Abstract

This study discusses the effectiveness of the implementation of the duties and authorities of regional heads in handling regional losses in South Bolaang Mongondow Regency from the perspective of state administrative law. Based on the provisions of laws and regulations, especially Law Number 23 of 2014 concerning Regional Government and Government Regulation Number 38 of 2016 concerning Procedures for Claiming Regional Compensation for Non-Treasurer Civil Servants or Other Officials, regional heads have a central role in the process of settling regional losses. This study uses a normative juridical method with a legislative approach and concrete cases in the area. The results of the study show that the implementation of the duties and authorities of regional heads in handling regional losses has not run optimally due to structural constraints, weak internal supervision, and lack of understanding of the apparatus regarding the mechanism of claiming compensation. Therefore, it is necessary to strengthen implementing regulations, increase the capacity of apparatus, and optimize the function of regional inspectorates as part of the internal supervision system of local governments.

Abstract

This study aims to analyze the implementation of supervision carried out by the Government Internal Supervision Apparatus (APIP) on village financial management in Bolaang Uki District, as well as to find out the obstacles faced in its implementation. Village financial management is an important aspect of transparent and accountable village development, so it requires an effective supervision mechanism. The research method used is an empirical juridical approach with data collection through field studies and documentation. The results of the study show that supervision by APIP has not been fully optimal, characterized by inconsistencies in the reporting and use of village funds. The inhibiting factors include limited human resources, low understanding of village officials on financial regulations, and weak coordination between APIP and village governments. Therefore, it is necessary to strengthen the capacity of APIP, increase training for village officials, and synergy between institutions to encourage village financial management in accordance with the principles of good governance.

Abstract

This study employs a Research and Development methodology, guided by the ADDIE framework, to design a sustainable restorative digital rehabilitation model for children in conflict with the law. It responds to critical systemic deficiencies observed in juvenile justice, including fragmented service delivery, non standardized intervention protocols, and persistently high recidivism rates. Data were synthesized from structured literature reviews, field observations at LPKA Class II Gorontalo, expert consultations, and controlled pilot trials. The principal outputs comprise a detailed process architecture, operational workflow maps, and a modular integrated application. This digital platform consolidates standardized assessment, intervention tracking, behavioural monitoring, and post-release reintegration support. Validation analyses indicate that the proposed model adheres to normative child justice standards and demonstrates technical feasibility for scalable implementation. The framework enhances intervention precision, improves the measurement of behavioural transformation, and strengthens readiness for community reintegration. Consequently, this research contributes a hybrid socio-legal and digital framework designed to increase systemic reliability and standardisation in juvenile rehabilitation. The model presents a scalable solution with potential global relevance for reducing recidivism among young offenders.

Abstract

This article examines the relationship between neurocognitive dysfunction, criminal behaviour, legal theory, and Islamic thought, with particular attention to the neurobiological foundations of moral decision-making and criminal responsibility. Employing an interdisciplinary normative approach that integrates cognitive neuroscience, criminal law theory, moral philosophy, and Islamic jurisprudence, this study analyses how neurobiological dysfunctions especially those affecting the prefrontal cortex and amygdala may influence impulse control, moral judgement, and antisocial conduct. Drawing exclusively on a critical review of scholarly literature, judicial decisions, and normative legal sources, the article explores the implications of neuroscientific findings for concepts of free will, moral agency, and criminal liability. The analysis demonstrates that while neuroscientific evidence has the potential to inform sentencing mitigation and rehabilitative strategies, its application raises significant ethical and legal challenges, particularly concerning biological determinism, evidentiary reliability, and procedural fairness. From an Islamic legal perspective, sound intellect (‘aql) constitutes the foundation of taklīf (legal responsibility), yet Islamic jurisprudence recognises circumstances in which responsibility may be diminished or removed, in accordance with the principles of raf‘ al-ḥaraj and maqāṣid al-sharī‘ah. The article argues that the absence of clear procedural standards and limited doctrinal integration of neuroscience within criminal justice systems particularly in Indonesia and Malaysia necessitates a more coherent normative framework. Ultimately, this study proposes a holistic and ethically grounded approach to criminal justice reform that integrates neuroscientific insights with legal principles and religious values, aiming to enhance proportionality, procedural justice, and human dignity.

Abstract

Perkembangan ilmu pengetahuan dan teknologi yang pesat telah mengubah sistem penegakan hukum lalu lintas di Indonesia, termasuk di Provinsi Gorontalo. Metode tilang konvensional seringkali dianggap tidak efektif karena proses yang panjang, keterbatasan personel, dan rentan terhadap pungli. Untuk mengatasi permasalahan tersebut, sistem Penegakan Electronic Traffic Law Enforcement (ETLE) diperkenalkan sebagai inovasi teknologi yang bertujuan untuk memperkuat transparansi, efisiensi, dan akuntabilitas dalam penegakan hukum lalu lintas. Penelitian ini bertujuan untuk menganalisis implementasi ETLE di Provinsi Gorontalo dan mengidentifikasi kendala yang menghambat optimalisasi pelaksanaannya. Dengan menggunakan pendekatan empiris kualitatif yang didukung oleh analisis perundang-undangan, konseptual, dan studi kasus, penelitian ini mengumpulkan data primer melalui wawancara dan observasi di Direktorat Lalu Lintas Kepolisian Daerah Gorontalo, dilengkapi dengan data sekunder dari peraturan perundang-undangan dan literatur. Temuan penelitian menunjukkan bahwa ETLE telah berkontribusi dalam mengurangi pelanggaran lalu lintas dan meningkatkan kepatuhan masyarakat, sebagaimana tercermin dari penurunan pelanggaran yang tercatat secara signifikan dari tahun 2022 ke tahun 2024. Sistem ini juga telah meminimalkan interaksi langsung antara petugas dan pengguna jalan, sehingga mengurangi potensi praktik ilegal. Namun, masih terdapat beberapa tantangan, termasuk keterbatasan infrastruktur teknologi, data kepemilikan kendaraan yang tidak lengkap, rendahnya kesadaran masyarakat, dan tingginya biaya denda yang dianggap memberatkan oleh sebagian pengguna jalan. Kendala-kendala ini membutuhkan perbaikan infrastruktur, edukasi publik yang berkelanjutan, dan penguatan kebijakan untuk memastikan ETLE berfungsi secara efektif dan adil. Secara keseluruhan, ETLE merupakan langkah penting menuju modernisasi penegakan hukum lalu lintas dan mendorong budaya berkendara yang aman dan tertib di Provinsi Gorontalo.
