio-cultural world of Yogyakarta. Further research needs to be done to explore the problems experienced by overseas students and how to overcome them from various perspectives.

Abstract

This paper is prepared based on the research on 18 couples of husbands and wives from a faculty at a state Islamic university in Yogyakarta. The research found that good communication between husbands and wives in household life could build family resilience and prevent divorce. This study used normative-sociology approach combined with the maṣlaḥah mursalah and convergence theories, which was further combined with the Ibnu Miskawaih and K. Hajar Dewantoro’s theories. The data was collected by distributing questionnaires to 18 couples of husbands and wives. The study found that a good communication between wives and husbands could be built through verbal and non-verbal communications. These verbal and non-verbal communications had the same strength in building a good communication, depending on the situations. There were times when it was more appropriate to use verbal communication, while there were also times when non-verbal communication was the right choice. It could, therefore, be said that communication played a crucial role in building family resilience. Thus, analyzed using the maṣlaḥah mursalah theory, it was not an exaggeration to state that building communication is a necessity for husbands and wives. It is not even exaggerating to say that building a good communication is an obligation that husbands and wives cannot ignore.

Abstract

The rapid advancement of technology facilitates the learning process for students. One of them is by using technology-based learning media. In this research, a Nearpod-based blended learning media for Jurisprudence subject is developed, focusing on mawaris material. This learning media includes a summary of the material and practice questions which are all available in the Nearpod media that has been developed. The purpose of this study is to develop a valid and readable Nearpod-based blended learning media. This research is an RnD (Research and Development) study. This research applies the ADDIE development model which includes the stages of Analysis, Design, Development, Implementation, and Evaluation. The research subjects consisted of 32 XII grade students at MA Nahjatus Sholihin. The data collection techniques used were interviews and questionnaires. This research data includes qualitative and quantitative data. Qualitative data were obtained from interviews at the analysis stage, while quantitative data were obtained from the results of the readability questionnaire. The results of this study indicate that the media readability questionnaire meets very valid criteria, with a score of 87.5%. This media makes it easier for students to understand mawaris material and increase student interest in learning.

Abstract

Pengelolaan sampah yang dilakukan oleh Dinas Perumahan, Kawasan Permukiman dan Lingkungan Hidup Kota Sibolga selalu mendapat kritikan dari masyarakat karena belum maksimal. Hal ini dikarenakan hampir setiap hari masih banyak terjadi penumpukan sampah dipersimpangan jalan terutama yang terjadi di Pasar Sibolga dan di Jalan Sudirman yang lokasinya dekat dengan TPA Perbukitan Parombunan, sehingga menimbulkan bau tak sedap, kotor, kumuh dan banyak lalat. Padahal selama ini setiap bulannya warga ataupun badan usaha selalu membayar uang retribusi pelayanan persampahan kepada petugas. Lalu adanya program daur ulang sampah yang melibatkan masyarakat. Dengan seringnya menumpuk sampah tersebut banyak masyarakat ataupun pengendara yang melintas sering mencium bau tak sedap dan merusak keindahan.Tujuan dalam penelitian ini adalah untuk mengetahui bagaimana kebijakan pengelolaan sampah rumah tangga dan sampah sejenis rumah tangga di Kota Sibolga dan untuk mengetahui apa saja faktor penghambat dalam menjalankan kebijakan pengelolaan sampah rumah tangga dan sampah sejenis rumah tangga di Kota Sibolga. Metode penelitian yang digunakan adalah jenis kualitatif dengan mengambil responden penelitian yaitu Pegawai Dinas Perumahan, Kawasan Permukiman dan Lingkungan Hidup, Penanggung jawab TPA Parombunan, pedagang dan masyarakat. Pengumpulan data melalui teknik wawancara dan dianalisis secara kualitatif.Hasil penelitian menunjukkan bahwa kebijakan pengelolaan sampah rumah tangga dan sampah sejenis rumah tangga di Kota Sibolga merupakan kewenangan dari Dinas Perumahan, Kawasan Permukiman dan Lingkungan Hidup, dengan mengangkut sampah rumah tangga dari rumah-rumah warga yang diangkut ke Tempat Penampungan Sampah Sementara menggunakan gerobak pengangkut sampah dan motor pengangkut sampah ataupun beko untuk diangkut kembali ke TPA. Dinas Perumahan, Kawasan Permukiman dan Lingkungan Hidup menyediakan tempat penampungan sementara yang tersebar di empat kecamatan. Dinas juga mendaur ulang sampah menjadi pupuk kompos dan barang barang berguna seperti tas, botol dan sandal.Faktor penghambat dalam menjalankan kebijakan pengelolaan sampah rumah tangga dan sampah sejenis rumah tangga di Kota Sibolga diantaranya Dinas Perumahan, Kawasan Permukiman dan Lingkungan Hidup masih kekurangan sarana dan prasarana seperti alat angkut sampah dan jumlah pegawai untuk mengangkut sampah dari rumah tangga ke Tempat Pembuangan Akhir masih kurang. Kurang maksimalnya pelibatan masyarakat dalam melakukan daur ulang sampah, sehingga bisa dimanfaatkan oleh pemerintah untuk menjadi barang berguna seperti tas, botol dan kompos.Kata Kunci : Kebijakan, Pengelolaan, Sampah

Abstract

This paper aims to prove that after attending the Marriage Preparation Course, the prospective wives and husbands of the course participants feel the extraordinary benefits of attending the Marriage Preparation Course. Because the material presented is very relevant and vital as a provision in living household life. This paper reports the research results on implementing Marriage Preparation Courses among Muslims in Pekanbaru, Riau and Christians in Yogyakarta. These two objects result from selecting the best performance in carrying out the Marriage Preparation Course. This research includes qualitative research with a juridical approach and uses the theory of the legal system. The result of the study is that the implementation of a good Marriage Preparation Course can give a positive impression and knowledge to the course participants. The participants stated the importance of prospective wives and husbands taking Marriage Preparation Courses. This course assists candidates in dealing with the romance of domestic life in the future, especially if the material also provides testimonials of the couples. One problem to solve by working couples is not being able to get permission from the workplace to take courses. Hopefully, there will be a policy from the government that requires workplaces to permit workers to take courses in the future.

Abstract

This study examines the differing views on mut'ah (temporary) marriage between the Ja'fari and Sunni schools of Islamic jurisprudence through a comparative analysis of their legal reasoning methodologies. Employing qualitative research methods including textual analysis of primary sources, historical examination, and comparative legal analysis, the study explores the origins of these divergent interpretations and their implications for contemporary Muslim societies. The findings reveal that differences in scriptural interpretation, hadith authentication, and legal principles contribute to the contrasting positions on mut'ah marriage. While the Ja'fari school considers it permissible based on Quranic verses and certain hadith, Sunni schools generally prohibit it, citing abrogation and potential social harms. The study highlights how these differing views reflect broader patterns of legal pluralism in Islamic jurisprudence and impact contemporary debates on gender, marriage, and religious authority in Muslim communities. By critically evaluating arguments from both traditions, this research contributes to a more nuanced understanding of Islamic legal diversity and its ongoing negotiation in modern contexts.

Abstract

This paper aims to strengthen the opinion or the concept suggesting that family roles are significant in the attempt to overcome drug uses, violence and terrorism in Indonesia. This is a qualitative research, in which sources of data were literary works, such as academic books and articles.  The article refers to Berger’s theory of social construction during the first stage in the process of externalization out of three stages: externalization, objectification and internalization, which lead to transformation of social actions, which then shape people’s habits. Meanwhile, in the effort to control Social Actions or control people’s habits, the article refers to preventive and repressive efforts, while in terms of the process of social control; the article refers to persuasive, coercive and curative efforts. Our findings suggest that three main social problems: first, drug uses, violence against children, wives, and husbands and terrorism are still main social problems in Indonesia, which require serious, substantial and sustainable efforts to find effective solutions.However, population growth also needs attention even though it is not as vital as others mentioned earlier; second, there are several important reasons and/or factors that problem of drugs, violence and terrorism persist in Indonesia, one of which is the failure of the family to take important role in guiding its members;third, based on our reviews of literature, we conclude that to maximize roles of family, marriage couples should be knowledgeable and competent in keeping their family runs well. For that reason, it is paramount important for marriage couples to educate themselves regarding their roles and responsibilities within the family life. This can be done through taking the pre-marriage courses for those who are about to get married. In fact, marriage couples should persistently educate themselves through many means and channels.

Abstract

Traditional norms in households often assign domestic roles to wives. However, as more wives enter the workforce, these traditional norms must be restructured to foster family resilience. This article presents field research involving 100 working wives in Indonesia and Australia, supplemented with in-depth interviews and Focused Group Discussions (FGD) with 20 working wives and husbands. The collected data were analyzed descriptively using structural-functional theory. The study reveals contrasting dynamics in family responsibilities and the treatment of working wives in Indonesia and Australia. In Indonesia, traditional norms often confine wives to domestic roles, resulting in double burdens and systemic inequality, including domestic violence. In contrast, Australia promotes a more egalitarian approach, supported by strong legal frameworks and a social culture that encourages cooperation in balancing domestic and professional obligations. The study emphasizes that for family balance and stability, both working husbands and wives must respect and collaborate in fulfilling all family roles and functions. These roles should be carried out flexibly, free from rigid gender stereotypes, which is a key to the success of families with working wives. Furthermore, the research highlights the importance of legal reforms and cultural shifts in promoting family equality and preventing domestic violence.
