Abstract

Gorontalo Provincial Regulation Number 4 of 2023 concerning the Protection and Fulfillment of the Rights of Persons with Disabilities mandates inclusive education through Article 17 as an effort to provide equal educational opportunities. This study aims to analyze the juridical position of Article 17 as a legal basis for fulfilling the educational rights of persons with disabilities in Bongo Village, Batudaa Pantai District, Gorontalo Regency, and to identify gaps between normative mandates and field implementation. Using empirical legal research with a qualitative approach, data were collected through in-depth interviews with the Village Head, the Principal of SDN 03 Batudaa Pantai, and a parent of a student with disabilities, as well as through documentation studies. The findings indicate that Article 17 holds a normatively strategic position, aligning with national regulations and international human rights standards. However, implementation in Bongo Village faces significant gaps characterized by the absence of a Disability Service Unit (DSU), the lack of a Governor’s Regulation as a technical implementing rule, and limited accessible inclusive education facilities. These conditions result in the failure of both preventive and repressive legal protection for persons with disabilities.

Abstract

This study aims to analyze the disharmony between normative regulation and the implementation of the protection of Persons with Mental Disorders (ODGJ) in Indonesia, especially at the regional level, by integrating the perspectives of national law, human rights, and Islamic law. The method used is normative legal research (doctrinal legal research) enriched with a socio-legal approach. The research approach includes the statute approach, conceptual approach, and case approach, with theoretical frameworks in the form of legal functionalization theory, legal protection theory, and maqāṣid al-syarī'ah which emphasizes the protection of the soul (ḥifẓ al-nafs) and the principle of non-discrimination. The results of the study show that the failure of ODGJ protection does not stem from weaknesses in legal norms, but from structural failures in implementation. The disharmony of regulations is reflected in weak coordination between agencies, limited resources for mental health workers, and the lack of operational and applicable regional regulations. In addition, the legal culture of the community that is still full of stigma and discrimination exacerbates the ineffectiveness of legal protection for ODGJ. This study concludes that the effectiveness of ODGJ protection requires an integrative model that incorporates a human rights approach and the values of maqāṣid al-syarī'ah in an implemented manner. The main findings confirm that the main problem lies in structural and cultural aspects, not normative; Therefore, it is recommended to strengthen implementing regional regulations, increase institutional capacity and mental health services, and social interventions based on public education to remove stigma, in order to realize an inclusive, effective, and equitable ODGJ protection system.

Abstract

This study analyzes the urgency of strengthening the authority of Regional Governments to issue Small-scale Gold Mining Permits within the framework of the relationship between the Central Government and Provincial Governments, as part of equitable licensing decentralization. Strengthening regional authority is essential to support regional autonomy and improve the effectiveness of natural resource management based on local conditions and community needs. This research employs a juridical-empirical method with a qualitative approach, examining mining regulations and a case study in Gorontalo Province. Primary data were collected through interviews with relevant stakeholders, while secondary data were obtained from legal literature, policy documents, and official publications. The findings show that the current delegated authority system creates administrative limitations and delays in permit issuance. Therefore, this study proposes strengthening provincial government authority through an attributive model to accelerate licensing services, enhance administrative effectiveness, and reinforce the regional role in accountable and sustainable mineral and coal mining governance.

Abstract

Penguatan demokrasi lokal berbasis kearifan lokal dan perlindungan inklusif terhadap hak-hak kelompok rentan merupakan fondasi penting untuk mewujudkan tata kelola pemerintahan desa yang partisipatif, responsif, dan berkeadilan. Kegiatan pengabdian kepada masyarakat di Desa Talulobutu dilaksanakan untuk menjawab tantangan dan hambatan rendahnya partisipasi kelompok rentan dalam musyawarah desa serta belum adanya instrumen hukum yang menjamin keterlibatan mereka. Metode yang digunakan dalam pengabdian kepada masyarakat ini meliputi observasi lapangan, pelaksanaan pendidikan hukum dan hak asasi manusia, pendampingan advokasi hukum dalam penyusunan dan perancangan peraturan desa berbasis konsep Desa Inklusif, serta pelaksanaan monitoring dan evaluasi. Hasil pengabdian kepada masyarakat ini berhasil memberikan pemahaman baru dan peningkatan kesadaran akan demokrasi lokal. Selain itu, hasil lainnya adalah integrasi nilai-nilai kearifan lokal Huyula (gotong royong) dan Dulohupa (musyawarah mufakat) telah memperkuat legitimasi sosial dalam pembentukan kebijakan desa yang inklusif. Dengan demikian, pengabdian kepada masyarakat ini telah memberikan kontribusi nyata bagi pengembangan hukum daerah yang demokratis dan inklusif, serta menjadi model pemberdayaan desa yang menekankan kesetaraan, partisipasi, dan penghormatan terhadap hak asasi manusia.
