Abstract

This study aims to determine how the hotel policies in laying off employees are reviewed according to the labor law in Law No. 13 of 2003 and Civil Law in terms of work agreements. The interest of having a job is the most important interest of every society. Because by having a job, people have income to meet their daily needs.This study discusses the policy of the hotel to lay off employees while in the work agreement, employees have the right to pay that they must receive in accordance with the work contract. It is true that no one knows if the COVID 19 pandemic that attacks all countries in the world has had many adverse effects on society. One of the most important impacts is the decline in income and business due to government policies that require reducing the number of people gathering or creating crowds in Indonesia. As a result of this decreased income, employers made efforts to lay off employees to prevent their business from rolling down. However, this policy creates losses for employees who work in the place of business. The conclusion that can be drawn is a violation of the contents of the agreement if when laying off employees or workers but they do not give their rights, namely salary, because salary is the right of every employee who works, and when leaving but not returning to employ an employee where the contract is still valid it is a violation of the contents of the contract, except with the agreement and conditions to terminate the employee's unilateral contract with compensation for severance pay by the hotel. However, this will be difficult if the employees who are dismissed and not given a salary and who are not called back to work are employees who work under an oral agreement. Because there is no written agreement that is binding and proves what was agreed upon orally between the employee and the entrepreneur.

Abstract

This research aims to identify and discuss the problems and symptoms that occur when death and open inheritance occurs, while the will of the heir has been said verbally to the heirs in the traditional inheritance of Batak Toba. This research discusses the problems that arise when the traditional inheritance of Batak Toba is carried out and there is a verbal will by the heir, especially in the heir's land ownership. The problem that arises when open inheritance is carried out in customary inheritance is a dispute from the heirs who are dissatisfied with the unequal distribution to the heirs, while the heirs who get a portie in inheritance are boys, while for women it is a form of gift given male heirs to girls. In the event of a dispute over inherited land, when the name of the land is transferred to the BPN office, there will be obstacles.

Abstract

This study aims to determine how the implementation of in heritance that occurs and the problems that often occur with inheritance in the Batak community in Parapat. Inheritance is not a problem if it is carried out in accordance with the provisions of the division of inheritance, and the division of inheritance is carried out by mutual agreement. However, currently there are many problems that occur when inheritance is not carried out evenly, and it is not uncommon for inheritance to become a dispute for each heir. This study discusses the implementation of community inheritance in Parapat as well as the problems that often occur in the implementation of inheritance and the problem of transferring inheritance rights to the Batak community in Parapat. In the Parapat community, the dominant ethnicity is the Batak, most of them carry out inheritance by dividing the inheritance of customary law. The implementation of the division of inheritance is by focusing on boys as heirs, while for girls it is only limited to "Lean-lean = or commonly called gifts from male heirs". At the time of transferring the inheritance as the right of the heirs, there are many obstacles for the heirs to control their rights, due to the existence of heirs who make it difficult by not recognizing the rights of the other heirs according to their share. When you want to take over, you need the heirs, both boys and girls, to sign. However, when other heirs often do not want to recognize the rights of other heirs, it makes it difficult for other heirs to claim or transfer their rights as traditional owners of the inheritance. Therefore it is important in the implementation of customary inheritance in Parapat, the heirs make a certificate of inheritance rights and also a power of attorney to be able to transfer the rights of the inheritance. Because when later the heirs do not want to recognize or sign for the transfer of rights, the existence of such a power of attorney will not make it difficult for the other heirs to transfer their respective rights in the customary inheritance.
