Abstract

Tourism in Tenganan Dauh Tukad Village, Karangasem Regency, as an ancient village characterized by the Bali Aga tradition, possesses unique cultural and traditional potentials that attract both domestic and international tourists. The local Tourist Guide Group plays a crucial role as a communication bridge and provider of in-depth cultural experiences for visitors. However, most tour guides still face several limitations, including limited foreign language proficiency (English and Mandarin), minimal training in cultural interpretation, and the absence of Standard Operating Procedures (SOPs) based on the village’s awig-awig (customary regulations). This Community Service Program (Pengabdian kepada Masyarakat [PKM]) aimed to enhance the professionalism and competence of Tourist Guide Group members through socialization and basic training activities. The methods employed included assistance in drafting SOPs, facilitating socialization sessions conducted by the local Tourism Office, and implementing basic training programs. The solutions offered to address the partners’ challenges comprised improving human resource competencies, strengthening institutional capacity, standardizing services (including SOP development), and utilizing digital technology. The outputs of this program included the development of the Tenganan Dauh Tukad Tourist Guide SOP in the form of a pocketbook, publication of an accredited community service journal article, and dissemination through mass media. Improved professionalism is expected to result in more professional and educational services, increased income for tour guides, and strengthened cultural preservation and sustainability of tourism in the traditional village.

Abstract

The new paradigm of tourists in the last 10 (ten) years greatly affects the attractions visited by both foreign and domestic tourists. Tourists who used to only want to enjoy natural beauty, culinary, and night tours, now there is a change in the orientation of tourist destinations. Tourists now prefer to travel to villages with panoramic views and village culture, tourists miss seeing the beautiful village atmosphere and Balinese culture which is still very thick with the nuances of Hinduism. Bali, known as the Thousand Temples, is very rich in religious places and temples that used to be a place of yoga for holy people. Likewise with Jembrana Regency which is geographically with the East Java Island which is very thick with its Javanese culture. Along the coast of the Bali Strait and West Bali National Park, there are many petilasan which is a stopover and hermitage place for holy people who sailed from the ancient Mataram Kingdom and Islamic Mataram who expanded to Bali. One of them is the Petilasan of Sumur Kembar Temple and Petilasan of Mbah Temon which are located in the Cekik Forest area, Gilimanuk Village. To further introduce and more professional management of tourist objects, in accordance with the policy of the Department of Tourism and Culture of Jembrana Regency, the management is handed over to BUMDes. So that income from tourism objects managed through BUMDes is to increase the source of Village Original Income, which of course will be used to improve the welfare of the Village community.

Abstract

Isu kekerasan terhadap perempuan dalam perspektif industri kepariwisataan menjadi hal yang memprihatinkan dan menentukan jumlah wisatawan atau masyarakat yang berkunjung ke suatu negara. Banyak negara yang gagal mempromosikan potensi destinasi pariwisatanya karena adanya isu kekerasan terhadap perempuan. Negara-negara seperti Bangladesh, India Selatan, Negara-negara Afrika, dan lain sebagainya adalah kelompok negara-negara yang gagal menarik wisatawan karena terpengaruh isu kekerasan terhadap anak dan perempuan. Dunia pariwisata memang rentan dan sensitive sekali terhadap isu. Bali sebagai tujuan wisata berkelas dunia, bertubi-tubi diserang isu. Berbagai isu pernah menerpa Bali antara lain, kekerasan terhadap anak dan perempuan, isu terorisme Bom Bali I dan II, isu SARS, isu Flu Burung, dan yang terakhir isu Virus Corona 19 yang mampu menjadikan pariwisata bali stagnan. Wisatawan Cina, Australia, dan dari negara lainnya dilarang masuk ke Bali, sehingga Bali secara regional menderita kerugian kehilangan devisa sebesar kurang lebih 3 Triliyun per-bulan. Permasalahan yang ingin diberdayakan dalam pengabdian kepada masyarakat ini adalah, meningkatkan kemampuan para pengurus Desa Adat se Kabupaten Jembrana, khususnya pengurus Desa Adat Tuwed ditingkatkan pemahaman, ketrampilan, dan kesadaran hukumnya untuk menjadi seorang paralegal. Metode yang dipergunakan adalah Focus Group Disscussions dan partisipasi terlibat dalam menangani masalah kekerasan terhadap anak dan perempuan. Simpulan yang dirumuskan adalah, pengurus Desa Adat Tuwed sudah memiliki pengetahuan, pemahaman, ketrampilan, dan kesadaran hukum dalam rangka menangani maalah kekerasan terhadap perempuan.

Abstract

Desa Adat dan Pemerintah Desa sama-sama memiliki kewenangan untuk mengelola daya tarik wisata, yang dalam pelaksanaannya dijalankan oleh BUPDA untuk Desa Adat dan BUM Desa untuk Pemerintah Desa. Desa Adat Apuan bekerjasama dengan Pemerintah Desa Apuan dalam pengelolaan daya tarik wisata yang dalam pelaksanaannya melibatkan BUM Desa Dharma Abadi Apuan, namun  belum memiliki payung hukum berupa Peraturan Desa sebagai dasar legalitas dalam pengelolaan daya tarik wisata. Tujuan dari kegiatan Pengabdian kepada Masyarakat adalah memberikan pendampingan penyusuanan Rancangan Peraturan Desa Pengelolaan Usaha Wisata Di Desa Apuan Kecamatan Susut Kabupaten Bangli sebagai dasar yuridis BUM Desa dalam pengelolaan daya tarik wisata, serta pengkajian terhadap Perjanjian kerjasama ditinjau dari Pasal 1320 KUHPerdata. Hasil pengabdian menunjukkan bahwa kerjasama antara Desa Adat Apuan dengan Pemerintah Desa Apuan merupakan suatu bentuk sinergitas pengelolaan daya tarik wisata dalam rangka pengembangan wisata desa. Rancangan Peraturan Desa Pengelolaan Usaha Wisata disusun tidak hanya untuk menjawab kebutuhan hukum tetapi juga diperlukan untuk mengatur seluruh daya tarik wisata sesuai dengan potensi yang dimiliki agar pengelolaan dan pengembangan daya tarik wisata di Desa Apuan berjalan efektif. Perjanjian kerjasama yang disusun haruslah mencerminkan keadilan sesuai dengan kontribusi dari para pihak dan agar dapat memberikan manfaat bagi masyarakat Desa Apuan.

Abstract

Song or music works become an unique creation in one part of the copyright itself where song ormusic works are intangible but have legal power in copyright and do not need to be registered to recognize the work. And the transferof song or music works will be enjoyed as a whole, especially to its creator, the copyright holder, and the community. In its development, covering songs become a term in the transfer of song ormusic works. The need of law in protecting the transfer of song ormusic works, especially in the work uploaded on social media. The formulation of the problem in this study is 1. How is the legal certainty of the transfer of music to others? 2. How is the legal protection of copyright holders over the transfer of music that is uploaded through social media? This study uses normative legal research methods, uses a legal approach and conceptual approach, examines primary legal materials, secondary legal materials, and tertiary legal materials and uses legal material collection techniques with library studies, reading literature and related internet pages. The activity of transferring copyright in a musical work or referred to as covering a song where the legality can be carried out by someone else in someone's work in connection with the existence of a license and related royalties. This legal arrangement is basically still legal even though the law is in Law No. 28 of 2014 concerning License licensing rights and royalties in transfers. In the covered music and uploaded on social media, for example youtube, in the current development, YouTube has become an activity that produces economic value.In other words, when there is a copyright transfer, especially song atau music works from someone who is not the creator of the work and uploaded to the social media in general, a creator's license must be included.In connection with the economic value contained in social media, it means that the economic right of a work participates in switching.In other words, there is a royalty that must be given to the owner or creator of a song atau music works.

Abstract

Guarantee of work accident was an assurance given by workers in the form of money in lieu of the cost of freight, the cost of the inspection, the cost of medicine, as a result of a work accident. Against workers who had an accident at work is entitled to a guarantee of work accident. Based on the information in the field that occurs in the Risaldi Supermarket in Badung Regency has occurred that the Supermarket Risaldi Mart as entrepreneurs have yet to provide full protection of the law against the workers who were put to work. Is there any formula issues namely (1) How the implementation of a social security worker accident at Modern Store in Badung Regency? (2) Factors that become obstacles to Modern Stores not requiring workers in the social security program work accident Badung Regency? The research used in this thesis is the empirical research. Because in this study investigated people in a relationship are living in the community then the empirical legal research methods can be said to be a sociological legal research. Participants of the BPJS employment will get a special guarantee if a work accident, such as rehabilitation, health care, returns to work program (return to work), compensation for death and funeral expenses, as well as the workers will get Promote and preventive activities to support the realization of safety and occupational health. In the implementation of social security in the modern shop is still the lack of thoroughness of the worker in the complete warranty claim requirements work accident before it is given to the BPJS so take a long time in the process of dilution and lack of attention toward the payment of compensation to workers who have been stricken work accident.

Abstract

In its development, every industry today is a business activity that produces a large economy that requires a lot of labor. In its rules namely Law No. 13 of 2003 which applies primarily in labor matters has been established as a rule for systematically running the business activities of the company. The formulation of the problem in this study is 1) How do acts of violation of termination of employment against outsourcing workers? 2) What are the efforts of outsourcing workers who violate the employment contract and are affected by Termination of Employment? This study uses normative legal research methods, uses the statutory approach and conceptual approach, examines primary legal materials, secondary legal materials, and tertiary legal materials and uses legal material collection techniques by studying literature, reading literature and related internet pages. Outsourcing is a term that refers to the authority of the job to employ every community who wants to move in the company's business. Outsourcing workers are intended as workers who have joined certain companies to carry out a business activity in which of course there are terms and conditions governing the management of these workers, mentioned in the employment contract. The rules contained in each work contract allow there is no crime against business ventures and layoffs if there is fraud or breach of contract outsourcing workers in running a business, it is in accordance with the Manpower Act.

Abstract

Traditional medicine in Indonesia or Jamu has been known for a long time. If in traditional medicine contains medicinal chemicals it is where there is an indication of violation of the rules of manufacture or composition of traditional medicines produced. This situation creates unrest among the people as consumers, because its rights have been violated. Weak consumer positions are weakening. Based on the background of the problem described above. Then can be formulated some of the following problems (1) How is the role of BPOM in the supervision of traditional herbal medicine that contains hazardous chemicals in the community? 2 How is legal protection against the public against the traditional herbal medicine that contains harmful chemicals under Law No. 8 of 1999 about consumer protection? Referring to the formulation of the problem, then the type of research used in the writing is normative research. Surveillance conducted by BPOM on the distribution of traditional herbal medicine is done both in production activities where the product has not circulated or supervision of products that have been circulating the market. The legal purpose of repressive legal protection is to resolve disputes. BPOM's preventive law efforts in the supervision of traditional herbs can be coaching and quality improvement policy by enforcing the standardization of production quality.

Abstract

Pertamina as a producer (principal) sells products to consumers through agents, causing Pertamina not to deal directly with consumers, so there is no contractual liability between producers and consumers. The problem formulation in these studies is: 1) What is the legal relationship between principal and agent based on the Agency Agreement LPG Gas Non-PSO?; 2) What is the contractual liability based on the Agency Agreement LPG Gas Non-PSO?. This type of research is juridical normative with a legal approach and presented in the form of legal interpretation. Agency agreements between principals and agents are not specifically regulated in the KUH Perdata and KUHD, but the principle of freedom of contract allows for an Agency Agreement. The Agency Agreement made between Pertamina and Agent creates a legal relationship that is reflected in the rights and obligations of each party which if not fulfilled is an act of default. Contractual liability refers to legal liability in an agreement / contract. Pertamina gives a gradual sanction to agents. Agents are not permitted to change the selling price and reduction of the tube contents to consumers, so that if a consumer lawsuit occurs, Pertamina is freed from the demands of a third party. As long as the subject matter of the law is contrary to matters that are objects of law, then the case can be criminalized. Every act of a legal subject that is contrary to other legal subjects will become the realm of civil matters.

Abstract

Abstract—Technological developments affect all aspects of life that make life easier or more instant. One aspect of this technology is affected by the purchase agreement. This agreement was initially carried out by businessmen meeting with a buyer in a place (the market), today this agreement can be done simply by using mobile phones that have internet we are able to make buying and selling the so-called E-Commerce. As for the formulation of the problem 1. How is the validity of the Sale and Purchase Agreement using Electronic Media (E-Commerce) for the parties who make it? How is the Good Faith Principle in the Sale and Purchase Agreement of Goods using Electronic Media (E-Commerce)? This research uses normative research methods. The results of this study are Effect of E-Commerce has changed the way a person to transact in the electronic media have a positive impact for both side. When there is a positive impact then of course there are negative impacts, the negative impact entrepreneurs often commit fraud in transactions because they do not meet in person only meet in cyberspace alone. So in the world of E-Commerce importance of implementing in good faith greatly influence the nets of a business because when it has been using the good faith of both parties will not commit fraud with each other.
