Abstract

This study aims to analyze and examine the effectiveness of the Integrated Law Enforcement Center (Gakkumdu) in criminal enforcement of the 2024 Election in Central Java. This type of research is empirical or non-doctrinal law, the nature of analytical descriptive research. Using a qualitative approach with primary data from interviews and observations. Secondary data from books, scientific journal articles and legislative review. The results of the study show that the Central Java Gakkumdu Center has carried out its functions and authorities as a center for criminal law enforcement activities in accordance with the Election Law and Perbawaslu, but it has not been effective and legally certain. Because in handling election crime cases in 35 districts/cities as many as 110 cases, only 5 cases have permanent legal force, 2 cases stopped at the Police investigation, and 103 cases stopped at the discussion of the Gakkumdu Center. The causal factors are not in accordance with the theory of the legal system of law: (1) Legal substance: (a) the time to handle the case of election crimes is short (Speedy trial), (b) the legal subject of the perpetrator of the election crime is not fulfilled, (c) lack of evidence in the investigation of election crimes, and (d) difficulties in finding witnesses in the investigation of election crimes. (2) Legal structure: (a) many institutions in the Gakkumdu Center make coordination difficult, (b) different perceptions between institutions in the Gakkumdu Center make it difficult to determine election crimes, (c) the Gakkumdu Center is a non-institutional coordination forum in election crime enforcement, (d) the election crime enforcement coordinator Bawaslu only forwards reports and not as an election crime investigator. (3) Legal culture: (a) lack of understanding of election crime violations, (b) lack of public awareness of reporting election crimes to the gakkumdu center, (c) lack of public willingness to witness election crime cases, and (d) weak legal awareness of election participants to comply with the election law. The solutions to overcome the ineffectiveness of the Gakkumdu Center in election crime enforcement in the future: (a) the need for a single institution in election crime enforcement, and (b) the strengthening of Bawaslu's authority in election crime enforcement

Abstract

Upaya pemberantasan korupsi yang efektif dan komprehensif membutuhkan partisipasi banyak pihak, termasuk peranan kalangan perguruan tinggi, karena perguruan tinggi mempunyai peranan penting dalam mengembangkan nilai-nilai anti korupsi. Perguruan tinggi sebagai lingkungan kedua bagi mahasiswa, dapat menjadi tempat pembangunan karakter dan watak, sehingga dapat memberikan nuansa yang mendukung upaya untuk menginternalisasikan nilai-nilai dan etika yang hendak ditanamkan, termasuk di dalamnya perilaku anti korupsi. Tujuan pengabdian ini untuk memberikan pemahaman dan memotivasi kepada seluruh Pengurus Himpunan Mahasiswa Hukum (HIMAKUM) Fakultas Hukum Universitas Dirgantara Marsekal Suryadarma tentang nilai-nilai kejujuran, tangungjawab, dan keberanian dalam memerangi korupsi, menyamakan persepsi dikalangan para pengurus bahwa tugas pencegahan korupsi bukan saja merupakan tanggung jawab pemerintah akan tetapi juga menjadi tanggung jawab bersama, dan terbentuknya gerakan anti korupsi di dalam organisasi HIMAKUM. Sementara metode yang digunakan adalah metode ceramah (pemaparan), tanya jawab, dan simulasi dengan pemutaran film tentang nilai-nilai kejujuran, tanggang jawab, dan keberanian dalam memerangi korupsi di tengah-tengah masyarakat. hasil yang dicapai dalam kegiatan ini adalah memberikan pemahaman kepada mahasiswa khususnya Pengurs HIMAKUM tentang pendidikan anti korupsi khususnya nilai-nilai kejujuran, tanggung jawab, dan keberanian dalam memerangi korupsi termasuk pemahaman tentang aturan, serta terbentuknya gerakan anti korupsi di Fakultas Hukum Universitas Dirgantara Marsekal Suryadarma.

Abstract

Laporan Institute for Economics and Peace (IEP) bertajuk Global Terrorism Index (GTI) 2023 menunjukkan bahwa Indonesia menempati urutan ketiga negara yang paling terdampak terorisme di kawasan Asia Pasifik pada tahun ini. Indonesia tercatat memperoleh skor sebesar 5,502 poin; Adapun secara global Indonesia menempati peringkat ke-24 dunia, masih sama dengan posisi tahun lalu. Akhir-akhir ini masyarakat Indonesia masih sering di kejutkan dengan adanya serangan terorisme yang mengancam beberapa wilayah Indonesia dan meresahkan warga negara Indonesia. Melansir dari laman resmi Polri, terdapat 6 kejadian teror pada 2021 dengan 370 orang yang diduga menjadi pelaku terorisme. Kemudian pada 2022, jumlah aksi teror di Tanah Air menjadi turun. Begitupun dengan angka tersangka terorisme yang menyusut menjadi 248 orang. Kepala Badan Nasional Penanggulangan Terorisme (BNPT) RI Rycko Amelza Dahniel manjelaskan bahwa posisi Indonesia dalam Global Terrorism Index semakin baik, yakni berada pada kategori terdampak sedang atau medium impacted dengan menunjukkan data kasus serangan teror di Indonesia dalam rentang waktu 2018–2023 juga terus menurun. Hal ini perlu terus ditingkatkan sehingga pada pengabdian ini dilakukan sosialisasi deradikalisasi narapidana teroris di Lembaga Permasyarakatan Gunung Sindur

Abstract

Kegiatan Bakti Desa ini merupakan inisiasi organisasi Himpunan Mahasiswa Hukum (HIMAKUM) Fakultas Hukum Universitas Dirgantara Marsekal Suryadarma (Unsurya). Sebagai program kerja HIMAKUM Periode 2023-2024, maka pelaksanaan kegiatan Bakti Desa di periode ini dilaksanakan di Desa Sirnajaya, Kecamatan Sukamakmur, Kabupaten Bogor, Provinsi Jawa Barat. Kegiatan Bakti Desa ini merupakan salah satu bentuk kegiatan Pengabdian Kepada Masyarakat (PKM) yang dilakukan oleh mahasiswa fakultas hukum yang dikoordinasi oleh organisasi HIMAKUM dibawah bimbingan Fakultas Hukum Program Studi Ilmu Hukum dan Rektorat Unsurya. Melalui kegiatan Bakti Desa ini, mahasiswa dapat menerapkan ilmu yang sudah didapatkan di bangku perkuliahan ke dalam kehidupan nyata kepada lingkungan sekitar dan masyarakat tempat kegiatan Bakti Desa dilaksanakan. Hal tersebut diwujudkan melalui beberapa aspek yaitu aspek pendidikan, aspek sosial, dan aspek lingkungan. Pengabdian Kepada Masyarakat melalui Bakti Desa ini merupakan langkah kecil tetapi dapat menjadi ajang untuk menjalin kolaborasi dan kemitraan antara pemerintah desa, organisasi masyarakat, dan pihak kampus yang peduli terhadap pembangunan berkelanjutan khususnya pembangunan dibidang hukum. Oleh karenanya kegiatan ini perlu terus dilaksanakan dengan berkesinambungan sebagai perwujudan pelaksanaan Tri Dharma Perguruan Tinggi.

Abstract

Class IIA Bangli Narcotics Penitentiary is a Technical Implementation Unit under the Ministry of Law and Human Rights of the Republic of Indonesia which is specifically designed to accommodate leukemia with drug conversion cases, in addition to functioning as a remote place, Class IIA Bangli Narcotics Penitentiary is also used as a Rehabilitation place for drug addicts. Therefore, agreeing to a very important thing, the government provides additional income called a performance allowance. The government hopes that with the existence of employee performance allowances, it can improve each person's self-discipline which will directly improve individual performance and the performance of the Class IIA Bangli Narcotics Penitentiary Technical Implementation Unit. This study aims to determine the Effectiveness of the Policy of Providing Performance Allowances on Improving Employee Discipline in the Ministry of Law and Human Rights (Case Study at Class IIA Bangli Narcotics Penitentiary). This study uses an empirical method with a factual approach or what is familiarly known as a factual approach in the field in the form of data collection such as laws and regulations, reports, Attendance and submission of performance permits and interviews. Data processing is carried out by looking at employee discipline that uses laws and regulations as a reference for employee behavior and using data in the form of absences, submission of performance allowances and data from interviews conducted with task and function holders in the personnel field to describe how effective the influence of the Performance Allowance Policy is on Improving Employee Discipline in the Ministry of Law and Human Rights. The results of the study show that the performance allowance policy has a positive impact on the quality of work, communication, and employee discipline. The quality of employee work is reflected in the low level of lateness and the achievement of the Corruption-Free Area (WBK) predicate in 2024. Communication between employees and superiors is going well, creating harmonious professional relationships and supporting smooth operations. In addition, the level of employee discipline is also very high, with an average lateness of only 0.35% per month.

Abstract

Law enforcement is very necessary in handling violations of disciplinary regulations for correctional inmates. "The aim of disciplinary punishment as a form of administrative sanction is to correct and educate correctional inmates who commit disciplinary violations. In the problem formulation of this thesis, this is the Disciplinary Punishment Policy for Prisoners in Indonesia and the Implementation and Existence of Disciplinary Punishment for Prisoners in the Cipinang Class I Detention Center. The data analysis method used is a qualitative analysis method, namely by exploring and comparing the implementation of laws and regulations in practice. The results of this research are: In its implementation, the appropriate procedures for implementing administrative sanctions for correctional inmates are focused on correctional officers who must be required to re-examine correctional inmates in accordance with the flow of the disciplinary violation mechanism, with the aim of finding out violations that have been committed. For disciplinary violators If a prisoner commits a light level disciplinary sanction, the disciplinary sanction will be given in the form of a Warning. For medium level disciplinary violators, the disciplinary sanction given will be in the form of a postponement of the visit, and for serious disciplinary violations for prisoners suspected of committing a serious violation, an inspection will be carried out by an officer. , then the results of the examination will be used as recommendation material for carrying out the TPP trial, then the results of the TPP trial will be submitted to the Head of the Detention Center as a consideration for imposing disciplinary sanctions. My suggestion is that the Cipinang Class I Detention Center be more strict in implementing disciplinary sanctions/punishments against inmates who violate the detention center rules as regulated in Law Number 22 of 2022 concerning Corrections and Regulation of the Minister of Law and Human Rights Number 6 2013 concerning the Rules of Procedure for Correctional Institutions and State Detention Centers so that it can have a deterrent effect on residents of correctional institutions so that they no longer violate the rules and regulations of prisons.

Abstract

Permasalahan hukum yang seringkali dihadapi adalah ketika terkait dengan penyampaian informasi, komunikasi, dan/atau transaksi secara elektronik, khususnya dalam hal pembuktian dan hal yang terkait dengan perbuatan hukum yang dilaksanakan melalui sistem elektronik. Salah satu penyalahgunaan internet adalah pencemaran nama baik yang dilakukan seseorang terhadap pihak lain. Hal atau keadaan yang dikomunikasikan atau dipublikasikan lewat internet dapat dikatakan merupakan penghinaan atau pencemaran nama baik bila hal atau keadaan itu adalah tidak benar bagi pihak yang menjadi korban, baik itu merupakan itu yang merusak reputasi ataupun yang membawa kerugian material bagi pihak korban. Dari uraian tersebut dirumuskan permasalahan pokok yang dapat diteliti yaitu Bagaimana Pengaturan Pelaku Tindak Pidana Tanpa Hak Mendistribusikan Informasi Elektronik Yang Memiliki Muatan Pencemaran Nama Baik Berdasarkan Perundang-Undangan di Indonesia? Dan Bagaimana Pertanggungjawaban Pidana Pelaku Tindak Pidana Tanpa Hak Mendistribusikan Informasi Elektronik Yang Memiliki Muatan Pencemaran Nama Baik Berdasarkan Praktek Peradilan di Indonesia ? dengan metode penelitian yuridis normatif. Dihasilkan pembahahasan pengaturan pelaku tindak pidana tanpa hak mendistribusikan informasi elektronik yang memiliki muatan pencemaran nama baik berdasarkan perundang-undangan di Indonesia dan pertanggungjawaban pidana pelaku tindak pidana tanpa hak mendistribusikan informasi elektronik yang memiliki muatan pencemaran nama baik berdasarkan praktek peradilan di Indonesia. Dengan Kesimpulan delik pencemaran nama baik secara eksplisit dalam BAB XVI tentang Penghinaan mulai Pasal 310 sampai dengan Pasal 321 dan pada UU ITE pada Pasal 27 ayat (3). Pencemaran nama baik merupakan delik aduan dimana perkara pencemaran nama baik baru akan dikatakan sebagai tindak pidana bila ada pengaduan dari korban atau laporan dari orang lain yang mengetahui adanya dugaan tindak pidana pencemaran nama baik tersebut, seperti yang tertuang dalam Pasal 45 ayat 5 UU ITE No. 19 Tahun 2016. Dan saran Pada pasal 27 ayat (3) perlu diubah karena pasal tersebut merupakan Pasal yang dapat disalahgunakan demi kepentingan pribadi maupun kelompok dan para penegak hukum harus dengan hati-hati dalam memproses pelaku tindak pidana.

Abstract

Law enforcement of election crimes is a critical aspect to ensure the creation of a fair and transparent democratic process. This research discusses the role of Gakkumdu Bawaslu East Jakarta in enforcing the law on election crimes. Gakkumdu Bawaslu East Jakarta is responsible for handling and resolving cases of election law violations, which include administrative violations, code of ethics violations, and election crimes. This research identifies how the East Jakarta Bawaslu Gakkumdu functions in preventing and enforcing the law against election violations and the challenges faced in carrying out this task. The methodology used involves qualitative secondary data analysis, including documents, reports and interviews with related parties. The research results show that the East Jakarta Gakkumdu Bawaslu plays a crucial role in enforcing compliance with election regulations, despite several obstacles in carrying out its duties, such as limited resources and coordination between institutions. This research suggests several corrective steps to increase the effectiveness of Gakkumdu in enforcing election law in the future.

Abstract

Penemuan hukum merujuk pada proses di mana hakim atau pengadilan menciptakan atau mengidentifikasi prinsip-prinsip hukum baru untuk menyelesaikan suatu kasus yang belum diatur oleh hukum yang sudah ada. Prinsip etika hukum mengacu pada seperangkat nilai-nilai moral dan standar perilaku yang membimbing praktik hukum. Prinsip-prinsip etika hukum membantu memastikan bahwa hukum tidak hanya merupakan serangkaian aturan formal, tetapi juga mencerminkan nilai-nilai moral yang mendasari keadilan dan kebaikan dalam masyarakat. Judul Penelitian ini adalah Peran Hakim Pada Proses Penemuan Hukum Sebagai Upaya Penegakkan Keadilan Berdasarkan Kode Etik hakim. Rumusan masalah: Bagaimanakah kebijakan hakim pada proses penemuan hukum dalam upaya penegakan keadilan? Apakah peran hakim pada proses penemuan hukum yang dilakukan telah sesuai kode etik hakim? Penelitian dilakukan menggunakan pendekatan yuridis normatif. Data yang digunakan data primer, sekunder dan tersier. Analisis data dilakukan secara kualitatif dan berdasarkan hasil analisis kemudian ditarik kesimpulan melalui pendekatan deduktif. Kesimpulan dari penelitian ini adalah Proses penemuan hukum oleh hakim dapat dilakukan melalui beberapa metode, antara lain: Interpretasi gramatikal, Interpretasi sistematis, Interpretasi historis, Interpretasi teleologis. Dalam melakukan proses penemuan hukum, hakim tidak hanya terikat pada teks undang-undang, tetapi juga mempertimbangkan berbagai aspek lain, seperti rasa keadilan, kepatutan, dan kemanfaatan bagi masyarakat. Dalam menjalankan peran dan fungsinya, hakim terikat pada Kode Etik Hakim yang telah ditetapkan. Kode Etik Hakim mengatur berbagai prinsip dan standar perilaku yang harus dipatuhi oleh hakim, termasuk dalam proses penemuan hukum. Dalam melakukan proses penemuan hukum, hakim harus memastikan bahwa peranannya sesuai dengan prinsip-prinsip yang terkandung dalam Kode Etik Hakim.

Abstract

Online gambling is one of the negative impacts in the form of cybercrimes, which can be considered a cybercrime. Cybercrimes, especially online gambling, must be prevented or eradicated. Law enforcement efforts are needed to prevent and eradicate these crimes so that they are not increasingly rampant. Therefore, further research will be conducted on how online gambling criminal acts are regulated based on Indonesian laws and regulations, and how law enforcement against online gambling criminal actors is based on the theory of justice. The research method used in this research is the normative juridical research method. From the research results, it was found that the regulation of online gambling criminal acts based on Indonesian laws and regulations, conventional gambling in Indonesia has the potential to cause social and financial risks for players and the surrounding community. Basically, online gambling is a prohibited act in Article 27 paragraph (2) of Law 1/2024. referring to gambling provisions in terms of offering or providing opportunities for gambling games, making it a livelihood, offering or providing opportunities to the public to gamble, and participating in companies for that purpose. Then, people who violate the provisions of Article 27 paragraph (2) of Law 1/2024 are potentially sentenced to a maximum of 10 years in prison and/or a maximum fine of Rp10 billion, as regulated in Article 45 paragraph (3) of Law 1/2024. Article on Gambling in the Criminal Code, For information, in addition to being regulated in Law 1/2024, gambling crimes are also regulated in Article 303 and Article 303 bis of the Criminal Code and Article 426 and Article 427 1/2023 concerning the new Criminal Code and law enforcement against online gambling criminal actors based on the theory of justice, law enforcement against online gambling crimes based on the theory of justice will produce effective and fair law enforcement, and pay attention to the balance between strict law enforcement and respect for human dignity. From the research results for improvement, it is hoped that a new law will be made regarding online gambling crimes in the Criminal Code, laws and regulations, government regulations, Minister of Law and Human Rights regulations, and law enforcement against online gambling criminal actors must be firm and fair in the form of criminal sanctions while still paying attention to human rights.
