Abstract

Collecting donations for natural disaster victims is a form of social solidarity widely practiced by the community, including students. However, in practice, these fundraising activities must be carried out in accordance with applicable legal provisions, specifically Regulation of the Minister of Social Affairs of the Republic of Indonesia Number 8 of 2021 concerning the Implementation of the Collection of Money or Goods (PUB). This study aims to analyze the implementation of Ministerial Regulation Number 8 of 2021 in the practice of collecting donations for natural disasters by students. The research method used is a normative empirical research method with a legislative and sociological approach. Data were obtained through literature review and interviews with the Social Services Agency and student organizations. The results show that the implementation of Ministerial Regulation Number 8 of 2021 in student fundraising activities has actually taken place, but is not yet fully optimal. This is evident in the continued discovery of donation collections carried out without official permits from authorized agencies and the lack of accountability reporting for collected funds. This condition indicates that the level of compliance with administrative provisions in the implementation of fundraising is still relatively low. Therefore, increased regulatory dissemination, more effective oversight, and increased legal awareness among students are needed to ensure that fundraising activities are carried out transparently, accountably, and in accordance with applicable laws.

Abstract

This study aims to analyze the implications of the absence of fiscal guarantees on the effectiveness of fulfilling the rights of persons with disabilities under Regional Regulation of Gorontalo Province Number 4 of 2023. The research employs a normative juridical method using statutory, conceptual, and analytical approaches. The rights of persons with disabilities are categorized as social rights whose realization requires active fiscal intervention within the framework of a welfare state. The findings indicate that although the regional regulation has incorporated progressive norms concerning the protection and fulfillment of rights, the provisions on financing remain general and do not contain explicit fiscal guarantee schemes, such as minimum budget allocations or binding affirmative mechanisms. The absence of such fiscal guarantees results in the implementation of rights being highly dependent on the annual regional budgeting policy through the Regional Revenue and Expenditure Budget (APBD), which is political and dynamic in nature. This condition creates the risk of symbolic regulation, weakens legal certainty, and reduces the practical effectiveness of the norms. Therefore, an integration between substantive norms and a structured and sustainable fiscal design is required to ensure that the protection of the rights of persons with disabilities does not remain merely declaratory, but is realized concretely and consistently in accordance with the principles of the welfare state.

Abstract

Penelitian ini mengkaji pengaturan dan implikasi hukum terkait pelanggaran royalti musik dalam performing rights di Indonesia dengan menyoroti dinamika regulasi, kelembagaan, serta praktik penegakannya. Fokus utama diarahkan pada analisis kewajiban pembayaran royalti terhadap pemanfaatan musik dalam ruang publik, baik secara langsung maupun melalui media digital, sebagaimana diatur dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta serta Peraturan Pemerintah Nomor 56 Tahun 2021. Kajian normatif yang digunakan menelusuri ketidaktegasan pengaturan tentang pihak yang bertanggung jawab, dualisme kewenangan antara LMK dan LMKN, serta kelemahan prosedural seperti kewajiban mediasi yang kerap diabaikan. Analisis terhadap beberapa kasus menunjukkan bahwa pelanggaran performing rights dapat menimbulkan konsekuensi perdata, administratif, dan pidana, yang seluruhnya bertujuan menjaga nilai ekonomi karya serta memberikan perlindungan yang layak bagi pencipta. Pengaruh perjanjian internasional, terutama Konvensi Bern, TRIPS, dan WIPO Copyright Treaty, menjadi landasan penting yang memperkuat urgensi harmonisasi regulasi nasional dengan standar global. Kajian ini menegaskan perlunya reformasi menyeluruh terhadap tata kelola royalti musik untuk mencapai sistem yang adil, transparan, dan adaptif terhadap perkembangan industri kreatif.

Abstract

This article aims to analyze the concept of public participation within Jürgen Habermas’s deliberative democracy framework by focusing on three fundamental rights: the right to be heard, the right to be considered, and the right to be given an explanation. These rights are examined as an integrated deliberative process that links the lifeworld, the public sphere, and the political system. Using a qualitative method with a theoretical approach, this study relies on an extensive literature review to interpret Habermasian deliberative democracy and to explain how citizens’ voices obtain normative legitimacy in democratic decision-making. The findings indicate that the right to be heard highlights the importance of acknowledging citizens’ lived experiences as a moral foundation for public policy. The right to be considered emphasizes the need for an inclusive, domination-free public sphere in which arguments are assessed on equal terms. Meanwhile, the right to be given an explanation underscores the political system’s responsibility to respond to public opinion communicatively rather than merely through formal procedures. The analysis concludes that public participation becomes substantively meaningful only when grounded in communicative rationality and protected from system colonization. Therefore, political legitimacy in modern democracy should not rest solely on procedural compliance but on rational dialogue formed between citizens and the state within a deliberative public sphere.

Abstract

This study examines the legal implications of blank columns (empty boxes) on voter participation and electoral outcomes in Indonesia’s single-candidate regional elections (Pilkada). Utilizing normative legal research with statutory and case approaches, this paper analyzes how the blank column operates within the constitutional framework of local democracy. The findings indicate that while the blank column procedurally protects voting rights by preventing the automatic victory of single candidates, it fundamentally highlights a structural deficit in substantive democracy due to a severe lack of political competition. Furthermore, a blank column victory legally disrupts governance continuity, necessitating the appointment of unelected interim regional heads. Consequently, this study demonstrates that the blank column functions merely as a post-facto corrective mechanism rather than a preventive solution for flawed candidate recruitment. It concludes that Indonesian electoral design requires substantial reform to foster genuine political contestation and safeguard substantive democratic legitimacy.

Abstract

Women’s representation in Indonesia’s electoral legal system has been recognized through a minimum quota of 30 percent for legislative candidates. However, the effectiveness of this provision is not determined solely by the existence of the norm, but also by how that norm is enforced in practice. Existing regulations, whether in Law No. 7 of 2017 or the KPU’s technical regulations, place greater emphasis on compliance with administrative procedures rather than on the consequences of noncompliance. As a result, this obligation tends to function as a flexible formal requirement. This situation reflects the nature of lex imperfecta—that is, norms that are not accompanied by strict sanctions—thereby creating a regulatory gap and weakening law enforcement. This phenomenon was evident in the 2024 General Election in Gorontalo Electoral District 6, where the provisions on women’s representation were not fully complied with but were nonetheless accepted in the electoral process. This study employs a normative legal method using a statutory approach and a case-based approach through an analysis of Constitutional Court Decision No. 125-01-08-29/PHPU.DPR-DPRD-XXII/2024. The novelty of this study lies in the analysis of women’s representation not only as an affirmative action policy but as an issue concerning the nature of legal norms, examined through the concepts of lex imperfecta and regulatory gaps in the Indonesian electoral system. In addition, this study specifically examines the implications of the absence of sanctions for the authority and law enforcement practices of the General Elections Commission (KPU) following the Constitutional Court’s ruling. The results of the study indicate that the weakness of sanction mechanisms has caused the provisions on women’s representation to lose their enforceability and to rely more on political compliance by parties than on the effectiveness of the legal norms themselves. ABSTRAKKeterwakilan perempuan dalam sistem hukum pemilu Indonesia telah diakui melalui ketentuan kuota minimal 30 persen dalam pencalonan anggota legislatif. Namun, efektivitas ketentuan tersebut tidak hanya ditentukan oleh keberadaan norma, melainkan juga oleh bagaimana norma tersebut ditegakkan dalam praktik. Pengaturan yang ada, baik dalam Undang-Undang Nomor 7 Tahun 2017 maupun regulasi teknis KPU, lebih menekankan pada pemenuhan prosedur administratif dibandingkan dengan konsekuensi atas ketidakpatuhan. Akibatnya, kewajiban tersebut cenderung berfungsi sebagai persyaratan formal yang fleksibel. Kondisi ini menunjukkan karakter lex imperfecta, yaitu norma yang tidak disertai sanksi yang tegas, sehingga menimbulkan regulatory gap dan memperlemah penegakan hukum. Fenomena ini tampak dalam Pemilu 2024 di Dapil Gorontalo 6, di mana ketentuan keterwakilan perempuan tidak sepenuhnya dipatuhi namun tetap diterima dalam proses pemilu. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus melalui analisis Putusan Mahkamah Konstitusi Nomor 125-01-08-29/PHPU.DPR-DPRD-XXII/2024. Kebaruan (novelty) penelitian ini terletak pada analisis keterwakilan perempuan tidak hanya sebagai kebijakan afirmatif, tetapi sebagai persoalan karakter norma hukum yang dikaji melalui konsep lex imperfecta dan regulatory gap dalam sistem pemilu Indonesia. Selain itu, penelitian ini juga mengkaji secara spesifik implikasi kekosongan norma sanksi terhadap kewenangan dan praktik penegakan hukum oleh KPU pasca putusan Mahkamah Konstitusi. Hasil penelitian menunjukkan bahwa lemahnya mekanisme sanksi menyebabkan ketentuan keterwakilan perempuan kehilangan daya paksa dan lebih bergantung pada kepatuhan politik partai dibandingkan efektivitas norma hukum itu sendiri.

Abstract

This study analyses the impact of Dutch colonial law on the evolution of the Indonesian legal system following independence, as well as the integration of local and global principles in the establishment of National Legal Policy across several historical periods. The primary issue encountered was the legal duality between Dutch law and customary law, alongside the difficulty of establishing an autonomous national legal system. This study employs normative legal methodologies and a literature-based methodology to examine the progression of legal systems from the colonial era to the reform period. The findings indicated that, although Indonesia's independence, the remnants of colonial law continue to prevail within the legal framework, particularly in civil and criminal domains. Legal reforms initiated in the late 1990s aimed to eliminate colonial influences and include local values with global standards. The difficulty in achieving equilibrium between these two elements remains a significant topic of discussion in Indonesia's legal reform.

Abstract

This research aims to find out and analyze efforts to fulfill political rights for first-time voters with disabilities in the general election in Gorontalo Regency in 2019 and to find out and analyze the factors inhibiting the fulfillment of political rights for first-time voters with disabilities in the general election in Gorontalo Regency in 2019 , based on the title raised in this research, researchers see the weakness of Indonesia's defenses from attacks by things that endanger society, thousands of illegal drugs have been circulating throughout Indonesia. This research uses empirical methods. The data collection process examined by researchers in this research is primary data and secondary data. Data collection techniques that support and are related to this research are interviews, observation and literature study. The results of this research show that the KPU and the Government have ensured the implementation of efforts to respect and promote , protection and fulfillment of the rights of novice voters with disabilities to develop themselves and utilize all abilities according to their talents and interests to enjoy, participate and contribute optimally, safely, freely and with dignity in all aspects of national, state and social life. By socializing and expanding the network of first-time voters with disabilities to play an effective role in the general election system at all stages or parts of its implementation. Increasing the participation of people with disabilities in elections is also not easy. Every citizen has the right to social security necessary for a decent life and for full personal development. Every person with disabilities, elderly people, pregnant women and children have the right to receive special facilities and treatment. Accessibility problems are one of the factors that cause first-time voters with disabilities to not cast their votes optimally, as happened in Gorontalo where the Gorontalo Regency General Election Commission continuously coordinates with first-time voters with disabilities to ensure that these first-time voters with disabilities are still able to vote. exercise their rights when voting.
